 Subject: Legal and ethical requirements for drone policing

In several Member States, drones are being used to enforce restrictions on the freedom of movement imposed to contain the spread of COVID‑19, thus for law enforcement purposes. The drones transmit video footage and sometimes audio recordings of public spaces to the remote operator, who can speak to members of the public by way of loudspeakers.

1. What are the requirements in Union law relating to drone policing?

2. Does drone policing comply with Article 13 (1) of Directive (EU) 2016/680, which requires certain information on data processing to be made available to subjects? Can this requirement be satisfied in the case of drone policing, and if so, how?

3. In the opinion of the Commission, what are the ethical requirements for the use of drones for remote policing?
