Answer given by Mr Špidla on behalf of the Commission

In its answer to Written Question E‑5910/07 the Commission stated that it had opened an infringement concerning the implementation in the Republic of Malta of Council Directive 99/70/EC of 28 June 1999 concerning the framework agreement on fixed-term work concluded by ETUC, UNICE and CEEP(1).

In September 2008 Malta introduced a legislative instrument (Legal Notice 238/08) which amended Contracts of Service for a Fixed Term Regulation, 2007 (Legal Notice 51/07), which transposed Directive 1999/70/EC into Maltese national legislation. The amendment pertains to Regulation 3 (applicability) and Regulation 7 (successive fixed-term contracts).

The Commission has analysed the effect of this amending legislation including the changes to the categories excluded from the legislation transposing Directive 1999/70/EC. The Commission will shortly take a decision on how to proceed with this file.
