2. Approval of the minutes of the previous sitting
The minutes of the previous sitting were approved.
3. Composition of Parliament
The Maltese authorities had announced the election to the European Parliament of Claudette Abela Baldacchino to replace Louis Grech, Marlene Mizzi to replace Edward Scicluna, and Roberta Metsola to replace Simon Busuttil.
In accordance with Article 7(1) of the Act of 20 September 1976 concerning the election of the Members of the European Parliament by direct universal suffrage, and with Rule 4(1) and (4) of its Rules of Procedure, Parliament noted the election of Claudette Abela Baldacchino, Marlene Mizzi and Roberta Metsola as Members of the European Parliament, with effect from 25 April 2013.
Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Claudette Abela Baldacchino, Marlene Mizzi and Roberta Metsola would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.
The Italian authorities had announced the election of Debora Serracchiani as President of the Friuli-Venezia Giulia Region, and the election to the European Parliament of Franco Frigo to replace her, with effect from 7 May 2013.
In accordance with Article 7(1) of the Act of 20 September 1976 concerning the election of the Members of the European Parliament by direct universal suffrage, and with Rule 4(1) and (4) of its Rules of Procedure, Parliament established the vacancy of Debora Serracchiani's seat, and noted the election of Franco Frigo as a Member of the European Parliament from that date.
Under Rule 3(2), until such time as his credentials had been verified or a ruling had been given on any dispute, and provided that he had previously made a written declaration stating that he did not hold any office incompatible with that of Member of the European Parliament, Franco Frigo would take his seat in Parliament and on its bodies and would enjoy all the rights attaching thereto.
4. Interpretation of the Rules of Procedure
The President informed the House, under Rule 211(3), of the following interpretation of Rule 156(6), provided by the Committee on Constitutional Affairs, which had been consulted on the application of that provision:
'On a proposal from the President, an oral amendment, or any other oral modification, shall be treated in the same way as an amendment not distributed in all the official languages. If the President considers it admissible under Rule 157(3), and save in the case of objection under Rule 156(6), it shall be put to the vote in accordance with the order of voting established.
'In committee, the number of votes needed to object to such an amendment or such a modification is established on the basis of Rule 196 proportionally to that applicable in plenary, rounded up where necessary to the nearest complete number.'
If this interpretation was not contested by a political group or by at least 40 Members, in accordance with Rule 211(4), before the opening of the following day's sitting, Tuesday21 May 2013., it would be deemed to have been adopted. Otherwise, the matter would be put to the vote in Parliament.
5. Composition of committees and delegations
The President had received the following requests for appointments from the PPE Group:
- Committee on Civil Liberties, Justice and Home Affairs: Roberta Metsola
- Special Committee on Organised Crime, Corruption and Money Laundering: Roberta Metsola
- PETI Committee: Roberta Metsola.
The appointments would be deemed ratified if there were no objections before the approval of these minutes.
6. Corrigendum (Rule 216)
The Committee on Fisheries had forwarded the following corrigendum to a text adopted by Parliament:
- Corrigendum ( P7_TA-PROV(2012)0449(COR01)) to the position of the European Parliament adopted at first reading on 22 November 2012 with a view to the adoption of Regulation (EU) No .../2013 of the European Parliament and of the Council amending Council Regulation (EC) No 1185/2003 on the removal of fins of sharks on board vessels (P7_TA-PROV(2012)0449) (COM(2011)0798 – C7-0431/2011 – 2011/0364(COD)).
Pursuant to Rule 216(4), this corrigendum would be deemed approved unless, within 24 hours, a request was made by a political group or at least 40 Members that it be put to the vote.
The corrigendum was available on the Séance en direct site.
7. Election of the new Ombudsman (announcement of candidates)
The President said that applications for the office of European Ombudsman for the remainder of the parliamentary term had to be tabled by 8 May 2013 at the latest(minutes of 15.4.2013, item 7).
Eight applications had been received before that date. After consideration, it had emerged that six candidates fulfilled the admission criteria. They are listed below in alphabetical order:
- Alex Brenninkmeijer
- Markus Jaeger
- Ria Oomen-Ruijten
- Emily O'Reilly
- Dagmar Roth-Behrendt, and
- Francesco Enrico Speroni.
These six applications would be forwarded to the Committee on Petitions when the files were available in all official languages. The Committee on Petitions would hold hearings of the candidates on 18 June 2013; the hearings would be open to all Members.
The new Ombudsman would be elected in plenary during the July part-session.
8. Signature of acts adopted under the ordinary legislative procedure (Rule 74)
The President announced that, together with the President of the Council, since the April part-session, he had signed the following act adopted under the ordinary legislative procedure:
- Decision of the European Parliament and of the Council derogating temporarily from Directive 2003/87/EC establishing a scheme for greenhouse gas emission allowance trading within the Community (00011/2013/LEX - C7-0105/2013 - 2012/0328(COD)).

9. Statements by the President
The President spoke of Parliament's solidarity with the Chinese human rights activist Chen Guangcheng and his family, who had been subjected to physical brutality and harassment.
The President also expressed Parliament's solidarity with the Italian Minister for Integration, Cécile Kyenge, who had been the victim of racist remarks by Mario Borghezio MEP during a recent interview on Italian radio.
10. Texts of agreements forwarded by the Council
The Council had forwarded certified true copies of the following:
- Agreement in the form of an exchange of letters between the European Community and the Republic of Iceland concerning additional trade preferences in agricultural products undertaken on the basis of Article 19 of the Agreement on the European Economic Area;
