 Subject: Suspension of asylum in Greece

On 1 March 2020, the Greek National Security Council decided to suspend any new asylum applications for one month and invoked Article 78(3) of the Treaty on the Functioning of the European Union (TFEU) on the grounds of an emergency situation.

In view of this decision, we ask:

1. In the light of the 1951 Convention Relating to the Status of Refugees and EU law, does the Commission consider that the Greek Government has acted lawfully in suspending the receipt of all new asylum applications?

2. Does the Commission consider that the provisional measures under Article 78(3) of the TFEU can be extended to the suspension of the internationally recognised right to seek asylum and the principle of non-refoulement enshrined in EU law?
