 Subject: Human rights violations in Poland

As of 22 October 2020, it will be virtually impossible for women in Poland to terminate a pregnancy. In a ruling that has sparked outrage across the country and indeed Europe, the Constitutional Court held that abortion due to foetal defects was ‘unconstitutional’. Polish law now only permits a termination if the pregnancy resulted from rape or the woman’s health is in danger.

The news is even more alarming if we consider the fact that foetal defects are the reason behind almost all pregnancy terminations recorded in the country: 1 074 out of 1 100, almost 98%, according to 2019 data.

Polish women will continue to end pregnancies regardless of this ruling. The real problem is that it makes access to abortion the preserve of those who can afford to travel abroad; women who cannot will find cheaper solutions, with inevitably dramatic, tragic and traumatic consequences.

Can the Commission therefore say:

1. whether it is aware of this situation;

2. how it intends to protect the right to an abortion in Poland;

3. how it intends to protect human rights and the EU’s fundamental values in Poland?
