1. Resumption of the session

The sitting opened at 17.00.


2. Approval of the minutes of the previous sitting

The minutes of the previous sitting were approved.

Sean Kelly had been present at the sittings of 22 November 2010 and 1 February 2012, although his name was not on the attendance register.

The President recalled that José Manuel Barroso (President of the Commission) would present his declaration on the state of the Union (point 36 of the FDA) on Wednesday, 12 September 2012.


3. Tribute

On behalf of Parliament, the President paid tribute to the memory of Jiří Havel MEP, former MEPs Edith Mastenbroek, Alexander Falconer and Patrick Lane, and Oswaldo Payá, winner of the Sakharov Prize in 2002.

Parliament observed a minute's silence.


4. Statement by the President

The President made a statement on the continuing violations of human rights, democracy and the rule of law in Belarus and called on the President, Alexander Lukashenko, immediately to set free, without condition, all political prisoners and ensure that the forthcoming parliamentary elections would be fair and would conform to international standards.

The President announced that he had sent a letter to the President of the Republic of the Gambia after the state execution of nine people in that country. He called on the government to put an end to executions and to reintroduce the moratorium on the death penalty.

The President congratulated Stavros Lambrinidis, former MEP and Vice-President of Parliament, on his appointment to the post of EU Special Representative for Human Rights.


5. Composition of Parliament

The Cyprus authorities had given notice of the election of Sophocles Sophocleous to replace Kyriakos Mavronikolas as Member of Parliament with effect from 1 September 2012.

Under Rule 3(2), until such time as his credentials had been verified or a ruling had been given on any dispute, and provided that he had previously made a written declaration stating that he did not hold any office incompatible with that of Member of the European Parliament, Sophocles Sophocleous would take his seat in Parliament and on its bodies and would enjoy all the rights attaching thereto.


6. Verification of credentials

On a proposal from the JURI Committee, Parliament validated the mandates of MEPs Erik Bánki with effect from 1 June 2012 and Martina Anderson with effect from 12 June 2012.


7. Request for the waiver of parliamentary immunity

The Polish authorities had forwarded a request to waive the parliamentary immunity of Małgorzata Handzlik.

The Austrian authorities had forwarded a request to waive the parliamentary immunity of Ewald Stadler.

Under Rule 6(2), the request had been referred to the committee responsible, the JURI Committee.


8. Request for the defence of parliamentary immunity

Gabriele Albertini had written to the President requesting that his parliamentary immunity be upheld.

Under Rule 6(3), the request had been referred to the committee responsible, the JURI Committee.


9. Composition of committees and delegations

The President had received the following requests for appointments from the political groups and from the Secretariat of the non-attached Members:

Committee on Foreign Affairs: Laurence J.A.J. Stassen to replace Barry Madlener;

Committee on Transport and Tourism: Barry Madlener to replace Laurence J.A.J. Stassen, Erik Bànki to replace Ádám Kósa;

Committee on Women's Rights and Gender Equality: Krisztina Morvai, Norica Nicolai to replace Angelika Werthmann;

Delegation to the EU-Turkey Joint Parliamentary Committee: Laurence J.A.J. Stassen to replace Barry Madlener;

The appointments would be deemed ratified if there were no objections before the approval of these minutes.


10. Composition of political groups

Angelika Werthmann had joined the ALDE Group with effect from 4 July 2012.


11. Corrigendum (Rule 216)

The committee responsible had forwarded the following corrigendum to a text adopted by Parliament:

Corrigendum (P7_TA-PROV(2012)0241(COR1)) to the European Parliament position adopted at first reading on 13 June 2012 with a view to the adoption of the Regulation on the Scheme of Generalised Tariff Preferences and amending Council Regulation (EC) No 732/2008 (P7_TA-PROV(2012)0241 - COM(2011)0241 - C7-0116/2011 - 2011/0117(COD) - INTA).

Pursuant to Rule 216(4), this corrigendum would be deemed approved unless, within 24 hours, a request was made by a political group or at least 40 Members that it be put to the vote.

The corrigendum was available on the Séance en direct site.


12. Delegated acts and implementing measures (Rule 87a(6) and Rule 88(4)(d))

In accordance with Rule 87a(6), the President of the Conference of Committee Chairs had informed the President of Parliament that no objections had been raised with regard to:

1) a recommandation from the TRAN Committee to raise no objections to draft implementing provisions falling within the regulatory procedure with scrutiny 'Recommendation for a decision to raise no objections to the draft Commission decision authorising the French Republic to derogate from Commission Regulation (EU) No 1332/2011 with respect to the use of a new software version of the airborne collision avoidance system (ACAS II) on certain newly-built aircraft (B7-0423/2012)'.

2) a recommandation from the AGRI Committee to raise no objections to a delegated act: 'Recommendation for a decision to raise no objections to the Commission Delegated Regulation of 28 June 2012 supplementing Council Regulation (EC) No 1234/2007 as regards transnational cooperation and contractual negotiations of producer organisations in the milk and milk products sectors (B7-0424/2012)'.

If no objections were raised to these recommendations by a political group or at least 40 Members within 24 hours, they would be deemed to have been approved. Otherwise, they would be put to the vote.

13. Signature of acts adopted under the ordinary legislative procedure

The President announced that, together with the President of the Council, he had signed the following acts adopted under the ordinary legislative procedure (Article 74 of the Rules of Procedure) since the session had been interrupted in July:

- Regulation of the European Parliament and of the Council amending the Protocol on the Statute of the Court of Justice of the European Union and Annex I thereto (00028/2012/LEX - C7-0199/2012 - 2011/0901A(COD));

- Regulation of the European Parliament and of the Council amending Council Regulation (EC) No 73/2009 as regards the application of direct payments to farmers in respect of the year 2013 (00033/2012/LEX - C7-0177/2012 - 2011/0286(COD));

- Regulation of the European Parliament and of the Council amending Decision No 1639/2006/EC establishing a Competitiveness and Innovation Framework Programme (2007-2013) and Regulation (EC) No 680/2007 laying down general rules for the granting of Community financial aid in the field of the trans-European transport and energy networks (00027/2012/LEX - C7-0176/2012 - 2011/0301(COD)).

The President also pointed out that, together with the President of the Council, he would sign the following act adopted under the ordinary legislative procedure (Article 74 of the Rules of Procedure) during the current part-session:

- Directive of the European Parliament and of the Council amending Directive 2009/138/EC (Solvency II) as regards the date for its transposition and the date of its application, and the date of repeal of certain Directives (00034/2012/LEX - C7-0284/2012 - 2012/0110(COD)).


14. Action taken on Parliament's resolutions

The Commission communication on the action it had taken in response to the resolutions adopted by Parliament during the March I and II 2012 part-sessions was available on the Séance en direct site.


15. Texts of agreements forwarded by the Council

The Council had forwarded certified true copies of the following:

- Agreement in the form of an exchange of letters between the European Union and Thailand pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT 1994) relating to the modification of concessions with respect to processed poultry meat provided for in the EU Schedule annexed to GATT 1994;

- Agreement in the form of an exchange of letters between the European Union and Brazil pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT 1994) relating to the modification of concessions with respect to processed poultry meat provided for in the EU Schedule annexed to GATT 1994;

- Partnership and Cooperation Agreement between the European Union and its Member States, of the one part, and the Republic of Iraq, of the other part;

- Protocol amending the Euro-Mediterranean Aviation Agreement between the European Community and its Member States, of the one part, and the Kingdom of Morocco, of the other part, to take account of the accession to the European Union of the Republic of Bulgaria and Romania;

- Agreement between the EU and Moldova on the protection of geographical indications of agricultural products and foodstuffs;

- Agreement between the European Union and the Republic of Moldova amending the Agreement between the European Community and the Republic of Moldova on the facilitation of the issuance of visas;

- Common Aviation Area Agreement between the European Union and its Member States and the Republic of Moldova;

- Partnership and Cooperation Agreement between the European Union and its Member States, of the one part, and the Republic of the Philippines, of the other part;

- Comprehensive Framework Partnership and Cooperation Agreement between the European Union and its Member States, of the one part, and the Socialist Republic of Vietnam, of the other part;

17. Transfers of appropriations

The Committee on Budgets had authorised the Commission's proposal for transfer of appropriations DEC 11/2012 (N7-0071/2012 - C7-0135/2012 - 2012/2113(GBD)) in accordance with Article 24(4) of the Financial Regulation as interpreted in point 20 of the joint declaration on transitional measures applicable to the budgetary procedure after the entry into force of the Lisbon Treaty.

The Committee on Budgets had authorised the Commission's proposal for transfer of appropriations DEC 14/2012 (N7-0073/2012 - C7-0152/2012 - 2012/2122(GBD)) in accordance with Article 24(4) of the Financial Regulation as interpreted in point 20 of the joint declaration on transitional measures applicable to the budgetary procedure after the entry into force of the Lisbon Treaty.

The Committee on Budgets had authorised the Commission's proposal for transfer of appropriations DEC 18/2012 (N7-0080/2012 - C7-0172/2012 - 2012/2139(GBD)) in accordance with Article 24(4) of the Financial Regulation as interpreted in point 20 of the joint declaration on transitional measures applicable to the budgetary procedure after the entry into force of the Lisbon Treaty.

The Committee on Budgets had authorised the Commission's proposal for transfer of appropriations DEC 19/2012 (N7-0078/2012 - C7-0159/2012 - 2012/2125(GBD)) in accordance with Article 24(4) of the Financial Regulation as interpreted in point 20 of the joint declaration on transitional measures applicable to the budgetary procedure after the entry into force of the Lisbon Treaty.

The Committee on Budgets had authorised the Commission's proposal for transfer of appropriations DEC 21/2012 (N7-0079/2012 - C7-0160/2012 - 2012/2126(GBD)) in accordance with Article 24(4) of the Financial Regulation as interpreted in point 20 of the joint declaration on transitional measures applicable to the budgetary procedure after the entry into force of the Lisbon Treaty.

In accordance with Article 22(2) of the Financial Regulation, the Committee on Budgets had decided not to raise objections to the draft presented by the European Economic and Social Committee regarding the transfer of appropriations INF 01/2012.
