 Subject: Judgment banning abortions in Poland

The Polish Constitutional Court has delivered a condemnatory and obscure judgment in which it has declared abortions unconstitutional as a result of problems with the anatomy of the foetus. The ensuing protests, organised over a number of days, have led the government to temporarily refrain from applying the ruling.

Over time, Poland’s reactionary government has sought a total ban on abortions, forcing more women to have illegal abortions and putting their lives at risk. The decision is linked to the barbaric policy of commercialising health care pursued by the EU and all governments. A common factor is the perception of governments that women’s reproductive health is an area for capital investment and not a guaranteed right for women.

Poland is an example of the implementation of anti-populist EU guidelines that promote a full levelling of women’s rights and the working class as a whole, multifaceted support for business groups and the anti-communist criminalisation of public support for socialist ideas, including equality between women and men.

In the light of the above:

What is the Commission’s view on the need to ensure a legal framework which does not ban abortion but, above all, offers a public and free health care system that provides not only abortion services but also services offering sexual education, family planning, antenatal screening, medically assisted reproduction, pregnancy and childbirth?
