According to Article 223(1), second subparagraph, of the Treaty on the Functioning of the European Union, the provisions of Council Decision 2018/994[1] of 13 July 2018 amending the Act concerning the election of the members of the European Parliament by direct universal suffrage shall enter into force following their approval by the Member States in accordance with their respective constitutional requirements. There is no legal obligation in the Treaty for the Member States to approve those provisions, nor any time limit for such procedure.

The necessary notifications of approval from Cyprus, Germany and Spain for Council Decision 2018/994 to enter into force are still pending. Council Decision 2018/994 will enter into force on the first day after the last notification has been received (Article 2(2) of the decision). The date of entry into force of the decision will be published in the Official Journal of the European Union by the General Secretariat of the Council.

Council Decision 2018/994 is published in the Official Journal (OJ L 187, 16.7.2018, p. 1). The Treaties and Agreements database[2] is a database containing information on European Union Treaties and Agreements, which are not the same as and of a different nature to the Council Decision referred to by the Honourable Member.
