At the adoption of Directive (EU) 2019/904 on the reduction of the impact of certain plastic products on the environment(1), the Commission made the following declaration: ‘The Commission regrets the short deadlines for the adoption of implementing acts and guidelines referred to in Articles 4(2), 7(2), 9(2), 13(4) and 11a and expresses concern about the feasibility to comply with these deadlines in time.’

Nevertheless, in order to ensure timely delivery, the Commission started preparatory work, including the launching of a supporting study, already in December 2018. As required by Article 12 of the directive, the Commission has been developing the guidelines on single-use plastic products in consultation with the Member States and has sought input from stakeholders. As foreseen, due to the complexity of the issues, those consultations have taken additional time, and COVID-19 related necessities have further hindered meeting the challenging deadlines set by the legislators.

The guidelines are currently being finalised and Member States are kept abreast of their development in view of meeting the transposition deadlines laid down in the directive that can be amended only by means of a legislative proposal, which is currently not planned by the Commission.
