Protecting copyrighted creative work in the age of AI

On Tuesday, MEPs are expected to call for measures to protect the EU’s creative sector against exploitation by artificial intelligence.

The report prepared by the Legal Affairs Committee seeks to answer key legal questions about the interplay between generative artificial intelligence (genAI) and copyright. It calls for the transparent and remunerated use of copyrighted content by genAI. MEPs want AI providers to transparently acknowledge copyrighted work they used to train their systems and ensure that rightsholders receive fair remuneration for such use. They also want measures allowing rightsholders to exclude their copyrighted work from being used in AI training.

MEPs want the Commission to create a licensing market for copyrighted material and facilitate licensing agreements including with individual creators. MEPs are also set to urge the Commission and member states to protect the press and news media sectors, which are regularly exploited by AI systems, to ensure adequate compensation for news media outlets, and to protect media pluralism and diversity of information.
