Question for written answer P-002526-19
to the Commission
Rule 138
Dimitrios Papadimoulis (GUE/NGL)

Subject:  Greek Government dismisses members of the Hellenic Competition Commission
 Answer in writing

In recent years, Greece has made great efforts to ensure the proper functioning of independent authorities such as the Hellenic Competition Commission.

However, on 2 August, the Greek Government hastily tabled what is obviously a politically motivated amendment with no basis under EC law, the purpose being the dismissal with retroactive effect of Competition Commission members and officials who had recently served in government offices.

This comes at a time when the Competition Commission is responsible for monitoring existence of cartels in sensitive sectors, including SMEs.

Given the particular significance of this amendment and the urgency surrounding it:
1. What view does the Commission take of the amendment in the light of Directive (EU) 2019/1 seeking to increase the independence of the EU Member State competition authorities, which states (in Recital 17) that the grounds regarding dismissal should be laid down in advance?
2. What measures is it taking to ensure the implementation by the Member States of EU Directives, especially in sensitive areas such as those regarding competition authorities?
3. What measures will it take to ensure the proper functioning of competition commissions, especially in Greece, for the specific purpose of combating monopolies affecting SMEs?
