 Subject: Compliance with EU competition law in the air transport market

European businesses perform their activities in a single market with common competition rules. A European business wishing to participate in an international public tender, namely for the award of a contract for the provision of passenger air transport services, must abide by EU competition law. Therefore:

According to EU competition law, can a European business participate in an international public tender process for the award of a contract for the provision of passenger air transport services if, before and during the procurement procedure, that business has increased its share capital through bond loans bought or guaranteed by a public entity?

According to European competition law, can a European business provide passenger air transport services following an international public tender process if, before and during the contract period, that business has increased its share capital through bond loans bought or guaranteed by a public entity?
