1. Resumption of the session

The sitting opened at 15.05.


2. Statement by the President

The President made a statement on the occasion of the 30th anniversary of the nuclear accident in Chernobyl. He paid tribute to the victims of the disaster, the exact number of whom is still controversial.


3. Welcome

On behalf of Parliament, The President welcomed Ms Amal al-Qubaisi, Speaker of the Parliament of the United Arab Emirates, who had taken a seat in the distinguished visitors' gallery.

The following spoke: Manfred Weber, pursuant to Rules 186 and 11(2), on the visit to Parliament by Arnaldo Otegi, a former member of ETA, who had been invited by the GUE/NGL Group for the day of commemoration for the victims of terrorism which had been held two days earlier, on Monday 25 April 2016 (the President replied that the drafting of lists of political groups' guests was their responsibility, and asked Manfred Weber to raise this matter with the Conference of Presidents and the Bureau) and Gabriele Zimmer, on the remarks by Manfred Weber.


4. Approval of the minutes of the previous sitting

The minutes of the previous sitting were approved.


5. Verification of credentials

On a proposal from the JURI Committee, Parliament confirmed the validity of the mandate of Morten Løkkegaard with effect from 3 March 2016.


6. Request for the waiver of parliamentary immunity

The Greek authorities had forwarded a request to waive the parliamentary immunity of Sotirios Zarianopoulos and Giorgos Grammatikakis, respectively, in relation to criminal proceedings to be brought before the Thessaloniki Magistrates' Court and the Rethymno Magistrates' Court, respectively.

Pursuant to Rule 9(1), the request had been referred to the committee responsible, the JURI Committee.


7. Composition of committees and delegations

The President had received a request from the S&D Group for the following appointment:

Delegation to the ACP-EU Joint Parliamentary Assembly: Gabriele Preuß to replace Evelyne Gebhardt.

The appointment would be deemed ratified if no objections were raised before the approval of these Minutes.


8. Delegated acts (Rule 105(6))

In accordance with Rule 105(6), the Chair of the Conference of Committee Chairs had informed the President of Parliament that no objections had been raised with regard to:

the recommendation by the IMCO Committee to raise no objection to the Commission Delegated Regulation of 8 April 2016 correcting Delegated Regulation (EU) 2016/341 supplementing Regulation (EU) No 952/2013 of the European Parliament and of the Council as regards transitional rules for certain provisions of the Union Customs Code where the relevant electronic systems are not yet operational and amending Delegated Regulation (EU) 2015/2446 (2016/2656(DEA)) (B8-0515/2016)

If no objections to this recommendation are raised by a political group or at least 40 Members within 24 hours, it shall be deemed to have been approved. If this is not the case, it shall be put to the vote.

The recommendation is available on Europarl for the duration of the current part-session.


9. Signature of acts adopted under the ordinary legislative procedure (Rule 78)

The President announced that, jointly with the President of the Council, he had today signed the following acts adopted under the ordinary legislative procedure:

- Directive of the European Parliament and of the Council on the use of passenger name record (PNR) data for the prevention, detection, investigation and prosecution of terrorist offences and serious crime (00071/2015/LEX - C8-0155/2016 - 2011/0023(COD))

- Regulation of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (00017/2016/LEX - C8-0154/2016 - 2012/0011(COD))

- Directive of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data by competent authorities for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, and on the free movement of such data, and repealing Council Framework Decision 2008/977/JHA (00016/2016/LEX - C8-0153/2016 - 2012/0010(COD))

Request by the S&D Group for the inclusion on the agenda of a debate on the market economy status of China, winding up with the tabling of motions for resolutions which would be put to the vote at the May I part-session.

The following spoke: Gianni Pittella, on behalf of the S&D Group, to move the request, David Borrelli, on behalf of the EFDD Group, to second the request, Daniel Caspary, to oppose it, Philippe Lamberts, to propose that the debate and vote be held at the May I part-session, Gianni Pittella and David Borrelli to second this proposal, and Manfred Weber to ask that the matter be put to the Conference of Presidents (the President invited Members to request that he make a recommendation to the Conference of Presidents in connection with the drafting of the next part-session's agenda).

Request by the S&D Group for the inclusion the agenda of a debate on recent developments in Poland and their impact on fundamental rights.

The following spoke: Enrique Guerrero Salom, on behalf of the S&D Group, to move the request, Malin Björk, in favour of the request, Ryszard Antoni Legutko, against the request, Sophia in 't Veld to request that the debate be held at the next part-session or at the latest in June, and Esteban González Pons, to oppose the holding of a new debate before the Commission had notified any changes in the situation in Poland (as Enrique Guerrero Salom had agreed to the suggestion by Sophia in 't Veld, the President said that a request to that effect would be made at the next Conference of Presidents).

In agreement with the political groups, the President proposed the inclusion on the voting list of the Lebreton report on the waiver of the immunity of Bolesław G. Piecha (A8-0152/2016) and the request by the EMPL Committee to consult the European Economic and Social Committee on the European Pillar of Social Rights, further to Commission communication COM(2016)0127 of 8 March 2016.

Parliament approved the proposal.
