  Véronique De Keyser, auteure. − Monsieur le Président, le problème de la situation des migrants en Libye n'est certainement pas nouveau. Je me souviens qu'il n'y a pas tellement longtemps, encore sous le colonel Kadhafi, l'Union européenne tentait de négocier un accord absolument honteux, avec Kadhafi, pour qu'il maintienne les migrants dans son pays, alors que nous connaissions les conditions détestables auxquelles ils étaient soumis.

La faute n'est donc certainement pas au nouveau gouvernement libyen qui vient d'être élu, mais plutôt à une absence de législation, de structure, de culture, d'institutions qui pourraient protéger les migrants.

Aujourd'hui, ils sont dans une situation pire que jamais; persécutés par des milices, des ex-rebelles – les Katibas. Ce que nous voulons faire, c'est véritablement suggérer à ce nouveau gouvernement de travailler avec lui, main dans la main. À lui de créer un cadre institutionnel et à nous, Union européenne – j'en appelle ici au commissaire Rehn et à la Haute représentante – de travailler avec les Libyens pour que les migrants soient cette fois traités décemment et que l'on distingue les demandeurs d'asile, les réfugiés des migrants y travaillant. C'est vraiment un problème d'urgence humanitaire, au sens le meilleur du terme.

  Ryszard Czarnecki, autor. − Dziękuję bardzo, Panie Przewodniczący! Szkoda tylko, że Pan patrzy na mnie, kiedy mówi Pan o tej jednej minucie, kiedy ja zawsze jej przestrzegam, Panie Przewodniczący! Ale trudno.

Chciałbym powiedzieć, że ta rezolucja jest bardzo ważna, ponieważ dotyczy problemu, który nie jest egzotyczny, lecz ludzi, którzy przyjeżdżają do krajów europejskich, choć czasem wędrują trochę dalej. I trzeba tę kwestię uregulować. Choć oczywiście można zadać sobie pytanie. Ci ludzie uciekali w czasie, gdy był tam Kadafi, kiedy toczyły się walki. Uciekają oni, czy też starają się wyemigrować również teraz? Nasuwa się więc pytanie: czy rzeczywiście nowa władza jest tym, o czym Libijczycy myśleli? To tak na marginesie tej ważnej rezolucji, której mam zaszczyt być autorem. Dziękuję.

  Bernd Posselt, Verfasser. − Herr Präsident! Unser Europa hat eine gefährliche und strategisch wichtige Gegenküste in Nordafrika. Der Mittelmeerraum war unter den Römern das mare nostrum, Churchill hat ihn den weichen Unterleib Europas genannt. Das macht schon deutlich, wie sehr wir von dieser Region abhängen.

Libyen hat immer eine Schlüsselstellung in diesem Raum innegehabt als Partner in der Energieversorgung, als kultureller, wirtschaftlicher, geopolitischer Partner und nicht zuletzt auch als ein zentraler Ort der Einwanderungsströme. Deshalb sind wir darauf angewiesen, dass die neuen Strukturen, die in diesem Land entstehen, stabil und demokratisch sind, und dass wir mit ihnen gut auf allen Feldern kooperieren können. Deshalb müssen wir alles tun, was wir können, um der jungen, libyschen Demokratie auf die Füße zu helfen und darauf hinzuwirken, dass es dort eine funktionierende Verwaltung gibt, dass der junge Staat auch tatsächlich seinen Aufgaben gerecht werden kann.

Was die Einwanderung betrifft, so geht es zum einen darum, sie im Griff zu halten, damit sich nicht unkontrollierte Ströme ergießen, auf der anderen Seite aber dafür zu sorgen, dass diese Menschen menschenwürdig behandelt werden, dass sie ihre elementaren Rechte genießen, dass Libyen die internationalen Konventionen, die dazu nötig sind, ratifiziert und auch anwenden kann. Das ist nicht nur eine Aufgabe für die demokratischen Parteien in Libyen, das ist auch eine Aufgabe für uns Europäer. Deshalb begrüße ich diese Entschließung zutiefst, weil sie sich auch auf den ganzen Raum des nördlichen Afrika und nicht zuletzt auch auf die Staaten der Sahelzone bis hin nach Mali auswirkt.

  Marie-Christine Vergiat, auteur. − Monsieur le Président, c'est urgent et c'est motivé par les rapports alarmants de plusieurs grandes ONG concernant la situation des migrants en Libye.

Je crois que l'on peut dire que, d'une certaine façon, rien n'a changé pour les migrants depuis le renversement de Mouammar Kadhafi et que pour nombre d'entre eux, la situation a même empiré. Soupçonnés presque systématiquement d'être des anciens mercenaires de Kadhafi, ils sont internés dans des camps aux mains d'ex-rebelles. Leurs conditions de vie y sont déplorables. On ne compte plus les actes de violence, de torture envers des hommes, des femmes, des enfants, et il n'y a aujourd'hui aucune autorité en Libye capable d'y mettre un terme.

L'Union européenne, et notamment certains de ses États membres, ont une lourde responsabilité dans la situation actuelle, puisqu'ils se sont engagés tête baissée dans un conflit, sans tenir compte de ses conséquences. Je regrette que rien ne soit dit dans la résolution à ce sujet, d'autant plus que les ONG ne manquent pas de dénoncer cette responsabilité.

Si je ne devais prendre qu'un exemple, je dirais qu'il est assez significatif de constater qu'il a fallu quatre mois pour tirer les conséquences des élections de juillet et mettre en place un nouveau gouvernement. Pire, de nouveaux accords sont en cours de négociation entre l'Union, certains de ses États membres et la Libye. Nul ne doute que la question migratoire sera au centre des débats. À tout le moins, le Parlement européen devrait prendre position et refuser que ces accords soient conditionnés à des accords de réadmission dont on connaît la teneur, mais il ne le fait pas. La résolution est pour le moins faible, notamment de ce point de vue, et c'est pourquoi mon groupe ne la votera pas.

Frau Vergiat, ich möchte Sie wirklich fragen: Will Ihre Fraktion nicht auch die Demokratie in Libyen unterstützen oder sind Sie jemand, der dem Gaddafi-Regime nachtrauert und diese neue Regierung überhaupt nicht unterstützt, sondern von vornherein sabotiert?

  Marie-Christine Vergiat (GUE/NGL), réponse "carton bleu". – Monsieur Posselt, vous avez pour habitude de caricaturer mes positions; cela ne m'intéresse pas. Nous avons participé à la même réunion de négociation. Vous savez quelles sont mes positions.

Je suis militante des droits de l'homme depuis trente ans. Je n'ai pas de leçon à recevoir en la matière. J'ai dénoncé la situation sous le régime Kadhafi comme je l'ai dénoncée sous celui de Ben Ali, contrairement à d'autres dans cet hémicycle. Cessez vos insultes! Je soutiendrai la démocratie naissante en Libye et ce n'est pas vous qui allez me faire bouger d'une ligne! Je dénonce le comportement de l'Union européenne et de ses États membres. Je dénonce les accords de réadmission, qui conditionnent des aides au développement et à la démocratie dans ces pays-là, et vous ne me ferez pas revenir sur la teneur de mes propos. Vos insultes ne m'atteignent pas.

  Nicole Kiil-Nielsen, auteur. − Monsieur le Président, la situation actuelle des migrants en Libye est un héritage du passé. Nous voulons, avec cette résolution, mobiliser le nouveau gouvernement libyen sur la question des droits des migrants, lui dire que nous désirons vivement et que nous sommes prêts à l'aider à mettre en place de nouvelles politiques en faveur des migrants et des demandeurs d'asile, car c'est une question cruciale. De nombreuses violations des droits humains, y compris des enfants et des femmes victimes de violences sexuelles, ont été constatées par les ONG présentes sur place.

Enfin, pour permettre une plus grande protection des droits des migrants, il est urgent que la Libye, qui s'est engagée avec succès sur la voie de la démocratie, tire définitivement un trait sur le passé hérité de la dictature, en ratifiant les conventions internationales et, bien entendu, la convention sur le statut des réfugiés de 1951.

  Kristiina Ojuland, author. − Mr President, Mr Commissioner, I would like to congratulate the democratically elected government of Libya that was sworn in on 14 November this year. However, there is a long way to go until we see a fully-fledged democratic country that upholds human rights, civil liberties, the rule of law and gender equality. I wish Libya success and the best of luck.

One of the most imminent problems facing the new Libyan Government is the situation of migrants, which is the sad result of the open borders policy of the late dictator Muammar Gaddafi. I hope that the Libyan Government may rely on the assistance of the European Union in alleviating the situation, as well as on cooperation with international organisations and NGOs. The UNHCR would also be of great help if granted a legal status in Libya.

But it is most important for Libya to ratify the 1951 UN Convention relating to the Status of Refugees and for the Government to take full control over the external borders of the country and responsibility for the situation at hand.

  Seán Kelly, on behalf of the PPE Group. – Mr President, the situation of migrants in Libya is unfortunate; many of them sided with Gaddafi in the uprising of 2011 and indeed many of them may even have been sought out by Gaddafi to fight on his behalf. Having lost, they are in a precarious and perilous position. Nevertheless, something has to be done about it and there are three things, I think, that are required:

Firstly, we have to try to establish a stable government, which is hopefully developing; we cannot impose it but we can certainly do a lot to help. Secondly, Libya has to sign up to the 1951 Refugee Convention. This will give them status within Libya. And thirdly, where asylum seekers come to Europe and elsewhere the burden must be shared. I listened to the Maltese Prime Minister last week and very generously he said – even though it is a very small coutnry – that they would not turn back any asylum seekers. In fact, 250 asylum seekers had landed the day before; but the burden needs to be spread to all countries.

  Joanna Senyszyn, w imieniu grupy S&D. – Panie Przewodniczący! Libia to centrum dla ubiegających się o azyl i uchodźców z Afryki, Azji i Bliskiego Wschodu. Za rządów Kadafiego byli oni wyzyskiwani ekonomicznie, zmuszani do niewolniczej pracy, prześladowani, zatrzymywani, aresztowani, torturowani. Po obaleniu reżimu ich sytuacja wcale się nie poprawiła i nadal jest tragiczna: wielu cudzoziemców, w tym kobiety w ciąży, małe dzieci i dzieci bez opieki, jest zatrzymywanych przez grupy paramilitarne i przetrzymywanych bezterminowo w nieludzkich i poniżających warunkach w ośrodkach zatrzymań lub bezpośrednio przez oddziały zbrojne. Władze Libii muszą zapewnić wszystkim cudzoziemcom, niezależnie od ich statusu imigracyjnego, ochronę przed przemocą, wyzyskiem, zastraszaniem i wykorzystywaniem. Konieczna jest ratyfikacja konwencji dotyczącej statusu uchodźców oraz wprowadzenie spójnego z prawem międzynarodowym krajowego prawa regulującego kwestię azylu i pracowników migrujących.

  Jaroslav Paška, za skupinu EFD. – Líbya prešla v posledných rokoch veľmi zložitým obdobím, keď po ťažkej občianskej vojne, aj za materiálnej pomoci z Európy, došlo k zmene charakteru správy štátu.

Preto je prirodzené, že nové, čerstvo vytvorené inštitúcie na správu krajiny ešte nemajú vybudovaný ucelený systém komplexného správania štátu. Na druhej strane však by mali byť schopné pohotovo riešiť najakútnejšie problémy krajiny. Mimoriadne kritickou sa v krajine v poslednom čase stala situácia cudzincov v integračných zariadeniach v Kufre, Benghazi či Tripolise. Extrémne väzenské podmienky, ktorým sú vystavené aj ženy a deti s častými prípadmi rodového a sexuálneho násilia oprávnene vyvolávajú znepokojenie nad nečinnosťou líbyjských štátnych orgánov. Preto je našou povinnosťou dôrazne naliehať na Líbyu, aby urýchlene prijala zákony na zabezpečenie medzinárodných ľudských práv a v súlade s tým upravila postavenie prisťahovalcov v krajine tak, aby boli chránení pred násilím, vykorisťovaním, hrozbami, zastrašovaním a zneužívaním.

Verím, že aj nová líbyjská administratíva si uvedomuje vážnosť tohto problému.

  Jiří Maštálka, za skupinu GUE/NGL. – Pane předsedající, návrh usnesení o Libyi obsahuje požadavky, které směřují jak k nové vládě, tak i k evropským firmám, které tam působí. Myslím, že se jedná o oprávněné návrhy a doporučení. V usnesení mi však chybí zmínka o tom zásadním, co komplikuje situaci nejen v Libyi, ale i ve všech ostatních státech, kde se některé země Evropské unie podílely na změně vlády a změně režimu. Domnívám se, že bychom se tváří v tvář transformačním potížím v Afghánistánu, Iráku a nyní i v Libyi měli vážně zamyslet nad tím, jaké chyby děláme. Nestačí jen radit, mentorovat, posílat vojáky či humanitární pomoc, která často končí v rukou sice proevropsky politicky blízkých, ale zcela zkorumpovaných elit. Je třeba si konečně položit otázku, čemu vlastně v těchto zemích nerozumíme, když naše – někdy dokonce i dobře míněné – rady a činy nepadají na úrodnou půdu, mají dokonce i kontraproduktivní efekt.

  Sari Essayah (PPE). - Arvoisa puhemies, hyvä komission jäsen, Libyassa ei ole toimivaa turvapaikanhakujärjestelmää, eikä se ole myöskään mukana YK:n pakolaisia koskevassa sopimuksessa.

Amnesty raportoi, että paperittomat ulkomaalaiset ovat vaarassa joutua hyväksikäytön, mielivaltaisen käsittelyn ja myös pidätysten uhreiksi. Erityisesti tässä tilanteessa, kun maa toimii ilman keskitettyä hallintoa, koko valtion alueella aseistetut militaristijoukot ja yksilöt ovat saaneet vallan päättää maahanmuuttajien kohtalosta ilman lain suomaa kehystä. Libyasta on karkotettu ihmisiä UNHCR:n mukaan ilman mahdollisuutta saada asiaansa asiallisesti käsitellyksi myös maihin, joissa karkotetut kohtaavat vainoa, ja myös ihmiskaupan määrä on korkea.

EU:n on alleviivattava, että Libyan tulisi suojella kaikkia ulkomaalaisiakin ihmisiä alueellaan riippumatta heidän statuksestaan, ja hallinnon tulisi pystyä takaamaan ihmisarvoinen kohtelu ja myös turva väkivallalta. Ulkomaalaisille tulee myös järjestää pääsy juristin luokse siinä vaiheessa, kun he hakevat turvapaikkaa ja suojelua.

  Monica Luisa Macovei (PPE). - Mr President, while we welcome the return to political stability after July’s election in Libya, there are worrying reports about detention centres in Tripoli where migrants are allegedly mistreated. Democracy and the rule of law in this country cannot be separated from a functioning judicial system and equal treatment of all its citizens. The European Union must continue to assist Libya’s new democracy by offering financial assistance through its various Neighbourhood Policy instruments. However, we must always underline that our help does depend on the fulfilment of commitments, such as those relating to the principles of the rule of law and democracy.

I trust we can develop a good political partnership with Libya’s new government. I endorse Parliament’s call on Vice-President/High Representative Catherine Ashton to develop, together with the Libyan Foreign Affairs Minister, a comprehensive approach to mobility which will make use of the EU toolkit of human rights-based strategies and approaches.

  Zita Gurmai (S&D). - Mr President, while the first democratically elected Libyan government has just been formed, we should not forget the fragility of the local situation and the many challenges that remain to be overcome. The terrible conditions and severe human rights abuses faced by migrants should be a priority among these.

I am deeply preoccupied by the conditions faced by women and children, especially those who have arbitrarily been put into detention. We have received several reports of sexual and gender-based violence in those detention centres, where pregnant women, women with young children and unaccompanied children are being held alongside adults. Their lack of recourse to adequate protection makes them vulnerable to all kinds of exploitation and violence.

The situation in Libya was widely discussed in the framework of the last ACP–EU Joint Parliamentary Assembly in May 2012, and I underlined this tragic situation at that time. I welcome the implementation of migration programmes by the Commission and EEAS and I urge you to do your utmost to put an end to this situation.

  Cristian Silviu Buşoi (ALDE). - Libia este un exemplu de cum un popor se poate elibera de sub tiranie, cu sprijinul comunităţii internaţionale. Este clar că tranziţia către o societate democratică, pluralistă, prosperă nu poate fi una rapidă sau uşoară într-o ţară ca Libia, dar, pentru a reuşi, trebuie să-şi ducă la îndeplinire angajamentele şi să accepte sprijinul nostru.

Pentru că Libia a fost o ţară bogată în resurse, şi mă refer aici la petrol, în primul rând, mulţi migranţi au lucrat sau lucrează în această ţară. Şi, fără vina lor, cei mai mulţi dintre ei au fost prinşi la mijloc în conflictul care a izbucnit în Libia. Din păcate, şi în acest moment, mulţi străini sunt supuşi abuzurilor şi încălcărilor drepturilor omului, iar condiţiile celor care se află în detenţie sunt absolut inacceptabile şi revoltătoare.

Parlamentul European trebuie să ceară foarte ferm guvernului libian, şi o face cu această rezoluţie, să ia măsuri pentru a rezolva această situaţie, în conformitate cu reglementările internaţionale.

  Mitro Repo (S&D). - Arvoisa puhemies, Libya on ottanut selkeitä askeleita kohti demokratiaa. Libyaa pitää voida ohjeistaa erityistä huomiota tarvitsevista ihmisoikeudellisista kipukohdista. Useat kansainväliset ihmisoikeusjärjestöt ovat raportoineet Libyassa tapahtuneista ihmisoikeusloukkauksista, jopa väkivallanteoista.

Libyaa tulee kannustaa ratifioimaan pakolaisten asemaa koskeva YK:n yleissopimus vuodelta 1951. Tämä helpottaisi myös YK:n pakolaisasiain päävaltuutetun toimiston toimintaa maassa. Myös siirtotyöläisten oikeuksiin tulee kiinnittää huomiota.

Euroopan unionin tulee tarjota yhteistyötä Libyalle. Ehtona tulee olla demokraattisesti toimiva Libyan hallitus. Libyan viranomaiset ovat velvollisia suojelemaan kaikkia ulkomaalaisia väkivallalta, riistolta, uhkauksilta, pelotteluilta ja muulta hyväksikäytöltä. Toivottavasti Euroopan talousalueen hyödyt kannustavat Libyaa etenemään tällä tiellä.

  Lidia Joanna Geringer de Oedenberg (S&D). - Panie Przewodniczący! Położenie geograficzne Libii i jej dobrze funkcjonująca gospodarka sprawiły, że kraj stał się atrakcyjnym miejscem tranzytu dla setek tysięcy imigrantów, głównie z Afryki Subsaharyjskiej. Międzynarodowa organizacja ds. migracji szacuje, że aż jedną trzecią całej populacji Libii stanowią imigranci, z których większość przebywa w kraju bez ważnych dokumentów. Ci nielegalni mieszkańcy, do których zalicza się także uchodźców, padają ofiarami wyzysku, dyskryminacji rasowej, a nawet przemocy fizycznej ze strony libijskiej ludności oraz władz. Brak jakiegokolwiek statusu czy ochrony prawnej pozbawia ich możliwości szukania pomocy w odpowiednich instytucjach czy sądach.

Porewolucyjny libijski rząd obiecywał uregulowanie kwestii praw człowieka oraz praw imigrantów w jak najszybszym czasie w zgodzie z międzynarodowymi standardami w tej dziedzinie. Ważnym krokiem naprzód byłoby ratyfikowanie przez libijskie władze konwencji ONZ z 1951 r. dotyczącej statusu uchodźców oraz uznanie innych porozumień dotyczących międzynarodowych standardów przestrzegania praw człowieka.

  Olli Rehn, Member of the Commission. − Mr President, we are deeply concerned at the latest reports regarding the situation of migrants, asylum seekers and other vulnerable foreign nationals in Libya. We have raised these issues with the Libyan authorities on a regular basis and will continue to do so in the future. In reply, the authorities have acknowledged the problems and have expressed their readiness to address these issues.

The contradiction between these practices and the values that triggered the 17 February revolution is very clear. The EU supported the Libyan revolution from the outset because it was rooted in values that we share, especially of course respect for human rights and democratic principles.

The European Union will continue to be a strong partner for Libya during the process of democratic transition. Nevertheless – in this same spirit of partnership – we will not hesitate to convey concerns on issues of fundamental importance, such as those we are discussing today.

At the same time we are sensitive to the complex situation in Libya at present. Over the past four months Libya has undergone a period of political uncertainty with a caretaker government having to deal with numerous challenges, including a major security crisis, not just in Benghazi but in a number of other parts of the country. Moreover, it faces a long list of urgent priorities to address, including state-building, disarmament, demobilisation and reintegration of the revolutionary militias, national reconciliation, the promotion of the rule of law and the protection of human rights.

The new government was sworn in just over a week ago. We note our full political support to Prime Minister Zidan’s new government and trust he will do his outmost to address the different challenges lying ahead. As is the case for every new government – and in particular for Libya – the authorities need time to put their house in order. Nevertheless, we will not be complacent. We will continue to follow this issue closely. We will continue to press the authorities to ensure respect for human rights standards and we will continue to help them meet their responsibilities under international law. In this regard, I would like to recall that the EU is already providing a EUR 20 million support package aimed at improving the protection of vulnerable groups, including migrants. Further measures and projects in this regard are in the pipeline.

Finally, with regard to our assistance in broader terms, we are also preparing a substantial programme on the security sector reform as well as on the rule of law under the European Neighbourhood Policy instrument, the design of which is being finalised. The overall objective of this programme is to promote the rule of law in Libya by strengthening democratic control and good governance in the security and justice sectors. The specific objective is to respond to the needs expressed by the Libyan authorities in managing the process of democratic transition, especially in the security and justice sector.

  Ana Gomes (S&D), por escrito. – In my opinion, this is not the best time to have this resolution adopted by the European Parliament, since the first Libyan government resulting from democratic elections has just been sworn in last week. It obviously needs time to grasp with the many daunting challenges the country faces in a post-war situation. One of the appalling legacies from Gaddafi concerns is the mistreatment of migrants and asylum seekers in Libya: migrants were and are exploited and discriminated, many of them detained under inhumane conditions, subject to torture and barred from access to justice. Yet, the 17 of February Revolution was made to restore dignity and human rights to all in Libya. And Libya is, and will continue to be, a magnet for migrants and asylum seekers from all over Africa. This requires the new democratic Libya to ensure legal protection and respect for the human rights to all foreign workers, asylum seekers and refugees. The EU and the UN must support Libya in this effort, in the framework of assisting its democratic transition. I hope the new Libyan authorities and the Libyan people will take this EP stand in this constructive and cooperative spirit.

  Charles Tannock (ECR), in writing. – There is no doubting the importance of this issue; many thousands of migrants face genuine human rights abuses while incarcerated in Libya, and are subject to substantive discrimination when at liberty. But I have real reservations about the timing of this resolution: the new government, the first to be democratically elected in half a century, was sworn in literally a week ago, and has had no opportunity to improve the human rights situation for migrants, or indeed, citizens in general. Nevertheless, it is important that the new government finds ways of regularizing the legal situation of these migrants, or assisting in their safe and orderly return to their countries of origin. I hope that this problem can be resolved satisfactorily, as the new Libya faces many challenges in its reconstruction and transition to a multi-party democracy, and needs all the help from the international community that it can get.
