1. Resumption of the session

The sitting opened at 17.00.


2. Approval of the minutes of the previous sitting

The minutes of the previous sitting were approved.

The following spoke: Sonia Alfano, to state that she had been absent from the previous part-session, having received an invitation from the United Nations in her capacity as Chair of Parliament's Special Committee on Organised Crime, Corruption and Money Laundering.


3. Statement by the President

The President made a statement on the recent deposition of President Fernando Lugo and expressed Parliament's concern at the situation. He noted that Parliament would look into the possibility of sending a delegation to Paraguay.


4. Request for the waiver of parliamentary immunity

The Austrian authorities had sent Parliament a request for the waiver of the parliamentary immunity of Martin Ehrenhauser in legal proceedings in progress before the Public Prosecutor's Office of Vienna.

Pursuant to Rule 6(2), the request had been referred to the committee responsible, the JURI Committee.


5. Request for the defence of parliamentary immunity

Clemente Mastella presented his request for the defence of his immunity and privileges in legal proceedings in progress at the Court of Benevento.

Under Rule 6(3), the request had been referred to the committee responsible, the JURI Committee.


6. Corrigendum (Rule 216)

The committee responsible had forwarded the following corrigendum to a text adopted by Parliament:

Corrigendum (P7_TA-PROV(2012)0106(COR01)) to the position of the European Parliament adopted at first reading on 29 March 2012 with a view to the adoption of Regulation (EU) No .../2012 of the European Parliament and of the Council on OTC derivatives, central counterparties and trade repositories (P7_TA-PROV(2012)0106COM(2010)0484 – C7-0265/2010 – 2010/0250(COD)) ECON

Pursuant to Rule 216(4), this corrigendum would be deemed approved unless, within 24 hours, a request was made by a political group or at least 40 Members that it be put to the vote.

The corrigendum was available on the Séance en direct site.


7. Interpretation of the Rules of Procedure

The President informed the House, under Rule 211(3), of the following interpretation of Rule 156(1), second paragraph, provided by the Committee on Constitutional Affairs, which had been consulted on the application of that provision:

'Amendments may be signed electronically as part of a pilot project involving a limited number of parliamentary committees, on condition, first, that the committees participating in the project have given their agreement and, second, that appropriate measures have been put in place to ensure the authenticity of the signatures.'

If this interpretation was not contested by a political group or by at least 40 Members (Rule 211(4)) before the opening of the following day's sitting, on Tuesday, 3 July, it would be deemed to have been adopted. Otherwise, the matter would be put to the vote in Parliament.

21. Composition of Parliament

The French authorities had sent the following information.

In accordance with French legislation on the election of the Members of the European Parliament, Nora Berra, elected in the South-East constituency and replaced in the European Parliament by Michel Dantin while she held the office of State Secretary in the French Government, had taken up her mandate as Member of the European Parliament with effect from 16 June 2012.

Damien Abad and Estelle Grelier had been elected Members of the French National Assembly. Parliament noted that under Article 7(2) of the Act of concerning the election of the members of the European Parliament by direct universal suffrage, this office was incompatible with that of Member of the European Parliament and that their seats were vacant with effect from 17 June 2012.

Isabelle Thomas had been elected a Member of the European Parliament to replace Stéphane Le Foll with effect from 16 May 2012.

Jean-Louis Cottigny had been elected a Member of the European Parliament to replace Estelle Grelier with effect from 17 June 2012.

Michel Dantin had been elected a Member of the European Parliament to replace Damien Abad with effect from 17 June 2012.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Nora Berra, Isabelle Thomas, Jean-Louis Cottigny and Michel Dantin would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.
