 Subject: Termination of the Commission’s catering tender on the grounds of ‘force majeure’

Last week the Commission communicated its intention to end its tender for catering services on its premises as of 1 January 2021 on the grounds of ‘force majeure’.

1. Is the Commission aware that in practice ‘force majeure’ means that subcontracted companies will carry out a mass dismissal – more than 400 jobs – without any negotiated collective agreement, while the ‘force majeure’ cause should instead be used to adopt exceptional measures precisely to avoid mass dismissals?

2. Does the Commission believe that it can evade its responsibility by arguing that is not directly firing the workers, who work in the same Commission buildings as Commission officials, and are the weakest link in the chain?

3. Is the Commission aware of the danger of the ‘carry-over effect’ that this decision could have not only in the other European institutions but also in other companies in Belgium and other Member States, especially given that the decision is not consistent with the objective of the Next Generation EU Plan launched by the Commission?
