The Commission is aware of media reports on possible monitoring activities carried out by Yahoo with respect to incoming emails to its customers' accounts in response to a request issued by an unnamed US intelligence agency (or agencies). These activities allegedly happened in 2015. The Commission was not aware of these alleged activities by Yahoo at the time that the Privacy Shield decision was discussed and adopted.

The media reports differ as to the legal basis, scope and nature of these activities. As part of the Commission's task to continuously monitor the Privacy Shield, the Commission services have contacted the U.S. authorities to ask for a number of clarifications.
