The European Parliament,

–  having regard to the Commission proposal to Parliament and the Council (COM(2020)0309),

–  having regard to Article 294(2) and Article 78(2), Article 79(2) and (4), Article 82(1), Article 84 and Article 87(2) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C9‑0202/2020),

–  having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–  having regard to the undertaking given by the Council representative by letter of 22 September 2020 to approve Parliament’s position, in accordance with Article 294(4) of the Treaty on the Functioning of the European Union,

–  having regard to Rules 59 and 52(1) of its Rules of Procedure,

–  having regard to the report of the Committee on Civil Liberties, Justice and Home Affairs (A9-0171/2020),

1.  Adopts its position at first reading hereinafter set out;

2.  Calls on the Commission to refer the matter to Parliament again if it replaces, substantially amends or intends to substantially amend its proposal;

3.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

Position of the European Parliament adopted at first reading on 6 October 2020 with a view to the adoption of Regulation (EU) 2020/… of the European Parliament and of the Council amending Regulation (EU) No 514/2014 as regards the decommitment procedure

European Parliament resolution of 6 October 2020 on the Council position on Draft amending budget No 7/2020 of the European Union for the financial year 2020 - Update of revenue (own resources) (10430/2020 – C9-0283/2020 – 2020/1999(BUD))

The European Parliament,

–  having regard to Article 314 of the Treaty on the Functioning of the European Union,

–  having regard to Article 106a of the Treaty establishing the European Atomic Energy Community,

–  having regard to Regulation (EU, Euratom) 2018/1046 of the European Parliament and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union, amending Regulations (EU) No 1296/2013, (EU) No 1301/2013, (EU) No 1303/2013, (EU) No 1304/2013, (EU) No 1309/2013, (EU) No 1316/2013, (EU) No 223/2014, (EU) No 283/2014, and Decision No 541/2014/EU and repealing Regulation (EU, Euratom) No 966/2012(1), and in particular Article 44 thereof,

–  having regard to the general budget of the European Union for the financial year 2020, as definitively adopted on 27 November 2019(2),

–  having regard to Council Regulation (EU, Euratom) No 1311/2013 of 2 December 2013 laying down the multiannual financial framework for the years 2014-2020(3),

–  having regard to the Interinstitutional Agreement of 2 December 2013 between the European Parliament, the Council and the Commission on budgetary discipline, on cooperation in budgetary matters and on sound financial management(4),

–  having regard to Council Decision 2014/335/EU, Euratom of 26 May 2014 on the system of own resources of the European Union(5),

–  having regard to Draft amending budget No 7/2020, which the Commission adopted on 6 July 2020 (COM(2020)0424),

–  having regard to the position on Draft amending budget No 7/2020 which the Council adopted on 4 September 2020 and forwarded to Parliament on 7 September 2020 (10430/2020 – C9‑0283/2020),

–  having regard to Rules 94 and 96 of its Rules of Procedure,

–  having regard to the report of the Committee on Budgets (A9-0163/2020),

A.  whereas the purpose of Draft amending budget No 7/2020 is to update the revenue side of the budget to take account of the latest developments,

B.  whereas the COVID-19 pandemic has drastically changed the outlook for the Union economy and the Commission spring 2020 forecast expects the Union economy to contract by a record 7,5 % this year, followed by a rebound of 6,1 % in 2021, not enough to fully make up for this year’s loss, and whereas the worsening economic situation is reflected in the own resources forecast for 2020,

C.  whereas two types of adjustments to the revenue side of the budget are required, namely an update of the estimates for Traditional Own Resources (TOR) as well as for the own resources based on the Value Added Tax (VAT) and Gross National Income (GNI) to take account of more recent economic forecasts, and an update of the UK correction,

D.  whereas the other revenue also needs to be updated to take into account finally cashed fines and penalty payments until June 2020 and negative exchange rate differences,

1.  Takes note of Draft amending budget No 7/2020 as submitted by the Commission, which is devoted to update the revenue side of the budget;

2.  Approves the Council position on Draft amending budget No 7/2020;

3.  Instructs its President to declare that Amending budget No 7/2020 has been definitively adopted and arrange for its publication in the Official Journal of the European Union;

4.  Instructs its President to forward this resolution to the Council, the Commission, the other institutions and bodies concerned and the national parliaments.
