 Subject:  National implementation of Directive (EU) 2019/790

In its judgment in Case C-401/19, the Court of Justice of the European Union held that the application of Article 17 of Directive (EU) 2019/790 must not lead to any general monitoring obligation. Online content-sharing service providers cannot, therefore, be obliged to prevent from being uploaded and made available to the public content that they would be required to assess independently in the light of information provided by rightholders and any exceptions and limitations to copyright in order to establish whether it is unlawful.

Can the Commission state which Member States have already correctly implemented this CJEU ruling in the process of incorporating Directive (EU) 2019/790 into national law?
