‘Green pass’: weapon of discrimination

Given that Recital 36 of Regulation (EU) 2021/953 of the European Parliament and of the Council of 14 June 2021 stipulates that direct or indirect discrimination against people who are not vaccinated is prohibited:
- 1.In the Commission’s view, does the new Italian ‘Green Pass’ comply with the requirements set out in the above-mentioned Recital 36?
- 2.Only people who are vaccinated, who have been cured of COVID-19 in the last 6 months or who have taken a swab test in the last 48 hours are allowed to access: public establishments, shows, sports events and competitions, museums, cultural institutions and places of culture, swimming pools, gyms, wellness centres, fairs, festivals, conferences and congresses, spas, theme and amusement parks, cultural and recreation centres, gaming halls and casinos, and public competitions. Does this not discriminate against those who have chosen to not get vaccinated, or who cannot take the vaccine, but comply with all the prescribed health and hygiene rules, especially given that it has been scientifically proven that vaccinated people, too, can be carriers of the COVID-19 virus, and that they, too, should therefore have to take a swab test?
- 3.Having to take a swab test every 48 hours has a significant cost. Is this also not a source of discrimination?
