La Présidente. - L'ordre du jour appelle le débat sur la déclaration de la Commission sur la non-discrimination dans le cadre de la santé et des droits génésiques et sexuels (2014/2514(RSP)).
Siim Kallas, Vice-President of the Commission. − Madam President, the Commission fully recognises that each and every individual has the fundamental right of access to high-quality healthcare. Despite the work done and the results achieved over the years, problems of inequality and discrimination, sadly, persist in Europe. We therefore need to continue and increase our efforts to eliminate all forms of inequality and discrimination, including discrimination based on gender and sexual orientation. We must also continue to actively promote equality between men and women.
The Commission organised an event on this theme last October with the aim of contributing towards a healthier and fairer Europe, and it will convene a conference in March on the issue. Health must be for all. Everybody should have access to high-quality healthcare, regardless of gender, age, race, sexual orientation, disease, social status, education or country of residence.
Health – free of prejudice and discrimination, and with full respect to all beliefs and behaviours – calls for the involvement of the whole of society. It involves, for example, education, justice and social affairs – in short, all the different constituent areas that collectively make up our societal models.
Sexual and reproductive health is, of course, part of the health status of the population and equally needs to be considered within a perspective of equality and non-discrimination, both inside and outside the European Union. We must strive to do better. For example, it is unacceptable that, even if it is comparatively low in the European Union, maternal mortality is still a problem and is significantly high within some vulnerable groups. It is unacceptable that female genital mutilation still exists in the EU, as well as in the wider world. It is unacceptable that many forms of violence – which clearly have an impact on health – are still deemed, in certain quarters, to be ‘justified’ by custom, tradition, culture, privacy, religion or honour.
Let me finish by reiterating that the Commission stands among the staunchest opponents of inequality and discrimination in all its forms. Whilst respecting the national competences of the Member States, the Commission actively supports governments’ efforts to ensure that health systems have the capacity to deal effectively with health needs and that equality and fairness are championed at every opportunity.
Edit Bauer, on behalf of the PPE Group. – Madam President, with full respect to Article 168 of the Lisbon Treaty, the PPE Group is standing firm on the position that sexual and reproductive health and rights come under subsidiarity and, as such, under the competence and responsibility of the Member States. It was clear that different traditions, situations and legislation in the Member States divide European public opinion – as well as this House – just as it was clear last time when Parliament rejected the Estrela report.
We cannot impose or recommend solutions which are profoundly unacceptable in different Member States on such a sensitive issue. What we can and should do is to support improvements in healthcare for pregnant women and mothers, and to improve the conditions for reproductive health, as maternal mortality is still high in some Member States, as was stated by the Commission.
On the other hand, the statistics show that 15 % of couples are infertile. In this field, the Commission should facilitate the exchange of best practices. What we can and should do is follow the principle of non-discrimination as one of the main values of the Union in the accessibility of health services. What we can and should do is step up efforts to eliminate violence against women and girls: not just because it often results in a deterioration of sexual and reproductive health, but also because it is a serious offence against human dignity. What we can and should do is strengthen the fight against Female Genital Mutilation (FGM) as a special form of violence which is also present in the European Union and which often stays hidden and goes unpunished. There is a lot of room for better law enforcement, because many violent acts against women and girls go unpunished, while victims are stigmatised.
La Présidente. - Je voudrais accueillir tous les visiteurs qui sont à la tribune mais, en particulier un groupe de femmes qui travaillent dans le planning familial et sont certainement très concernées par notre débat.
Iratxe García Pérez, en nombre del Grupo S&D. – Señora Presidenta, algunos deseaban que hoy no tuviera lugar este debate; algunos se plantean la cuestión de las competencias de la Unión Europea para no hablar de una cuestión fundamental: los valores de la Unión, la libertad y la dignidad de las mujeres.
Europa no puede permanecer impasible mientras el Gobierno del señor Rajoy pretende acabar con décadas de lucha de las mujeres por el derecho a decidir, por la dignidad, por la libertad.
Hoy en España no es necesario cambiar la ley si no es porque una parte de la población quiere imponer una moral a todo el resto de las mujeres. Porque la ley que existe actualmente en España no obliga a nadie a abortar, pero la ley que quiere imponer el Partido Popular obliga a todas las mujeres a ser madres, aun cuando ellas no lo deseen.
Habla el proyecto de ley de protección a los concebidos no nacidos, pero se ha olvidado el Gobierno de los nacidos, de los niños que hoy en España viven bajo el umbral de la pobreza porque obligan a las mujeres a tener hijos con discapacidad, a la vez que están retirando las ayudas a las familias dependientes. ¡Es vergonzoso que nos encontremos con esa situación! Y, además, es una ley discriminatoria. Porque las mujeres con recursos económicos van a poder ir a otros países de la Unión Europea, mientras que las mujeres que no tienen recursos económicos van a tener que acudir a los abortos clandestinos o ser madres sin desearlo.
Me niego, nos negamos, a que nuestras hijas en Europa vayan a tener menos derechos que nuestras madres.
Michael Cashman (S&D). - Madam President, the clock is not actually working in accordance with your timer, so it makes it very difficult for us to conform with the time limitations which have been given to us.
Sophia in 't Veld, on behalf of the ALDE Group. – Madam President, before I make my point I would like firstly to state here that I give my support to Spanish women, who are EU citizens like all of us and are entitled to equal treatment. With regard to the point concerning subsidiarity, I believe the EPP is being slightly hypocritical here and applying double standards, because this House adopts many resolutions on a wide range of issues in which we have no competence. I remember an EPP rapporteur who once did a report on the rights of circus animals – so we cannot talk about the rights of Spanish women, but we can talk about circus animals!
The EPP supports the so-called ‘Alliance for Families’, which is understood as families in the conservative traditional sense. So is that an EU competence? You are applying double standards, and I do not like it.
As the Commissioner rightly said, sexual and reproductive health rights are part of our national health systems. We have an EU public health strategy, but sexual and reproductive health rights are a glaring omission. Why? Why can we talk about Alzheimer’s, obesity or colon cancer but not about the things that affect us every day and that are so important?
As regards the Spanish Government, I really wonder if this is the most pressing problem the it has to solve these days. Have you not got anything better to do? Is it true that Spanish women have massively resorted to abortion because it was legal? It is a well-known fact that in countries where abortion is legal, the abortion rates are lower.
Finally, if you think that women are competent to decide on something as important as having children and raising them, or if you think women are competent enough to run, say, Germany or the IMF, then surely they are competent enough to decide about their own bodies and their own lives. Let us give support to Spanish women.
Raül Romeva i Rueda, en nombre del Grupo Verts/ALE. – Señora Presidenta, señor Comisario, estamos ante un tema de derechos fundamentales. La contrarreforma de ley de los derechos sexuales y reproductivos y de interrupción voluntaria del embarazo que presenta el PP en España es un menosprecio a los derechos de las mujeres y tiene una fuerte carga ultraconservadora y reaccionaria que se convierte en una imposición de corte machista que supone la restricción más dura del aborto en la época democrática.
La limitación del aborto a solo dos supuestos situaría el marco legal de España lejos de los tratados internacionales, las resoluciones europeas y las recomendaciones de la OMS en materia de derechos sexuales y reproductivos, relegando los derechos de las mujeres a la cola de Europa y al nivel de países que no suscriben los tratados internacionales y vulneran los derechos humanos.
La base ideológica de la contrarreforma concibe a las mujeres como sujetos sin derechos que hay que tutelar y cuya voluntad queda relegada por una supuesta defensa de los derechos del concebido.
Este fundamentalismo misógino nos devuelve a los tiempos en los que el aborto era privilegio de las clases altas, creando así una discriminación por razones económicas que conducirá a las mujeres a realizar abortos clandestinos, aumentando el riesgo sobre la vida y la salud de las mujeres.
Es, por tanto, una ley innecesaria, inoportuna, machista, clasista, retrógrada, anacrónica, improcedente e impropia de los tiempos que vivimos y, por ello, insto a la Comisión Europea a hacer todo lo posible para evitar que tenga lugar tal despropósito.
Ryszard Antoni Legutko, on behalf of the ECR Group. – Madam President, after this revolting document called the Estrela report was defeated in this Chamber, the Left has come back with another ideological offensive. The concept of a reproductive right is absurd. It is nothing but an ideological ploy to condone morally dubious practices. This is what the Left did in the past, and this is what they are doing today.
The particularly alarming consequences of so-called ‘reproductive rights’ are massive violations of human conscience. The conscience clauses have been suspended, removed or drastically limited. Doctors, priests, teachers, lawyers, state functionaries and ordinary people are forced to do something which is morally wrong. All of this is simply outrageous and cannot be accepted. If this is the direction in which the EU is going, I am afraid we are on the threshold of a dark age.

Mikael Gustafsson, för GUE/NGL-gruppen. – Fru talman! Sexuell och reproduktiv hälsa och rättigheter är grundläggande rättigheter och en del av de mänskliga rättigheterna. Det handlar om rätten till sin egen kropp, tillgång till preventivmedel och sexualundervisning. I hundratals år har män och patriarkala strukturer försökt kontrollera kvinnors sexualitet, kvinnors reproduktion och kvinnors möjlighet till abort och preventivmedel.
När nu högerregeringen i Spanien vill göra det de vill göra, så backar man in i framtiden. Någon säger att det här är en del av subsidiaritetsprincipen – ja, det är klart att det är! Det spanska folket får anta precis vilka lagar de vill på det här området – det råder ingen tvekan om det. Men jag som politiker har en skyldighet att agera och tala om när jag ser att det begås brott mot mänskliga rättigheter, var det än är.
Jag måste säga till vare sig det sker i mitt eget land Sverige, i Spanien eller någon annanstans i världen, och då måste jag agera. Att kämpa för spanska kvinnors rätt till sin egen kropp är att visa solidaritet med de spanska kvinnorna. Men att visa solidaritet är också en symbolfråga för alla andra kvinnor på det här jordklotet och det är därför jag visar solidaritet med de spanska kvinnorna.

Sophia in 't Veld (ALDE), blue-card question. – I would like to understand what my colleague Mr Paksas means when he says that the rights of parents to raise their children according to their own convictions are being restricted. I would like to know how the rights of parents are restricted by giving the right of choice to women. Nobody is obliged to have an abortion; nobody is obliged to use their access to family planning methods. How are the rights of parents restricted by giving more freedom and more choice to women?
In conclusion, Mr Paksas, I am so glad that I come from a country where abortion is safe and legal and people like you do not get to decide over my life and my body.

Was ist das für eine Heuchelei, wenn man einen Tagesordnungspunkt verlangt zur „Nichtdiskriminierung der sexuellen Rechte und reproduktiven Gesundheit“ und hier in Wahrheit eine Kampagne gegen die spanische Regierung führen möchte? Ist das nicht Heuchelei? Was ist das für eine Heuchelei, wenn man sagt, die Armutsbekämpfung in Spanien sei der Grund für Abtreibungen? Statt den Frauen Hilfe anzubieten, bietet man ihnen Abtreibung an! Ist das nicht Heuchelei? Was ist das für eine Form der Heuchelei, wenn man hier eine Debatte haben möchte, die Kommission vor den Zug spannen möchte, in Wirklichkeit aber nur die zweimalige Niederlage bei diesem skandalösen Estrela-Bericht ausmerzen möchte? Ist das nicht Heuchelei? Es ist mindestens so heuchlerisch, wenn Sie der PPE Heuchelei vorwerfen!
Ich verlange, dass in erster Linie das Grundrecht auf Leben geschützt wird! Das schützenswerte Grundrecht auf Leben, das ist das fundamentalste Grundrecht! Wenn Sie von Grundrechten reden, dann reden Sie zunächst vom Grundrecht auf Leben von jenem Wesen, das sich nicht wehren kann, vom ungeborenen Bürger! Das ist das fundamentale Grundrecht! Das sollten Sie sehen!
Elisabeth Morin-Chartier (PPE). - Madame la Présidente, je voudrais d'abord remercier le commissaire, qui a bien su centrer le débat, même si après nous nous en éloignons un peu.
En effet, la santé est un droit tout à fait fondamental, qui doit être accessible à tous. L'Europe doit s'honorer de faire valoir ce droit à la santé tout en respectant les croyances, les comportements, mais nous devons particulièrement nous concentrer sur la lutte contre la mortalité maternelle et contre les mutilations génitales.
Je ne voudrais pas qu'il y ait de caricature, qu'il y ait les bons d'un côté, et les méchants de l'autre. C'est la même chose dans les groupes politiques: il ne doit pas y avoir de caricature. Je voudrais rappeler que, en France, cela fait trente-huit ans que nous avons les lois Veil, qui ont assuré un équilibre parfait entre le respect de la vie, le respect des femmes et le droit à la santé. Mme Veil a été un très grand ministre de la santé et elle a été présidente de ce Parlement pour le PPE.
Je m'étonne que, trente-huit ans plus tard, nous soyons capables de tels comportements, de tels freins, de telles dissensions alors qu'il existe des textes équilibrés qui pourraient réunir un consensus. En tous cas, c'est ce que je souhaite, Madame la Présidente.
Peter van Dalen (ECR). - Ja, Voorzitter, inderdaad, ik heb een punt van orde. Ik doe een beroep op uw voorzitterschap. We hebben een goed gebruik in deze zaal dat wij ons onthouden van het exposeren van allerlei pamfletten en andere documenten. Ik zie aan die zijde een reeks van pamfletten die nu worden opgehangen. Zita Gurmai (S&D). - Madam President, Commissioner, colleagues, thank you for making this statement today. Sexual and reproductive health rights are fundamental rights. Today’s Europe should ensure equal rights and treatment and access for all. It is an issue of shared concern that requires a European approach. I cannot accept the fact that certain European women, due to their geographical location and/or social status in the Europe of the 21st century, will soon be denied the free choice and access to sexual and reproductive health rights, including abortion – as in Spain.
I therefore call on the European Commission to defend those rights and the free choice of all women by promoting sexual education, medical assistance and support, prevention, contraception, the morning-after pill and abortion. This should be affordable and accessible for everyone. Moreover, guaranteeing sexual and reproductive rights is not only a health issue, it also contributes to women’s empowerment and economic independence. Introducing a stricter abortion law is not only saying ‘no’ to abortion, it is also saying ‘no’ to women’s rights and turning back the clock 30 years, to a time where religious lobbies prevailed over women’s rights. We say again today: my body is my right.
Izaskun Bilbao Barandica (ALDE). - Señora Presidenta, la salud sexual y reproductiva es una cuestión de derechos fundamentales y forma parte del modelo social europeo. Estamos hablando de igualdad, de libertad, del derecho a la salud y, en definitiva, de democracia.
Europa no puede regresar a los tiempos en los que las convicciones religiosas de una parte de la sociedad imponían leyes al resto. El Gobierno de España pretende ahora eliminar derechos básicos de las mujeres, como la libertad de elegir cuándo y cómo quieren ser madres, mediante una modificación unilateral de la Ley del aborto.
La medida considera a las mujeres menores de edad y va a generar riesgos sanitarios para las personas con pocos medios económicos, que se verán obligadas a volver a operaciones clandestinas que originaron muertes y daños irreversibles en el pasado.
La propuesta no responde a ningún debate social, ni resuelve problemas: más bien reabre algunos que estaban superados y responde a intereses electorales del Partido Popular. España sale así del espacio de libertad y democracia europeo.
Rechazamos, por ello, este retroceso y pedimos a las instituciones europeas ―como se intentó en el informe Estrela― que establezcan una norma común que garantice a la ciudadanía europea, a las mujeres europeas, el ejercicio de la libertad y el derecho a la salud en un ámbito íntimo, humano, fundamental para el desarrollo individual como es la salud sexual y reproductiva.

Alejo Vidal-Quadras (PPE), pregunta de tarjeta azul. – Me levanto, señora Bilbao, sin ningún ánimo de polémica, e incluso le diré que parte de su intervención podría suscribirla. Me levanto con ánimo de clarificación.
Me gustaría conocer su opinión sobre dos puntos concretos: ¿cree usted que una legislación correcta sobre el aborto debería buscar un razonable equilibrio entre los derechos de la mujer embarazada ―que sin duda los tiene― y los del ser humano concebido y todavía no nacido?
Y la segunda cuestión es la siguiente: ¿cree usted que los Gobiernos europeos deberían promover más activamente políticas públicas —educativas, sociales, de la salud— para que las mujeres embarazadas, en situación de precariedad, que deseen llevar adelante su maternidad puedan hacerlo?
Izaskun Bilbao Barandica (ALDE), respuesta de «tarjeta azul». – Señor Vidal-Quadras, muchas gracias por sus afirmaciones.
Nosotros lo que creemos y lo que afirmaba en mi propuesta es, en primer lugar, que las mujeres queremos tener libertad para decidir cuándo y cómo queremos concebir a nuestros hijos. Y, en segundo lugar, he manifestado que entiendo que Europa debería legislar de una manera clara para proteger esa libertad de las mujeres, porque a la vez esa libertad de las mujeres supone una mejor protección para los hijos. Y, evidentemente, para todas las personas en situación de precariedad, sean las circunstancias que sean, hemos defendido en esta Cámara ―como hacemos en el resto de las instituciones― medidas adecuadas para que, con libertad, cada uno decida su futuro en las condiciones que mejor considere.
Pero defiendo la libertad de las mujeres y no defiendo la medida y la posición del Partido Popular ni del Gobierno español con esta ley que, sin duda, ha supuesto un retroceso total con respecto a una legislación que ya estaba aprobada.
Iñaki Irazabalbeitia Fernández (Verts/ALE). - Señora Presidenta, Señorías, señor Comisario, quiero agradecer a la Comisión haber vuelto a traer el tema a este Pleno. Creo que era necesario y conveniente.
Estamos hablando de un derecho fundamental: el derecho de las mujeres a elegir sobre su sexualidad y su maternidad; un derecho que la Unión tiene que defender y promover; un debate, este, que viene como anillo al dedo, ya que en el Estado español se va a cercenar el derecho de las mujeres a decidir sobre su maternidad.
La nueva Ley del aborto va a ser un retroceso, tanto por lo que respecta al derecho de las mujeres como en el camino hacia la total igualdad de género: no habrá igualdad real si la mujer no puede decidir sobre su maternidad.
Reclamo una política europea común que garantice el derecho a decidir de las mujeres, que garantice los mismos derechos a todas las mujeres europeas.
Peter van Dalen (ECR). - Voorzitter, ik maak eerst een punt van orde. Ik herhaal wat ik net in mijn punt van orde heb gezegd, namelijk de manier waarop u toestaat dat in deze zaal allerlei biljetten worden getoond, dat lijkt me tégen het gebruik van dit Huis. Ik wil u nog eens vragen dat voor te leggen aan bijvoorbeeld de Conferentie van fractievoorzitters om een eenduidige lijn op dit vlak te trekken, want de ene keer wordt zoiets wel toegestaan en de andere keer niet. Ik vind dat een onduidelijke politiek. Dus ik vraag u bij dezen dat nog eens terug te nemen en daar helderheid over te scheppen.
Dan nu mijn bijdrage. Ik denk dat het leven bescherming verdient na de geboorte en ook vóór de geboorte. En ik weet heel goed dat zwangerschappen moeilijk kunnen zijn en risico's kunnen hebben. Ik heb dat ook in nabijheid ervaren. En dan is het, denk ik, goed dat er familie en professionals en vrienden zijn om je daarbij te helpen. Maar we hebben in december, Voorzitter, wel met elkaar hier het verslag-Estrela behandeld en in meerderheid gezegd: dit is niet een zaak voor Brussel, dit is een zaak voor de lidstaten.
Dus, Voorzitter, ik wens de Spaanse afgevaardigden in Madrid veel wijsheid toe om te kiezen voor het leven, en dat doe ik vanuit de overtuiging dat het leven gegeven is en dat dat bescherming verdient.

Es un derecho fundamental que respeto, que defiendo, y usted no tiene más que ver mi trayectoria política para saber cuál ha sido mi posición ante su pregunta subliminal «¿cuál es mi posición ante la violencia de ETA?».
Ewald Stadler (NI). - Frau Präsidentin! Kollege Romeva hat gesagt: „die Pamphlete, die hier präsentiert werden …“ Mir ist es egal, Sie können noch 20 Pamphlete bringen, das beeindruckt mich nicht. Aber ich verwahre mich dagegen, dass Sie Ihre miserablen Pamphlete mit dem Hoheitszeichen meines Landes, das verfassungsrechtlich geschützt ist, gleichsetzen! Dieses Hoheitszeichen steht dort vorne, steht für die nationale Souveränität meines Landes, und ich verwahre mich dagegen, dass Sie Ihre dreckigen Pamphlete mit der Flagge meines Landes gleichsetzen!
Willy Meyer (GUE/NGL). - Señora Presidenta, el patriarcado fundamentalista ultracatólico del Gobierno del Partido Popular en España pretende, efectivamente, llevar a cabo un retroceso sin precedentes en la historia de la democracia de España, haciendo retroceder los derechos de la mujer: nos retrotrae a hace treinta años.
Este patriarcado fundamentalista ultracatólico también se expresa aquí, en esta Cámara: siempre es intolerante, siempre ―la intervención del señor Legutko llamando «asqueroso» un informe de la señora Estrela; «¡asqueroso!», expresiones que son propias de la ultraderecha, del fascismo―, y, por eso, ese anteproyecto de ley en España ―regresivo, retrógrado― también tiene aquí expresiones y tiene aliados.
Por eso, yo animo a los diputados y diputadas a que suscriban la declaración que está circulando en contra de esa regresión. Desde el lunes está circulando esa declaración: 179 firmas, a día de ayer.
Yo creo que la reacción a este retroceso tiene que ser una reacción unitaria, de todos los grupos parlamentarios que defienden el derecho a la salud sexual y reproductiva de forma libre.
Dicen las mujeres ―y esto es una bandera, Señorías, esto es una bandera―: «Nosotras parimos, nosotras decidimos».
Tadeusz Cymański (EFD). - Nie ma jednej szali i nie ma jednej strony tego medalu. Nie ma jednej wartości – prawa kobiet. Jest również druga wartość, wartość życia poczętego, wartość życia nienarodzonego i musimy o tej sprawie mówić spokojnie, bo mówimy o sprawie najważniejszej. Każdy z nas tu siedzących był kiedyś zygotą, embrionem. To podstawowa prawda. Nie możemy krzyczeć i nie możemy tej Izby wystawiać na ośmieszenie przez konfrontację i agresję. A musimy szanować zasadę, że te sprawy są regulowane w państwach członkowskich. Ktoś może być dumny, że jest z kraju, gdzie jest aborcja na życzenie. Ja jestem Polakiem, jestem dumny, że życie ludzkie w Polsce jest chronione prawem. Trybunał Konstytucyjny tak orzekł. Uszanujmy odmienność! Europa jest jedna, ale każde państwo w tej kwestii samo rozstrzyga i samo stanowi prawo.
Nicole Sinclaire (NI). - Madam President, since the Estrela report was voted on in the European Parliament, I have received more correspondence from constituents on this report than almost any other. It is of course a vital policy area that affects us all as individuals and as a society. It is also an area in which certain groups may be particularly vulnerable. This includes those in developing nations, the economically-disadvantaged and the poorly-informed or educated, and those women who live in societies in which women are treated unequally or even regarded simply as property.
Through my work on the European Parliament’s Subcommittee on Human Rights, I have witnessed such situations at first hand. There are important debates to be had: access to contraception, sexual health, education and healthcare, and abortion are just some of the issues. It will also come as a surprise to learn that in several countries in the EU the age of consent is as low as fourteen.
These debates must include all actors in society – not just politicians, but also healthcare professionals, teachers, parents and, given the moral implications, the Church. The Church should not be made an enemy. The Estrela report, however, appears to be dominated by a political agenda and in my opinion is unacceptable. That is why I could not support it, as I believe this to be a national competence.
Teresa Jiménez-Becerril Barrio (PPE). - Señora Presidenta, he de reconocer que me sorprende el tono acusatorio de las intervenciones de algunas de sus Señorías, quienes al parecer no han entendido o —lo que sería peor— no han aceptado lo que quedó más que claro tras la votación del pasado 10 de diciembre: que la formulación y aplicación de políticas en materia de salud sexual y reproductiva es competencia de los Estados miembros, y es en los Parlamentos nacionales donde tiene que debatirse y a ellos a los que tienen que dirigir su esfuerzo.
Pero lo que estamos comprobando aquí hoy es que ustedes pretenden saltarse las reglas del juego que democráticamente nos hemos dado y traer aquí un debate porque temen no poder ganarlo donde tienen ustedes que jugar la partida: en su Parlamento nacional, donde nuestro partido —el Partido Popular— ha obtenido mayoritariamente la confianza de los ciudadanos y está legitimado para llevar a cabo los cambios legislativos que considere necesario, conforme a su programa.
Y, lo que es más importante, conforme a los valores que defiende, entre ellos, la defensa de la vida. Porque yo no admito que nadie nos acuse de recortar los derechos de las mujeres por querer conciliar el derecho a la vida con la salud y la protección de las mujeres; no son irreconciliables, como ustedes están mostrando aquí. Tenemos que trabajar juntos para llegar a una conciliación de esos derechos.
Creo que el Partido Popular en España y en Europa siempre estará en contra de cualquier discriminación y a favor de los derechos humanos, y apoyará todas las iniciativas de la Comisión en ese sentido.
Ustedes se han llenado la boca hablando de los derechos de la mujer. Yo soy una mujer, y por supuesto que defiendo mis derechos, pero no han tenido ni una sola palabra para hablar de los derechos del no nacido, y eso hace que me pregunte qué es lo que les pasa. Tienen ustedes alergia a hablar del derecho del no nacido.
Edite Estrela (S&D). - Senhora Presidente, um esclarecimento prévio, a direita do Parlamento Europeu recorreu a todos os meios para impedir a votação do meu relatório. O relatório Estrela nunca foi votado, por isso nunca foi rejeitado. Ao contrário do que dizem, não ficou clara qual era a posição do Parlamento Europeu, porque estou convencida de que, se não tivesse havido os erros grosseiros de tradução, designadamente para francês e para alemão, provavelmente o meu relatório teria sido votado e aprovado.
O que se está a passar em Espanha com a interrupção voluntária da gravidez diz respeito a todas as mulheres. Sou solidária com as mulheres espanholas. A saúde sexual e reprodutiva não é uma questão de tradição ou de cultura. É um direito fundamental. É uma questão de liberdade, de dignidade e de respeito pelas mulheres.
Portugal foi um dos últimos países ocidentais a legalizar o aborto. Foi em 2007. Antes de 2007 as portuguesas ricas viajavam para Espanha para interromperem a gravidez em condições de segurança. As mais pobres recorriam ao aborto clandestino. Se esta alteração que agora o Governo quer fazer for para a frente, serão as espanholas a ir a Portugal para fazerem o aborto em segurança – aquelas que tiverem possibilidades económicas.
Marije Cornelissen (Verts/ALE). - Madam President, I was six years old when I first demonstrated for the right to choose. My mother and her generation fought for, and won, autonomy over their own bodies. I thought that these rights, once they were won, were safe for my generation and that of our sons and daughters, and that we could go on to fight for other rights that we have yet to gain, such as equality in business leadership or equal parenting. How extremely depressing it is to find that this is not the case.
The Spanish plan for a restrictive abortion law is a huge setback, not only for Spanish women but for the fight for women’s rights everywhere. It means that this fight will never be over. We will have to keep on defending every right forever. I wish we did not have to, but if we must, we will fight. I want to assure my Spanish colleagues that they are not alone. They have the full strength of all progressive forces and of the women’s rights movement behind them, and we will do everything in our power to make sure that every woman in the EU gets and keeps the right to decide.
Ruža Tomašić (ECR). - Gospođo predsjedavajuća, diskriminacija je svevremenski problem za kojega je teško pronaći univerzalno rješenje. Držim i duboko vjerujem kako svi građani moraju biti jednaki pred zakonom i da moramo poštovati ljudska prava.
No, stječem dojam kako određene skupine žele biti jednakije, što je put u potpuno krivom smjeru. Diskriminacija je diskriminacija, bila ona negativna ili pozitivna i kao takva je nepravedna i nepoželjna. Prava jednih ne smiju ići na uštrb drugih i to je najjednostavnija i jedina ispravna formula koju valja slijediti. Moram iskazati žaljenje i razočaranje što se ova tema našla na dnevnom redu jer držim kako su zastupnici jasno i nedvosmisleno rekli što misle o njoj. Bojim se da određene političke snage ne mogu u potpunosti pojmiti demokraciju pa koriste i nasilne metode da svima nama nametnu svoja ideološka stajališta.
Gospođo predsjednice, svi znamo da su potrebni muškarac i žena da se začne dijete. Onaj čas kada dođe vrijeme da žena može sama, bez pomoći muškarca, začeti to dijete, onda može sama i odlučivati o tom djetetu.
Inês Cristina Zuber (GUE/NGL). - Senhora Presidente, é inadmissível que hoje o Parlamento não sirva sequer para, pelo menos teoricamente, defender os direitos das mulheres e os direitos sexuais e reprodutivos. Direitos esses que é preciso lembrar que foram conquistados durante décadas pela luta de muitas pessoas, e sobretudo pela luta árdua de muitas mulheres. Esta é também uma questão que nós sabemos, em Espanha, que se for para a frente vai afetar e vai pôr em causa a saúde de muitas mulheres, sobretudo das camadas mais desfavorecidas. Com isso parece que ninguém se preocupa. E é também importante dizer que aqueles que têm tanta preocupação com os embriões e com os fetos são também aqueles que defendem políticas que negam às pessoas o direito à educação, o direito à saúde, o direito a uma vida digna. É por isso que é uma hipocrisia.

Krisztina Morvai (NI). - Érdeklődéssel hallgattam az abortuszról szóló vitában baloldali férfi képviselőtársaimnak a harcos kiállását, a nőknek a választáshoz való joga, illetve testük fölötti kontroll mellett. Szeretettel fordulok hozzájuk, és arra kérem őket, hogy akkor írjanak a férfiak felelősségéről egy jelentést – azt messzemenően támogatni fogom. Szervezzenek felvilágosító kampányokat a férfitársaik számára, ahol például elmesélik nekik azt, amit talán az illetők édesanyja elfelejtett említeni, hogy a gyermeket nem a gólya hozza, nem is káposztalevélben keletkezik, a nem tervezett gyermek sem, hanem ezt módja van az Önök férfitársainak megakadályozni. Tehát szóljon arról egy alapos, európai méretű kampány, hogy a férfiak álljanak valóban a nők mellé a családtervezésben, a születésszabályozásban, és legyen mondjuk az a jelszó, hogy egy igazi férfi soha nem ejtene teherbe egy nőt akarata ellenére, sem alkalmi kapcsolatban sem házasságban.
És, ha valódi választás mellett állnak kedves férfi képviselőtársaim, akkor arra is bíztassák férfitársaikat, hogy ha mégis létrejön a nem tervezett terhesség, akkor abból lehessen valóban várandósság – másfél percem van kedves elnök asszony, még, hogy ha nem is tetszik a véleményem, akkor is engedje végigmondani – tehát, a nem tervezett terhesség esetén is vállaljon felelősséget a férfi ember, és tegye lehetővé azt, hogy ha a nő úgy kívánja, akkor igenis viselje a terhességet és vállalja az apasággal járó feladatokat az a sok férfi, akit Önöknek meg kell szólítaniuk. Ha komolyan veszik a nők érdekét, és az, hogy ne kelljen nőknek azon a fizikai, érzelmi és spirituális megpróbáltatáson és szenvedésen végigmenni, amit az ... Carlo Casini (PPE). - Signor Presidente, onorevoli colleghi, io vorrei introdurre un elemento di razionalità in questo dibattito, introducendo la distinzione tra fine e mezzi. Che qualsiasi forza politica, qualsiasi partito, debba avere per fine ultimo la difesa della vita di qualsiasi essere umano, la difesa della dignità di tutti gli esseri umani, è sicuro. Che noi siamo tutti d'accordo sul principio di eguaglianza è sicuro. Quindi non c'è dubbio che si debba riconoscere la necessità di difendere tutti gli esseri umani indipendentemente dall'età, dalla salute, dalla ricchezza, dal concepimento in poi, cioè da quando sono qualificabili come esseri umani.
Ora vi parlo da giurista: non esiste un solo documento, nazionale o internazionale, nel quale sia scritto che il concepito non è un essere umano. Non è scritto da nessuna parte. Non ho tempo di dimostrarlo ma è così. E allora, voglio dire, cerchiamo di difendere i diritti di tutti, i diritti delle donne e i diritti dei bambini, come sta scritto da tante parti.
Sul fine non c'è discussione. Se qualcuno mi viene a dire: "No, ci sono alcuni esseri umani che non devono essere difesi", non può trovarmi d'accordo. Ma se discutiamo sul come, cioè sui mezzi per difendere, in situazioni particolarmente complesse in caso di conflitti fra diritti e fra interessi, beh, qui c'è una possibilità di diverse valutazioni che devono essere rimesse alla sensibilità locale: ecco che interviene il principio di sussidiarietà, che anch'esso ha un fondamento teorico. Occorre quindi operare una distinzione fra i mezzi e il fine.
La situazione della gravidanza è una situazione particolarmente delicata, che c'è soltanto una volta nella vita di ciascuno di noi. Certamente, c'è la vita di un figlio affidato in primo luogo alla donna, alla madre. E allora è logico che i mezzi per difendere questa vita non possono essere gli stessi che si usano quando la vita è già nata. Ma questa è un'altra questione. Prima distinzione.
Seconda distinzione importante è la chiarezza del linguaggio: tutti siamo per la salute sessuale e riproduttiva, mi pare logico. Ma non possiamo introdurre in questo concetto ciò che è contro la salute e contro la vita. L'aborto viene programmato come una necessità. La necessità si rimuove, si combatte contro la necessità. Non si dice che fa parte della salute sessuale e riproduttiva.
Britta Thomsen (S&D). - Fru formand! Jeg er meget glad for, at dette emne er på dagsordenen i dag, for ligestilling mellem kønnene, frihed og menneskelig værdighed er nogle af Unionens grundlæggende værdier! Det indbefatter også retten til seksuelle og sundhedsmæssige rettigheder. I flere medlemsstater stiger antallet af teenagegraviditeter, fordi der fungerer den ret nemlig ikke! Der findes ingen familieplanlægning og præventive foranstaltninger i forhold til uønskede graviditeter. Når kvinder frarøves muligheden for abort, frarøves de samtidigt friheden til at bestemme over deres egen krop. Og nu hører vi så, at den spanske regering vil føre landets abortlovgivning 30 år tilbage! Det er en meget bekymrende udvikling, som vil medføre, at de kvinder, der har råd til det, vil rejse til udlandet og få afbrudt svangerskabet, mens fattige kvinder vil være overladt til sundhedsfarlige kvaksalvere med døden til følge i værste konsekvens. Det kender vi fra alle vores lande i 50'erne, 40'erne, 60'erne, der var der mange kvinder, der døde hos disse kvaksalvere. Jeg kan ikke forstå, at de mænd, der har så travlt med at kontrollere kvinders krop i Spanien, ikke i stedet for, som vores tidligere talere sagde, koncentrerer sig om mænd, der bringer kvinder i denne situation. Vi ved jo godt, der er voldtægt i mange ægteskaber, skal vi så løse det, som om vi ikke var en civilisation? Europa er en civilisation, vi skal ikke bruge de samme metoder, som hvis vi var Afghanistan.

Konrad Szymański (ECR). - Pani Przewodnicząca! Parlament Europejski nie ma żadnego powodu, aby dyskutować na temat dostępności aborcji w państwach członkowskich Unii Europejskiej. Ta debata jest oczywistą stratą czasu i pieniędzy. Ale skoro powiedziano już tyle gorzkich słów pod adresem Hiszpanii, to ja w swoim imieniu chciałbym zadeklarować, że działania rządu hiszpańskiego zasługują na najwyższe uznanie, ponieważ aborcja, w szczególności ta na życzenie, to jest zwykłe barbarzyństwo. Będziemy się wstydzili aborcji, tak jak dzisiaj wstydzimy się niewolnictwa. To jest olbrzymi błąd, który popełnia Europa.
Mam dwa bardzo konkretne pytania do Komisji Europejskiej i do komisarza Kallasa: Czy Komisja przypisuje sobie jakiekolwiek uprawnienia w zakresie kształtowania dostępności aborcji w krajach członkowskich UE? Czy Komisja Europejska przypisuje sobie jakiekolwiek uprawnienia w zakresie obecności edukacji seksualnej w szkołach na terenie państw członkowskich UE? Proszę o ścisłą z prawnego punktu widzenia odpowiedź, a nie publicystyczną.
Joanna Senyszyn (S&D). - Pani Przewodnicząca! Zakaz lub ograniczenie prawa do przerywania ciąży stanowi formę instytucjonalnej przemocy wobec kobiet. Jest wyrazem nierównego traktowania kobiet i mężczyzn, dyskryminacji kobiet, naruszania ich godności, zdrowia oraz prawa do wolności od nieludzkiego i poniżającego traktowania. Hiszpania wraca do antyaborcyjnej retoryki, to ukłon w stronę kościoła katolickiego i próba odwrócenia uwagi od kryzysu i zastraszającego poziomu bezrobocia młodych.
Zakaz aborcji, trzeba o tym pamiętać, jest atrybutem totalitaryzmu, obowiązywał w czasach hitleryzmu, stalinizmu i frankizmu. W Polsce jest restrykcyjna ustawa antyaborcyjna, jej efekty są żałosne: jest kilkaset legalnych aborcji rocznie i 150 tysięcy nielegalnych. Zakaz aborcji nie likwiduje aborcji, a jedynie spycha ją do podziemia. Antyaborcyjne ustawy są groźne dla zdrowia i życia kobiet. Stanowią formę dyskryminacji ze względu na poziom zamożności, bo zakaz aborcji uderza głównie w kobiety biedne. Wzywam Hiszpanów, aby szanowali prawa kobiet i nie szli polską drogą, bo jest to droga katolickiej obłudy.
Michael Cashman (S&D). - Madam President, I have listened to the views of the other side of the House, and I respect their views, but I do not endorse them. I believe that the draft Spanish law discriminates against women, and the argument of subsidiarity holds no weight. We express our views on foreign affairs, so why not abolish the Committee on Foreign Affairs if we are going to follow through on the argument of subsidiarity?
The EU mandates the European Union to defend human rights. Let us be absolutely clear: the Spanish draft law affects us all. If women are denied their basic rights in an EU Member State, such as Spain, it affects not only those women who live there but also other women citizens of that Member State or any women who work, reside, study or even go there as tourists. Therefore I say this: I stand by the generation of women who have fought for their right for equality, their right to choose what to do with their bodies and for their continuing fight. The denial of the rights of women is a competence of this House.

María Muñiz De Urquiza (S&D). - Señora Podimata, si usted fuera española el señor Rajoy le diría: «Usted puede presidir nada menos que el Parlamento Europeo, pero sobre su cuerpo mando yo». Y no se lo diría en el Parlamento, porque el Grupo Popular en España ha impedido, hasta en ocho ocasiones, las peticiones de toda la oposición de celebrar un debate libre y abierto en el Parlamento sobre este proyecto de ley, que devuelve a las catacumbas de la ciudadanía a las mujeres españolas.
Y ningún ministro, ningún juez, ningún psiquiatra ni ninguna otra persona autodesignada como autoridad para decidir sobre el cuerpo de las mujeres ha podido evitar que las mujeres abortemos cuando lo consideremos necesario ―por razones sociales, por razones personales, por razones familiares―. No se ha podido impedir.
Lo que sí se puede cambiar es la forma en la que abortan las mujeres: con seguridad o arriesgando su vida y su salud. De los 122 000 abortos que se producen en España cada año, 100 000 serían ilegales bajo esta nueva ley, que no disminuirá el número de abortos en España.
Lo que disminuiría el número de abortos en España sería algo que también nos niega el Gobierno de España: una buena educación sexual, porque también se ha prohibido la «Educación para la Ciudadanía» en las escuelas españolas.
Señores del Gobierno de España, si quieren proteger a las familias, lo que tienen que hacer es acabar con la vergüenza de los niños que viven en España bajo el umbral de la pobreza.
Pervenche Berès (S&D). - Madame la Présidente, nous demandons que le gouvernement espagnol renonce à son projet de loi sur l'avortement. Ce texte est un texte qui va mettre en cause la situation des femmes les plus faibles, qui va les conduire à la clandestinité, qui les renvoie aux situations les plus dangereuses et qui favorise les femmes les plus riches qui, elles, pourront faire du tourisme social.
Ce projet de loi renvoie aux heures les plus noires de l'histoire des femmes, de l'histoire de l'Europe car, lorsque la situation des femmes est attaquée, c'est aussi l'histoire de l'Europe qui est attaquée, ce sont les fondements mêmes de la démocratie.
Si M. Rajoy n'est pas convaincu par le Parlement européen, qu'il regarde les études de l'OMS, qui disent clairement que là où il y a prohibition, l'avortement n'est pas limité pour autant.
Puis, le groupe PPE avec lequel nous voulons travailler n'est pas celui de M. Rajoy. C'est éventuellement celui de Mme Simone Veil qui, il y a quarante ans, nous disait: "On ne peut pas empêcher les avortements clandestins." M. Rajoy devrait s'en souvenir et s'en inspirer.
L'Espagne que nous aimons, celle avec laquelle nous aimons coopérer comme européens, c'est celle de Felipe González, qui nous a apporté, avec le traité de Maastricht, un chapitre entier sur la citoyenneté européenne. Retrouvons cet esprit, l'esprit européen.
Sergio Gaetano Cofferati (S&D). - Signor Presidente, onorevoli colleghi, signor Commissario, quando si mette in discussione un diritto fondamentale, come quello dell'autodeterminazione nella maternità delle donne, si compie un atto grave e inaccettabile, qualunque sia il paese in cui questo atto si consuma. E siamo di fronte a un tentativo che non è riconducibile alla logica della sussidiarietà.
Le leggo: "Sappiamo che abbiamo fatto qualcosa che non ha precedenti in Europa negli ultimi decenni. Abbiamo scritto la prima legge che riflette l'opinione della maggioranza dei cittadini europei. Sono fiducioso che questa iniziativa sarà adottata anche da altri parlamenti di altri Stati membri". Sono le parole di Alberto Ruiz-Gallardón, il Ministro spagnolo che ha promosso quella legge, rilasciate in un'intervista al giornale ABC. Dunque non siamo davanti ad un tentativo di regressione consumato soltanto nella Spagna di oggi: siamo di fronte ad un'opinione che rischia di assumere il confine e il contorno di un atto ideologico che rischia di investire l'intera Europa. Io penso che la Commissione debba difendere l'Europa da questo rischio.

Miroslav Mikolášik (PPE) - Vôľa Parlamentu bola dvakrát vyjadrená, keď odmietla škandalóznu, ideologicky motivovanú správu Estrela. Zákonodarstvo v oblasti zdravotníctva totiž vrátane reprodukcie patrí podľa platných zmlúv o Európskej únii výlučne, vážení priatelia, do právomoci členských štátov.
Výrok Najvyššieho súdneho dvora v Luxemburgu z októbra 2011 v procese o experimentovaní na žijúcich embryách hovorí, že ľudský život začína oplodnením, počatím a že od tej chvíle má aj neodcudziteľnú ľudskú dôstojnosť. A to ako lekár tiež podpisujem.
Pri tehotenstve sa nerozhoduje len o práve ženy, ale rovnako o práve nenarodeného dieťaťa. Toto dieťa má už plné dedičské právo z právnej stránky, ale zaujímavé, nemá právo sa narodiť. A ľavica tu bojuje za systematické odstraňovanie aj zdravých ľudských bytostí.
María Irigoyen Pérez (S&D). - Señora Presidenta, la reforma de la ley de interrupción del embarazo en España ―del Gobierno de Rajoy― es un ataque a los derechos y libertades fundamentales de las mujeres, el 53 % de la población.
La decisión de ser madre corresponde a las mujeres, algo que olvidan aquellos que consideran que las mujeres no somos iguales. Nadie ―y digo bien, nadie― puede usurpar derechos, ni someter ni doblegar a un igual. Dignidad, respeto y libertad, iguales. Y hago una petición. Aquellos que levantan la voz contra la actual ley de plazos, que ha demostrado ser eficaz, son los que no respetan los derechos de las mujeres; mejor harían en callar porque se desacreditan.
No a la reaccionaria reforma de Gallardón; sí a la libertad, el derecho a decidir, derechos fundamentales, por tanto, de obligado cumplimiento. Menos cinismo, menos golpes de pecho y al Tratado fundamental. Esté vigilante, señor Comisario, ante el incumplimiento de las normas comunes y respete y haga cumplir el derecho a decidir, porque recuerdo aquí que ningún derecho excluye al otro, todos son derechos fundamentales.
Marie-Christine Vergiat (GUE/NGL). - Madame la Présidente, dans l'Union européenne, seuls trois pays ont des législations très restrictives en matière d'avortement. À Malte, l'avortement est totalement interdit. En Irlande, la législation a très légèrement évolué. En Pologne, une tentative de régression supplémentaire vient d'échouer. La proposition du gouvernement espagnol renverrait les femmes trente ans en arrière.
Restreindre le droit à l'avortement n'a jamais fait diminuer le nombre d'avortements. Cette démarche renvoie les femmes les plus pauvres à la misère des avortements clandestins, au mépris de leur droit à la santé et même de leur droit à la vie. L'avortement clandestin est une violence pour toutes les femmes. Les femmes doivent avoir la liberté de disposer de leurs corps.
Nul n'est obligé d'avorter. Nul ne doit pouvoir imposer ses choix, notamment religieux, à l'ensemble des femmes d'un pays. Le lobbying de groupes ultraréactionnaires qui pratiquent le mensonge comme méthode de conviction est indigne de nos démocraties. On sait où est l'idéologie, on sait où est le respect des droits des femmes. Faire reculer les droits des femmes, c'est faire régresser l'ensemble de la société.
Zbigniew Ziobro (EFD). - Pani Przewodnicząca! Nie na taką Unię umawialiśmy się – Unię, która z butami ingeruje w sprawy wewnętrzne poszczególnych krajów, ich porządek, który demokratyczne kraje mają same wyłączne uprawnienia regulować, Unię, która narzuca w sferze moralnej działania, które są nieakceptowalne, które można uznać za barbarzyńskie. Nie na taką Unię umawialiśmy się i dlatego trzeba zdać sobie sprawę, że tego rodzaju dyskusje jak ta dzisiaj, która odbyła się w Parlamencie Europejskim, będą też budzić nastroje antyunijne. Musimy zdawać sobie sprawę, że wielu mieszkańców Europy chce Unii, ale takiej, w której będzie można ze sobą współpracować, szanując jednocześnie własne odrębności, szanując to, że każdy z krajów ma wyłączne prawo stanowienia o swoich moralnych zasadach. Nie można z butami narzucać innym swoich wewnętrznych przekonań w sferze sumienia, wiary, życia, bo będzie to budzić nie tylko emocje, ale również coraz większe podziały i może wreszcie obrócić się przeciw Unii Europejskiej. Pamiętajcie o tym.

Anna Hedh (S&D). - Fru talman! Sexuell och reproduktiv hälsa och rättigheter är ett område där kommissionen har legat lågt. Ja, man har faktiskt knappt yttrat sig över huvud taget under de tio år som jag har suttit i parlamentet. Visst är frågan känslig och visst delar den vår kontinent och våra partigrupper, men till skillnad från vad PPE och andra kolleger tycker så har europeiska medborgare faktiskt ett egenintresse av att hela Europa respekterar de sexuella och reproduktiva rättigheterna.
Dålig tillgång till information, preventivmedel och vård inom EU leder till spridning av sjukdomar som inte stannar vid landsgränserna. Sedan är det faktiskt inte många år sedan som homosexualitet presenterades bredvid pedofili i de svenska skolornas biologiböcker. Det sker fortfarande i Europa och hindrar de homosexuellas fria rörlighet.
Extremhögern i Europa upplever att de har medvind – och det är en majoritet i rådet, kommissionen och i parlamentet medskyldiga till. Det var skrämmande att se det genomslag som lobbyisterna fick i samband med Estrelabetänkandet.
EU måste våga stå upp för mänskliga rättigheter även när det blåser mörka högervindar, eller kanske framför allt då. Vår kontinent har sett både mörker och ljus i fråga om sexuell och reproduktiv hälsa, men att vi också får gå från ljus till mörker som i Spaniens fall är oacceptabelt. Applåder.
Davor Ivo Stier (PPE). - Señora Presidenta, parece que todo este debate es por un proyecto de ley en España y por eso voy a hablar en español.
En la Edad Media, Santo Tomás de Aquino pensaba que la vida humana no comenzaba con la concepción; claro, él no conocía nada de genética en ese entonces, pero parece que los socialistas se han quedado en la teología de la Edad Media y, ¿quién es entonces el retrógrado?
Hay que aceptar las conclusiones de la ciencia del siglo XXI, que dice que la vida comienza con la concepción, y esa vida hay que defenderla.
Por eso, si bien este debate no corresponde a este Parlamento sino al Parlamento español, mi mensaje es muy claro a los colegas españoles: ¡adelante! ¡Que viva España! ¡Que viva la Europa de las libertades y del derecho a la vida!

Siim Kallas, Vice-President of the Commission. − Madam President, honourable Members, thank you very much for your remarks and comments on this very sensitive issue. The Commission has been asked to make a statement for this plenary session. There is no document for discussion, but I can make some remarks.
The Commission, of course, fully recognises that each and every individual has the fundamental right of access to high-quality healthcare but, as you very well know, in relation to health and health care, the Treaties have granted limited competence to the European Union. The Treaties stipulate that the definition of health policies and the organisation and delivery of health services and medical care is the responsibility of individual Member States – a responsibility that the European Union respects.
The Commission acknowledges the differences between Member States’ national policies and laws with regard to these sensitive issues, especially with regard to abortion.
In answer to some specific questions, according to the Treaty on European Union and the Treaty on the Functioning of the European Union, the EU has no competence on abortion policy at national level and therefore cannot interfere in Member States’ policies in this area.
Sex education is also the competence of the Member States. The EU can facilitate the exchange of best practices, and is doing so.
I can also say that the Commission, together with the European Parliament and the Member States, is clearly committed to working to abolish any form of discrimination in health care.

Biljana Borzan (S&D), napisan. – Ovdje je riječ o temeljnim ljudskim pravima na jednakost, zdravlje i slobodu. Smrtnost rodilja je važan pokazatelj kvalitete zdravstvene usluge i s ponosom ističem da dolazim iz zemlje u kojoj je ta stopa vrlo niska. No, velike razlike u toj stopi među pojedinim državama članicama ostavljaju velik prostor za poboljšanja. Države članice treba ohrabrivati u provođenju spolnog odgoja u osnovnim i srednjim školama. Trend smanjenja broja pobačaja i tinejdžerskih trudnoća u Europi nije posljedica zabrane pobačaja, već sustavne edukacije u školi, ali naravno, i u obitelji. Spolni odgoj u školama koji uči djecu spolno odgovornom ponašanju, u kojem je naglasak na spolnoj jednakosti i poštovanju prema različitima vodi ka stvaranju tolerantnog, demokratskog, a samim tim i naprednog društva.
Mary Honeyball (S&D), in writing. – Women in Spain deserve the full support of Parliament to oppose the appalling anti-abortion legislation being proposed by the right-wing government in their country. Control over their bodies is a fundamental right for women. Women should have access to safe abortion. We are only talking about access – no-one is forcing women to have abortions or doctors to perform them, contrary to the propaganda put forward by the ECR Group and others. Few women undergo abortion with a light heart – it is generally a difficult and heart-rending decision. Taken together with the fact that there is always a time limit after which abortion is illegal, these two aspects of the abortion question provide protection for the unborn foetus as well as the living woman. Access to abortion is essential to protect the health of all women in the European Union. Health has long been regarded as a competence and abortion definitely comes under this category. Health is recognised as a cross-border matter. Those female EU citizens living in Spain should have access to abortion and all aspects of reproductive health. Fundamental rights in the EU, including the right to health, do not stop at national borders.
Alexander Mirsky (S&D), in writing. – The statement by the Commission is toothless and cowardly. In this situation it is an attempt to overlook the fact that Spain, an EU Member State, wants to restrict significantly womenʼs right to private life. In such cases, conclusions and thoughts need to be formulated clearly instead of trying to please both opponents and advocates of abortion. The PPE Memberʼs statements concerning Spainʼs competence in this matter are just a cynical mocking of Spanish women. An attempt to incorporate questions of private life into national legislation raises many other questions. For example, why have we united in the European Union? How is it possible to live in a political and social world if EU citizensʼ rights differ substantially? In what way are Spanish women worse than Italian or German women? Who in the EU has decided to differentiate between citizens on the basis of where they live and their citizenship? Such kinds of cases with restrictions on abortion in Spain can be continued in other directions, such as sexual life or sexual rights and freedoms. Nobody is entitled to encroach upon the private life of EU citizens. I call for all sensible MEPs to block Parliament resolutions or statements directed at discrimination against women.
Isabelle Thomas (S&D), par écrit. – On constate aujourd'hui encore de nombreux problèmes d'inégalité et de discrimination dans l'accès aux soins de santé et dans le cadre des droits génésiques et sexuels. La volonté du gouvernement espagnol de revenir sur le droit à l'avortement illustre tragiquement ce constat. C'est un camouflet contre des siècles de combat menés par les femmes pour leurs droits, en Espagne et partout en Europe. C'est également la résurgence de problèmes de santé pour les femmes qui n'ont d'autre choix que d'avoir recours à la contraception clandestine. C'est aussi une atteinte à l'égalité entre citoyennes, compte tenu du coût que représente un avortement à l'étranger. C'est enfin une remise en cause de la liberté des femmes de disposer de leurs corps. Alors que certains s'arc-boutent sur les Traités, nul ne peut contester que l'Union européenne est avant tout une communauté de valeurs, attachée au respect des droits humains, à la liberté et à l'égalité entre ses citoyens et citoyennes. Le rôle de l'Union européenne doit être de tirer la sonnette d'alarme là où ses membres s'écartent de ses valeurs. Nul ne peut se targuer de défendre des différences culturelles là où ces valeurs sont bafouées.
Bernadette Vergnaud (S&D), par écrit. – Citée en exemple pour sa loi-cadre contre les violences faites aux femmes, l'Espagne a joué le rôle de précurseur en matière des droits des femmes en Europe. L'égal accès aux droits et le principe de non-discrimination en matière sexuelle sont par ailleurs deux principes fondamentaux du respect de la dignité humaine, rappelés par la Charte des droits fondamentaux à laquelle tous les États-membres sont soumis. Le revirement que constitue la présentation de cette loi espagnole limitant dramatiquement l'accès à l'IVG illustre la fragilité de ces acquis face à une vague réactionnaire grandissante: l'alliance des conservateurs et de l'extrême-droite a ici cédé aux lobbies religieux et traditionnalistes. Ce texte remet en cause la situation des femmes les plus faibles et encourage le droit à l'avortement dans la clandestinité: ce n'est pas avec les artisans d'un tel texte que nous voulons faire avancer les droits sociaux en Europe. Monsieur Rajoy a voulu satisfaire la hiérarchie de l'église et séduire l'aile la plus conservatrice de son électorat: le droit à décider des femmes sur leur maternité ne peut, toutefois, et en aucun cas, entrer dans le cadre d'un débat politique ou éthique qui n'envisage pas comme point de départ incontournable la libre décision des femmes.
Anna Záborská (PPE), písomne – Diskusia nám dnes ponúka príležitosť potvrdiť to, o čom sme rozhodli rezolúciou 10. decembra 2013: vypracovávanie a vykonávanie politických stratégií v oblasti sexuálneho a reprodukčného zdravia a práv a sexuálnej výchovy na školách patrí do právomoci členských štátov. Aby sa však obišlo naše uznesenie, otázka potratov je v tejto debate postavená na agende nediskriminácie, aby bola európskym inštitúciám predsa len priznaná nejaká kompetencia. Tento postup ukazuje limity európskeho systému: politické snahy sú reinterpretované tak dlho, až vyhovujú politickým riešeniam stanoveným vopred. Pokúšame sa o nerešpektovanie členských štátov v citlivých etických otázkach. Táto diskusia vo svojej podstate slúži ako útok proti kresťanskodemokratickej vláde v Španielsku. Je mi ľúto, že sa nemôžem vyjadriť po španielsky, ale cítim solidaritu so španielskou vládou a miliónmi španielskych občanov. Na záver pozývam španielsky národ a všetkých občanov, ktorí chránia život pred narodením a právo ženy stať sa matkou, aby nestrácali svoju vieru v európsky projekt. Využite svoje právo počas májových volieb do Európskeho parlamentu.
