Malta - Electoral Law

(Election to the European Parliament : 12 June 2004)

1. LEGAL BASIS

European Parliament Elections Act, adopted 26 November 2003, based on the Act of the member States of the European Community concerning the election of the representatives of the Assembly by direct universal suffrage annexed to decision 76/787/ECSE, EEC Euratom.

2. ELECTORAL SYSTEM

Proportional representation: by means of the single transferable vote. Malta shall constitute one single electoral district. Parties and candidates indicated on ballot papers in alphabetical order.

Allocation of seats: According to the system of the single transferable vote.

3. REGISTRATION OF CANDIDATES

Deadline for registration: Date to be set between 31 March (deadline for registration of voters) and 35 days before election day (when the names of the candidates have to be published in the Gazette)

Deposit: 40 Maltese Pounds ( 90 Euro) per candidate (to be returned if obtaining 10% of the votes)

Conditions: A person shall be qualified to stand for the EP elections if registered as a voter in the Electoral Register or in the EU Electoral Register. Public Officers may be restricted from standing for election by the Public Service Management Code. Not allowed to stand for elections if being member of Disciplined Forces (Armed Forces, Police or Prison Service), the Judiciary, declared bankrupt, interdicted or incapacitated for any mental infirmity or prodigality, serving a sentence of imprisonment exceeding 12 months, disqualified for standing for the elections of MEP in terms of any law in force.

Incompatibilities: Membership of House of Representatives, membership of Local Council in Malta or any other EU Member State.

4. POLLING DAY : 12 JUNE 2004

Other elections on the same day: Elections Local Councils (1/3 of Local Councils)

Polling hours:

The count begins: Noon, Sunday June, 13

Final results: Not until after the close of polling in all Member States

5. VOTING / STANDING FOR ELECTION

Right to vote: Voting rights as from the age of 18 years. Every person whose name appears in the Electoral Register or in the European Union Electoral Register. No person shall be registered in the EU Electoral Register if he/she is interdicted or incapacitated for any mental infirmity by a court in a Member State, he/she is serving imprisonment exceeding twelve months, he/she is disqualified for registration as a voter by or under any law in Malta.

Voting is compulsory: No

Voting by post: Not possible. Voting should take place in the country. The government offers special facilities for voters residing in other EU countries to vote in Malta.

Right to stand for election: Qualified to stand for election if registered as a voter in the Electoral Register or in the EU Electoral Register (see also point 3 'Conditions'). A candidate must be at least 18 years old.

6. ELECTION CAMPAIGN

Funding: Maximum of 600 Maltese Pounds (1400 Euro) per candidate.

Official campaign starting date: No official starting date.

Media access: Two main political parties (Malta Labour Party and the Nationalist Party) own their own television and radio stations as well as newspapers. Access to public stations under discussion.

Opinion polls: Campaigning nor polling is allowed from one day prior to the elections.
