Answer given by Mr Reynders on behalf of the European Commission

Article 17 of the Charter of Fundamental Rights of the European Union (the Charter) provides that everyone has the right to own, use, dispose of and bequeath his or her lawfully acquired possessions. However, according to its Article 51(1), the provisions of the Charter are addressed to the Member States only when they are implementing EU law.

On the basis of the information provided, it does not appear that the matter referred to by the Honourable Member is related to the implementation of EU law. In the present case, it is thus for the concerned Member State to ensure that fundamental rights are effectively respected and protected in accordance with their national law and international obligations.
