1. Resumption of the session

The sitting opened at 17.00.


2. Approval of the minutes of the previous sitting

The minutes of the previous sitting were approved.

Andrea Zanoni had made it known that he had been present at the sitting of 11 March 2013, but that his name was not on the attendance register.


3. Composition of Parliament

Louis Grech had been appointed Malta's Minister for European Affairs, with effect from 13 March 2013.

Edward Scicluna had been appointed Malta's Minister for Finance with effect from 13 March 2013.

Simon Busuttil had been elected to Malta's national parliament with effect from 6 April 2013.

Under Article 7(1) of the Act concerning the election of the members of the European Parliament by direct universal suffrage and Rule 4(1) and (4), Parliament established that Louis Grech and Edward Scicluna's seats were vacant with effect from 13 March 2013 and that Simon Busuttil's seat was vacant with effect from 6 April 2013 and informed the national authority concerned.

Gabriele Albertini, Mario Mauro and Gianluca Susta had been elected to the Italian Senate with effect from 15 March 2013.

Under Article 7(1) of the Act concerning the election of the members of the European Parliament by direct universal suffrage and Rule 4(1) and (4), Parliament established that Gabriele Albertini, Mario Mauro and Gianluca Susta's seats were vacant with effect from 15 March and informed the national authority concerned.

The Italian authorities had informed Parliament of the election of Isabella De Martini to replace Mario Mauro, Fabrizio Bertot to replace Gabriele Albertini, and Franco Bonanini to replace Gianluca Susta, as Members of the European Parliament with effect from 12 April 2013.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Isabella De Martini, Fabrizio Bertot and Franco Bonanini would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.


4. Verification of credentials

On the JURI Committee's proposal, Parliament decided to approve the validity of Andreas Pitsillides' mandate with effect from 4 March 2013.


5. Composition of political groups

Emilie Turunen had joined the S&D with effect from 21 March 2013.


6. Composition of committees and delegations

The President had received requests for the following appointments from the S&D, PPE and EFD Groups:

- Delegation for relations with the United States: Karin Kadenbach to replace Hannes Swoboda

- Delegation to the Parliamentary Assembly of the Union for the Mediterranean: Cristina Gutiérrez-Cortines to replace Salvador Garriga Polledo

- PETI Committee: Jaroslav Paška to replace Rolandas Paksas

- REGI Committee: Francesca Barracciu to replace Salvatore Caronna

- Committee on Civil Liberties, Justice and Home Affairs: Salvatore Caronna to replace Francesca Barracciu

The appointments would be deemed ratified if there were no objections before the approval of these minutes.


7. Announcement by the President

The President said that Nikiforos Diamandouros had announced he would be stepping down as European Ombudsman with effect from 1 October 2013. A call for applications had been published in the Official Journal on 4 April; the closing date for forwarding applications to the President was 8 May 2013.

Under Rule 204(2), each application had to have the support of at least 40 Members who were nationals of at least two Member States, and Members could support only one application. If a Member supported several applications, none of these choices would be taken into account. Once an application had been forwarded to the President, i.e. after 8 May, it would no longer be possible to withdraw or add a supporting signature.

Under Rule 204(3), applications that met all the criteria would be forwarded to the Chair of the Committee on Petitions. The Committee on Petitions would hold hearings of applicants, probably in mid-June. The hearings would be open to all Members.

The President added that the election in plenary would be held during the July part-session so the new Ombudsman could take up his duties on 1 October 2013.

This information would be forwarded to all Members in the form of a communication from the President sent from the 'Ombudsman Election 2013' electronic mailbox which had been set up for this purpose and to receive Members' questions on this subject.

The ECON Committee had forwarded the following corrigenda to texts adopted by Parliament :

- Corrigendum (P7_TA-PROV(2013)0070(COR01)) to the position of the European Parliament adopted at first reading on 12 March 2013 with a view to the adoption of Regulation (EU) No .../2013 of the European Parliament and of the Council on common provisions for monitoring and assessing draft budgetary plans and ensuring the correction of excessive deficit of the Member States in the euro area (P7_TA-PROV(2013)0070) (COM(2011)0821 – C7-0448/2011– 2011/0386(COD)).

Pursuant to Rule 216(4) of the Rules of Procedure, these corrigenda would be deemed approved unless, not later than 24 hours after their announcement, a request was made by a political group or at least 40 Members that it be put to the vote.

The corrigenda were available on the Séance en direct site.


9. Interpretation of the Rules of Procedure

The President informed the House, under Rule 211(3), of the following interpretation of Rule 159(3), provided by the Committee on Constitutional Affairs, which had been consulted on the application of that provision:

Rule 159(3) is to be interpreted as meaning that, where there is a tied vote on a draft recommendation under Rule 128(4) not to intervene in proceedings before the Court of Justice of the European Union, such a tie does not signify the adoption of a recommendation that Parliament should intervene in those proceedings. In such a case, the committee responsible is to be deemed not to have expressed any recommendation.

If this interpretation was not contested by a political group or by at least 40 Members, in accordance with Rule 211(4), up until the opening of the following day's sitting, Tuesday 16 April 2013, it would be deemed to have been adopted. Otherwise, the matter would be put to the vote in Parliament.


10. Signature of acts adopted under the ordinary legislative procedure (Rule 74)
