 Subject: The newly adopted Danish law L 226 on asylum processing

On 8 June 2021, Denmark adopted Law L 226/2021 amending the Law on Foreigners, which allows non‑EU nationals to be transferred to a given non‑EU country, with the purpose of processing their asylum applications and subsequently granting them protection in that non‑EU country.

1. Is this law, which introduces the possibility of setting up asylum processing centres in non‑EU countries, consistent with the provisions of EU legislation, the Charter of Fundamental Rights of the European Union and international law, including the European Convention on Human Rights and the Geneva Convention, which are applicable to people claiming protection in the EU?

2. Can Denmark grant refugee status or subsidiary protection in a foreign country in conformity with the Dublin Regulation, the Asylum Procedures Directive and the Charter of Fundamental Rights of the European Union?

3. Will the externalisation of asylum procedures jeopardise the application of the Asylum Procedures Directive in the Member States that Denmark cooperates with on the application of the Dublin Regulation?
