On 23 February 2023, the Commission announced its digital connectivity package, which includes a draft recommendation on the regulatory promotion of gigabit connectivity.
According to a number of stakeholders, the draft recommendation goes far beyond the legal instrument it is based upon – the European Electronic Communications Code, adopted in 2018 with the votes of the Council and Parliament, representing the political expression of EU citizens’ will.
In the light of the disruptive effect that its approval would have on competition and for consumers:
- 1.Can the Commission share an impact assessment?
- 2.Has it consulted the relevant stakeholders, including electronic communications operators, on a full draft text with exact wording, and if so, what was the main feedback?
- 3.How will it involve the co-legislators in the adoption process, enabling the Council and Parliament to assess (in substance and in procedural terms) the draft text that has been sent to the Body of European Regulators for Electronic Communications (BEREC) and the opinion of BEREC itself?
