3. Defence of parliamentary immunity

Following Parliament's decision of 05.07.2005 to uphold Umberto Bossi's immunity in the context of criminal proceedings in progress before a court in Bergamo (Minutes of 05.07.2005, Item 7.8), and under Rule 7(9) of the Rules of Procedure, the Italian authorities had forwarded information to the President from the court concerned stipulating that its judgment of 21.01.1998 on the case was final.

That information had been sent to the commitee responsible, the JURI Committee.

7. Announcement by the President

In case C-305/05, on a request from the Belgian Ordres des barreaux, the Cour d'arbitrage (Belgium) had referred to the European Court of Justice a question relating to the validity of certain provisions of Directive 2001/97/EC of the European Parliament and of the Council of 4 December 2001 amending Council Directive 91/308/EEC on prevention of the use of the financial system for the purpose of money laundering (OJ L 344, 28.12.2001, p. 76).

Giuseppe Gargani, Chairman of the JURI Committee, had informed the President of Parliament of his committee's wish to avail of the opportunity to submit observations to the Court of Justice under Article 23 of the Court's statute.

Having informed the Conference of Presidents of the matter, the President of Parliament, on the basis of the powers conferred upon him by Rule 19(4) of the Rules of Procedure, had decided that, within the set timeframe, the necessary observations would be submitted to the Court in favour of a ruling in case C-305/05 that the act in question adopted under the codecision procedure was indeed valid.

Miguel Angel Martínez Martínez moved the adjournment of the debate under Rule 170(1).

The President established that the debate would go ahead, because the request for adjournment had not been made in line with the deadline set out in the relevant Rule, and because the rapporteur did not accept it.

Before the vote, Miguel Angel Martínez Martínez, on behalf of the PSE Group, moved the adjournment of the vote under Rule 170(4). Bernd Posselt, on behalf of the PPE-DE Group, and Françoise Grossetête opposed the request. Marios Matsakis highlighted the risks that such requests posed to Parliament's work.

Parliament rejected the request by electronic vote (26 for, 42 against, 4 abstentions).

15. Budget calendar

The deadline for tabling amendments for the second reading of the general budget for the 2006 financial year would be Wednesday, 30.11.2005, 12.00.

Draft amendments were to be tabled by at least 37 Members or by a committee.

Only draft amendments to the amended text from the Council would be admissible.

16. Agenda for next part-session

At its meeting the previous day, the Conference of Presidents had proposed the following changes to the agenda for the forthcoming sittings in Brussels:

Wednesday 30.11.2005:

- The debate on the oral questions to the Council and Commission on development and sport (Item 82 on the agenda), which were to be part of the joint debate on sport, would also be wound up with motions for resolutions.

The following tabling deadlines had been set:

- motions for resolution: Friday, 25.11.2005, 10.00,

- amendments and joint motions for resolutions: Monday, 28.11.2005, 18.00.

- The debate on the oral question to the Commission on the imposition of criminal penalties in the event of an infringement of Community law (Item 5 on the agenda) would not be wound up with motions for resolutions.

- The report by Dariusz Rosati on the proposal for a Council regulation amending Regulation (EC) No 974/98 on the introduction of the euro [COM(2005)0357 - 2005/0145(CNS)] (Item 64 on the agenda), had been adopted under Rule 131 and had been scheduled for voting time on Thursday, 1.12.2005.

Thursday 1.12.2005:

- On 22 November 2005, the Committee on Budgets would be adopting a report on the 2007-2013 financial perspective.

The deadline for tabling amendments had been set as Monday 28.11.2005, 12.00.

The item had been scheduled for voting time on Thursday, 1 December.
