European Parliament decision on the verification of credentials of Members following the fifth direct elections to the European Parliament on 10 to 13 June 1999
The European Parliament,
- having regard to the Act of 20 September 1976 concerning the election of the representatives of the European Parliament by direct universal suffrage,
- having regard to Rules 7, 8, and 9 and Annex I of its Rules of Procedure,
- charged with verifying the credentials of the Members elected by virtue of the elections of 10 to 13 June 1999,
- having regard to the official notifications from the competent authorities of the Member States concerning the election to the European Parliament,
- having regard to the report of the Committee on Legal Affairs and the Internal Market (A5-0084/1999
),
A. whereas Article 6(1) of the Act of 20 September 1976 clearly sets out the offices which are incompatible with that of Member of the European Parliament, and whereas Members are obliged, pursuant to Rule 7(2) of the Rules of Procedure, to indicate such incompatibility,
B. whereas every Member is obliged, pursuant to Rule 9 and Annex I of its Rules of Procedure, to make a declaration of “his professional activities and any other remunerated functions or activities” and “any support, whether financial or in terms of staff or material, additional to that provided by Parliament and granted to the Member in connection with his political activities by third parties, whose identity shall be disclosed”,
C. expressing its regret at the fact that, contrary to the provisions of the Treaty of Rome, the resolutions adopted by the European Parliament and the Draft act adopted by the European Parliament on 15 July 1998 enabling the Members of the European Parliament to be elected by direct universal suffrage in accordance with principles common to all the Member States(1)
, a uniform electoral system has still not been adopted for the election of the Members of the European Parliament, with the result that national procedures are still in force that differ in fundamental respects,
D. whereas the European Parliament is empowered to rule only on objections arising from infringements of the Act of 20 September 1976, since objections based on national laws have to be dealt with by the appropriate bodies of Member States,
E. whereas all of the Member States have notified the European Parliament of the names of the elected candidates; whereas, however, some Member States have still not forwarded the lists of any substitutes together with their ranking in accordance with the results of the vote, as is required under Rule 7(2) of Parliament's Rules of Procedure (the lists received are available for inspection in the appropriate departments of Parliament's Secretariat-General);
1. Declares valid, pending any decisions by the competent bodies in those Member States where objections have been raised to the election result, the mandate of the Members of the European Parliament notice of whose election has been forwarded by the competent national authorities and who have signed a declaration on the offices which are incompatible with that of Member of the European Parliament, as set out in Article 6(1) of the Act of 20 September 1976, and who have made the declaration provided for in Annex I of the Rules of Procedure of the European Parliament (the names of the Members whose mandate has been declared valid are listed in the Annex to this decision);
2. Repeats its request to the authorities of the Member States whose task is not only to notify the European Parliament of the names of the elected candidates, but also to forward the names of any substitutes together with their ranking in accordance with the results of the vote;
3. Calls on the competent authorities of the Member States to complete, as soon as possible, the examination of the objections submitted to them;
4. Instructs its President to forward this decision to the competent national authorities and the parliaments of the Member States.

(*) Mr Goerens resigned as a Member of the European Parliament on 6 August 1999 because his membership of Parliament was incompatible with his office in the Luxembourg Government. Consequently, he did not submit the declarations provided for in the Rules of Procedure.
(**) By the time that the constituent part-session of the fifth parliamentary term opened on 20 July 1999, Luxembourg had notified the election of only five of its Members. The election of the sixth, Mrs Viviane Reding (PPE/LU) was notified later with effect from 7 August 1999. She resigned her seat upon her appointment as Commissioner. The Member appointed to replace her will be the subject of a separate verification report.

hould an elected Member resign from Parliament before the report on the verification of credentials has been adopted in plenary, the vacancy and the name of the new Member shall be verified, pursuant to Rule 8 of the Rules in conjunction with the relevant provisions of the Act of 20 September 1976, in a separate procedure independent of this report, which relates only to the acquisition of a mandate as a result of the fifth direct elections.
