European Parliament legislative resolution of 9 July 2020 on the Council position at first reading with a view to the adoption of a directive of the European Parliament and of the Council laying down specific rules with respect to Directive 96/71/EC and Directive 2014/67/EU for posting drivers in the road transport sector and amending Directive 2006/22/EC as regards enforcement requirements and Regulation (EU) No 1024/2012 (05112/1/2020 – C9-0106/2020 – 2017/0121(COD))

The European Parliament,

–  having regard to the Council position at first reading (05112/1/2020 – C9‑0106/2020),

–  having regard to the reasoned opinion submitted, within the framework of Protocol No 2 on the application of the principles of subsidiarity and proportionality, by the Senate of the Republic of Poland, asserting that the draft legislative act does not comply with the principle of subsidiarity,

–  having regard to the opinion of the European Economic and Social Committee of 18 January 2018(1),

–  having regard to the opinion of the Committee of the Regions of 1 February 2018(2),

–  having regard to its position at first reading(3) on the Commission proposal to Parliament and the Council (COM(2017)0278),

–  having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

–  having regard to the provisional agreement approved by the committee responsible under Rule 74(4) of its Rules of Procedure,

–  having regard to Rule 67 of its Rules of Procedure,

–  having regard to the recommendation for second reading of the Committee on Transport and Tourism (A9-0114/2020),

1.  Approves the Council position at first reading;

2.  Notes that the act is adopted in accordance with the Council position;

3.  Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;

4.  Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;

5.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

The European Parliament,

–  having regard to the Commission delegated regulation (C(2020)04140),

–  having regard to the Commission’s letter of 22 June 2020 asking Parliament to declare that it will raise no objections to the delegated regulation,

–  having regard to the letter from the Committee on Economic and Monetary Affairs to the Chair of the Conference of Committee Chairs of 3 July 2020,

–  having regard to Article 290 of the Treaty on the Functioning of the European Union,

–  having regard to Regulation (EU) No 473/2013 of the European Parliament and of the Council of 21 May 2013 on common provisions for monitoring and assessing draft budgetary plans and ensuring the correction of excessive deficit of the Member States in the euro area(1), and in particular Article 10(3) and Article 14(5) thereof,

–  having regard to Rule 111(6) of its Rules of Procedure,

–  having regard to the recommendation for a decision of the Committee on Economic and Monetary Affairs,

–  having regard to the fact that no objections have been raised within the period laid down in the third and fourth indents of Rule 111(6) of its Rules of Procedure, which expired on 9 July 2020,

A.  whereas in the Eurogroup meeting of 9 April 2020, the Ministers of Finance of the euro area Member States proposed to establish the Pandemic Crisis Support, based on the Enhanced Conditions Credit Line of the European Stability Mechanism, in response to the COVID-19 pandemic;

B.  whereas the Eurogroup report states that the only requirement to access the Pandemic Crisis Support will be that euro area Member States requesting support would commit to use this credit line to support domestic financing of direct and indirect healthcare, cure and prevention related costs due to the COVID-19 crisis;

C.  whereas in a joint letter dated 7 May 2020, Executive Vice-president Dombrovskis and Commissioner Gentiloni announced the intention to amend Commission Delegated Regulation (EU) No 877/2013 of 27 June 2013 supplementing Regulation (EU) No 473/2013 of the European Parliament and of the Council on common provisions for monitoring and assessing draft budgetary plans and ensuring the correction of excessive deficit of the Member States in the euro area(2) to further specify the reporting requirements applying to Member States drawing on the Pandemic Crisis Support;

D.  whereas the delegated act amends the reporting requirements and specifies that the reporting in the current situation only concerns the use of the Pandemic Crisis Support funds to cover the direct and indirect healthcare, cure and prevention related costs resulting from the COVID-19 crisis, given the very specific and limited scope of the Pandemic Crisis Support, and the new Annex II sets out the related reporting template;

E.  whereas this delegated act should enter into force as soon as possible in order to streamline the reporting requirements applying to Member States drawing on the Pandemic Crisis Support;

1.  Declares that it has no objections to the delegated regulation;

2.  Instructs its President to forward this decision to the Council and the Commission.

European Parliament legislative resolution of 9 July 2020 on the proposal for a regulation of the European Parliament and of the Council laying down temporary measures concerning the time limits for the collection, verification and examination stages provided for in Regulation (EU) 2019/788 on the European citizens' initiative in view of the COVID-19 outbreak (COM(2020)0221 – C9‑0142/2020 – 2020/0099(COD))

The European Parliament,

–  having regard to the Commission proposal to Parliament and the Council (COM(2020)0221),

–  having regard to Article 294(2) and Article 24 of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C9-0142/2020),

–  having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–  having regard to the provisional agreement approved by the committee responsible under Rule 74(4) of its Rules of Procedure and the undertaking given by the Council representative by letter of 30 June 2020 to approve Parliament’s position, in accordance with Article 294(4) of the Treaty on the Functioning of the European Union,

–  having regard to Rules 59 and 163 of its Rules of Procedure,

1.  Adopts its position at first reading hereinafter set out(1);

2.  Calls on the Commission to refer the matter to Parliament again if it replaces, substantially amends or intends to substantially amend its proposal;

3.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.
