 Subject:  Effects of the implementation of the commitment decision concluding antitrust proceedings against Gazprom
 Answer in writing 

On 24 May 2018, the Commission adopted a commitment decision concluding antitrust proceedings against Gazprom. According to the Commission, its implementation was supposed to quickly restore competition on the gas markets of Central and Eastern Europe.

Since over six months have elapsed in the meantime, could the Commission provide answers to the following questions concerning the effects of the implementation of the decision by Gazprom:
1. How many undertakings fulfilled the criteria to be allowed to receive an offer to change the price revision clause on the date of adoption of the decision (i.e. 24 May 2018)? The relevant undertakings should be understood as ‘Existing’ or ‘Eligible’ Customers (as defined in the annex to the decision) having a valid gas supply contract exceeding three years’ duration. Could the Commission provide the number of undertakings from each Member State?
2. How many of Gazprom’s customers have accepted/rejected Gazprom’s offer to change the revision clause? Could the Commission provide the reasoning received?
3. How many existing customers have received information from Gazprom stating that the territorial restriction clauses in their contracts are null and void (point 6 of the annex to the decision)?
