Greece - Electoral Law

1. LEGAL BASIS
  • Law 1180/81 on election of representatives to the European Parliament
  • Law 1427/84 on the exercise of the electoral rights of Greek nationals living in the EU
  • Law 2196/94: ratification of Council Directives 93/81 and 93/109
  • Law 3001/02: ratification of the Nice Treaty

2. ELECTORAL SYSTEM
Single constituency.
Proportional representation (closed lists): Election of representatives to the European Parliament is by a strictly proportional system. Seats will be allocated among all the lists of parties or coalitions of parties obtaining a minimum of 3% of the vote, in proportion to the number of votes obtained over the whole territory.
Allocation of seats: The High Electoral Commission, based in the Interior Ministry, will proclaim the results. The Courts of First Instance will send in the results in each constituency to the Ministry. On that basis the High Electoral Commission will draw up the final, overall table of results for the whole territory and then allocate the seats.

The votes of Greek voters living in other EU Member States will also be counted.

3. REGISTRATION OF CANDIDATES
Deadline for registration: 26 May, or at the latest 13 days after the opening of the election campaign, which begins 30 days before the elections.
Deposit: A certificate from the payments office of the Athens Public Treasury stating that the sum of € 2934.70 has been deposited must be attached to the proposals from each list. Proposals for registration as candidates must be delivered by a bailiff to the public prosecutor of the Court of Cassation (Areios Pagos) or be sent to its office by recorded delivery no later than 13 days after the opening of the election campaign.

Conditions: Only parties and coalitions of parties are entitled to register candidates. Lists comprise up to 24 candidates. Proposals must include the surname, forename, father's forename, occupation and exact address of the person proposed, together with their written agreement and a declaration on their honour.

Incompatibilities:

(a) Ineligibility: Persons holding posts listed at Article 56(1) and (4) of the Constitution and members of the Greek Parliament are ineligible. The procedure for resigning a post conferring ineligibility is governed by the provisions of the electoral laws.

(b)Incompatibility: The following offices are incompatible with the office of MEP:

  • the posts and offices listed at Article 57 of the Constitution,
  • Member of the Greek Parliament,
  • the offices stipulated in the Act of 20 September 1976 of the Council of the European Communities, in particular :
  • member of the Greek Government
  • member of the European Commission
  • Judge, Advocate-General or Registrar of the Court of Justice of the European Communities
  • member of the Board of Directors of the European Central Bank
  • member of the European Court of Auditors
  • European Community Ombudsman
  • member of the Economic and Social Committee of the European Economic Community and of the European Atomic Energy Community,
  • member of committees or other bodies set up pursuant to the Treaties establishing the European Coal and Steel Community, the European Economic Community and the European Atomic Energy Community for the purpose of managing the Communities' funds or carrying out a permanent direct administrative task,
  • member of the Board of Directors, Management Committee or staff of the European Investment Bank,
  • active official or servant of the institutions of the European Communities or of the specialised bodies attached to them or of the European Central Bank.


(c) Proclamation of candidatures: The First Chamber of the Court of Cassation will proclaim the candidatures which fulfil the conditions laid down by law, list by list, on the 14th day preceding polling day, in the order given in the list. It should be noted that the law does not provide for a preferential vote for the candidates; it is up to the parties and party coalitions to determine the order of candidates.

4. POLLING DAY : 13 JUNE 2004
The count begins: 19.00
Estimation/publication of results: from 22.00 to 24.00
Final results: 4-5 days
5. VOTING / STANDING FOR ELECTION

Right to vote: All EU nationals who are:

  • aged 18 or over
  • registered on the electoral roll of a municipality or local authority in Greece if they have not lost their voting rights.

Who does not have the right to vote?

  • Anyone subject to a guardianship order under the provisions of the Civil Code
  • anyone with an irrevocable criminal conviction for one of crimes laid down by the criminal code or military criminal code
Registration on electoral rolls:

Every voter must register on the electoral roll of the municipality or local authority where they are registered on the general register. Every voter is entitled to register on only one electoral roll.

Under Law 2623/98, the electoral rolls have been revised on the basis of the general registers of residents of municipalities and local authorities.

Eligibility: All EU citizens aged 25 or over on polling day who have the right to stand as candidates are eligible.
6. ELECTION CAMPAIGN
Funding: Political parties represented in the Greek Parliament or European Parliament and parties obtaining more than 1.5% will receive funding.
Official campaign starting date: 30 days before polling day.

Media access: All parties represented in the Greek Parliament or the European Parliament will have proportional access to the public media.

Opinion polls: Conducting opinion polls and publishing any results of such polls must cease 15 days before polling day.
