 Subject:  Referendum in Hungary on 2 October
 Answer in writing 

On 24 February 2016, Viktor Orbán announced that his government was calling a referendum on the EU's refugee policy. On 29 February, the National Electoral Committee endorsed the following question: ‘Do you want the European Union to order the mandatory settlement of non-Hungarian citizens in Hungary without the approval of the National Assembly?’ The date for the referendum was then set at 2 October. The question raises a number of concerns. It suggests that the EU may take action on refugee matters only with the approval of the Hungarian National Assembly. This means that, if the referendum is successful and valid, the National Assembly will have to pass a law rejecting or approving decisions on EU migration policy. In the light of the above, I would like to ask the Commission the following questions:

If, following the referendum in Hungary on 2 October, the Hungarian National Assembly passes a law which conflicts with EC law, what consequences might this have for Hungary (legal proceedings, fine)?

In the Commission's legal interpretation, might the referendum called by the Government influence Hungary's obligations under the EU Treaties?

In the Commission's view, will there be any legal consequences arising from this referendum from the point of view of the EU institutions?
