Luxembourg - Electoral Law
(Election to the European Parliament : 13 June 2004)

1. LEGAL BASIS
Electoral law of 18 February 2003, supplemented by the law of 10 February 2004 concerning the election of Members of the European Parliament in the new Member States.
2. ELECTORAL SYSTEM
Proportional representation on a national basis (the whole country forming a single constituency).
Allocation of seats: d'Hondt method. Each voter has the same number of votes as there are seats (six). Panachage (cross-party voting) is permitted. A voter may vote en bloc for an entire list, vote for candidates from more than one list, or choose individual candidates from a particular list. Where a voter votes for an entire list consisting of fewer than six candidates, this list is credited with as many votes as it has candidates. No list may include more than twelve names. Seats are allocated on the basis of the number of votes obtained by the different candidates and lists.
3. REGISTRATION OF CANDIDATES
Deadline for registration: 60 days before polling day.
Deposit: None.

Conditions: lists must be submitted by either 250 voters, or a Member of the European Parliament or a national MP.

Incompatibilities: Those laid down in the 1976 Act on Elections to the European Parliament.
4. POLLING DAY : 13 JUNE 2004
Other elections on the same day: National legislative elections.
Polling hours: from 08.00 to 14.00
The count begins: at 14.00 on Sunday together with the count for the national legislative elections. The first projections will be published from 22.00, calculated on the basis of 80% of the votes already counted.
Final results: once the calculations have been completed.
5. VOTING / STANDING FOR ELECTION
Right to vote: To be entitled to vote a citizen must:
  • be a Luxembourg national or national of another EU Member State;
  • be at least 18 years old on the day of the elections;
  • enjoy civil rights and not have been disenfranchised in their Member State of residence or of origin;
  • for Luxembourg nationals, be resident in the Grand Duchy of Luxembourg; Luxembourg nationals resident abroad may vote in European elections by post;
  • for nationals of another EU Member State, be resident in the Grand Duchy and have lived there, at the time of registration on the electoral roll, for at least five years; however, any EU voters who, owing to their residence outside their Member State of origin or the duration of such residence, are not entitled to vote, cannot be prevented from voting by the duration of residence condition (the law of 10 February 2004 also allows nationals of the new Member States to vote, provided that they register on an electoral roll).
Voting is compulsory for all voters on the electoral roll.
Voting by post: Luxembourg citizens resident abroad may vote by post, as may certain other categories of voter (both Luxembourg citizens and other EU citizens).

Right to stand for election: To be entitled to stand for election a citizen must:

  1. be a Luxembourg national or national of another EU Member State;
  2. enjoy civil rights and not have been disenfranchised in the Grand Duchy of Luxembourg or in their Member State of origin;
  3. be at least 18 years old on the day of the elections;
  4. for Luxembourg nationals, be resident in the Grand Duchy of Luxembourg;
  5. for nationals of another EU Member State, be resident in the Grand Duchy and have lived there, at the time of submission of the list of candidates, for five years; however, any EU citizen wishing to stand for election who, owing to their residence outside their Member State of origin or the duration of such residence, are not eligible to stand, cannot be prevented from doing so by the duration of residence condition.
6. ELECTION CAMPAIGN

Funding: lists obtaining at least 5% of the total vote are entitled to reimbursement of the costs of mailing one leaflet per voter and reimbursement of part of their election expenses according to a scale of flat-rate allowances calculated in proportion to the number of votes received.

  • € 12 500 for at least 5 % of the total vote
  • € 25 000 for at least 10 % of the total vote
  • € 37 500 for at least 15 % of the total vote
  • € 50 000 for at least 20 % of the total vote
  • € 74 500 for at least 25 % of the total vote

An additional sum of € 12 500 per elected MEP is also granted.

Official campaign starting date: None. The parties agree among themselves on a date.

Media access: the media campaign will begin on 10 May 2004 and will last for five weeks. Each complete list will have 8 minutes.

Opinion polls: No results may be published in the month before polling day.
