  Monika Flašíková Beňová, spravodajkyňa. − Správa o dodržiavaní základných práv v Európskej únii za obdobie 2010 – 2011 sa pripravovala dva roky a bola to správa, kde sme skutočne veľmi intenzívne spolupracovali na úrovni tieňových spravodajcov, ktorým sa touto cestou chcem srdečne poďakovať.

Ak dovolíte, budem hovoriť o niektorých opatreniach, ktoré z môjho pohľadu sú dôležité najmä v tomto krízovom období – v období hospodárskej a sociálnej krízy, keď správa o základných právach v Európskej únii má byť dôkazom, že Európsky parlament napriek tomu, že nemôže zabezpečiť zvýšenie miezd občanov členských štátov, nemôže zabezpečiť ani odstránenie nezamestnanosti v členských štátoch, je ale pripravený naozaj bojovať za dodržiavanie základných práv v členských štátoch.

Článkom 2 Zmluvy o Európskej únii sa zakladá Únia ako spoločenstvo nedeliteľných a univerzálnych hodnôt v ľudskej dôstojnosti, slobode, demokracii, rodovej rovnosti, nediskriminácie, solidarity, právneho štátu a dodržiavania ľudských práv a občianskych slobôd, a to pre všetky osoby žijúce na území Európskej únie vrátane osôb patriacich k menšinám, osôb bez štátnej príslušnosti a osôb, ktoré sú na území Európskej únie dočasne. Tieto hodnoty sú pre členské štáty v spoločnosti, v ktorej sa presadzuje pluralizmus, nediskriminácia, tolerancia, spravodlivosť a rovnosť medzi ženami a mužmi, spoločné. Preto aj rešpektovanie a presadzovanie týchto hodnôt je zásadným prvkom identity Európskej únie, podmienkou získania členstva v Európskej únii a plnohodnotného zachovania členských práv. Nadobudnutím platnosti Lisabonskej zmluvy má Charta základných práv Európskej únie na základe článku 6 Zmluvy o Európskej únii rovnakú právnu hodnotu ako Lisabonská zmluva a stala sa právne záväznou pre inštitúcie, orgány a agentúry Európskej únie, ako aj pre členské štáty pri vykonávaní práva Európskej únie. Charta premenila hodnoty a zásady na hmatateľné a vykonateľné práva.

Účinná ochrana a presadzovanie práv musí byť preto celkovým cieľom všetkých politík Európskej únie vrátane ich vonkajšieho rozmeru. A keďže dodržiavanie povinnosti chrániť, presadzovať a napĺňať práva si nevyžaduje nové právomoci Európskej únie, ale skôr proaktívne inštitucionálne odhodlanie v oblasti ľudských práv, treba rozvíjať a posilňovať skutočnú kultúru základných práv v inštitúciách Únie a v členských štátoch. Európska únia musí podporovať súdržnú politiku v oblasti ľudských práv a mechanizmus, ktorý spája rôzne subjekty v oblasti základných práv v rámci štruktúry Európskej únie.

Kolegyne a kolegovia, občania môžu svoje práva plnohodnotne využívať len vtedy, ak sa rešpektujú základné hodnoty a zásady, ako sú zásady právneho štátu, nezávislosť súdnictva, sloboda médií a nediskriminácia. Medzera medzi základnými právami a ich zavádzaním do praxe však oslabuje dôveryhodnosť Európskej únie aj jej členských štátov. Účinná ochrana a presadzovanie základných práv si vyžadujú, aby členské štáty v duchu solidarity a úprimnej spolupráce s ostatnými členskými štátmi prijali kontrolu rešpektovania hodnôt Európskej únie v legislatívnych politikách a praxi zo strany Európskej únie. Článok 7 Zmluvy o Európskej únii s článkom 2 dávajú inštitúciám Európskej únie právomoc posudzovať, či v členských štátoch dochádza k porušeniu spoločných hodnôt, ako sú dodržiavanie ľudských práv, demokracia a zásady právneho štátu. A umožňuje tiež v príslušných krajinách politicky zasahovať s cieľom zabrániť takémuto porušovaniu a urobiť nápravu. Preto je našou povinnosťou vyžadovať uplatňovanie týchto cieľov.

Súčasná hospodárska kríza a sociálna kríza, a najmä jej dopady, ohrozuje zásadu solidarity, ktorá je dôležitou súčasťou histórie a identity Európskej únie, ako aj základnú väzbu, ktorá spája občanov Európskej únie ako členov jedného politického spoločenstva. Preto vás chcem aj v tejto diskusii napriek tomu, že už je neskoro večer, požiadať, aby ste zajtra v hlasovaní túto veľmi dôležitú správu ako odkaz občanom členských štátov Európskej únie podporili.

  Viviane Reding, Vice-President of the Commission. − Mr President, I welcome the debate in the European Parliament on the situation of fundamental rights. You know that when I took up my duties, one of my first commitments was to present an annual report on the application of the EU Charter and to have a general debate every year on the way in which this Charter is being applied. By this I was responding, de facto, to a request made by the European Parliament one year ago: I would just like to recall the 2007 report of Johannes Voggenhuber.

I am glad to see that today, on the basis of the report prepared by Ms Flašíková-Beňová and the Commission’s Annual Reports, we are able to hold a fully informed discussion.

Let me start by stressing that, since the entry into force of the Lisbon Treaty and then of the Charter, progress has been achieved on three fronts: Firstly, the Commission has defined a clear policy on how to put the Charter into practice. This was laid down, as you know, in the strategy for the effective implementation of the Charter, and it has also ensured that the Charter has become a compass for all EU policies. The strategies were assessing the consequences of having a legally binding Charter and the measures taken by the Commission to ensure its respect: for instance, checking the new legislation for compliance with the Charter. So not a single initiative comes from the Commission without passing this compliance check with the Charter. Furthermore, when the Commission went before the Court of Justice to take an oath to respect the Treaties, we also gave an oath that we will respect the Charter. This is a symbolic act, I know, but it is also a political commitment from the whole College to ensure that the Charter is respected.

This policy has already brought tangible effects for our citizens because not only does the Commission go ahead with putting the Charter into practice, but the Commission has also been followed by the Council. For instance, the impact assessment which the Commission makes on its basic texts has been followed by an impact assessment which is carried out by the Council on its own amendments to Commission proposals.

Let us not forget that the Court of Justice is applying more and more rules on the basis of the Charter. There are, for instance, two pieces of EU legislation which have been invalidated by the Court of Justice for non-compliance with the Charter. This, I believe, shows that the Charter has evolved into a powerful tool.

Of course, not everything is perfect. However, we can no longer say that the EU institutions do not take fundamental rights seriously. The Charter and the active work in promoting its application have ensured that today these rights play a fundamental role in the development of new policies – not only in the general application of the Charter, but also in specific policy initiatives dedicated to specific fundamental rights. Let me just quote some of them: the Agenda on the Rights of the Child, the EU Framework for the National Roma Integration Strategies, the Strategy for Equality between Men and Women and the European Disability Strategy. All these strategies have given a new momentum in these specific areas, and the Citizenship Report, which is going to be presented in 2013, will look at the very specific area of rights for citizens when crossing borders. It will also present further concrete actions during the European Year of Citizens to enhance those citizens’ rights.

The second front relating to the application of the Charter is the effective enforcement of the Charter in the Member States. You all know our famous Article 51, which has been quoted again and again in this Chamber: the Charter is addressed to the institutions, the bodies, the offices and the agencies of the Union, and to the Member States only when they are implementing EU law.

But in this context, the Commission takes very seriously its role as guardian of the Treaties. Some examples: the question of the Roma in France in the summer of 2010 and in the summer of this year, and the actions regarding Hungary and Romania. These examples reveal our determination to intervene, where necessary, when the Commission has the power to do so.

Let me come to the Hungarian example, where the Commission did not hesitate to refer Hungary very quickly to the Court of Justice regarding the independence of the data protection supervisory authority and the age of retirement of judges, prosecutors and notaries. We were followed by the Court of Justice in this case, and now the very short transitional period has been declared incompatible with the EU equal treatment law. Hungary will, therefore, have to change these rules in order to comply with the EU law.

You will recall the events last summer in Romania, where the Commission set out in detail its concerns in its report under the Verification Mechanism adopted on 18 July 2012. The Romanian Government made a number of important commitments, and the Commission is analysing what is happening in practical terms and will issue a further report analysing whether these concerns have been addressed and whether democratic checks and balances have been restored.

Another very important element is gaining ground, and this can be seen in our national courts. As explained in the 2011 Commission Annual Report, national courts, when addressing questions to the Court of Justice (preliminary rulings), have increasingly referred to the Charter. As compared to 2010, in 2011 these references rose by 50%. That is a very strong progress that means something; that really shows the reflection in our judiciary, not only at the European Court of Justice, but in our national courts. In general, the reflection that there is this Charter and that it needs to be applied is gradually gaining ground.

The third front where there was key progress is the development of new secondary legislation on fundamental rights. You know all of those, but let me just quote a few to show you want I mean. The data protection rules, which are real routes to better protection of personal data of individuals, or another element, which is the recently adopted proposal for women on corporate boards. What is interesting in this proposal is that we had to balance several fundamental rights included in the Charter: gender equality, of course, but also non-discrimination, which has many court cases dedicated to it, and the freedom to conduct a business. So we have, if we present new legislation, always to strike a balance between different rights. I am sure that the Parliament, with its relentless commitment, will turn the Commission's proposal into a legally binding act.

Let me also quickly remind you of all the work which has been done on procedural rights for the accused, but also on the rights of victims in criminal proceedings, and all the new directives which have already been adopted or which will be adopted very soon.

The recent adoption of the new directive on victims’ rights will improve the rights of an estimated 75 million crime victims annually across the EU. So, when you really look at what has been done since the Charter has become our compass, it is remarkable, although it is a direction in which we are going; we have not reached the destination yet, but we are on the path.

Let me finish, President, with one remark concerning the Fundamental Rights Agency, which we need in order to support our fundamental rights policy, because the Agency has the role of gathering comparative data. If we did not have these data, we would be facing a data gap, and we would then have difficulties in obtaining the necessary evidence to underpin our policies on fundamental rights. This Agency is, therefore, really necessary.

Unfortunately, the good work done by the Agency is being jeopardised, as it now seems clear that the Council will not be in a position to adopt the Multiannual Framework for the Agency by the end of the year. I am seriously worried about this, because we all knew about the deadline. This also explains why the EU institutions made intense efforts in order to enable an agreement to be reached on time among the Member States in the Council.

That also explains the concessions to the Council. The concession, for example, that the Agency will not be able to initiate work on police and judicial cooperation on criminal matters on its own initiative. It has to be asked by the Parliament, by the Commission or by the Council. That was something I did not like to give in to, but I gave in for the sake of unanimity in Council, in order to get this unanimity. Now, in spite of this, one Member State has failed to take the necessary steps which would have ensured that the Multiannual Framework is adopted in time, and as a result the Agency and its staff will be in caretaker mode from January.

Now, we have again here an example of how the requirement of unanimity is blocking the work in the Union, so I regret this very much and I hope that the problem can be solved, but it is very unfortunate.

  Lívia Járóka, rapporteur for the opinion of the Committee on Women’s Rights and Gender Equality. − Mr President, the ability of disadvantaged groups to exercise their full range of fundamental rights is the litmus test of our Union’s founding principles. Direct or indirect exclusion based on affiliation with two or more vulnerable groups is especially hard to remedy, and it therefore deserves a targeted approach and tailor-made programmes. This is the case with elderly women below the poverty line, female and under-age victims of crime, and minority women, in particular Roma women. Therefore, I think it is extremely important that all the proposals on the table today take account of the social stigma and devote a whole section to the social exclusion of the poorest.

I think that, instead of looking at the ideological and political games that are going on around this report, we must look at the Member States and what their actions are. Therefore, the measures presented in their integration plans are the most important. This is our objective with this report and with all the proposals on the table. I think it is extremely important that the Commission plays a very important role in the next half year in looking at strategies to integrate the poorest 40 million, half of whom are women.

  Kinga Gál, a PPE képviselőcsoport nevében. – Tisztelt elnök úr, alelnök asszony, kedves képviselőtársaim! Mindenekelőtt engedjék meg, hogy őszinte elismeréssel adózzak Beňová asszonynak és tanácsadóinak, akik nagyon sokat dolgoztak ezen a jelentésen, és minden tőlük telhetőt megtettek, hogy azt sikerre vigyék.

A szöveg nagyon helyesen kitér számos olyan fontos kérdéskörre, ahol az Európai Uniónak és a tagállamoknak van teendőjük a jobb védelem érdekében. Személy szerint én külön örülök annak, hogy a nemzeti kisebbségeket érintő problémák és az arra adandó válaszok kellő hangsúlyt kaptak a szövegben ugyanúgy, mint a gyermekek jogai is. A közös egyeztetések eredményeként a Néppárt számára számos elfogadhatatlan elem kikerült ugyan a szövegből, mégis maradt sok olyan megfogalmazás, elvárás, amely szembemegy a Néppárt által képviselt értékekkel, és érint olyan területeket, amelyek kifejezetten tagállami hatáskörbe tartoznak a szubszidiaritás elvének alapján. Ezen kérdések az egyes országok hagyományait, értékeit, alkotmányos berendezkedéseit feszegetik, amelyek tiszteletben tartása az egymás iránti tiszteletből, mint alapvető emberi jogból kellene fakadjon. Hangsúlyozni szeretném, hogy ez nem jelenti azt, hogy vannak különböző, kétféle alapvető jogok az Unióban, azok ugyanazok a jogok, amelyek érvényesüléséért egyaránt küzdünk mi néppártiak, de nagyon sok esetben az alapvető jogok védelmét nem tartjuk szerencsésnek eszközként használni, politikai küzdelmet rejteni mögéje. Mivel a Néppárt mindig is kiállt az alapvető jogok védelme mellett, értékei az Unió alapértékei is egyben, amelyekhez ragaszkodik. Elhivatottságának kifejezésére ezúttal nem látott más lehetőséget, mint egy alternatív határozattervezet beterjesztését, amely igyekezett kitérni minden lényeges kérdéskörre az alapvető jogok védelme területén.

  Judith Sargentini (Verts/ALE), blue-card question. – Ms Gál, I hear you say that you are complimenting the rapporteur on an excellent report – you actually pick out a topic, minority rights – and then you go on to say that fundamental rights should not be a political debate, therefore the EPP will put forward an alternative resolution.

Could you please explain to the European citizens and this House why putting forward an alternative resolution dismissing the excellent report by the rapporteur is not a political game with fundamental rights?

  Kinga Gál (PPE), blue-card answer. – I praised Ms Flašíková Beňová because I know how much she worked on this report, but that does not mean that it is not full of issues which go against the values which the EPP Group shares.

Therefore, the EPP Group will not be able to support this report, but it does support fundamental rights issues. Accordingly, the EPP Group presented an alternative report which addresses all those issues of fundamental rights which are relevant and important issues nowadays in the European Union.

  Sylvie Guillaume, au nom du groupe S&D. – Monsieur le Président, Madame la Commissaire Reding, mes chers collègues, je tiens, moi aussi, à féliciter chaleureusement ma collègue, Monika Flašíková Beňová, mais je n'en tire pas du tout les mêmes conséquences que Mme Gál.

En effet, Mme Beňová n'a pas ménagé sa peine ces dernières semaines pour faire de ce rapport sur les droits fondamentaux dans l'Union européenne un condensé courageux sur les faiblesses dont souffrent encore nos systèmes démocratiques en Europe.

C'est en présentant objectivement ces défaillances qui peuvent être repérées dans nos États que nous serons le mieux à même de contribuer tous ensemble, États membres et institutions européennes confondus, à une amélioration des droits fondamentaux des citoyens européens.

Qu'il s'agisse des droits des minorités, de l'égalité des chances, des droits des migrants, de la protection des données, ou bien encore de l'accès à la justice, nous avons le devoir de nous mobiliser pour faire en sorte que ces droits ne se réduisent pas à de simples vœux pieux.

Alors que la crise économique frappe encore plus durement les plus vulnérables et que la pauvreté menace chaque jour plus de personnes, la question du respect des droits économiques et sociaux revêt aujourd'hui encore davantage d'acuité. Et la montée inquiétante de l'extrémisme nous invite également à procéder à cet examen objectif comme autant de symptômes du mal qui ronge aujourd'hui nos démocraties, qui peinent à répondre aux souffrances que subissent nos concitoyens.

Je dois dire que je regrette la manœuvre du PPE, qui vise à présenter une résolution alternative. Celle-ci vide de sa substance ce rapport en passant sous silence un grand nombre de faits et de recommandations que nous avons pourtant la responsabilité, en tant que parlementaires européens, de porter haut et fort par respect pour les citoyens européens qui nous ont élus. Il s'agit d'un procédé inapproprié alors même que nous parlons ici des droits fondamentaux.

J'en appelle donc à l'engagement de nos collègues pour que demain nous puissions effectivement être fiers du prix Nobel de la paix qui nous a été remis en ce début de semaine à Oslo, sans quoi ce succès n'aurait été que d'un goût très amer.

  Renate Weber, on behalf of the ALDE Group. – Mr President, I want first of all to thank the rapporteur for her very good work and for the report she drafted in strong cooperation with us. She has taken on board the suggestions and requests of all the shadows, including the EPP, which is why the EPP decision to vote against it without any prior notice was equally unexpected and unfair. This is most unfortunate as it sends a negative message to our citizens in relation to this Parliament’s position on fundamental rights, putting at risk the adoption of this report, while the EPP alternative resolution is completely empty. I cannot but hope that the EPP, as a Group, will not fall into the trap organised by some of its Members to cover up what their national parties are doing back home.

The ALDE Group fully supports the report, as it consolidates this House’s continuing concerns in relation to the situation of fundamental rights, democracy and the rule of law in the EU and in its Member States. We all know that the European Union is experiencing not only an economic crisis but also a deeper crisis in terms of our basic principles and values. This is why we have to use to the maximum all the potential instruments that our treaties give us and reflect on strengthening these powers in the future.

The EU institutions should make full use of Articles 2 and 7 of the Treaty on European Union and address the Copenhagen dilemma by developing a clear set of indicators, monitoring and sanctioning mechanisms, including an early warning and freezing mechanism that the EPP has suggested in the past.

Among other things, this report also addresses the rights of specific groups such as Roma minorities, LGBT persons, people with disabilities, migrants and refugees, which is one more reason to hope that, in the same week when the EU received the Nobel Peace Prize and the world celebrates Human Rights Day, the European Parliament will vote in favour of a report on fundamental rights at home.

  Tatjana Ždanoka, on behalf of the Verts/ALE Group. – Mr President, I too would like to congratulate Monika Flašíková Beňová and to show my appreciation of her great efforts in producing a report consolidating – and I stress consolidating – Parliament’s positions on fundamental rights, democracy and the rule of law within the EU. Our Group fully supports the text of the report as it has been submitted to the plenary vote following the vote in the Committee on Civil Liberties, Justice and Home Affairs.

Nevertheless we hope that, in future, reports about the violation of fundamental rights in the EU – in 2012 as well as in future years – will not avoid mentioning specific Member States. For our Group it is extremely important that the report calls on the Commission and the Council to return, in addition to the thematic approach, to the country-specific approach, and to draw up annual reports analysing the situation of fundamental rights in the Member States.

The current situation is that a country-specific approach is used when speaking of human rights outside the EU, while avoiding mentioning specific Member States within the EU. This double approach is unacceptable if we really want the European Union to be one of the most advanced areas in the world in terms of the observation of fundamental rights.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Monsieur le Président, je voudrais à mon tour remercier Mme Flašíková Beňová pour sa patience et sa ténacité à chercher un accord en respectant la position de l'ensemble des groupes. Visiblement, nous n'y sommes pas arrivés. Pourtant, dans la période actuelle, il serait essentiel que le Parlement européen soit à la hauteur de sa réputation.

De nombreuses voix s'émeuvent des évolutions en matière de droits de l'homme dans l'Union européenne. Je ne prendrai qu'un indicateur significatif: le nombre de condamnations des États membres par la Cour européenne des droits de l'homme. Au-delà des discours, les tendances sont inquiétantes. Au nom de la lutte contre le terrorisme et, désormais, de la grande criminalité, un nombre croissant de libertés publiques et de droits fondamentaux sont bafoués comme si les droits de l'homme étaient désormais secondaires par rapport à la nécessaire sécurité.

Les migrants et les minorités voient aussi leurs droits bafoués quand ils ne sont pas jetés à la vindicte populaire, boucs émissaires faciles des échecs des politiques économiques et sociales.

Tout se passe comme si un nombre croissant d'hommes, de femmes et d'enfants, qui vivent sur le territoire de l'Union, n'avaient pas les mêmes droits que d'autres. Au lieu de réagir, nombre de gouvernements, d'hommes et de femmes politiques emboîtent le pas aux discours de haine. Les paroles xénophobes fleurissent et ce au plus haut niveau politique. Le rapport dénonce ces dérives et fait des propositions. Je m'en félicite. Non, les droits de l'homme ne doivent pas être instrumentalisés, ils sont universels en Europe comme ailleurs.

Nous le voyons chaque jour. Les États membres ne sont pas les mieux placés pour les défendre. Moi aussi, je regrette sincèrement l'attitude du groupe du PPE qui est une rupture par rapport aux précédents rapports qui étaient pourtant signés par Mme Gál.

  Gerard Batten, on behalf of the EFD Group. – Mr President, England had fundamental rights under the common law for centuries before the concept was dreamed of by the European Union, and we do not need the European Convention on Human Rights to bestow them on us. Those ancient rights and liberties are now being destroyed by the creation of an EU system of criminal law, for example under the infamous European Arrest Warrant.

What have your fundamental rights given us in return? Suspects against whom no evidence has been presented to a British court can be extradited and imprisoned for months or years without trial. Meanwhile, we have been prevented from extraditing non-British suspect terrorists and criminals to their own countries outside the European Union because of legal judgments made under the Convention. Those of you who lived under Communist dictatorships prior to your joining the European Union might think that this is an improvement. The English do not.

  Ewald Stadler (NI). - Herr Präsident! Zunächst möchte ich Frau Kollegin Gál danken, dass sie angekündigt hat, dass die EVP einen alternativen Berichtsvorschlag vorlegen wird. Ich bin schon sehr gespannt darauf und bin im Übrigen auch froh. Vielleicht ist es mir möglich, diesem Bericht zuzustimmen.

Frau Kollegin Gál hat völlig Recht: Die Grundrechtsdebatte wird natürlich dazu missbraucht, ideologische Auseinandersetzungen zu führen. Man sollte Frau Kollegin Gál nicht vorhalten, dass die Grundrechte nicht politisch diskutiert werden können. Darum geht es ja gar nicht! Es geht um die ideologische Auseinandersetzung und den Missbrauch der Grundrechte für ideologische Grabenkämpfe.

Ich will Ihnen ein paar Bruchlinien dieses Grabenkampfes zeigen: Es gibt ein Grundrecht auf Religions- und Gewissensfreiheit. Nahezu sämtliche Vorschläge – ein erheblicher Teil davon, ich möchte korrekt sein –, die in diesem Bericht gemacht werden, sind für einen Katholiken inakzeptabel! Wenn ich etwa den ganzen Bereich der reproduktiven Gesundheit anschaue, der sexuellen Ausrichtung, der Geschlechtsidentität – das ist für einen Katholiken inakzeptabel! Das Grundrecht auf Leben, das fundamentalste Grundrecht, findet in diesem Bericht nicht einmal Erwähnung! Wenn Sie Millionen von ungeborenen Unionsbürgern das Grundrecht auf Leben nehmen wollen, welche Grundrechtsdebatte führen Sie dann?

  Carlos Coelho (PPE). - Senhor Presidente, os direitos humanos e as liberdades fundamentais são um conjunto de valores e de princípios que nos distinguem enquanto seres humanos, são universais, indivisíveis e interdependentes.

A promoção destes direitos deve constituir um objetivo global de todas as políticas da União Europeia. Temos o direito de exigir que os outros respeitem estes direitos e temos o dever de dar o exemplo. Por isso, este Parlamento aprecia dois relatórios. Um que analisa o respeito pelos direitos humanos no resto do mundo, e este, em que analisamos o que se passa no território da União Europeia.

No âmbito da estratégia para a aplicação efetiva da Carta dos Direitos Fundamentais, como já foi referido pela Vice-Presidente Reding, foram apresentados já dois relatórios avaliando os progressos realizados na sua aplicação. Registaram-se progressos significativos, mas ainda há muito a fazer para reduzir o fosso existente entre os direitos fundamentais e a sua implementação, o que não só põe em causa a promoção e o respetivo efeito desses direitos mas também prejudica a credibilidade da União Europeia.

É igualmente importante que se melhore a informação para que os cidadãos saibam quando se aplica a Carta e reconheçam os recursos de que dispõem em caso de violação.

Apoio a proposta apresentada pela Comissão no sentido de se criar um painel de avaliação permanente sobre a justiça, o Estado de direito, a democracia e os direitos fundamentais.

Aplaudo grande parte das recomendações que constam do relatório Beňová. Sublinho, porém, que valorizar este património comum deve exigir de nós todos que nos concentremos no que é comum e que não se desrespeite o princípio da subsidiariedade. Há matérias no relatório que dependem exclusivamente da legítima vontade soberana de cada Estado-Membro. Não devemos utilizar os direitos humanos para agendas políticas partidárias ou para sobrevalorizar eventuais diferenças. Fazê-lo só degrada o valor mais alto que todos deveríamos querer defender.

  Claude Moraes (S&D). - Mr President, in her speech the rapporteur mentioned the report for human rights in the world. The vote on that parallel report will take place on Thursday morning, and it is exactly because this Parliament deigns to talk about human rights in the world and give out the Sakharov Prize that, when we discuss the annual report on our fundamental rights, we should have a unified position, as we have had in the past. It is with regret that we have an alternative motion for resolution, because I have to say, as coordinator, that I regret that we do not have that unified position.

I want to say on record that we did everything that we could to facilitate that position. I believe we did nothing to cause a situation whereby we would not have just one vote on our fundamental rights. Why did we want to do that? Because this is the first report since the Lisbon Treaty and it is on very valuable issues which the Commissioner and other speakers have mentioned: the European Parliament’s commitment to the EU accession to the European Charter of Human Rights; the data protection standards aimed at protecting domestic processing of data; the clear sets of indicators; early warnings; and so on and so forth. We have a whole range of issues which are extremely important to this Parliament, and we do not want an un-unified position on many of these points. LGBT rights, gender equality, access to justice, the vulnerable at a time of austerity – people are looking to us not to be divided when we talk about other countries and other states.

I noticed that in many of the speeches in this House, time after time people have talked about the quality of the report. I have to say again, as coordinator for the Member who has been rapporteur for this report – and listening to the Commissioner talking about the fundamental rights conference last week, the Victims’ Rights Package and procedural rights – that, although we are in the midst now of a debate about opt-outs and so on, we are talking about real issues which are helping real people, and in this annual report we are simply checking whether we are doing the right things for real people. This is not a theoretical exercise. In my own Member State, the Victims’ Rights Package was welcomed, but it has to be known to more people.

What is happening today is very valuable, and I think we should be unified in communicating this to people and not be divided. I want to put on record that we tried not to be divided and to project something very profound and something of very high quality. I congratulate the rapporteur on what she has done, and I hope we will gain a majority tomorrow for all the right reasons.

  Judith Sargentini (Verts/ALE). - Voorzitter, commissaris, ik zie een interessant samenspel tussen u en uw collega Rehn en voorzitter Van Rompuy. U stelde in september een "justice scoreboard" voor, een jaarlijkse beoordeling van de rechtsstelsels van alle lidstaten in de context van het Europees Semester. Commissaris Rehn nam het stokje over en legde vorige maand in zijn jaarlijkse groeianalyse meer nadruk op de kwaliteit en de onafhankelijkheid van nationale rechtsstelsels.

De landenspecifieke aanbevelingen die daaruit voortvloeien, krijgen een wat meer bindend karakter in de plannen van Van Rompuy, de derde man in uw driemanschap. Hij wil dat de Commissie en de lidstaten de aanbevelingen omzetten in hervormingscontracten met financiële prikkels. Het is wellicht een wat moeizame constructie, maar het contractueel vastleggen dat de manco's in de rechtsbescherming worden aangepakt, zou volgens mij een flinke stap vooruit kunnen zijn in het toezicht op onze grondrechten.

Mag ik u daarvoor complimenteren? Maar mag ik u dan ook vragen om daarbij niet alleen justitie te bekijken, maar ook democratie en mediavrijheid en het hele pakket? Graag uw antwoord.

  Jaroslav Paška (EFD). - Návrh uznesenia o situácii v oblasti základných práv v Európskej únii za roky 2010 až 2011, predložený na rokovanie Výboru pre občianske slobody, spravodlivosť a vnútorné veci, obsahuje širokú škálu návrhov a odporúčaní tak pre Komisiu, Radu, ako aj pre členské štáty. Popri všeobecných odporúčaniach sa pani poslankyňa Monika Flašíková-Beňová vo svojej správe zamerala aj na odporúčania orientované na odstránenie diskriminácie z našej spoločnosti, ochranu jednotlivcov patriacich k menšinovým skupinám, prístup k rovnakým príležitostiam bez ohľadu na vek, pohlavie či zdravotné postihnutie, problémy migrantov a utečencov, ochranu práv detí či obetí trestných činov s dôrazom na zlepšenie prístupu k spravodlivosti, ako aj na všeobecné postavenie občanov v Únii a narábanie inštitúcie s ich údajmi.

Možno práve rozsiahlosť a podrobnosť navrhovaného uznesenia vytvára v nadväznosti na rozdielne kultúrne a civilizačné tradície európskych národov istý priestor pre polemiku nad niektorými formuláciami. Aj keď sa predložená správa v plnej miere opiera o platnú európsku legislatívu v oblasti základných práv, každý z nás sa bude môcť na záver sám rozhodnúť, do akej miery sa s navrhnutým textom celého uznesenia stotožní.

  Anna Záborská (PPE). - Mám zásadné pripomienky k správe pani Flašíkovej-Beňovej. Pani Flašíková-Beňová spochybňuje nezávislosť súdnej moci, snaží sa zasahovať do kompetencií národných štátov a zavádza práva, ktoré nemožno ani pri najlepšej vôli považovať za základné. Aplikovanie ľudských práv je v kompetencii súdov. Tzv. priebežné hodnotenie súdnictva by viedlo k známkovaniu súdnych rozhodnutí neziskovými organizáciami a inými inštitúciami. Pýtam sa, na základe čoho? Jedine na základe vlastnej interpretácie práva.

Spravodajkyňa je hrdá na to, že v jej správe sa prvýkrát uvádzajú témy reprodukčného zdravia, sexuálnej výchovy, plánovaného rodičovstva a uplatňovanie legislatívy legálnych interrupcií. No tieto témy sú vo výlučnej kompetencii členských štátov. Do agendy základných práv Európskej únie nepatria, rovnako ani požiadavka zavedenia manželstva osôb rovnakého pohlavia. A právo na eutanáziu nie je ani základným, ani európskym, ani univerzálnym ľudským právom. Tu opakovane spomínaná Charta základných práv Európskej únie tieto práva neobsahuje. Naopak, môj návrh začleniť do správy aj odsek o chudobe ako prekážke pri využívaní základných práv pani spravodajkyňa odmietla.

Dovoľte mi ešte na záver jednu poznámku. V médiách pani spravodajkyňa neváhala označiť ľudí za bigotných a zaostalých len preto, že sú katolíci a nemajú rovnaké názory ako ona. Jej správa pritom žiada trestné stíhanie nenávistných prejavov. Ak to myslí vážne, mala by zmeniť slovník, inak sa sama vystavuje riziku trestného stíhania.

  Monika Flašíková Beňová, spravodajkyňa, question "carton bleu". − Chcela by som sa pani poslankyne Záborskej spýtať, keby mohla odcitovať konkrétny pozmeňujúci a doplňujúci návrh alebo časť správy, ktorá hovorí o povinnosti pre členské štáty zavádzať legislatívu pre manželstvá príslušníkov LGBT. Keby mohla konkrétne zacitovať, kde sa to v správe uvádza.

  Anna Záborská (PPE), odpoveď na otázku položenú zdvihnutím modrej karty. – Ja si myslím, že keby zo správy vyplývala povinnosť, to by už bolo prekročenie akýchkoľvek hraníc. Správa by sa toho nemala dotýkať ani v rovine odporúčaní, hlavne správa, ktorá je hodnotiaca, pretože to skutočne spadá do kompetencie členských štátov.

  Anna Hedh (S&D). - Herr talman! Årets betänkande om de grundläggande rättigheterna har blivit mer omdiskuterat än tidigare år. Med tanke på hur den ekonomiska krisen har drabbat Europa samt de brott som sker mot grundläggande rättigheter är läget allvarligare än på länge. Trots ett hårt arbete av föredraganden och en genuin vilja från andra politiska grupper att ta fram ett gemensamt betänkande, har PPE valt att lägga fram ett alternativ som är en totalt urvattnad text, som absolut inte lever upp till de mål som EU står för. Det är kusligt hur vår syn på vad grundläggande rättigheter är skiljer sig här i Europaparlamentet!

Det finns många anledningar till varför man ska rösta för det breda gemensamma betänkandet. Det främsta skälet är att diskriminering av hbt-personer, övergrepp mot flyktingar och förföljelser av romer inte kommer att sluta förrän vi öppet vågar erkänna att dessa saker sker i EU i dag och vidtar politiska åtgärder för att stoppa dem. Europaparlamentet har en unik möjlighet att göra just detta i det här betänkandet.

En annan viktig sak som PPE:s betänkande inte tar upp är rätten till sexuell och reproduktiv hälsa för alla Europas kvinnor. Efter Savita Halappanavars skamfulla och tragiska död på Irland är det hög tid att vi som europaparlamentariker återigen betonar att kvinnors rätt till sin egen kropp i allra högsta grad är en grundläggande rättighet.

I går tog EU emot Nobels fredspris, men nu verkar det som om Europaparlamentet inte klarar av att anta ett gemensamt betänkande som lever upp till de grundläggande rättigheterna i Europa. Det är skamligt!

  Edit Bauer (PPE). - Elnök úr, biztos asszony! Úgy gondolom, hogy Beňová asszonyt elismerés illeti azért a munkáért, amit ebbe a jelentésbe fektetett, és ez így van akkor is, ha nagyon sok minden dologgal nem értünk egyet, amit a jelentés tartalmaz.

Az alapvető jogok helyzetéről az Unión belül nem gyakran beszélünk, ha mégis, gyakran az fordul elő, hogy nem az Alapjogi Chartáról és annak gyakorlati alkalmazásáról, hanem különböző politikai megfontolásból kerülnek elő az alapjogok megsértésének különböző valós vagy vélt esetei. A mostani jelentés jó alkalom áttekinteni az Unión belüli helyzetet, és valljuk be, a sok pozitív lépésen kívül van az Unión belül is probléma bőven. Például, hogy csak egyet említsek, az őshonos kisebbségek jogállását tekintve szükség lenne előrelépésre, mert hisz kettős mérce létezik a csatlakozó és a tagállamokkal szembeni elvárások tekintetében. Ahogy a roma kérdésben sikerült egy európai stratégiát elfogadni, úgy a hagyományos kisebbségek jogállásáról is szükség lenne egy normarendszer, hisz néhány tagállam gyakran hivatkozik nem létező európai standardokra. A megoldandó problémák szőnyeg alá söprése nem jó stratégia, hisz a feszültségek így nem csökkennek. Európa-szerte vannak jó és rossz példák, és elfogadhatatlan, hogy aktuálpolitikai problémák miatt ne igyekezzünk a valós problémákra megfelelő megoldást keresni. Kár, hogy a mostani jelentés is részben az aktuálpolitika túsza lett, kár, hogy nem szól egy sor alapvető jogról, melyek nem problémamentesek, mint például a szabad mozgáshoz való jog, a tulajdonhoz való jog, vagy a hatékony jogorvoslathoz való jog.

Úgy gondolom, hogy a Nobel-békedíj birtokában az alapvető jogok betartását tekinthetjük akár minimumnak is, amely nélkül az Európai Unió nem tud eleget tenni küldetésének.

  Josef Weidenholzer (S&D). - Herr Präsident! Die Europäische Union hat dieser Tage den Friedensnobelpreis erhalten, vor allem auch deswegen, weil es hier nach der großen Katastrophe des Faschismus gelungen ist, nicht in die alten Fehler der Vergangenheit zurückzufallen. Das Bekenntnis zur uneingeschränkten Gültigkeit der Menschenrechte war eine wichtige Konsequenz. Die Grundrechtecharta ist ein wichtiges Fundament der Europäischen Union. Immer wieder zu überprüfen, ob die proklamierten Rechte auch einem Realitätscheck standhalten, ist von großer Bedeutung.

Die Berichterstatterin zeigt auf, dass die Grundrechte keineswegs in allen Bereichen und in allen Mitgliedstaaten eingehalten werden. Menschen werden nach wie vor wegen ihrer Herkunft, ihres Geschlechts, ihrer Religion, ihrer sexuellen Orientierung oder ihrer körperlichen oder geistigen Beeinträchtigung diskriminiert. Immer noch haben Menschen auf der Basis solcher Diskriminierung keinen adäquaten Zugang zu Bildung und Sozialsystemen. Die Freiheit des Individuums ist nach wie vor Einschränkungen ausgesetzt und die persönlichen Daten der Bürgerinnen und Bürger sind keineswegs optimal geschützt. Einzelne ethnische Gruppen, insbesondere die Roma, werden immer häufiger Opfer von Bedrohung und Gewalttaten. All diese Fakten werden von der Berichterstatterin sehr klar und sehr ausgewogen aufgezeigt.

Ich ersuche Sie daher, diese Frage zu keiner Parteifrage zu machen, Polemiken zurückzustellen und über die Fraktionsgrenzen hinweg diesem Bericht zuzustimmen!

  Hubert Pirker (PPE). - Herr Präsident, Frau Kommissarin! Ich bedaure es sehr, dass diese sogenannte Menschenrechtsdebatte nicht dazu genutzt wird, um tatsächlich Überprüfungen vorzunehmen, ebenso wenig wie der Bericht darüber, wo Menschenrechte eingehalten bzw. wo sie nicht eingehalten werden. Sondern es passiert dasselbe wie alle Jahre: Dieser Bericht, diese Debatte werden dazu instrumentalisiert, eine ideologiebelastete Debatte zu führen, eine gesellschaftspolitische Debatte zu führen und den Versuch zu machen, in subsidiäre Rechte der Mitgliedstaaten einzugreifen.

In dem Bericht werden zum Beispiel diskutiert die güterrechtlichen Auswirkungen von eingetragenen homosexuellen Partnerschaften – eindeutig eine subsidiäre Angelegenheit, die Finanzierung der Familienplanung – eindeutig eine subsidiäre Angelegenheit, oder Sie üben im Zusammenhang mit der Diskussion über reproduktive Rechte Kritik an einigen besonderen Mitgliedstaaten, und Sie diskutieren das Wahlrecht von Nichtunionsbürgern – ebenso eine subsidiäre Angelegenheit.

Das sind die Gründe, warum die Europäische Volkspartei hier einen eigenen Entschließungsantrag eingebracht hat, denn wir wollen tatsächlich die Menschenrechte diskutieren und nicht eine rein ideologische, gesellschaftspolitische Debatte führen. Ich lade daher alle ein, den Entschließungsantrag von Kinga Gál, den Entschließungsantrag der Europäischen Volkspartei, im Interesse der Diskussion der Menschenrechte zu unterstützen.

  Salvatore Iacolino (PPE). - Signor Presidente, onorevoli colleghi, un'Europa forte e caratterizzata da un'eccezionale tensione emotiva nei confronti dei diritti fondamentali della persona. Essi sono la misura del grado di civiltà dei popoli e devono essere riconosciuti, accettati e, laddove occorra, protetti. Il popolo europeo deve esprimere il suo consenso sul grado e l'intensità dei diritti fondamentali nella loro tutela, che è fondamentale e che è così il valore più profondo dell'Europa libera, dignitosa e protagonista, con una giustizia più veloce e più efficace, quindi concreta.

Concordiamo quindi con un quadro ordinato che valorizzi la libertà e i diritti fondamentali contro le violenze, in particolare quelle di genere e nei confronti dei minori. Tuttavia, siamo per la famiglia tradizionale, pur riconoscendo la libertà di orientamento sessuale e tenuto conto evidentemente del principio di sussidiarietà. Tuteliamo i giovani, i disabili e gli anziani, confidando in un rinnovato slancio della Commissione anche sull'offerta formativa per consentire un più ampio accesso al mercato del lavoro, visto che il lavoro rimane oggi più che mai un diritto fondamentale.

Esistono tuttavia nella relazione in esame questioni sensibili che attengono alla connotazione tradizionale della famiglia e per esempio al consumo delle droghe, sul quale si prevede un approccio orientato sul piano ideologico, ovvero, nel caso della riduzione del danno, ha avuto riguardo a una caratteristica che noi non condividiamo, pensando invece alla prevenzione e alla riabilitazione del contrasto alla droga. Rimangono quindi una serie di perplessità che riteniamo avrebbero dovuto essere affrontate in un altro contesto e non in quello che riguarda i diritti fondamentali e la loro effettiva applicazione e tutela.

  Sergio Gaetano Cofferati (S&D). - Signor Presidente, onorevoli colleghi, il lavoro della collega Flašíková Beňová è un ottimo lavoro. Tuttavia, domani ci troveremo in una situazione paradossale: all'inizio della seduta ci sarà un'occasione solenne di celebrazione della consegna del Premio Nobel all'Unione europea e qualche ora dopo ci divideremo sul tema dei diritti che sono oggettivamente alla base di quel riconoscimento. Allora è proprio vero che siamo stati premiati per il nostro passato e non per il nostro presente.

Io credo che i diritti, come il Commissario sa benissimo, vengano messi sotto tensione tutte le volte che ci sono processi di trasformazione o grandi crisi, e noi siamo in questa condizione. Allora andrebbero valorizzati e considerati come un elemento identitario di un'intera comunità. Sarei molto contento se ad esempio si istituisse la città europea dei diritti, così come c'è la città europea della cultura. Diritti e valori, da un lato, e cultura dall'altro sono da sempre gli elementi fondamentali dell'identità delle comunità. Spero si arrivi presto anche a questo punto.

  Viviane Reding, Vice-President of the Commission. − Mr President, I would like to say to Mr Cofferati that there is a city of human rights. Graz considers itself to have become the city of human rights out of the European City of Culture. It is very interesting to see how they have developed their institutions from being the European City of Culture into the European City of Human Rights. It is not an official title, but it is a title which they care about and one which they are developing in their policy in the city. It is very interesting to look at that and to take from it good ideas about how human rights can function at a local level. I just wanted to say this as a reaction to the proposal which the honourable Member made.

The debate – and I do not want to enter into a party-political discussion – made it very obvious that there is a kind of frustration with the way the Charter is applied. It is not applied horizontally and not to everything, and it is not applicable in situations which have no link with EU law. That can be very frustrating, and I agree with those who have underlined their frustrations. But the Charter does not replace national constitutions and national systems of fundamental rights, it complements them. I believe we have at our disposal a wonderful instrument, and we have to try – even if it cannot always be applied perfectly – to apply it as much as we can and to extend its scope of application. I believe this is vital for the credibility of the legally-binding charter and for the rule of law in the European legal order.

We also have the Convention on Human Rights, which is not a European Union instrument but an instrument of the Council of Europe. As you know, the Treaty foresees the European Union becoming a party to the Convention on Human Rights. It is important that we make rapid progress towards a speedy accession. We have made it on a technical level, and it has resulted in the elaboration of a draft accession agreement. There has been very intensive work done on this. The amendments which have been brought forward are limited and do not jeopardise the overall architecture and balance of the draft accession agreement. I am convinced that, with political will and determination, it will be possible to solve the outstanding issues rapidly. I make an appeal to all Member States to help us to go in this direction, because this will be an important complement to the Charter of Fundamental Rights.

To all those who are not satisfied with the limited scope of application of the Charter, I would say that we should be patient and go step by step. Look at the United States. It needed a hundred years and a very bloody civil war before the Bill of Rights was applied not only at federal level but also to individual states. This does not mean that we will need a civil war and a hundred years to get there, but we should also have the courage to go step by step and address future priorities. As I have already underlined, I believe that very slowly we are installing this culture of fundamental rights in all our institutions. It will come step by step – more quickly here, more slowly there – but we have always to control how it works.

I also know – because we have already had this debate in this Chamber – how frustrated many of you are that the only real strong instrument when something goes wrong is Article 7 of the Treaty of the European Union, which is the atomic bomb. Instead of going to the root of the problem in order to solve it, it is very difficult to do it in another way. In his State of the Union speech the President of the Commission addressed the threats to the legal and democratic fabric in some of our European states in recent months and expressed his worries. At the same time he also underlined the limits of our institutional arrangements.

Believe me, I would also prefer, instead of having only soft power or the nuclear option, to have something in between. Those who have underlined the Copenhagen deal dilemma are absolutely right, because we do have instruments before a state becomes a member of the Union, but once a state is a member of the Union, we no longer have these instruments.

This is why I have taken the first step in developing such an instrument. This is the justice scoreboard, which is one of the tools better to help address the Copenhagen dilemma but, Mrs Sargentini, it is only the first step. You should be very happy that I managed to put that in the system. As a first step, it will be linked to economic and social development – for civil law application – but I hope that later we will take a second and a third step and that it will become a justice scoreboard for all the applications of our justice systems. This is one of the ways in which I am trying to take a step-by-step approach in order to create, with everybody’s agreement, an instrument which might help us cope with the deficiencies of the institutional possibilities of applying the Charter to its full extent.

I would like to thank all those Members of Parliament who, for many years – for some I would say decades – have been working and fighting in order to make fundamental rights a reality, and a reality – as has been said – not only in a text but for human beings, for our citizens. So let us unite our forces and go in this direction, because I think it is an important direction.

Unfortunately – and I say this very clearly to Mr Moraes – we take a lot of very important new initiatives in this House, but until citizens understand that we have done that, we need a lot of time and a lot of energy. I hope that in the European Year of Citizens – the year in which we should go out in order to explain to our citizens, also about our instruments and our initiatives – that this will be of help. I hope we will all go out in order to explain what Europe is about. It is about the rights of the individual. I do not think that we should act as though this Europe was a space without rights. Fortunately this is not the case. It is not perfect, but it is perfectible.

  Monika Flašíková Beňová, spravodajkyňa. − Ak by som mala byť úprimná, po tejto diskusii by som musela, možno s výnimkou dvoch kolegov, povedať, že cítim veľkú podporu v pléne Európskeho parlamentu, pretože zo strany PPE tu zaznelo, že si vážia moju prácu a že moja správa je dobrá. A následne od členov PPE prišli výhrady k tomu, čo PPE požadovala zmeniť v mojej správe. A budem hovoriť o konkrétnych príkladoch. Pán kolega Pirker hovorí o tom, že sme nemenovali žiaden konkrétny štát a nevyčítali žiadnemu konkrétnemu štátu, kde pochybil v dodržiavaní základných práv. Kinga Gál, predsa vaša požiadavka bola „no naming and shaming“, to znamená nemenovať a nekritizovať žiaden členský štát. Práve preto, že sme chceli rozsiahlu podporu v pléne Európskeho parlamentu pre túto veľmi dôležitú správu, vyhoveli sme vám. Boli tu ďalšie informácie zo strany pána Coelha, pani Bauer o veciach, s ktorými prípadne nesúhlasia. Nič z tohto ale na rokovaní tieňových spravodajcov nikdy neodznelo. V celom procese prijímania tejto správy som bola absolútne transparentná a chcem, aby to tu veľmi jasne odznelo v tomto pléne, že sme neurobili nič, na čom by sme sa neboli vopred dohodli. Následne – minulý týždeň v stredu – sa PPE rozhodla predložiť vlastnú alternatívnu rezolúciu. Takže nie socialisti a demokrati, nie ALDE, nie Verts/ALE, nie GUE, ale PPE a niektorí ich členovia sú tí, ktorí celú túto správu, žiaľbohu, zideologizovali. A ja si naozaj neviem predstaviť, kolegyne a kolegovia, že na druhý deň po tom, čo máme hlasovať o správe, o dodržiavaní základných práv v Európskej únii, kde PPE vopred predkladá vlastnú päťstranovú alternatívnu rezolúciu po tom, čo sme dva roky na tejto správe pracovali, máme hlasovať o dodržiavaní základných práv vo svete.

Aké právo má Európska únia kritizovať dodržiavanie základných práv vo svete v čase, keď nie sme schopní prijať rezolúciu o dodržiavaní základných práv v členských štátoch Európskej únie?

  Kinga Göncz (S&D), írásban. – Véletlen egybeesés, hogy az emberi jogok európai helyzetéről készült jelentést azon a héten fogadja el az Európai Parlament, amikor az elnöke - két másik uniós intézmény vezetőjével együtt - átvette Oslóban a Nobel-békedíjat. A Nobel-díj arra emlékeztet, hogy nem csökkenhet elkötelezettségünk a béke, a biztonság, a társadalmi összetartás, az emberi jogok garantálása iránt. Közös felelősségünk, hogy naponta megküzdjünk a munkavállalók, a nők, a gyermekek, a kisebbséghez tartozók, a fogyatékossággal élők, a hontalanok, a bevándorlók jogaiért... Ebben a jelentésben hangot adunk az aggodalmainknak, és megfogalmazzuk, hogy mit kell tennünk azért, hogy a jövőben is méltóak legyünk az elismerésre. A bűnbakképzés, a kirekesztés, a gyűlöletkeltés, a nacionalizmus, a nemzeti radikalizmus erősödésének idején Európában ki kell állnunk valamennyi embertársunk alapvető jogainak tiszteletben tartásáért. Hogyan várhatja el az EU a partnereitől a jogállam, a demokrácia, a szabadságjogok érvényesítését, ha maga nem mutat példát ebben? Sajnálattal vettem tudomásul, hogy néppárti kollégáink az utolsó pillanatban visszatáncoltak a közös megállapodástól. Ebben a parlamentben a törvényeket és az állásfoglalásokat alapos, olykor hosszadalmas egyeztetéseken öntjük formába, azzal a szándékkal, hogy azok a lehető legnagyobb támogatással szülessenek meg. Az EU-ban szerencsére kivételnek számít az a nemzeti törvényhozás, amely nem így működik. Ebben a parlamentben konszenzusra törekszünk. Mutassunk ebben is példát!”

  Lívia Járóka (PPE), in writing. – The ability of disadvantaged groups to exercise the full range of their fundamental rights is the litmus test of our Union's founding principles. Direct or indirect exclusion based on affiliation with two or more vulnerable groups is especially hard to remedy, and it deserves a targeted approach and tailor-made programmes. Such is the case with elderly women below the poverty line, female and underage victims of crime, and minority women – in particular Roma women, the majority of whom face deep poverty, joblessness and low education, sealing the vicious circle of deprivation with a multitude of severe social stigmas.

I would therefore like to welcome the fact that the report devotes a whole section to the social inclusion of Roma. We must call on Member States to implement the measures presented in their national Roma integration strategies and to allocate sufficient budgetary resources to realise the related objectives. I am looking forward to the Commission's upcoming evaluation of the first year of implementation of these action plans, in particular its assessment regarding the financial feasibility and sustainability of these strategies and the data regarding the progress achieved in each Member State.

  Alajos Mészáros (PPE), írásban. – Pozitívum lehetne, hogy jelentés született az alapvető jogok Európai Unión belüli helyzetéről. Egy jelentős hiánypótlásról van szó. Ha visszatekintünk az integráció történetére, ez egy lényeges előrelépés. Sajnálattal tapasztaltam a dokumentum olvasásakor, hogy nem miden politikai csoport és kolléga gondolkodik hasonlóan az alapjogok védelmét illetően. Ismét az uniós polgárokat megillető jogok vonalán kívánják máshogy értelmezni az alapvető jogokat, pedig azok mindenütt azonosak kell, hogy legyenek. A jelentés szövege olyan területeket is érint, amelyek tagállami hatáskörbe tartoznak, illetve szembe mennek a Néppárt által képviselt keresztény, konzervatív értékekkel. Pont ezért nem értek egyet a jelentés teljes szellemiségével és nem tudtam azt megszavazni. A néppárti frakció saját határozattervezete korrigálhatta volna az említett elemeket, de azt sajnos elutasította a parlament. Kiemelném viszont, hogy a jelentés nyelvi és etnikai kisebbségekhez tartozó személyek védelmét érintő pontjai, főként az ahhoz benyújtott módosító indítványok révén olyan elvárásokat fogalmaznak meg a tagállamok és az uniós intézmények felé, amelyek megvalósítása elvárható és megkövetelhető. Az uniós politikák nem tartalmaznak a kisebbségi jogokra vonatkozó normákat, pedig a kisebbségi jogok az alapvető emberi jogok szerves részét képezik. Ezt a deficitet az Európai Parlament elismeri és felhívja a Bizottságot a cselekvésre. Nem lehet elégszer hangoztatni a nemzeti kisebbségekhez tartozó személyek jogai tiszteletben tartásának fontosságát.

  Csaba Sándor Tabajdi (S&D), írásban. – Ahhoz, hogy az EU megőrizze hitelességét az állampolgárok szemében a közösségnek hatékonyan kell fellépnie a tagállamokban tapasztalható emberi jogi jogsértésekkel, a demokratikus értékek csorbításával szemben. Ezt várják el tőlünk az európai polgárok, ezt jelzik az egyes tagállamokban sajnos egyre erősebb antidemokratikus folyamatok, amelyeket az Európai Bizottság vezetői is elismertek. Az európai polgárok azt várják el tőlünk, hogy az EU alapját jelentő demokratikus alapjogok betartására kötelezzük a tagállamokat. Sajnálatos, hogy ennek szükségessége először éppen a hazámban, Magyarországon, az Orbán-kormány antidemokratikus lépései kapcsán merült fel. Amikor egy tagállamban egy kétharmaddal rendelkező kormány letarolja a médiát, megfosztja az állampolgárokat alapvető jogaiktól, visszamenőlegesen törvénykezik, röghöz köti a diákokat és korlátozza a választójogot, ahogyan Magyarországon, szükséges az európai fellépés. Igenis szükséges az európai szemeszterhez kapcsolt jogi eredménytábla. Igenis szükséges azon kezdeményezés elfogadása, amely felhívja az Európai Bizottságot, hogy készítsen éves jelentést az Alapvető Jogok Chartájában szereplő jogok és alapértékek helyzetéről. Amikor több tagállamban is, ahogyan Magyarországon, tobzódnak a neonáci elemek, akkor igenis európai eszközökkel kell hangsúlyosabbá tennünk a kisebbségek jogvédelmét. Amikor egy tagállamban az EU-csatlakozás után erősítik meg a kollektív bűnösség elvét, szükséges, hogy az EU tegyen a nemzeti kisebbségekhez tartozó személyek jogainak tisztelete, az Európa Tanács Regionális vagy Kisebbségi Nyelvek Európai Chartájának ratifikálása érdekében.
