 Subject: Trade agreements with the UK: composition of the arbitration tribunal

Under the Trade and Cooperation Agreement signed by the United Kingdom and the European Union on 24 December 2020, an arbitration mechanism will be established which, in theory, will have sole jurisdiction(1) to resolve any disputes. One of the fundamental principles of such arbitration must be neutrality.

To that end, it is laid down that the arbitrators composing this body shall not be affiliated to, or work for, either Party or for any government or organisation having an interest in any dispute between the two Parties to the agreement(2).

In order to prevent any risk of conflict of interest and to ensure full transparency, can the Commission confirm that the list of individuals who will make up the arbitration mechanism under the cooperation agreement will be made public?
