European Parliament legislative resolution on the proposal for a Council regulation amending Regulation (EEC) No 1766/92 with regard to the calculation of import duties on certain cereals (COM(2002) 732 – C5&nbhy;0028/2003 – 2002/0292(CNS))

The European Parliament,
– having regard to the Commission proposal to the Council (COM(2002) 732)(1),
– having regard to Article 37 of the EC Treaty, pursuant to which the Council consulted Parliament (C5&nbhy;0028/2003),
– having regard to Rule 67 of its Rules of Procedure,
– having regard to the report of the Committee on Agriculture and Rural Development (A5&nbhy;0070/2003),
1. Approves the Commission proposal as amended;
2. Calls on the Commission to alter its proposal accordingly, pursuant to Article 250(2) of the EC Treaty;
3. Calls on the Council to notify Parliament if it intends to depart from the text approved by Parliament;
4. Asks the Council to consult Parliament again if it intends to amend the Commission proposal substantially;
5. Instructs its President to forward its position to the Council and Commission.
2. Notwithstanding paragraph 1, the import duty on products covered by CN codes 1001 90 91, ex 1001 90 99, 1002, ex 1005 other than hybrid seed, and ex 1007 other than hybrid for sowing, shall be equal to the intervention price valid for such products on importation and increased by 55%, minus the cif import price applicable to the consignment in question. However, that duty may not exceed the rate of duty in the Common Customs Tariff.
2. Notwithstanding paragraph 1, the import duty on products covered by CN codes 1001 90 91 (Common wheat seed), ex 1001 90 99 (High quality common wheat), 1001 10 00 (Durum wheat), 1002 (Rye), ex 1005 (Maize) other than hybrid seed, and ex 1007 (Sorghum) other than hybrid for sowing, shall be equal to the intervention price valid for such products on importation and increased by 55%, minus the cif import price applicable to the consignment in question. However, that duty may not exceed the rate of duty in the Common Customs Tariff.
