1. Resumption of the session

The sitting opened at 17.05.


2. Statements by the President

The President made a statement condemning, on behalf of Parliament, the attack of 7 March 2009 on the Massereene army base in Northern Ireland, in which two soldiers of the Royal Engineers - Mark Quinsey and Cengiz Azimkar - had died, and several others had been wounded.

The House observed a minute's silence in memory of the victims.

The following spoke: James Nicholson, Liam Aylward and Jim Allister, who associated themselves with the President's remarks.

The President made a statement on the occasion of International Women's Rights Day 2009.


3. Approval of the minutes of the previous sitting

The minutes of the previous sitting were approved.

Adina-Ioana Vălean had made it known that she had been present at the sitting of 19.02.2009 but that her name was not on the attendance register.


4. Composition of Parliament

The Romanian authorities had given notice of the appointment of Marian Zlotea to a post incompatible with that of Member of the European Parliament, pursuant to Article 7(1) of the Act concerning the election of the Members of the European Parliament by direct universal suffrage. Parliament noted the appointment and, under Rule 4(1), established this vacancy with effect from 17 February 2009.

The same authorities had advised of the election to the European Parliament of Ioan Lucian Hămbăşan in place of Marian Zlotea, with effect from 1 March 2009.

Under Rule 3(2), until such time as his credentials had been verified or a ruling had been given on any dispute, and provided that he had previously made a written declaration stating that he did not hold any office incompatible with that of Member of the European Parliament, Ioan Lucian Hămbăşan would take his seat in Parliament and on its bodies and would enjoy all the rights attaching thereto.


5. Requests for the defence of parliamentary immunity

Aldo Patriciello had submitted a request for the defence of his immunity and privileges, in connection with proceedings brought against him before Isernia District Court.

Umberto Bossi, former Member of the European Parliament, had submitted, through his lawyer, a request for the defence of his immunity and privileges, in connection with proceedings before the Verbania District Court relating to events which had taken place while he was a Member of the European Parliament.

Pursuant to Rule 6(3), those requests had been referred to the relevant committee, in this case the JURI Committee.


6. Follow-up to a request for the defence of immunity

Following the decision of the European Parliament of 24 October 2006 to waive the parliamentary immunity of Bogdan Golik at the request of the Prosecutor's Office of the Court of Appeal of Brussels, the Belgian authorities had notified Parliament, in accordance with Rule 7(9), of the conclusion of the legal proceedings concerning him.

That communication would be forwarded for information to the JURI Committee.

At the request of the PPE-DE Group, Parliament ratified the following appointments:

9. Request for urgent procedure

Council request for the application of urgent procedure (Rule 134) for:

Multi-annual recovery plan for bluefin tuna in the Eastern Atlantic and Mediterranean [COM(2009)0093 - C6-0081/2009 - 2009/0029(CNS)]

Reason for request:

This proposal on the implementation of a new plan for bluefin tuna should enter into force before 15 April 2009, date of the beginning of the main fishing season.

Parliament would take a decision on the request for urgent procedure at the beginning of the following day's sitting.

14. Transfers of appropriations

The Committee on Budgets had considered the Commission's proposal for transfer of appropriations DEC 01/2009 (C6-0053/2009).

Having noted the Council's opinion, it had authorised the transfer in full under Article 24(3) of the Financial Regulation applicable to the general budget of the European Communities.


15. Order of business

The next item was the order of business.

The final draft agenda for the March I 2009 sittings (PE 420.647/PDOJ) had been distributed and a number of changes had been proposed (Rule 132):

Monday

Request from the PSE Group to add the report by Magda Kósáné Kovács on the social situation of the Roma and their improved access to the labour market in the EU (A6-0038/2009) (item 12 on the final draft agenda) to voting time the next day (Tuesday).

Request from the PPE-DE Group to add the report by Herbert Reul on possible solutions to the challenges in relation to oil supply (A6-0035/2009) (item 73 on the final draft agenda) to voting time the next day (Tuesday).

The President said that the deadline for tabling replacement joint motions for resolution had been set at 19.00 that evening and that it was therefore not technically possible to put those reports to the vote the next day. He proposed that the vote on the two reports be held on Wednesday, 11 March 2009.

Request from the PSE Group to extend the afternoon debates to 18.30, and hence for Question Time to the Commission to be held from 18.30 to 20.00.

Wednesday

The President said that 113 amendments had been tabled on the report by Elisa Ferreira on the European Economic Recovery Plan (A6-0063/2009) (item 35 of the final draft agenda). He noted that the threshold of 50 amendments laid down in Rule 156 had been exceeded, and consequently asked the relevant committee to meet to consider them. The debate on that report would be held on Wednesday, as scheduled.

Request from the PPE-DE Group to bring forward to 15.00 the debate on the Oral Questions to the Council (O-0005/2009) and to the Commission (O-0006/2009) on the state of play of SIS II (item 80 on the final draft agenda).

Since all the political groups supported that request, the agenda was amended accordingly.
