I would like to draw attention to the seriousness of a new German law, which was implemented on 1 January 2015, concerning a minimum wage for employees, including foreign nationals, working in Germany. The legislation also applies to the transport sector.

The ‘Mindestlohngesetz’ (MiLoG, Paragraph 20) applies to foreign transport operators whose employees work in Germany (including transit). This forces, for example, Polish road carriers to pay their truck drivers EUR 8.50 when operating in Germany.

From my point of view this goes beyond the scope of the new legislation and interferes with Polish national legislation.

1. What is the Commission’s position regarding the new legislation and its impact on the wage policies in other Member States, and is the legislation in line with the EU principal of subsidiarity?

2. Will the Commission intervene and urge Germany to change the scope of the MiLoG, which ignores the economic reality of many Member States?

3. What affect will the MiLoG have on the aviation sector, when aircrafts are using German air space?
