 Subject: Tax havens

Can the Commission confirm that it is consistent with EU law for Member States to make any public financial support to undertakings – such as corona aid packages or other financial support – conditional upon the undertaking concerned:

1. not being resident for tax purposes in jurisdictions appearing on the EU’s blacklist of tax havens;

2. not being directly or indirectly controlled by shareholders in jurisdictions appearing on the EU’s blacklist of tax havens; not directly or indirectly controlling subsidiaries or holding permanent establishments in jurisdictions appearing on the EU’s blacklist of tax havens;

3. and not sharing ownership with undertakings in jurisdictions appearing on the EU’s blacklist of tax havens?

I am referring here to Commission Recommendation (EU) 2020/1039 of 14 July 2020 on making State financial support to undertakings in the Union conditional on the absence of links to non-cooperative jurisdictions.
