On 18 February 2021 the Commission sent a reasoned opinion to the Kingdom of Belgium, under Article 258 of the Treaty on the Functioning of the European Union, for incorrect implementation of Directive 2008/50/EC of 21 May 2008 on ambient air quality and cleaner air for Europe (‘the Directive’). On 20 April 2021 the Flemish Minister for the Environment, Zuhal Demir, objected to the content of that opinion. Minister Demir asked Mr Virginijus Sinkevičius, Commissioner for the Environment, Oceans and Fisheries, to suspend infringement proceedings for alleged non-compliance with Article 13 and Article 23(1) in air quality zone BEF02A ‘Agglomeratie Antwerpen’.
