  Linda McAvan, rapporteur. − Madam President, colleagues, the day has come, we are having this debate and we are going to vote at 12 o’clock. It has been a long slog to get here, with thousands of amendments, but I sincerely hope today that this Parliament will do the right thing.

Before going into details about the vote, maybe we should just pause for one minute and remember what this law is really about. The key aim is to stop young people from being recruited as the next generation of smokers. We know it is children, not adults, who start smoking, and despite the downward trend in the number of adults smoking across our countries, in the last few years the World Health Organisation reports worrying upward trends in a number of Member States amongst children. Maybe products such as these have something to do with it: nice pink lipstick products aimed at recruiting young girls as smokers, products called ‘Allure’ with flowers on them, chocolate filter papers. We have got to stop the tobacco companies using gimmicky products like these to recruit young people and we have to make sure that the warnings are highly visible on these packages. You can hardly see them on these tiny little packages.

For me, there are four key issues we are going to vote on today. The size of the warnings: in Canada, large pictorial warnings were brought in just over 10 years ago and the number of young smokers has halved to 12 %, with 29 % in the EU. So please, do not vote to reduce the size of warnings to 50 % – that is a key demand of the tobacco industry and in accepting it we would put ourselves behind a number of EU countries today. The Council has voted for 65 % because they do not want to go backwards on public health, and nor should we this morning.

As regards the position of the warnings: it does matter where the warnings are. The warnings should be at the top of the packet, visible at the point of display and not hidden at the bottom by the displays. If we put them at the bottom, the displays will all hide them. Please do not listen to those siren voices calling for you to move the warnings to the bottom.

On flavourings, the Commissioner said when he introduced this law to Parliament that tobacco should look like tobacco, smell like tobacco and taste like tobacco and I totally agree. Our own Scientific Committee on Health has said that menthol cigarettes act as a local anaesthetic to reduce coughing and actually allow smokers to inhale more deeply. It is a growing market in Europe. The American Food and Drugs Administration finds that tobacco companies are aware of the appeal of menthol cigarettes for younger novice smokers because they are easier to smoke. Let us get rid of the flavouring. Slim cigarettes targeting mainly young women: if you do not believe me, read what the tobacco companies themselves say about slim cigarettes. They are designed to be smaller, slimmer, less masculine, aimed at the female under-30 market.

Those to me are the four main things. And then there is the question of e-cigarettes. We have amendments here, some to have no regulation, and then amendments to have some form of regulation, and we are going to debate what kind of regulation. I hope we can have a sensible calm debate on this issue and not some of the misrepresentations we have seen in recent weeks.

Finally, time is running out in this Parliament. The Council has already agreed a common approach. The group leaders all asked Commissioner Borg to put this legislation on the table. In fact it was a condition of his hearing. He did that in December last year. It would, to me, be totally unacceptable if now this Parliament held up this legislation. How do we explain that to our voters? Colleagues, please support this legislation and please let us start negotiations.

  Vytenis Povilas Andriukaitis, President-in-Office of the Council. − Madam President, I am grateful for this opportunity to address the honourable Members on behalf of the Health Council.

Let me start by recalling the wider public interest in this proposal. Tobacco use is the largest single avoidable health threat in the European Union. Statistics demonstrate clearly that the vast majority of smokers – more than 90% – start to smoke before they are 25 years old, and 70% even before the age of 18 years. Half of these smokers – around 700 000 people per year – die prematurely. Can we imagine what these figures mean? They call for live-saving health measures; they call for our democratic responsibility. If we diminish life-saving health measures in the interests of the tobacco industry, what will Europeans think of our reputation?

My personal experience as a physician allows me to tell you how painful death from tobacco-related diseases is. Two of my brothers died from tobacco-related diseases and I still cannot forget their suffering and pain before they died. I am speaking now on behalf of millions of Europeans who have already died and cannot speak, as well as on behalf of those who have started to smoke but have not yet recognised that they are responsible for their own suffering and possible premature deaths.

Each early death as a result of tobacco is a personal tragedy and a scourge on our society, but there is also a very direct economic consequence. These premature deaths cost the European Union more than EUR 500 billion every year. Generations of our children are becoming dependent on tobacco, creating a range of health problems. This huge social cost could be avoided and future generations of our children be protected if we were ready to take the necessary actions at European level.

It is our collective responsibility to respond to this challenge now and to ensure that the public health interest prevails over the narrow interests of the tobacco industry. Growing Europe is impossible without better and modern public health. This is the principal objective of the proposal for the revision of this directive – something that both the European Parliament and the Council have regularly called for.

The proposal before us now provides for measures such as increasing the size of combined health warnings for smoking tobacco, the prohibition of tobacco products with particular flavours or with increased toxicity or addictiveness, and better tracking and tracing of tobacco products to combat illicit trade. We very much hope that these life-saving health measures will alert young people in particular to the dangers of smoking and will discourage them from adopting the habit.

I therefore very much welcome this proposal and I am grateful to Commissioner Borg for the way in which he has devoted himself to tackling the tobacco problem. The Council was able to agree on a general approach to the proposal in June under the Irish Presidency. The fact that it was able to do so very quickly shows its determination to take action at EU level.

The debate this morning and Parliament’s decision on a mandate to start negotiations with the Council represents another key step in moving this legislation forward. The Presidency is fully committed to entering into negotiations as soon as Parliament has adopted its amendments. Our objective is to reach a first reading agreement as soon as possible and I look forward to working with the rapporteur, Linda McAvan, to that end.

I am sure that the Council can count on your support and cooperation. This is an opportunity that we should not miss. We must shoulder our responsibility towards European citizens and help protect our children from smoking. We must ensure that active smokers and potential future smokers are not misled but are better informed about the negative consequences of smoking.

The European Union has a good track record in this area. We have been the driving force behind the adoption of the WHO Framework Convention on Tobacco Control. This convention has been signed and ratified by the EU and its Member States. It is a pity that the European Union has lost leadership in the prevention of tobacco smoking. I am convinced that the European Union, acting in the light of the WHO Framework Convention on Tobacco Control, especially Article 5(3) which recognises the fundamental and irreconcilable conflict of interests between the tobacco industry and public health policy-making, should lead the global campaign against smoking and set an example to the rest of the world.

The revision of this directive would send an important signal that Europe is ready to take the lead in tackling the problem of smoking which is such blight on our societies.

  Tonio Borg, Member of the Commission. − Madam President, will today be the moment of truth or the moment of decision? I hope it will be both.

Usually governments are criticised for being too conservative because they have the responsibility to govern, while parliamentarians are much more adventurous. So I hope that Parliament will live up to its trait of being adventurous on this Directive and, hopefully, give a mandate to the rapporteur so that negotiations can start with the Council.

May I start by thanking the rapporteur, Linda McAvan, and all the shadow rapporteurs across parties for their personal commitment. I can assure Mrs McAvan that her verve and enthusiasm were contagious, and her commitment remarkable.

During my hearing, I promised to launch the Directive by the end of January. In fact, the Commission launched it a month earlier than that. I took office on 28 November and by 19 December we had launched the Directive. By 21 June, with compromises which were sponsored by the Irish Presidency, the Council took a common approach on this Tobacco Directive. So I have kept my promise and the Council has kept its promise too. So I look forward to a good debate today. Certainly the time has come to take decisions and to deliver together on our commitment to strengthen European law on tobacco products.

Perhaps this will become a mantra, but the scope of the directive is that tobacco products should look like tobacco products and taste like tobacco products. This morning someone in my Cabinet bought this packet of cigarettes in this building. Now does this look like a tobacco product? It looks like perfume. This is from Parliament’s own building.

So this is what we are trying to do. We are not trying to ban tobacco. Everyone is free to smoke as much as they like but the tobacco product should at least look like tobacco and should taste like tobacco as well. This is why we are introducing the pictorial health warnings, prohibiting this attractive appearance and why we are also prohibiting the lure of characterising flavours.

The Commission’s aim is clear. We would like to reduce the number of smokers by 2 % over the next five years, that is to say reduce the number of smokers in the European Union by 2.4 million. This is in line, as the Presidency has said, with our obligations – and by our obligations under the WHO Convention I refer not only to governments, but also to lawmakers, including the institutions represented here. They are all bound by the WHO Convention – which was ratified by all the Member States and by the European Union as an institution – and which obliges us to reduce the number of smokers and the use of tobacco. The aim of the Convention, and I quote, is ‘to protect present and future generations from the devastating ... consequences of tobacco consumption (…)’ and to ‘reduce continually and substantially ... tobacco use’.

This is at least one of the aims of this Directive. Just in case we think that we are in the forefront of tobacco control, may I remind you that, while our rate of smokers in the European Union is still 28 %, in the United States it is 18 % and in Canada is as low as 16 %. They have reached these objectives through picture warnings and also limitations on flavours.

So, first, the Commission is proposing a large mandatory picture and text warnings covering 75% of the front and the back of cigarette packs and placed on the top of the pack. For those who think that there is no difference between top and bottom, I would like to show you a leaflet which has just been passed to me by the Smoke Free Partnership, where it is evident that, if you put the health warning lower down, then when it is displayed in those shops selling tobacco it will also be covered up and what you will see will be the trade name itself. And why insist on having it down below and not at the top? The only purpose is that someone must have persuaded someone else that it is good for the industry. But is it good for our citizens, for their lives and for their health?

I know that some of you feel that 75 % is perhaps a bit too large for a health warning. Well it is not as big as in many other countries worldwide which already use larger warnings: just think of Mexico and Brazil, which use 100 % size warnings on one side of the pack; or Uruguay, which uses 80 % warnings on both sides, not to mention Australia with 90 % on one side and 75 % on the other. The 75 % which the Commission is proposing is only slightly larger than what is already in use in some Member States, for instance in Belgium, and big enough to be fully visible, effective – and I stress – legally sound. The Commission proposal also includes rules on package shape and appearance to ensure that packages display the health warnings properly.

Secondly, the Commission proposes to prohibit tobacco products with characterising flavours. There will no longer be any vanilla, chocolate or menthol flavoured cigarettes and, by the way, the Commission did not prohibit additives essential for the production of tobacco products, such as sugar. Characterising flavours just serve to make tobacco more palatable, less harsh and more attractive, in particular to young people. Do not forget that 90 % of those who smoke start smoking under the age of 25. Europe does not need tobacco products targeted at children and new recruits. That is why I believe there is no place for characterising flavours in tobacco products.

Another much-debated issue has been electronic cigarettes. Today an electronic cigarette is less strictly regulated than a shower gel or a bar of soap, despite being a product designed to inhale nicotine and other substances directly into the lungs. In this legislative vacuum, Member States are taking different regulatory approaches which will hinder the smooth functioning of the internal market. This is not acceptable. So I await Parliament’s position to assess how to make progress on this issue, also in the light of the Council position.

Finally, on illicit trade, I welcome the fact that the proposed measures against illicit products – including a tracking and tracing system and a security feature – have been largely accepted both by Parliament’s Committee on the Environment and by the Council. This sends a clear signal that the legislators are determined to take strong and effective action to protect people and the internal market from illicit products.

The Commission will be examining all the amendments that will be adopted here today very carefully, and will consider what position to take. I count on Parliament to successfully pave the way for negotiations to proceed so that we can deliver this important law to our citizens during the current parliamentary mandate.

We need to hear the voice of the people who are most affected by tobacco. These are the 700 000 people – which the Presidency mentioned – in the EU alone who die prematurely every year as a result of tobacco. That is like the entire population of the city of Kraków in Poland or Palermo in Italy being wiped out every single year. These are the families which see their parents or children die of smoking-related diseases.

So our decisions today will affect millions of people throughout the European Union. We should approve this Directive because it is the right thing to do, but it is also what the citizens of the European Union are expecting us to do. Politicians usually examine polls, because popularity is important in politics. So let me remind parliamentarians that the vast majority of European citizens strongly support the measures we are proposing. According to the latest Eurobarometer survey, for instance, 76 % of EU citizens support large mandatory picture warnings, 75 % ask us to take measures against illicit trade, and 63 % want us to prohibit flavours that make tobacco products attractive.

I appeal to Parliament to give a strong mandate to your rapporteur, Linda McAvan, so that trilogues can start as soon as possible. The Commission has delivered. The Council has delivered. The time has come for Parliament to deliver as well.

  Метин Казак, докладчик по становище INTA Убеден съм, че намаляването на броя на пушачите и разумното ограничаване на потреблението на тютюневи изделия заради техния вреден ефект е важна цел от гледна точка на общественото здраве, но заедно с това бих искал да изразя и загрижеността на комисията по международна търговия относно пропорционалността на представените в директивата мерки, които биха въздействали негативно на тютюнопроизводителите в Европейския съюз.

Всяко решение за съставките на тютюневи изделия следва да вземе предвид съпътстващите социално-икономически последици за населението, зависещо от отглеждането на тютюн, защото това допринася за икономическата стабилност на европейските региони с липса на алтернативи за производство.

Унифицирането и прекалената стандартизация на опаковките противоречи на основните принципи на свободната конкуренция, свободния пазар и защитената интелектуална и индустриална собственост.

В допълнение бих искал да изразя и резервите си относно широкия обхват на предвидените делегирани актове, с които Европейската комисия получава пълни правомощия за цялостно регулиране в почти всички области.

И накрая, бих искал да се обърна с призив икономическите и социални фактори да бъдат отчетени, защото те не са по-маловажни от здравните аспекти на предложения законодателен акт.

  Robert Goebbels, rapporteur pour avis de la commission de l'industrie, de la recherche et de l'énergie. − Madame la Présidente, la directive sur le tabac illustre parfaitement le mauvais fonctionnement du travail législatif du Parlement.

Cinq commissions sont mobilisées pour rendre un avis sur les propositions de la Commission. Dans chaque commission, des centaines d'amendements sont discutés. Et les cinq commissions adoptent trois cent quatre-vingt-huit amendements généralement assez critiques face à certaines propositions de la Commission qui, manifestement, veut abuser des actes délégués.

ENVI, la commission compétente, rejette pratiquement tous les amendements des cinq commissions consultatives et, comme à son habitude, la commission ENVI va encore plus loin que la Commission. Les députés critiques sont accusés d'être à la solde des lobbyistes du tabac. Personnellement, je n'ai jamais fumé et je n'ai reçu aucun lobbyiste, mais je veux raison garder.

Je ne vois pas comment empêcher les jeunes de fumer en tentant de leur faire peur par des photos choc. Regardez les tatouages dont ils se couvrent. Ne serait-il pas plus intelligent de mettre sur les paquets des informations sur le sevrage tabagique pour leur montrer comment ils peuvent arrêter?

C'est ridicule, Madame la Présidente, mais soixante secondes pour rendre compte du travail de ma commission, c'est insuffisant. Le commissaire a parlé pendant douze minutes.

  Małgorzata Handzlik, autorka projektu opinii Komisji Rynku Wewnętrznego i Ochrony Konsumentów. − Pani Przewodnicząca! Ta dyrektywa ma szansę uchronić konsumentów, a w szczególności ludzi młodych, przed jakże negatywnymi dla zdrowia skutkami palenia tytoniu. Stanowczo potępiam działania mające na celu zachęcanie młodych ludzi do palenia. Dlatego też uważam, że powinniśmy poprzeć widoczne, duże – 75-procentowe – ostrzeżenia zdrowotne tak, aby konsumenci, a szczególnie właśnie ci wrażliwi konsumenci jak dzieci i młodzież, byli świadomi zagrożenia.

W mojej opinii w komisji IMCO opowiadałam się za wyważeniem aspektów rynkowych i aspektów ochrony zdrowia. Nie osiągniemy celów dyrektywy, zakazując jednego rodzaju produktu tytoniowego, podczas gdy pozostawiamy na rynku wiele innych tak samo szkodliwych. Kluczowe jest lepsze informowanie i zmniejszenie atrakcyjności tych produktów.

Palenie tytoniu pozostaje najpoważniejszym problemem zdrowotnym; aż 70% osób rozpoczyna palenie tuż przed 18 rokiem życia. Dlatego naszym zadaniem jako reprezentantów obywateli jest ochrona konsumentów i to powinno zostać odzwierciedlone w dzisiejszym głosowaniu.

  Csaba Sándor Tabajdi, A Mezőgazdasági Bizottság véleményének előadója. − A Mezőgazdasági Bizottság azért is tudja Linda McAvan kiegyensúlyozott jelentését támogatni, mivel az nem tartalmaz olyan intézkedéseket, amelyek az európai dohánytermesztés megszűnéséhez vezetnének. A dohánytermesztő gazdákat nem hozza kilátástalan helyzetbe olyan elszegényedett régiókban, ahol a dohánytermesztésen kívül nincs más munkalehetőség. Európában 400.000 mezőgazdasági gazdálkodó sorsa függ a dohánytermesztéstől. Hazánkban 30.000 embernek jelent egyedüli megélhetési forrást.

A Mezőgazdasági Bizottságban javaslatot tettünk a fiatalkori dohányzás visszaszorítására, hogy hozzon létre a Bizottság egy európai dohányzásmegelőzési alapot a fiatalkori dohányzás visszaszorítására. Tiltsa be az internetes kereskedelmet uniós szinten, mert ez a fiatalok számára rendkívül veszélyes, és az illegális kereskedelem melegágya. Végezetül a dohányosokat meg kell nyernünk ennek az ügynek. Nem szabad bűntudatot ébresztenünk a dohányosokban, hanem a felelősségérzetüket kell erősítenünk, mert az ő együttműködésük nélkül nem lehet a dohányzást visszaszorítani.

Bardzo Pana cenię i dziękuję, że poruszył Pan temat utraty pracy przez europejskich rolników w wyniku przyjęcia tej dyrektywy. Polska jest największym producentem tytoniu i papierosów. Czy przeprowadzili Państwo badania dotyczące tego, ile tysięcy miejsc pracy zostanie utraconych w wyniku przyjęcia tej dyrektywy i czy mają Państwo jakiekolwiek propozycje dla osób, które w wyniku Państwa decyzji regulującej życie Europejczyków stracą pracę i będą musiały szukać jej gdzie indziej?

  Csaba Sándor Tabajdi, Kékkártyás válasz. – A Mezőgazdasági Bizottság részletesen elemezte a helyzetet és különösen fontos volt a „Burley” termesztése szempontjából az, amit a Biztos úr is említ és Linda McAvan jelentésében is benne van, hogy a cukor, mint adalékanyag használatának engedélyezése azt jelenti, hogy az európai dohánytermesztésben a „Burley”-t lehet termeszteni. Nem veszélyezteti az európai dohánytermelőket ez az irányelv. Az egy más kérdés, hogy a közös agrárpolitika finanszírozási rendje sokkal nagyobb veszélyt jelent az agrártermelők számára, mint ez az irányelv.

  Klaus-Heiner Lehne, Verfasser der Stellungnahme des mitberatenden Rechtsausschusses. − Frau Präsidentin, meine sehr verehrten Damen und Herren! Es ist völlig ausgeschlossen, in einer Minute die rechtlichen Probleme im Zusammenhang mit diesem Kommissionsvorschlag zu erörtern. Darum will ich ganz einfach auf meinen Bericht verweisen, in dem alles Wichtige steht.

Nur eine ganz grundsätzliche Anmerkung will ich in der kurzen Zeit machen: Artikel 168 Absatz 5 des Vertrags verbietet ausdrücklich die Harmonisierung im Bereich des Gesundheitswesens. Was wir hier tun, ist ein juristischer Hochseilakt. Das Parlament hat schon einmal im Zusammenhang mit einer Tabakrichtlinie eine Niederlage vor dem Gerichtshof erlitten. Die Bemühungen des Rechtsausschusses sind darauf ausgerichtet, dafür zu sorgen, diesen Vorschlag der Kommission, der im Grundsatz richtig ist, gerichtsfest zu machen. Je weiter man sich von unserer Position entfernt, desto größer wird die Wahrscheinlichkeit, eine weitere Niederlage vor dem Gerichtshof zu erleiden.

Wir diskutieren hier ausschließlich aus Gesichtspunkten des Gesundheitsschutzes. Das ist politisch zu verstehen. Aber die Rechtsgrundlage, auf der dieser Vorschlag gemacht wird, ist der Binnenmarkt. Binnenmarktgesichtspunkte haben in der politischen Diskussion bisher so gut wie keine Rolle gespielt. Ich möchte auf dieses Risiko hinweisen.

  Karl-Heinz Florenz, im Namen der PPE-Fraktion. – Frau Präsidentin! Erst einmal ein herzliches Dankeschön an Linda McAvan! Du hast Deine Arbeit gut gemacht. Zwei, drei Änderungsanträge finde ich nicht so gut, doch ansonsten sind wir schon in einer gleichen Himmelsrichtung.

Ich bin sehr glücklich, Herr Kommissar, dass ich Sie heute gesund und munter hier sehe. Das kann man ja von Ihrem Vorgänger nicht sagen, der ist in die Mühlen der Lobbyisten geraten und auf etwas unsanfte Weise von Kommissionspräsidenten Barroso in den merkwürdigen Ruhestand geschickt worden. Ich bin also froh, dass Sie da sind, und ich bin auch froh, dass Sie den Bericht nicht geändert haben, denn er ist eine gute Grundlage, auch wenn er an der einen oder anderen Stelle relativ weit geht.

700 000 Tote haben wir in Europa im Jahr. Und wenn ich das mal so hin und wieder erkläre, muss ich mir manchmal anhören, ich sei ein Sensibelchen. Aber sind 700 000 Tote nichts? Das sind 700 000 Tote, Kummer, Elend, Leid und Tränen! Und dagegen haben die Lobbyisten und auch diejenigen, die hier die Wirtschaftspolitik verteidigen, doch wirklich nur dünne Argumente. Was wollen Sie gegen 700 000 Tote an Argumenten ins Feld führen? Das, was ich da gehört habe, liebe Lobbyisten, das war so mager und dünn, das heißt nur: Nein, das wollen wir nicht. Wir wollen junge Menschen vom Rauchen abhalten. Der 40-jährige Mann, der rauchen will, der soll in Gottes Namen rauchen. Das wollen wir doch gar nicht verhindern. Aber wir wollen sie davon abhalten, dass sie auf solche Tricks hereinfallen. Wenn das rechtlich schwierig ist, dann freue ich mich, wenn Klaus-Heiner Lehne uns hilft, dass so ein Lockmittel unsere Kinder und Jugendlichen nicht verführt. Da müssen wir hin. Hoffentlich bringen wir die Kraft auf, das auch gemeinsam zu machen. Denn es sind unsere Toten, die 700 000, die wir im Auge behalten wollen.

Aber was möchte ich in dieser Richtlinie noch gerne verwirklichen? 800 unterschiedliche Substanzen werden in Zigaretten eingemischt. In jeder einzelnen sind 100 enthalten. Wenn Sie diese 100 Substanzen nehmen, die im Tabak und im Papier bei 800 Grad unter Ihrer Nase verbrannt werden, dann tobt da ein Abgaswirrwarr ohne Ende. Genau das müssen wir prüfen, und deswegen müssen wir Zigaretten in Zukunft natürlich auf den Prüfstand stellen.

Wir sind auf dem richtigen Weg. Halten wir jetzt die Ohren steif, dann werden wir für die Generation, die nach uns kommt, etwas Gutes tun!

  Andrés Perelló Rodríguez, en nombre del Grupo S&D. – Señora Presidenta, a estas alturas tenemos que hablar ya claro entre nosotros. Nadie puede demostrar que esta Directiva vaya a plantear la supresión de puestos de trabajo. Nadie. En cambio, sí que se ha demostrado científicamente que setecientos mil europeos y europeas pierden el puesto de trabajo, junto a la vida, cada año. Se trata de un objetivo tan ambicioso, o tan poco ambicioso en este caso, como lograr que dos millones y medio de europeos y europeas no pierdan cada año el trabajo junto a la vida.

Y, frente a ese objetivo poco ambicioso, hemos tenido que soportar la campaña de los lobbies más indecente, más poco honesta y más insidiosa que jamás haya habido en este Parlamento, con manipulación de argumentos, con mentiras y sumando adeptos en contra de todo tipo. Y hay que denunciarlo en este Parlamento.

¿Se trata de optar por la cifra de 140 000 millones de euros y deslumbrarse por ella o de proteger la salud? ¿Qué tipo de Parlamento vamos a ser si aprobamos un objetivo por debajo del que ya ha aprobado el Consejo? ¿De qué lado vamos a poner nuestra confianza si, en vez de apoyar el mandato de Linda McAvan para que negocie ya con el Consejo y con la voluntad de la Comisión, nos situamos en el terreno de los que nos han presionado?

Esa es la pregunta que nos tenemos que hacer y no buscar argumentos falaces, como los que hemos tenido que oír. La salud o el negocio. La confianza al Parlamento o a los lobbies. Y esa es la dicotomía que tiene que resolver este Parlamento. Y no valen medias tintas ni ambigüedades, porque esa es la verdad que hemos de resolver.

Yo estoy con el mandato y con la salud. Cada uno que decida lo que quiera.

  Frédérique Ries, au nom du groupe ALDE. – Madame la Présidente, Monsieur le Commissaire, j'aimerais à mon tour remercier notre rapporteure, Mme McAvan, pour l'excellente collaboration qui fut la nôtre tout au long de ces mois de travail et de pression.

M. Perelló Rodríguez vient de l'évoquer, le tabac tue un fumeur sur deux; 700 000 morts par an en Europe, 50 par jour rien que dans mon pays, la Belgique. Les jeunes commencent de plus en plus tôt, ils sont la raison d'être première – nous l'avons dit – de nos actions.

Le groupe libéral, que je représente, remercie la Commission et la soutient dans la plupart des mesures ambitieuses qu'elle nous propose, à commencer par cette volonté d'interdire les arômes caractérisants qui donnent au tabac ce goût de fruit, de vanille, de chocolat et de menthol bien entendu, bref, qui donnent à penser qu'il serait peu ou pas nocif du tout.

Il était essentiel, par ailleurs, de trouver un bon équilibre en ce qui concerne la taille des avertissements sanitaires, autre disposition phare de cette directive. À l'heure actuelle, dix États membres seulement proposent ces avis combinés, photos plus messages. Notre groupe propose un compromis de 65 % de la surface avant et arrière des paquets de cigarettes et s'oppose aux paquets neutres qui ne laissent plus la liberté de choisir au fumeur qui a fait ce choix-là.

La liberté de fumer, par ailleurs, c'est aussi celle de tenter de sortir du tabac, si le fumeur le veut. C'est la raison d'être de notre combat libéral pour une cigarette électronique sûre et accessible, un produit, en tout état de cause et d'après la recherche, infiniment moins toxique que la cigarette. Notre amendement 170, amendement commun aujourd'hui, a une double finalité: rejeter la voie proposée par la Commission et les ministres, d'ailleurs. La cigarette électronique n'est pas un médicament. Il est de notre devoir d'en garantir l'accès facile aux fumeurs et à ces millions de vapoteurs qui attendent, aujourd'hui, mieux de nous, et ce avec des conditions très strictes: l'application de la législation sur la qualité, la sécurité, l'interdiction de la vente aux mineurs et aussi la restriction de la publicité et du marketing alignée sur celle du tabac.

En conclusion, chers collègues, ce midi – nous l'avons dit –, le Parlement a une chance unique de montrer qu'il est indépendant. Nous saurons s'il a gagné la bataille contre les lobbies. Nous n'avons d'autre choix que l'ambition, et elle passe par le vote du mandat à notre rapporteure.

  Marek Henryk Migalski (ECR). - Muszę państwa poinformować, że właśnie dowiedziałem się od współpracowników pani przewodniczącej, że nie będzie mi już przyznawana „niebieska kartka”, dlatego że chciałem zadać pytanie jednemu z mówców, nie zgadzając się z jego tezą i chcąc dopytać się o to, co miał na myśli. Niestety poinformowano mnie, że „niebieska kartka” będzie traktowana restrykcyjnie, co jak rozumiem, ogranicza nasze prawo do debaty i pokazuje niedemokratyczny charakter naszej Izby, chociażby w takich sprawach.

  Marc Tarabella (S&D), question "carton bleu" adressée à Frédérique Ries. – Madame la Présidente, Madame Ries, nous partageons évidemment l'ensemble des préoccupations.

La cigarette électronique n'est pas un médicament, avez-vous dit, mais, aujourd'hui, on peut vous annoncer que les grands industriels du tabac, Philip Morris aux États-Unis, Japan Tobacco et British American Tobacco, ont déjà acheté une ou plusieurs marques de cigarettes électroniques.

Leurs objectifs sont clairs: si le marché reste aussi rentable et en expansion, ils feront totalement main basse sur ce marché. Donc, c'est un problème grave, ils vont vendre le mal et le remède. Dans un problème aussi délicat au niveau de l'éthique, cette éthique risque de partir en fumée, si j'ose l'expression. Et donc, ne conviendrait-il pas de sécuriser l'alternative que représente la cigarette électronique par une vente beaucoup mieux cadrée?

  Frédérique Ries (ALDE), réponse "carton bleu" à Marc Tarabella. – Madame la Présidente, je ne suis pas sûre que M. Tarabella ait lu notre amendement de compromis, que nous soumettons aujourd'hui avec le PPE, l'ECR et toute une série de collègues qui nous ont rejoints dans ce combat.

Effectivement, ce que nous voulons faire, c'est très exactement ce qu'il me soumet ici, c'est-à-dire garantir la sécurité et la qualité de ces dispositifs, mais nous ne voulons pas que ce soit un médicament. Quand il me parle effectivement des grands fabricants de tabac, je pense qu'il oublie de signaler que ceux qui sont derrière la porte de façon beaucoup plus invisible dans ce débat, mais depuis le début aussi, ce sont les lobbies pharmaceutiques.

Ce qui est en jeu ici, c'est la concurrence avec son substitut nicotinique, qui constitue l'essentiel de ce marché. Donc, il faut faire attention quand on parle de lobby. Ce que nous voulons effectivement, c'est ne pas réduire l'accès à la cigarette électronique à ces millions et ces millions de vapoteurs. Cette cigarette électronique leur permet de fumer avec des risques considérablement moindres que le tabac et je pense qu'à la clé, ce sont des morts que nous allons sauver. Donc, il faut savoir de quoi on parle ici.

  Carl Schlyter, för Verts/ALE-gruppen. – Fru talman! Tobaken dödar varje år fyra gånger fler européer än arbetsplatsolyckor, trafikolyckor, mord, aids och dessutom alla andra droger gör tillsammans.

De åtgärder som vi nu föreslår, dvs. om vi skärper regelverket, är i princip kostnadsfria för samhället, men hälsovinsterna kan bli desto större. Attityden gentemot tobak kan förändras, så att nästa generation européer slipper växa upp redan från livmodern med att utsättas för tobakens skadeverkningar, och så att vi slipper en situation där 70 procent av dem som röker börjar som barn, före 18 års ålder. Då talar vi inte längre om det fria valet, utan då pratar vi om vårt demokratiska ansvar att hjälpa barn att inte välja tobakens och lidandets väg.

Med tanke på detta tycker jag att det är skandalöst att folk här i kammaren, särskilt från PPE-gruppen, i samtliga frågor som tobaksindustrin har identifierat som viktiga går på denna industris linje i sina ändringsförslag, även om er förhandlare har haft en mycket god position och gott samarbete med oss andra.

Varför ska varningstexten vara på toppen? Jo, därför att den ska varna folk! Då ska den synas och inte gömmas bakom en hyllkant. Det finns inga sakliga skäl för att ha den på botten. Enda syftet är då att gömma undan den.

Stora ordentliga varningsbilder – jag förespråkar denna variant, som i Australien, där man undviker att hela paketet blir det sista marknadsföringsknepet i tobaksbolagens arsenal. Jag vet att jag kommer att förlora det, men då kan vi väl åtminstone undvika att försämra kommissionens förslag och behålla 75 procent.

Delegerade akter låter som en tekniskt detalj, men om vi stryker alla dessa, försvårar vi väldigt mycket för kommissionen att anpassa direktivet efter verkligheten när nya problem uppstår. Det är viktigt att vi inte tar bort delegerade akter. Det är en annan prioritet av tobaksindustrin. Hoppas att de förslagen röstas ner.

Den stora frågan är också nästa generations produkter. Vi har nu fokuserat på artikel 18 om e-cigaretter. Vi talar om en produkt som fick 160 000 nya amerikanska ungdomar att börja med nikotinanvändning förra året. Det är inte bara en avvänjningsprodukt, utan det är också en tillvänjningsprodukt. Tobaksindustrin själv räknar med att den tjänar mer pengar på detta om tio år än vad den gör på cigarettförsäljning.

Om man har en nikotincigarett med smak piña colada finns det stor risk att någon råkar hälla det i sin drinkmix och faktiskt dö av en överdos. Vi måste reglera detta på ett seriöst sätt, så att vi undviker skador.

Slutligen: Hur snuset ska smaka kommer att bestämmas av Sverige, och lakritspipor blir ej förbjudna.

  Marina Yannakoudakis, on behalf of the ECR Group. – Madam President, this has been a difficult directive. It is important for the health of smokers and non-smokers alike. I am pleased that in this Chamber the objective seems to be very similar: we are all interested in the health of our citizens. The route we take differs.

One of the key elements in this directive is electronic cigarettes. Like so many elements in this directive, e-cigarettes are controversial. Their main role is as a tool to give up smoking, and we need to recognise the importance of the different means people use to give up smoking. As an ex-smoker I know only too well that it is not an easy habit to give up. Nevertheless, this directive is about protecting people’s health.

I understand why people do not want to see electronic cigarettes go unregulated. The amendment put forward by my Group will allow electronic cigarettes to remain in use as a tool for quitting smoking. The amendment will better control electronic cigarettes in the same way as cigarettes are controlled, by including health warnings, by not allowing the sale of products to under-18s and by ensuring a list of ingredients is submitted to the competent authorities.

While people continue to smoke we must support those who wish to give up. By over-regulating products, such as e-cigarettes, we would make it more difficult, not easy, for people to quit. This is why, if Amendment 170 on e-cigarettes is not adopted, my Group will be voting against, giving the rapporteur a first reading mandate.

  Martina Anderson, on behalf of the GUE/NGL Group. – Madam President, although the large tobacco companies can lay claim to numerous victories over the course of this directive – namely the many delays we have experienced – we are finally here, and I wish to thank Linda McAvan for getting us ready to vote on crucial legislation which could help protect generations of young people.

It is true that the aims of the tobacco industry can never be reconciled with those of public health. The measures proposed by this directive would reduce, after five years, the number of people smoking by 2.4 million and result in a net increase of 2 243 jobs created, due to increased disposable income spent on other goods and services. This would have a positive impact on that 20 % of most deprived areas in EU constituencies where the rate of smoking-related deaths is double that of the least deprived areas.

Without doubt, the amount of lobbying by tobacco companies has reached unprecedented levels. Here are some of the goodies that were sent to me – but I will say that I will vote to save lives and to deliver for those constituents who are anxious to see new tobacco control measures implemented.

In Europe each year, the total deaths caused by road accidents, drugs, murders, suicide and accidents at work do not come to a fifth of those caused by tobacco: 700 000 of our constituents die every year from tobacco-related diseases. That is 700 000 people – mothers, fathers, brothers, sisters, aunts, uncles, grandparents and children. Some of them are known to us – as we have heard in the Chamber today – and yet there are MEPs who still find it difficult to vote in favour of public health measures to combat these avoidable and unnecessary deaths.

This legislation is not reinventing the wheel: the measures proposed are necessary and effective. 75 % picture and text health warnings, banning characterising flavours like chocolate, bubble gum and vanilla, and a ban on slims, will prevent such attractive gimmicks being used by the tobacco industry to get children and young people addicted to their deadly product.

  Lorenzo Fontana, a nome del gruppo EFD. – Signora Presidente, onorevoli colleghi, devo dire che, sentendo un po' il dibattito oggi in Aula, sono abbastanza sorpreso, nel senso che dal mio punto di vista c'è una grossa ipocrisia. Se tutti i dati – e ne sono convinto perché non metto in dubbio l'onestà dei colleghi – sono veri, se ci sono 700.000 morti all'anno a causa del fumo, allora dovevamo fare una direttiva molto più semplice e lineare: il fumo deve essere vietato in tutt'Europa!

Invece mi sembra che non si vieti il fumo, mi sembra che si vietino i pacchetti da 10 – e non riesco a capire il perché – si vietano gli aromi – sì, questo lo posso già capire di più perché, magari, possono incentivare al fumo – però, mi sembra che si faccia poco se il pericolo è così grave – e non metto in dubbio che il pericolo sia così grave. Ma quindi, evidentemente, c'è un po' d'ipocrisia.

Perché, non posso io pensare che oggi vietiamo magari una parte del fumo ma gli alcolici? Non fanno forse male anche gli alcolici? Anche mangiare certi alimenti fa male, troppi grassi, eccetera, quindi dovremmo vietare i grassi, eccetera. Poi ho sentito parlare addirittura che dobbiamo tutelare i diritti dei bambini nell'utero materno, se una madre fuma e mi piacerebbe sentire questo dibattito anche quando si parla dell'aborto, quindi.

Eikö Teitä yhtään järkytä se, että todellakin joka toinen tupakoitsija jollain tavalla sairastuu tähän tupakkaan? Ette ole ottaneet huomioon lääkärien huomautuksia, ja se, että tähän samaan direktiiviin tai ajatteluun pitää sisällyttää kaikki muut tuhoisat asiat maailmassa, niin sehän on tekopyhyyttä jos joku.

Non vietare i pacchetti da 10 o gli aromi, perché se fa male, se una cosa fa effettivamente male ed è scientificamente provato, bisogna dire nella direttiva che si vieta, senza trovare tanti espedienti!

  Franco Bonanini (NI). - Signora Presidente, onorevoli colleghi, desidero esprimere il mio generale sostegno per l'iniziativa della Commissione europea. Non è ovviamente una normativa perfetta, in quanto affronta, ad esempio, in modo del tutto insufficiente alcuni aspetti cruciali fra cui il tema delle campagne di informazione, educazione a lungo termine delle nuove generazioni, ma essa ha tuttavia il merito di aggiornare la regolamentazione di un mercato così particolare come quello dei prodotti del tabacco, ribadendo la priorità del perseguimento di salvaguardia della salute pubblica e di una seria lotta al tabagismo e in particolare la salvaguardia per le giovani generazioni e altre categorie vulnerabili di consumatori.

Nell'affrontare questa discussione appare necessario ricordare come i prodotti del tabacco non siano purtroppo assimilabili ad altre categorie di merce ordinaria, come il fumo rappresenti sempre una micidiale causa di morte e come sia necessario dunque regolamentare con equilibrio e con serietà la commercializzazione di tali prodotti.

Ritengo doveroso che le autorità pubbliche europee non concedano spazio ad aromi caratterizzanti, confezioni ammaglianti e slogan subdoli, che rendono i prodotti del tabacco falsamente attrattivi e che allontanano almeno inconsciamente la consapevolezza della dannosità di tali prodotti. Ce lo chiedono in particolare le casse delle amministrazioni sanitarie nazionali, gravate dal peso dei costi necessari per le cure dei malati, ma soprattutto ce lo impone la nostra coscienza.

  Peter Liese (PPE). - Frau Präsidentin! Ich möchte mich zunächst einmal bei Kommissar Tonio Borg bedanken. Er hat das Amt des Gesundheitskommissars in einer turbulenten Zeit übernommen und unter hohem Druck sehr schnell – schneller als versprochen – diesen Vorschlag vorgelegt. Dafür gebühren ihm Dank und Anerkennung. Ich danke auch Linda McAvan und Karlheinz Florenz und den vielen anderen, die diesen Vorschlag im Ausschuss bearbeitet haben und dafür gesorgt haben, dass wir heute abstimmen können.

Die EVP-Fraktion ist für den Vorschlag. Wir werden auch heute dafür stimmen, dass Linda McAvan ein Mandat bekommt, um mit dem Rat zu verhandeln. Wir unterstützen den Vorschlag im Kern, und wir sind optimistisch, dass wir an einigen wichtigen Stellen unsere Änderungsanträge durchbekommen werden zur besseren Berücksichtigung von KMU und insbesondere bei der E-Zigarette. Der Änderungsantrag 170, den wir gemeinsam mit ALDE und ECR eingereicht haben, sieht vor, dass wir die E-Zigarette streng regulieren. Das ist kein normales Verbraucherprodukt. Hier gibt es Gefahren, vor allen Dingen für Jugendliche. Aber wir wollen die E-Zigarette nicht als Arzneimittel in die Apotheke verbannen. Ich habe von Anfang an gesagt, ich kann das schwer verstehen, dass wir Spritzen an Drogensüchtige verteilen – Methadon und Heroin – und gleichzeitig die E-Zigarette so streng regulieren, dass man zu ihr kaum noch Zugang hat. Deswegen wollen wir diesen Antrag unterstützen.

Zu Klaus-Heiner Lehne: Natürlich müssen wir auf die Rechtsgrundlagen achten. Aber der Binnenmarktartikel 114 – ich habe ihn gerade noch einmal nachgelesen – verpflichtet uns und auch die Kommission, bei den Binnenmarktregeln ein hohes Gesundheitsschutzniveau anzustreben. Das tun wir heute, und deswegen kann man das auch rechtlich verteidigen.

Einige können sich erinnern, vielleicht nicht alle: Wir haben vor wenigen Monaten den Süßstoff Stevia zugelassen. Fünf Jahre hat es gedauert, um dieses Produkt zuzulassen, das keine Gesundheitsgefahren mit sich bringt. Wenn heute jemand den Antrag stellen würde, Tabak in der Europäischen Union zuzulassen, wenn es nicht ein traditionelles Produkt wäre, würden wir den vom Hof jagen, weil etwas, das so gefährlich ist, heute gar nicht mehr zugelassen würde. Deswegen müssen wir die Jugendlichen schützen, und deswegen ist der Vorschlag der Kommission gut.

  Dagmar Roth-Behrendt (S&D). - Frau Präsidentin! Ich kann nicht verstehen, wie man so zynisch sein kann zu glauben, dass wir Aromastoffe bei Zigaretten zwar verbieten, weil sie suggerieren, dass Nikotin etwas Leichtes, Süßes ist – Karamell, Schokolade –, dass dies aber bei E-Zigaretten zugelassen sein soll. Das ist mir völlig unverständlich. Und nur dafür zu sorgen, dass wir endlich von den Herstellern auch erfahren, ob es gefährlich ist oder nicht, und dass dies gekennzeichnet ist, ist bei Weitem zu wenig, es ist zynisch. Der Änderungsantrag, der dazu vorgelegt wird, schadet der Gesetzgebung. Er schadet dem, was die Mitgliedstaaten wollen, und er ist falsch von den Kollegen aus der EVP, der ECR und den Liberalen vorgelegt worden.

Ich halte es für extrem bedenklich, dass wir sagen, wie Frau Yannakoudakis es getan hat, dass E-Zigaretten zwar ein Mittel sind, sich das Rauchen abzugewöhnen, dass sie aber privilegiert werden und anders behandelt werden als Nikotinsprays oder Nikotinpflaster. Jeder, der hier sagt, der Zugang zu E-Zigaretten sei schwierig gewesen, lügt, denn das, was im Umweltausschuss angenommen wurde, war ganz klar: Die Mitgliedstaaten können selbst entscheiden, wo sie verkauft werden sollen.

Liebe Kollegen und liebe Kolleginnen, viele von Ihnen wollen sich im nächsten Jahr zur Wiederwahl stellen. Das sind noch ungefähr sieben oder acht Monate. Wie wollen Sie denn auf die Straße gehen und Ihren Wählerinnen und Wählern, die Sie wählen sollen, erklären, warum das nötig ist? Wollen Sie ihnen sagen: „Ja, wir arbeiten hier als der verlängerte Arm der Zigarettenindustrie. Wir sind wichtig für sie“? Wollen Sie das tun? Wollen Sie tatsächlich – wir hoffen, dass einige Kollegen so oder so nicht wieder in dieses Parlament gewählt werden, ich hoffe das zumindest – meinen Sie tatsächlich, dass es richtig ist, Gesundheitsschutz hintanzustellen? Diejenigen von Ihnen, die tatsächlich ernst nehmen, wofür sie gewählt sind und wofür sie in diesem Parlament sind, stimmen heute bitte für eine strenge Regelung auch bei E-Zigaretten.

  Chris Davies (ALDE). - Madam President, I am afraid that the Commission and the rapporteur are wrong to call for e-cigarettes to be treated as medicinal products. I just think they are missing the big picture, which is that these are a potential game changer in the fight against tobacco-related disease. They can save millions of lives. I have had hundreds of letters from constituents, former smokers, who have said ‘We have tried everything else, we have tried nicotine patches and the like. They have not worked. These things have made a huge difference to my life’.

Of course, e-cigarettes have got to be properly regulated. Advertising should be controlled. Our amendment introduces these controls.

It would be quite wrong to take measures that might in some way restrict the availability of e-cigarettes, or increase their price. Let us just remember that 700 000 people die of tobacco-related disease in Europe each year. The goal is to reduce that number, by millions. We should not make it any harder to buy e-cigarettes than it is to buy conventional tobacco cigarettes.

  Janusz Wojciechowski (ECR). - Szanuję wszystkie poglądy wypowiadane na tej sali, ale prosiłbym, aby nie tworzyć atmosfery podejrzeń wobec tych, którzy mają jakiekolwiek wątpliwości co do niniejszej dyrektywy, o lobbing w imieniu koncernów tytoniowych. Otóż tak nie jest. Można by się nad tym zastanawiać, gdybyśmy rzeczywiście dyskutowali nad pełnym zakazem palenia papierosów. Ale tego nie robimy i w związku z tym można opowiadać się za ograniczaniem palenia (za czym jestem całym sercem – sam nie palę i popieram rozwiązania służące ograniczeniu palenia tytoniu), ale to nie znaczy, że mam w ciemno popierać wszystkie rozwiązania zawarte w tym projekcie, także te, które są podszyte hipokryzją. To słowo padało dzisiaj na tej sali i ja się nim również posłużę. Bo czymże innym, jeśli nie hipokryzją są rozwiązania zmierzające do wyeliminowania papierosów typu slim czy papierosów mentolowych? Nie ma badań, które pokazywałyby, że więcej ludzi zaczyna palenie od tych łagodniejszych papierosów, czy też jaka jest liczba ludzi, którzy dzięki tym papierosom wychodzą z nałogu. Znam bardzo wiele osób, które przestawiły się na papierosy mentolowe, po czym całkowicie rzuciły palenie. Nie chodzi tu o zdrowie, tylko o biznes – powiedzmy to sobie szczerze. W niektórych krajach, w których produkuje się papierosy mentolowe, przestanie się je produkować, a ich produkcja przeniesie się do innych krajów, które produkują papierosy mocne. Nie tylko o zdrowie w tej dyrektywie chodzi, ale również i o biznes. I tu jest niestety ta hipokryzja, którą dostrzegam i dlatego nie mogę w takim kształcie tej dyrektywy poprzeć.

Kieruję się tą samą troską, co Pan, ale obawiam się, że zakaz sprzedaży papierosów mentolowych i „slimów” nie ograniczy palenia, a może je nawet zwiększyć, bo ci, którzy teraz palą te papierosy, będą palili mocne papierosy, jeszcze bardziej szkodliwe. Mój cel jest taki sam – chcę, żeby palono mniej papierosów – ale nie wszystkie środki prowadzą do tego celu.

  Michèle Rivasi (Verts/ALE). - Madame la Présidente, je vois que le débat est chaud, mais je pense que le vote auquel nous sommes soumis, aujourd'hui, est vraiment un vote politiquement important et hautement symbolique. Il montre aux citoyens européens que le rôle de l'Union européenne est de protéger la santé des consommateurs.

La cigarette, faut-il encore le rappeler, est un véritable fléau sanitaire qui provoque la mort de 700 000 personnes par an en Europe. En France, ce nombre est de 60 000 personnes par an, à savoir un airbus qui tombe tous les jours! Il est de notre responsabilité de faire le maximum pour dissuader les jeunes de commencer.

Le groupe des Verts/ALE appuie donc les propositions faites par la Commission européenne: diminuer l'attractivité des paquets; paquets neutres; messages sanitaires; empêcher justement les cigarettes slim et au menthol, parce que cela pousse les jeunes à fumer. Le menthol enlève l'âpreté du tabac. Cela permettra de lutter contre la dédiabolisation du tabac que provoquent le marketing et le packaging.

En aucun cas, il n'est tolérable de laisser le marketing séduire de jeunes consommateurs avec des produits mortels. Diminuer l'addiction est une priorité. C'est pourquoi j'en appelle à la responsabilité des eurodéputés car ce vote est décisif et montrera quelle est la véritable influence des lobbies à Bruxelles. Il en va de l'image d'intégrité du Parlement européen. Nous ne pouvons cautionner le fait de perdre des vies pour sauver des emplois et seulement des emplois!

  Kartika Tamara Liotard (GUE/NGL). - Mevrouw McAvan, allereerst hartelijk bedankt voor uw verslag. Naar schatting sterven jaarlijks 700 000 mensen aan roken. Het is al een aantal malen genoemd, maar het blijft een verschrikkelijk hoog cijfer. De tabaksindustrie denkt echter liever aan ándere cijfers, namelijk winstcijfers.

Ik niet. Ik steun alle maatregelen die mensen en vooral jongeren ontmoedigen om te roken. En hoeveel rokende ouders hopen niet dat hun kind er nooit aan zal beginnen? Dat is de kern van dit voorstel. We verbieden roken niet, we nemen niemand zijn of haar arbeidsplaats af. Het gaat hier puur om de volksgezondheid.

De enorme lobby die er vanuit de tabaksindustrie is geweest. Honderden brieven heb ik ontvangen. E-mails van tabaks- en verpakkingsfabrikanten. In de afgelopen weken kreeg ik zelfs gratis grootverpakkingen shag toegestuurd door lobbyisten. Dat soort dodelijke cadeaus overschrijden naar mijn mening een grens en ik heb er dan ook direct een retouretiket opgeplakt.

Geen hippe of kleine pakjes, geen toegevoegde smaakstoffen, geen reclame-uitingen die mensen verleiden om te beginnen met roken. Ook met vervangende producten, die roken als gewoonte in stand houden, moeten we heel voorzichtig mee zijn. E-sigaretten zijn in potentie wellicht een middel om mensen van het roken af te helpen, maar die moeten dan wel veilig zijn.

Nu wordt er eindelijk gestemd over dit voorstel en ik hoop dat volksgezondheid zal prevaleren en niet de massale lobby.

  Paul Nuttall (EFD). - Madam President, usually when I get up and criticise EU directives I can see a logic to them. It is usually a twisted and bad logic, but there is still a logic. There are a number of areas in this report which I believe actually defy logic. Firstly, the banning of tens. To me it makes no sense. You are not going to stop people smoking by banning 10 cigarettes. What you are going to do is encourage them to buy 20. So in effect what we are doing is, we are criticising places like McDonalds for supersizing their product but we are encouraging the tobacco industry to do the same. And all it will do is make poor people poorer. As regards the menthol cigarettes issue, a million people in the UK smoke menthol cigarettes. They are not going to stop overnight if you ban them, they will go to conventional cigarettes and you will increase the size of the black market.

Finally, e-cigarettes: e-cigarettes are proving, according to latest research, to be the most effective way of stopping people from smoking. Therefore, why on earth would you make them medicinal? Why would you make it harder to stop people smoking? I would ask my colleagues please to vote against this. It is ill-thought out, it is counterproductive and it is contradictory.

  Ewald Stadler (NI). - Frau Präsidentin! Ich selber rauche nicht, aber ich bin entschieden gegen staatlich verordnete Lebensweisen. Ich bin entschieden dagegen, dass der Staat den Bürger bevormundet mit einem aufdringlichen staatlichen Schutzgehabe. Ich bin dagegen, dass wir mit gouvernantenhaftem Moralisieren etwas regeln, das wir nicht zu regeln haben, was meinem Bild vom freien, mündigen Bürger widerspricht.

Es gibt jedes Jahr zigtausende Alkoholtote. Wann, Herr Kommissar, werden Sie Flaschen – Weinflaschen, Whiskyflaschen – zwingend mit entsprechenden Schockbildern vorsehen, um die Leute vom Alkohol wegzubringen? Es gibt jedes Jahr zigtausende Diabetestote. Wann werden Sie Süßigkeiten verbieten? Wann müssen Süßigkeiten – Pralinen – mit Schockbildern von Diabetestoten versehen werden? Wann kommt das alles?

Das alles sind staatlich verordnete Lebensweisen, die niemand haben will. Das ist der Grund, warum die Europäische Union immer unpopulärer wird. Sie mischen sich in Dinge ein, wo der Bürger es nicht haben will.

Diese 85 000 Eingaben im Konsultationsverfahren haben eine deutliche Sprache gesprochen. Der Bürger will das nicht. Regeln Sie die Dinge, die notwendig sind, und nicht jene Dinge, die mit dem freien und mündigen Bürger in Widerspruch stehen. Ausgerechnet jene politischen Kräfte, die die Liberalisierung weicher Drogen verlangen, treten heute gegen den Tabakkonsum auf. Das ist heuchlerisch bis zum Gehtnichtmehr!

  Pilar Ayuso (PPE). - Señora Presidenta, muchas gracias a todos los que han intervenido.

Pocos textos legislativos han creado tanta polémica como este texto de la Directiva del tabaco. Y es que intentar proteger la salud contra un producto que es adictivo, que se ha demostrado científicamente que es perjudicial para la salud, pero que, no olvidemos, es legal y tiene detrás una actividad económica que también es legal y mueve muchísimos puestos de trabajo, es como pretender cuadrar un círculo.

Pero lo verdaderamente prioritario es la salud. Por eso, estamos totalmente de acuerdo con las advertencias sanitarias muy visibles acerca del peligro de fumar; de acuerdo con prohibir las presentaciones engañosas que incitan a fumar; de acuerdo con acabar con los sabores atractivos que enmascaran el verdadero sabor del tabaco; de acuerdo con regular muy estrictamente los cigarrillos electrónicos, que serán el nuevo incentivo para iniciar a los jóvenes; de acuerdo con luchar enérgicamente contra el contrabando y la falsificación de tabaco.

Pero hay que permitir los aditivos estrictamente necesarios y esenciales para fabricar las labores de tabaco, con todas las variedades que se cultivan y que se utilizan. Ni un aditivo más ni uno menos, porque no solamente se trata del azúcar. Y por eso, pido el apoyo a la enmienda 187 del PPE.

Señora Presidenta, cada uno es libre de atentar contra su salud como quiera, no lo vamos a evitar, pero, al menos, que lo haga informado y sin facilidades.

  Edite Estrela (S&D). - Senhora Presidente, eu gostaria de começar por felicitar a relatora, a Sra. McAvan, pelo excelente trabalho, pelo excelente relatório que nos apresentou. O tabaco faz mal à saúde, o tabaco mata. Eu fui fumadora, deixei de fumar há 13 anos, mas infelizmente já assisti à morte de alguns amigos por serem fumadores. Apesar das medidas de controlo do tabagismo adotadas nos últimos anos, a verdade é que os jovens continuam a fumar e continuam a começar essa iniciação cada vez mais cedo.

Por isso precisamos de adotar medidas restritivas e são bem-vindas as advertências em grandes dimensões, a proibição de informação enganosa, os cigarros slim, bem como as medidas contra o comércio ilícito de produtos de tabaco. Quanto aos cigarros eletrónicos, que não se encontram regulamentados, é necessário corrigir esta lacuna para garantir a segurança e a qualidade e penso que o procedimento de autorização como produto farmacêutico é aquele que nos dá mais garantias. Para terminar, faço um apelo a que aprovem as alterações 111 e 112 que o grupo dos socialistas e democratas apresentou e que visa corrigir um aspeto técnico que discriminava determinado tipo de maços de cigarros.

  Jürgen Creutzmann (ALDE). - Frau Präsidentin, meine lieben Kollegen! Um gleich allen Missverständnissen vorzubeugen: Rauchen ist gesundheitsschädlich, und ich kann jedem nur raten, damit aufzuhören. Jedoch gibt es kein allgemeines Verbot. Wer will, darf rauchen, solange er andere nicht schädigt. Der Ansatz der Kommission – unterstützt vom Umweltausschuss –, den Rauchern den Spaß am Rauchen zu verderben, indem gewisse Produktformate vorgegeben, Geschmacksrichtungen und einige Produkte gleich ganz verboten werden, erscheint mir als eine unnötige Gängelung unserer Bürger. Wer gerne Menthol- oder Slim-Zigaretten raucht, soll das auch weiterhin tun dürfen. Wir können und dürfen nicht jeden Aspekt des Privatlebens regulieren. Gleiches gilt für die E-Zigarette, die eine echte Alternative für die Raucher darstellt. Da bin ich strikt gegen eine Einstufung als Medizinprodukt und für einen freien Verkauf, und das eben nicht nur in den Apotheken.

Schließen möchte ich mit einem Hinweis auf die notwendigen Kampagnen gegen das Rauchen, die wir seit Jahren insbesondere auf Jugendliche ausrichten – und das mit Erfolg. In Deutschland hat in den letzten zehn Jahren die Rate der rauchenden Jugendlichen nunmehr um 12 % abgenommen, wir müssen auf diesem Weg fortfahren!

Kanadassa 15–19-vuotiaiden tupakointi putosi puoleen, kun tupakkapakkausten terveysvaroituksia suurennettiin. Vuonna 2000 heistä tupakoi neljännes, vuonna 2011 enää joka kahdeksas. Nyt on kyse siitä, annammeko tupakkateollisuuden koukuttaa yhä uusia teini-ikäisiä riippuvuuteen tappavista tuotteista vai emme. Isot terveysvaroitukset ja makuaineiden, kuten mentholin, kielto ovat keskeisiä.

Tupakkariippuvuus ei ole teollisuudenkaan etu. Euroopassa tupakan aiheuttamat sairauslomat maksavat vuosittain 7 miljardia euroa.

Sähkötupakasta on nopeasti tulossa uusi kasvava nikotiiniriippuvuuden kanava. Esimerkiksi Unkarissa viime vuonna 15 prosenttia 13–15-vuotiaista oli kokeillut sähkötupakkaa, Pariisissa sähkötupakkaa kokeilleiden opiskelijoiden määrä kaksinkertaistui ja kolmannes heistä ei ollut ennestään tupakoinut.

  Hynek Fajmon (ECR). - Paní předsedající, cesta do pekel bývá dlážděna dobrými úmysly, a to je přesně případ této směrnice. Úmysly jsou zdánlivě ušlechtilé, ale důsledky budou velmi negativní. Jsem si jistý, že přijetí této směrnice přinese následující negativní dopady: zaprvé snížení příjmů státních rozpočtů o miliardy eur ročně, zadruhé zánik tisíců pracovních míst v tabákovém průmyslu a také v obchodní síti, zatřetí masivní nárůst černého trhu, pašování a nelegálního, nezdaněného obchodování s tabákovými výrobky.

Evropská komise by se měla zamyslet nad tím, že stále z rozpočtu dotuje pěstování tabáku. Jak je to možné? Proč nenavrhuje v zájmu ochrany zdraví zrušit dotace na pěstování tabáku a místo toho navrhuje samé zákazy? Jsem přesvědčen o tom, že tato oblast má být regulována na národní úrovni, a nikoliv na úrovni evropské. Proto budu hlasovat proti této směrnici.

  Paul Rübig (PPE), Frage nach dem Verfahren der „blauen Karte“. – Sie haben von Schmuggelzigaretten gesprochen. Immerhin 25 % der Produkte auf dem Markt sind Schmuggelzigaretten. Wird sich hier die EU-Regelung auch durchsetzen lassen, oder wird das zu stark steigenden Gewinnen bei der Schmuggelmafia führen? Was ist Ihre Meinung dazu?

  Hynek Fajmon (ECR), odpověď na otázku položenou zvednutím modré karty. – Já jsem přesvědčen, že to povede k dalšímu obrovskému nárůstu pašování. Vidíme to nakonec i my tady, když bydlíme v Kehlu. V Německu jsou levnější cigaretové výrobky a Francouzi masivně jezdí do Kehlu nakupovat cigarety. To samé uvidíme všude podél hranic Evropské unie. Všude toto pašování naroste díky této směrnici.

  Daniël van der Stoep (NI). - Voorzitter, roken is een keuze net als bijvoorbeeld religie. Als de EU consequent is, komt ze ook met voorstellen om waarschuwingsteksten op bijbels en korans te plaatsen. Tenslotte is religie vele malen dodelijker geweest dan roken ooit zal zijn.

Ik rook al bijna twintig jaar met veel plezier, ondanks dat ik pas 33 ben. Het is mijn hobby, ik geniet er nog steeds elke dag van en ik ben ook erg goed in roken, als ik het zelf mag zeggen.

Wij rokers dragen gigantisch bij aan de overheidsfinanciën. Als iedereen zou stoppen met roken, gaan alle landen in de EU bankroet. In plaats van dank daarvoor worden rokers continu achtervolgd door gezondheidsmalloten.

(Er wordt geroepen in de zaal.) U kunt ook een blauwe kaart opsteken in plaats van door de zaal heen te schreeuwen.

Voorzitter, de tabaksrichtlijn is een perfect voorbeeld van 'burgertje pesten' door nutteloze politici die niets beter te doen hebben dan te neuzelen op de vierkante millimeter.

  Françoise Grossetête (PPE). - Madame la Présidente, il faut tout faire pour diminuer le nombre de fumeurs, car l'industrie du tabac ne recule devant rien pour séduire des publics ciblés: paquets attractifs, arômes ou encore cigarettes fines très appréciées chez les jeunes femmes. Leur lobbying a fonctionné car aujourd'hui, plusieurs de leurs propositions ont été reprises stricto sensu par certains d'entre nous, qui ont servi de boîtes à lettres à ces lobbyistes du tabac. C'est une honte!

Cela fait trois ans que l'industrie du tabac fait barrage à la directive. Serait-elle une menace pour les emplois? Soyons sérieux, trente-quatre mille emplois seulement dans l'Union européenne. Les lobbyistes du tabac, qui sont de véritables marchands de mort, essayent de faire croire que le tabac enrichit l'Europe, alors qu'il la ruine, tout comme la santé de toute une génération de citoyens européens.

Pour réduire l'attractivité du tabac chez les jeunes et les femmes en particulier, il faut de grands avertissements sanitaires en haut du paquet, l'interdiction des arômes et des cigarettes fines, tout comme un strict contrôle des ingrédients et des additifs présents dans les cigarettes.

De même, la cigarette électronique n'est pas, et surtout pas, un médicament, mais elle doit faire l'objet d'un encadrement strict. Avant de donner quitus à la cigarette électronique, il faudrait en connaître les effets à long terme. L'effet de mode, dont jouit aujourd'hui la cigarette électronique, ne doit en aucun cas être une porte d'entrée vers le tabagisme.

Ne sacrifions pas l'intérêt supérieur de la protection de la santé pour cette terrible machine à cash des géants du tabac et donnons surtout un mandat à Mme McAvan.

  Glenis Willmott (S&D). - Madam President, the purpose of this legislation is to try and prevent a new generation of smokers. Introducing 75 % health warnings and getting rid of flavourings which make smoking more attractive to children is the minimum we should do. I hope that governments across the EU will also introduce standardised packaging as soon as possible and I am disappointed that the UK government has scrapped plans to do so.

Why is this so important? It is important because one in two regular smokers are killed by tobacco and we have a responsibility to do whatever we can to stop the carnage. I have heard many people argue about the negative impact on revenue from tobacco, but what about the cost to our health services? More importantly, what about the human cost?

We all know there has been a huge lobby by the tobacco industry. Unfortunately, much of their lobbying seems to have had an effect. This legislation has been constantly delayed and still, now, there are more attempts to weaken and delay it.

I hope the British Conservatives will follow their government’s line and support many of the measures proposed, including on e-cigarettes, and if they fail to support their government, they should at least listen to the voices of concerned constituents, doctors, cancer researchers, heart charities, respiratory societies and the World Health Organisation, all calling on us to protect the next generation from death, disease and disability caused by tobacco.

  Rebecca Taylor (ALDE). - Madam President, we have the chance today to vote for tobacco control measures such as large health warnings and a ban on characterising flavours, which will help make smoking less appealing to young people so that fewer take up the habit.

We also need to think of existing smokers who want to quit their habit or reduce the harm involved, which is where electronic cigarettes come in. Many smokers have switched to e-cigarettes from tobacco – often not expecting to quit tobacco in the process – including the taxi driver who brought me to Parliament this morning.

There are two choices before us today on e-cigarettes. The first is to regulate them as medicines, which will increase costs, reduce product variety and in many EU countries make them less widely available than tobacco! This would not be a positive move for public health. The other choice is Amendment 170, which would keep e-cigarettes as consumer products but tighten up the regulation to include marketing restrictions, strict labelling requirements and an under-18 sales ban.

Fellow MEPs, we must legislate today in the interests of citizens, not tobacco companies.

  Bas Eickhout (Verts/ALE). - Voorzitter, ik zit met verbazing naar dit debat te luisteren. Want waar hebben we het nu precies over?

Het gaat helemaal niet om het verbieden van roken, zoals sommige mensen zeggen. Het gaat hier om het béter reguleren van wat we doen met roken. Roken dat dodelijk is, wat keer op keer is aangetoond.

Waar we naar streven is dat de juiste informatie op de etiketten staat, dat allerlei smaakjes die mensen verleiden om te roken, worden verboden, dat we beter het gebruik van e-sigarets reguleren. Daar gaat het om. En al die beweringen dat er allerlei banen verloren gaan, waar hebben we het precies over? Het is een industrie die op dit moment veel geld verdient. De banen die waarschijnlijk vooral onder druk staan, zijn de banen van de 161 lobbyisten van Philip Morris. Dát is waar we het over hebben.

Ik snap niet waarom we de behandeling van dit verslag al een maand hebben moeten uitstellen. Laten we nu een keer gaan stemmen en gaan onderhandelen. Deze wetgeving is hard nodig in Europa. Nú.

  Susy De Martini (ECR). - Signor Presidente, onorevoli colleghi, signor Commissario Lei ha molte ragioni ma questa direttiva sul tabacco è sbagliata, perché va contro l'interesse dei lavoratori e non porterà alcun beneficio alla salute. Infatti, le imitazioni che rasentano il proibizionismo non possono che alimentare il mercato del contrabbando, con conseguenze ancora più devastanti per la salute. Voi talebani della guerra antifumo siete pericolosi quanto il fumo!

Perché noi sappiamo bene, come medici, che anche la carne rossa ad esempio è dannosa per l'organismo e favorisce il cancro! E che dire del colesterolo? Allora su ogni uovo andrebbe scritto: nuoce gravemente alle vostre arterie, io non ho mai fumato e ho avuto un cancro e un infarto! E allora, a quando una direttiva per farci diventare tutti vegetariani? Aspetterò il momento di conoscere il prezzo della bistecca al mercato nero!

  Hans-Peter Martin (NI). - Herr Präsident! Worum geht es? Es geht darum, die Zahl von jährlich 700 000 Rauchertoten in der EU – allein 14 000 davon in Österreich – drastisch einzuschränken. Es geht darum, Warnungen zu platzieren, und nicht um Verbote. Es geht um unsere Verantwortung, denn es geht um Sicherheit unserer Wählerinnen und Wähler. Gerade das, was wir vorhaben, kann junge Menschen davon abbringen, ins Rauchen einzusteigen. Wir haben gesehen, dass diese kleinen Warnhinweise nicht ausreichen.

Jetzt gibt es die wirklich Mächtigen in dieser EU, die uns sagen: Nein, nein, das soll alles so bleiben oder darf nicht entsprechend groß werden. Falls sich diese todbringende Lobby durchsetzt, sollten wir auch zu ganz anderen Warnhinweisen greifen: Lobbying kann tödlich sein. Oder noch deutlicher: Lobbying kills! Und das auf die Türen von Philip Morris und all denjenigen, die versuchen, uns unter vollkommen falschen Vorspiegelungen etwas nahezubringen, was wir dringend ablehnen müssen. Wir sind verantwortlich für die Gesundheit unserer Bürgerinnen und Bürger!

  Richard Seeber (PPE). - Herr Präsident! Ich habe die Wortmeldung des Kollegen van der Stoep wirklich als blasphemisch empfunden, hier Zigaretten mit Religion zu vergleichen. Das finde ich wirklich unter dem guten Geschmack. Zum Zweiten finde ich es auch zynisch, das Schicksal der Arbeiter und Arbeiterinnen, die in Zigarettenfabriken arbeiten, hier in die Waagschale zu werfen gegen die Gesundheit der Menschen, die zur Zigarette greifen. Es geht hier auch nicht um Bevormundung, überhaupt nicht!

Aber es geht darum, dass wir als Gesetzgeber die Pflicht haben, erstens Produkte auf den Markt zu bringen, die möglichst sicher sind, und zum Zweiten klar zu machen, dass es drastische Folgen haben kann, wenn man zu solchen Produkten greift. Glaubt wirklich irgendjemand hier im Saal, dass Zigaretten heute noch eine Zulassung bekommen würden? Das ist, wie gesagt, ein Traditionsprodukt, aber bei unseren heutigen Standards ist das ein Produkt, das an und für sich unnotwendig ist, das man nicht braucht und das solche Auswirkungen hat – 700 000 Tote im Jahr, würden Sie wirklich einem solchen Produkt eine Zulassung geben? Ich glaube, da haben wir wirklich die Pflicht zu handeln. Hier ist auch dieser Warnhinweis mit einer gewissen Größe – ich habe jetzt in einem Kompromiss 65 % vorgeschlagen – der einzig richtige Weg.

Wir müssen uns auch darum bemühen, die Zigaretten möglichst sicher zu machen – darum diese Positivliste und auch hier ein Verbot von gewissen Geschmacksstoffen – und insbesondere versuchen, die Jugend nicht in das Rauchen kommen zu lassen, weil wir alle wissen: Die Menschen fangen relativ jung an und enden dann wirklich im späteren Leben als Suchttote.

  Pavel Poc (S&D). - Pane předsedající, hodně kolegů tady děkovalo paní zpravodajce Lindě McAvanové za vynikající zprávu. Já se k tomu připojuji, ale také jí chci poděkovat a vyjádřit svůj obdiv za její osobní statečnost. Tabákový průmysl udělal v posledních měsících v této záležitosti hotové divadlo. V členských státech diskutujeme o jakési zrůdné narkoekonomice, místo abychom vrátili tu diskuzi tam, kam patří. Ta diskuze patří do sféry zdravotnictví. Sedm set tisíc mrtvých za rok na následky kouření, to je Titanik, katastrofa Titaniku každý jednotlivý den v každém roce. Sedm z deseti kuřáků začíná kouřit před osmnáctým rokem.

Opatření, která jsou navržena, mají jednoznačně za cíl učinit tabák méně atraktivním pro nové konzumenty. Je to prokázáno studiemi, prokázáno zkušenostmi z jiných zemí. Cílem je zabránit zavlékání mladých lidí do závislosti, do nového otroctví závislosti na tabáku. Všechna opatření navržená ve směrnici směřují k tomuto jedinému cíli. Nejde zde o žádný zákaz kouření, ale o regulaci manipulativních marketingových nástrojů, to je všechno. Sám tabákový průmysl nám svou alergickou reakcí dokázal, že jdeme správným směrem.

A ještě jedna poznámka, pan komisař Borg zde velmi správně zmínil okamžik pravdy. To hlasování dnes bude takovým okamžikem pravdy. Ukáže se, zda v tomto domě rozhoduje demokracie, rozhodují poslanci v zájmu svých voličů, anebo zda v tomto domě rozhoduje tabáková lobby.

  Olle Schmidt (ALDE). - Herr talman! Rökning dödar – det vet vi alla. Mycket har faktiskt gjorts för att förhindra rökning både här i EU och i våra egna hemländer. I dag tar vi ytterligare nödvändiga steg. Det allra viktigaste är, som har påpekats här, att barn och ungdomar inte börjar röka.

Herr kommissionär, vi svenskar måste få behålla vårt snus. Det är en del av vår kultur. Sverige har ett lagligt undantag för snuset sedan vårt medlemskap 1995. Att förbjuda snus i Sverige vore som att förbjuda Alsacevin här i Strasbourg. Mitt entydiga budskap är: Rör inte snuset!

All lagstiftning måste vara rimlig och proportionell. Att förbjuda lakritspipor är faktiskt rent trams. Mitt entydiga budskap är: Rör inte lakritspiporna!

  Peter van Dalen (ECR). - Voorzitter, dank u wel. 700 000 doden elk jaar door roken. Dat is evenveel als het aantal inwoners van steden als Lissabon, Sevilla of Riga. Dat énorme getal moet naar beneden en deze richtlijn draagt daaraan bij. We moeten onze gezondheid niet in rook laten opgaan.

Ik denk ook dat het belangrijk is dat tabak naar tabak smaakt en er ook zo uitziet. Toevoegingen aan sigaretten bijvoorbeeld met smaakjes of met vitamines moeten worden verboden. Ze zijn misleidend. Ze doen vermoeden dat de sigaret goed of minder schadelijk is voor de gezondheid, wat natuurlijk absoluut niet zo is.

Jongeren blijken gevoelig voor die flitsende verpakkingen of voor die bijgevoegde smaakjes. Bijvoorbeeld door een chocoladesmaak toe te voegen wordt dan de echte scherpe smaak van tabak verminderd en raken jongeren eerder verslaafd. Dat moeten we niet doen. Daarom moeten er ook grótere waarschuwingen op de verpakkingen. In Canada heeft dat een enorm succes gehad. Daar pleit ik dus voor.

  Franz Obermayr (NI). - Herr Präsident! Ja, Tabakkonsum kann massive gesundheitliche Schäden verursachen, und man sollte Jugendliche davon abhalten, mit dem Rauchen zu beginnen. Ich begrüße daher das Verbot des Internethandels, weil hier Altersgrenzen leicht umgangen werden können. Aber was ich nicht gutheiße, sind Verbote und Vorschriften, die wissenschaftlich nicht fundiert sind und Unternehmen keinen Raum lassen, mit ihren Produkten zu handeln, wie Warnhinweise, die 75 % der Packung ausmachen. Das ist ein unverhältnismäßiger Eingriff in geistiges Eigentum.

Herr Kommissaar Borg: Die Kommission hat sich mittels zahlreicher delegierter Rechtsakte Ermächtigungen zu Rechtsetzungen eingeräumt. Diese betreffen zum Teil wesentliche Punkte wie zum Beispiel die Möglichkeit, Höchstgehalte von Nikotin nachträglich anzupassen, oder nachträglich die Form der Verpackung vorzuschreiben. Das sind klare Kompetenzüberschreitungen. Sie ignorieren hiermit die Grundrechtecharta. Das wiederum führt unerträglicherweise zu Rechtsunsicherheit der betroffenen Unternehmen.

  Dubravka Šuica (PPE). – Kada bih privatno odlučivala i kada bih ja bila ta koja treba donijeti odluku, emotivno bih rekla „Zabrana pušenju!”. Međutim, budući da je sloboda jedan od osnovnih stupova demokracije i budući da se zalažem za slobodu izbora i odlučivanja, onda treba biti realan. Naša zadaća ovdje je odvratiti mlade od pušenja. To je naš zadatak.

Zapanjujuća je brojka od 700 000 umrlih u Europi, a u jednoj maloj Hrvatskoj godišnje 10 000 ljudi umre od posljedica pušenja. Svi smo suočeni s demografskim problemima, s problemima depopulacije i zato zaista treba obratiti veliku pozornost kako bi se spriječile marketinške prevare u odnosu na mlade ljude. Kad je riječ o e-cigareti, onda ona je popularna danas, ali ona nije lijek i ne smije biti klasificirana kao lijek, treba je pustiti na tržište.

Zahvaljujem gospođi McAvan, zahvaljujem gospodinu povjereniku i zalažem se za to da gospođa McAvan dobije pravo na pregovore. To je jedan vrlo važan zadatak, da se nastave pregovori s Komisijom. U svakom slučaju podržavam ovu Direktivu i zalažem se za maksimalnu regulaciju proizvodnje duhanskih proizvoda.

  Kathleen Van Brempt (S&D). - Dank u, Voorzitter. Wij bespreken hier vandaag een aanpassing van een richtlijn over een product dat – en dat weten wij allemaal – bijzonder schadelijk, slecht voor de gezondheid en heel verslavend is.

Als dat product vandaag niet op de markt bestond en iemand zou dat uitvinden en op onze Europese markt willen brengen, zouden wij hier allemaal bijna unisono zeggen:'no way, we verbieden dat product'.

Doen wij dat vandaag? Natuurlijk niet. Het is ingeburgerd. Veel mensen roken. Maar we hebben wel een heel, heel belangrijk doel voor ogen. Ik verbaas mij er dan ook over dat we het, over de partijgrenzen heen, over rokers en niet-rokers heen, niet eens kunnen worden. Het gaat met name over onze kinderen en onze kleinkinderen. Wil er iemand van ons dat onze kinderen of kleinkinderen gaan roken? Natuurlijk niet.

Alle voorstellen, van de commissaris, gesteund door de Raad, en van onze ENVI-commissie met onze schitterende rapporteur, verdienen dan ook een brede steun in dit Parlement. Geef alstublieft straks onze rapporteur het mandaat om te beginnen te onderhandelen met de Raad. Binnen de kortste keren hebben we dan een betere wetgeving.

  Antonyia Parvanova (ALDE). - Mr President, I would like to thank Linda McAvan and my colleagues for the amazing work accomplished on this file supporting an ambitious line towards effective public health policy. We must recognise that this is not an easy task, especially with all the cynical tobacco industry lobbying going on. Public health will continue to be our main guiding principle and the free choice of consumers does not mean supporting anti-public health behaviour or practices.

Electronic cigarettes, the debate on which unfortunately has been hijacked by the core elements of this directive, should be as available as other tobacco products and they are a healthier alternative to smoking, but this does not justify a lighter regulatory framework for these products or a double standard compared to other nicotine-containing products aimed at quitting tobacco, such as gums and patches. Let us not forget that the fight against tobacco is a fight against addiction, not only against one type of product, real or electronic, so let us be consistent and keep in mind our public health objective and not play the devil’s advocate.

  Renate Sommer (PPE). - Herr Präsident! Ja, Rauchen ist ungesund. Und ja, Tabak ist immer ein hochemotionales Thema – insbesondere in diesem Haus – und ein Spielfeld für Ideologien. Ist es denn wirklich so, dass die wahren Guten nur die sind, die der Berichterstatterin folgen, und alle anderen sind von der Tabaklobby gekauft? Darf man nicht eine andere Auffassung haben? So einfach ist das doch alles gar nicht.

Auch bei Tabak müssen wir uns schließlich auf Fakten stützen und nicht nur auf Bauchgefühl und Populismus. Fakt ist zum Beispiel, dass E-Zigaretten Rauchern einen Ausweg bieten. Sie sind aber kein Medizinprodukt, und deshalb dürfen sie auch nicht klinischen Tests unterworfen werden. Das würde nämlich dazu führen, dass die kleinen Hersteller kaputtgingen, und das würde nur der großen Tabakindustrie in die Hände spielen. Wollen wir das? Das würde auch der Pharmaindustrie zupasskommen, die ein erstaunlich großes Interesse an diesem Dossier hat, aber im Lobbying niemals selber auftritt. Nein, sie macht das verdeckt, versteckt, über NGOs. Über NGOs, die sich gegen das Rauchen aussprechen.

NGOs – dagegen habe ich absolut nichts. Das ist gut. Aber man muss schon auch schauen, was dahinter steckt. Erschreckend viele dieser NGOs werden durch die Pharmaindustrie gesponsert. Diese NGOs haben ja zum Teil die Finger sogar in diesem Parlament, organisieren intergroups, stellen das Sekretariat bis zu dem Punkt, dass sie sogar die Pressemeldungen dieser intergroups schreiben. Ich finde, darüber sollte man auch mal nachdenken. Es kann doch wohl nicht sein, dass eine solche Intransparenz herrscht und das dann auch noch nur gut ist.

Ich meine, wir sollten ein bisschen anständiger mit uns umgehen, auch bei diesem Thema. Man darf auch hier unterschiedlicher Meinung sein. Ich bin auch nicht dafür, dass wir die Menschen ans Rauchen bringen, ich bin auch für strenge Regelungen. Aber ich meine auch immer, man muss noch die Kirche im Dorf lassen dürfen.

  Matthias Groote (S&D). - Herr Präsident, liebe Kolleginnen und Kollegen! Ich glaube, wir haben heute ein dickes Stück Gesetzgebung zur Revision auf dem Tisch liegen, und es geht um Gesundheit – zusammen mit dem Binnenmarkt –, und einige Kollegen haben angesprochen, die rechtliche Situation sei nicht geklärt. Die Tabakindustrie wird sowieso zum Gericht laufen. Das ist gute Tradition bei der Tabakindustrie. Wir sollten deswegen keine Angst haben, diese Gesetzgebung hier heute möglichst scharf auf den Weg zu bringen. Jeder hat nur eine Gesundheit. Und bei dieser Gesetzgebung geht es darum, jungen Leuten den Einstieg in eine Tabakkarriere so schwer wie möglich zu machen, nicht dem 50- oder 60-Jährigen das Rauchen zu verbieten und mit dem Zeigefinger zu zeigen, sondern möglichst viele junge Leute davon abzuhalten, in diese schädliche Karriere einzusteigen, und darum geht es – und das möglichst streng: Warnhinweise, Aromen gehören verboten, und die E-Zigarette gehört auch vernünftig und nicht halbseiden reguliert. Der Rat hat übrigens eine sehr vernünftige Position dazu eingenommen, das muss ich sagen.

  Holger Krahmer (ALDE). - Herr Präsident! Ich bin auch sehr dafür, dass wir auf die Gefahren des Rauchens aufmerksam machen. Ich bedaure aber sehr, dass wir die Debatte über diese Richtlinie, die uns hier vorliegt, nicht wirklich sachlich führen können.

Glauben wir wirklich, dass detaillierteste Verpackungsvorschriften ein Mehrwert für die Gesundheit unserer Bürger sind? Glauben wir wirklich, dass wir Leben retten, wenn wir verbieten, Tabak für Selbstdrehprodukte in Pappdosen zu verkaufen? Glauben wir wirklich, dass wir Leben retten, wenn wir detaillierteste Verpackungsvorschriften für Zigarettenschachteln machen und vorschreiben, dass eine Packung einen Klappdeckel haben muss? Ich glaube, dass hier die Verhältnismäßigkeit vieler Vorschläge einfach nicht gewahrt ist. Ich glaube auch nicht, dass es wirklich gut begründbar ist festzustellen, dass Gesundheitsschutz größer ist, wenn der Warnhinweis 75 % und nicht 50 % der Verpackungsfläche einnimmt. Das ist eine irrationale Diskussion.

Ich wünschte mir sehr, wir würden hier auf der Basis von Argumenten diskutieren und nicht so sehr diejenigen, die kritische Anmerkungen haben, einfach zu fremdbestimmten, lobbygesteuerten Wesen erklären. Das genau ist nämlich in der Debatte passiert. Ich glaube, dass wir am Ende hier eine Richtlinie machen, die eher die Anti-EU-Reflexe in der Bevölkerung verstärkt, als tatsächlich einen Beitrag zum Gesundheitsschutz zu leisten.

  Γεώργιος Κουμουτσάκος (PPE). - Κύριε Πρόεδρε, η οδηγία που συζητάμε καθορίζει ένα διπλό στόχο: πρώτον, την προστασία της δημόσιας υγείας με έμφαση στην αποθάρρυνση των νέων από το να γίνουν καπνιστές και, δεύτερον, τη βελτίωση της λειτουργίας της εσωτερικής αγοράς για τα προϊόντα καπνού.

Οφείλουμε λοιπόν να επιτύχουμε μια ικανοποιητική ισορροπία: τα μέτρα θα πρέπει να αποθαρρύνουν αποτελεσματικά τους πολίτες, και ειδικά τους νέους, από την επικίνδυνη και εθιστική συνήθεια του καπνίσματος, χωρίς όμως να προκαλέσουν μεγάλη στρέβλωση του ανταγωνισμού.

Θα ήταν λάθος η οδηγία να γίνει πολιτικό και ιδεολογικό μανιφέστο κατά του καπνίσματος χωρίς να υπάρχουν όμως ουσιαστικά αποτελέσματα υπέρ της δημόσιας υγείας, αλλά με πολύ αρνητικές συνέπειες, τόσο από πολιτικής σκοπιάς, όσο και υπό το πρίσμα της απασχόλησης σε μία Ευρώπη 20 εκατομμυρίων ανέργων. Κινδυνεύουμε, αντί να μειώσουμε τους καπνιστές, να μειώσουμε τους εργαζόμενους. Επίσης, είναι υπαρκτός ο κίνδυνος να ενισχύσουμε, αντί να αποθαρρύνουμε, το λαθρεμπόριο και την παραποίηση προϊόντων καπνού.

Γι’ αυτό, ενώ πιστεύω ότι το κάπνισμα βλάπτει και υποστηρίζω την ανάγκη μιας οδηγίας, δεν μπορώ και δεν θα υποστηρίξω ορισμένα σημεία της, όπως την κατάργηση ορισμένων πρόσθετων συστατικών, και ειδικά της ζάχαρης, την κατάργηση των τσιγάρων τύπου "SLIM" και τις εκτός λογικής υπερμεγέθεις προειδοποιήσεις σε θέματα υγείας. Πολύ φοβάμαι ότι με τα μέτρα αυτά δεν θα έχουμε τα επιθυμητά αποτελέσματα.

Τέλος, θέλω να πω ότι υποστηρίζω την διαπραγματευτική εντολή προκειμένου να επιφέρουμε αποτελέσματα σε πρώτη ανάγνωση.

  Mario Pirillo (S&D). - Signor Presidente, onorevoli colleghi, un ringraziamento alla collega McAvan per l'ottimo lavoro svolto su quest'importante dossier, di cui ne condivido l'impostazione e molte delle scelte operate per rendere il fumo meno attrattivo. Un lungo e articolato dibattito nelle commissioni parlamentari ha consentito di valutare bene la proposta della Commissione.

Al di là però delle disposizioni normative restrittive, resto del parere che solo le campagne pubbliche di prevenzione e di informazione sugli effetti nocivi del fumo potranno scoraggiare dal fumare. Questo compito spetta agli Stati membri che hanno la responsabilità per la prevenzione della salute pubblica. Sono convinto che il divieto della vendita delle sigarette slim non sia una misura proporzionata al raggiungimento dell'obiettivo di dissuadere i giovani dal fumo, per cui mi discosterò dall'indicazione di voto del mio gruppo.

  Corinne Lepage (ALDE). - Monsieur le Président, Monsieur le Commissaire, tout d'abord mes félicitations à Mme McAvan et à la présidence lituanienne pour avoir tenu bon face à une offensive sans précédent du lobby du tabac. Ce n'est pas le seul lobby à se manifester ici, du reste, comme un collègue l'a rappelé, le lobby pharmaceutique est également très présent.

700 000 morts par an, cela veut dire que, durant notre débat, 240 personnes sont mortes du tabac en Europe. En France, 16 millions de fumeurs, cela coûte à ce pays 47 milliards d'euros, soit 3 % du PIB. Aujourd'hui, nous devons nous engager pour lutter effectivement contre le tabac. Cela veut dire 75 % de messages sanitaires. Cela veut dire lutter contre les artifices de marketing des producteurs. Cela veut dire que la cigarette électronique est un formidable espoir pour sortir de la dépendance du tabac. Cela ne doit pas être un formidable moyen pour les cigarettiers de développer encore leur activité, en particulier vers les jeunes. C'est une question qui concerne la crédibilité et l'honorabilité de ce Parlement. Il est notoire, ici, qu'un parti qui siège a reçu de l'argent de la part du lobby du tabac. C'est publié dans la presse anglaise de ces jours-ci. Oui, absolument! Nous devons donc montrer que nous représentons les citoyens européens...

  Marianne Thyssen (PPE). - Voorzitter, mijnheer de voorzitter van de Raad, mijnheer de commissaris, beste collega's. In elk dossier zijn er momenten waarop wij uiteenlopende belangen en argumenten moeten afwegen, maar altijd komt er daarna een ogenblik waarop we duidelijke keuzes moeten maken.

De keuzes die we vandaag maken, mogen niet halfslachtig zijn. Want wanneer wij ons straks uitspreken over de nieuwe tabaksrichtlijn, dan stemmen we niet alleen over een pakket regeltjes. We stemmen dan letterlijk over het leven en de gezondheid van mensen, van jónge mensen in het bijzonder, van mensen die dikwijls nog niet weerbaar genoeg zijn om aan allerlei verleidingen te weerstaan.

Laten we daarom alstublieft de gezondheid ondubbelzinnig vooropstellen. Laten we duidelijke regels goedkeuren en laten we ook meteen een mandaat geven aan de onderhandelaars. Laten we het gebruik van tabak verregaand ontmoedigen, laten we duidelijk néé zeggen tegen álle verkooptrucs die tabak aantrekkelijk maken voor jonge mensen, die – ik kan het niet genoeg onderstrepen – nog niet altijd het lef en de kracht hebben om aan al die verleidingen te weerstaan en de best mogelijke keuzes voor hun eigen gezondheid te maken.

Collega's, water en vuur verzoenen, dat gaat niet. Dat moeten we dus ook niet willen. Wel moeten we de gezondheid van de Europeanen, en de jónge Europeanen in het bijzonder, bóven de economische belangen stellen.

Voor de collega's die de economische belangen laten primeren, voeg ik daar graag aan toe dat tabak niet alleen gezondheidsschade aanricht, maar dat die schade bovendien zeer hoge economische kosten heeft.

Collega's, wij kunnen vandaag iets doen om te voorkomen dat vele jonge mensen zich nog laten verleiden. Laat ons die kans grijpen.

  Christel Schaldemose (S&D). - Hr. formand! Kære kolleger! Rygning dræber! Så enkelt er det! Og antallet af unge rygere er på vej op. Vi får flere og flere af dem. Om året dør der 700 000 mennesker i EU af rygning. I Danmark er det tal 14 000 mennesker. Skulle vi så bare læne os tilbage og ikke gøre noget? Nej, selvfølgelig bliver vi nødt til at handle! Vi har brug for strammere regler, så vi kan gøre en indsats for at forhindre unge mennesker i at begynde at ryge. Det er altafgørende! Og vi har reglerne på bordet nu. Det er utroligt vigtigt, at vi får støttet Linda McAvan og det forslag, der ligger på bordet, så vi kan forhindre unge mennesker i at begynde at ryge. For med et stramt regelsæt kan vi redde liv, og jeg synes, at det er vores forpligtigelse at redde europæiske borgeres liv.

Hvala poročevalki Lindi Mc Avan. Ključno je, da zavarujemo pred tobakom mlado generacijo. Gre za eminentno vprašanje javnega zdravja, kjer Evropska zveza ima nekaj kompetence in jo mora uporabiti.

S to direktivo se postavljamo na stran življenja. O škodljivosti tobaka ne potrebujemo novih dokazov. Manj kajenja pomeni več zdravja in več življenja. Problema tobaka ne bomo rešili z lepo dišečimi aditivi in drugimi zavajajočimi triki. Sladka cigareta bo še vedno škodljiva cigareta, naj bo tanka ali debela. Tobak bo škodljiv tudi, če se predstavi kot čista zadeva mode.

Ne pustimo se zavesti v razpravo o škodljivosti ali neškodljivosti posameznih aditivov. Ključno je, da smo pozorni na skupne učinke, na vse, kar ima namen promovirati kajenje, in poskusimo omejiti njegov obseg.

V tem duhu podpiram 75% zgoraj in reguliran pristop do e- cigarete, kot ga je opredelil Karl Heinz Florenz.

Na koncu bi se rad zahvalil neodvisnim evropskim in nacionalnim nevladnim organizacijam za njihovo predano delo za več zdravja.

  Karin Kadenbach (S&D). - Herr Präsident, sehr geehrter Herr Kommissar! Mein Motiv und wahrscheinlich das vieler anderer hier, in die Politik zu gehen, war, Lebensqualität zu schaffen, Lebensqualität zu erhalten und dazu beizutragen, Gesundheitsschutz in Europa voranzutreiben. Wir haben mit der vorliegenden Richtlinie eine ganz große Möglichkeit, diesen Gesundheitsschutz voranzutreiben.

Allein in Österreich sind 29,4 % der Jugendlichen zwischen 15 und 24 tägliche Raucher. Jeden Tag eine Zigarette. Sie sind dazu animiert worden aus ihrem Umfeld, aber sie werden auch verführt. Ich selber komme aus der Werbung, ich habe Kommunikation studiert, und ich weiß, wie viele Millionen und Milliarden in Wirklichkeit in diesen Bereich fließen, weil wir neue Zielgruppen erreichen wollen. Und so werden die Produkte gestaltet. Die Produkte werden so gestaltet, dass sie optisch gefällig sind, dass sie einladen, dass sie aussehen wie Kosmetik- oder Zuckerlpackerln, dass sie nicht abschreckend sind. Im Gegenteil – sie sollen das Rauchen so angenehm wie möglich machen durch Zusatzstoffe, Inhaltsstoffe, die schwer körperschädigend sind, aber nach Schokolade, Menthol oder Vanille schmecken.

Wir haben die große Chance, hier eine Gesetzgebung zu schaffen, die auf der einen Seite natürlich Rücksicht auf die Wirtschaft und auf die Arbeitsplätze in Europa nimmt. Wir stehen in einer Zeit, in der wir um jeden Arbeitsplatz zu kämpfen haben. Diese Arbeitsplätze müssen erhalten werden. Aber sie müssen so erhalten werden, dass wir auf der anderen Seite unseren Jugendlichen die Chance eines gesunden Lebens geben, damit uns nicht 700 000 Tote in Europa anklagen. Das sind in der Zeit, in der wir hier reden, schon 200 Menschen, die ....

Quiero llamar la atención a quien quiera que esté en la tribuna y esté filmando, porque no está autorizado a ello; por tanto, si vemos a alguien filmando desde la tribuna, será expulsado inmediatamente.

Por otra parte, no es menos cierto que la conducta de estos «lobistas» ha estado permanentemente al margen o en el límite de lo que es legal y, por lo tanto, no me sorprende nada una conducta que puede identificarles en contra de lo que son las normas de la democracia establecidas por esta Casa.

  Σπύρος Δανέλλης (S&D). - Κύριε Πρόεδρε, νομίζω ότι πρέπει να συνειδητοποιήσουμε πως δεν νομοθετούμε την απαγόρευση πώλησης καπνικών προϊόντων. Προσπαθούμε να αποτρέψουμε την προσέλκυση των νέων στο κάπνισμα και τον εθισμό σε τοξικές συνήθειες.

Παρά τις σημερινές δηλώσεις καλών προθέσεων, το 6.1.δ. επιτρέπει δυνητικά την απαγόρευση της επεξεργασίας καπνών ανατολικού τύπου και "BURLEY", θέτοντας έτσι σε κίνδυνο αφανισμού τον ευρωπαϊκό τομέα καπνού. Κι ενώ αυτές οι ποικιλίες αποτελούν το 90% της ευρωπαϊκής παραγωγής καπνού, τίποτα δεν εμποδίζει προϊόντα καπνών "VIRGINIA" από τρίτες χώρες να καταλάβουν τη θέση των ευρωπαϊκών στις επιλογές των καπνιστών.

Η οδηγία προβαίνει σε μια δυσανάλογη σε ορισμένα σημεία – και συχνά μη αιτιολογημένη – υπερρύθμιση σε σχέση με την επιχειρούμενη προστασία της δημόσιας υγείας που, προφανώς, είναι το βασικό ζητούμενο όλων μας. Παράδειγμα τα τσιγάρα "SLIM", ή η δημιουργία δυσκολιών στην προώθηση του ηλεκτρονικού τσιγάρου στο οποίο καταφεύγει κανείς προκειμένου να σταματήσει και όχι να αρχίσει το κάπνισμα.

Ponieważ kilku Kolegów mówiło o lobbystach, zacznę tę krótką wypowiedź od tego, że jako wieloletni działacz organizacji pozarządowych uważam, że jest absolutnym skandalem, żeby lobbyści podszywali się pod organizacje pozarządowe, pod organizacje społeczne, czy to ze strony farmaceutycznej, czy to ze strony przemysłu tytoniowego. Nie po to z trudem budowaliśmy społeczeństwo obywatelskie – ja sama pochodzę z kraju postkomunistycznego – żeby było ono wykorzystywane przez grupy lobbystyczne. Przychodźcie do nas jako lobbyści, co zresztą i tak robicie, bo inaczej podkopujecie najważniejszy element demokracji, a mianowicie autentyczne społeczeństwo obywatelskie.

Drugą uwagę kieruję do tych, którzy uważają, że musimy wprowadzić bardzo surowe zakazy. Oczywiście świetnie by było, gdyby ludzie byli zdrowi, szczęśliwi, rozsądni, nie palili i nie mieli nałogów, ale palą i mają nałogi, więc musimy tworzyć prawo dla człowieka i dla obywatela tak, żeby on przez nie za bardzo nie cierpiał. Wprowadźmy okresy przejściowe, zróbmy to rozsądnie, bo jesteśmy posłami rozsądnymi. Dajmy mandat pani McAvan po to, żeby znieść wszystko, co zachęca, ale nie powodujmy cierpienia obywatela.

  Biljana Borzan (S&D). - Cijenjene kolegice i kolege, prije nego glasate o ovoj Direktivi zapitajte se jedno temeljno pitanje. Želite li da vaše dijete jednoga dana postane pušač? Upravo je odvraćanje mladih jedan od osnovnih ciljeva ove Direktive, naravno, ako ga izglasamo u obliku kako je to predložila izvjestiteljica kojoj čestitam na odrađenom poslu, a ne onako kako to odgovara duhanskoj industriji.

Oko 70 % pušača počinje pušiti prije 18 godine. Njih 94 % prije 25 godine. Dakle, oni će desetljećima negativno utjecati na svoje zdravlje. Imajući na umu starenje populacije i sve veći pritisak na zdravstveni sustav, svaka sadašnja odluka višestruko će nam se isplatiti u budućnosti, a kamate na naše propuštene prilike plaćat će buduće generacije. Ovo nije samo zdravstveno i ekonomsko pitanje, ovo je pitanje o našoj vjerodostojnosti. Rezultati ovoga glasanja pokazat će je li Europski parlament institucija koja zaista brine o boljitku građana.

  Bendt Bendtsen (PPE). - Hr. formand! Jeg er helt enig i formålet med dette direktiv, nemlig at færre unge skal begynde at ryge. I den nordlige del af Europa har vi en række borgere, gerne tidligere rygere, der bruger snus, og det er utroligt, at vi nu vil forbyde snus, som er op til 90 % mindre skadeligt end røgtobak. Jeg mener, at det bør være op til den enkelte medlemsstat at beslutte, om de vil tillade eller forbyde snus, der er et traditionelt oralt røgfrit tobaksprodukt, som er langt, langt mindre skadeligt end røgtobak. Det hænger altså ikke sammen at forbyde snus, når cigaretter er tilladt.

  Zbigniew Ziobro (EFD). - Panie Przewodniczący! W tej sprawie widać brak konsekwencji, brak szczerości tych, którzy mówią nam, że chcieliby ograniczyć produkcję i konsumpcję papierosów i tytoniu w Europie. Otóż z jednej strony zakazuje się pewnych kategorii papierosów, a z drugiej strony nie wprowadza się takiego zakazu wobec innych kategorii. Zakazuje się np. papierosów typu slim, które produkowane są w Polsce czy w Bułgarii, ale nie zakazuje się papierosów typu Extra mocne, które – dajmy na to – produkowane są we Francji czy w innych krajach. To jest niekonsekwencja, która pokazuje, że w tle może chodzić o interesy. Więc jeżeli wprowadzamy zakaz, to może powinien on dotyczyć produkcji wszystkich papierosów. Ale jeżeli wprowadzamy takie ograniczenia wybiórczo i uderzamy w producentów w określonych krajach, to znaczy, że może kryć się za tym jakiś interes i to nie jest szczere.

Jestem przeciwnikiem palenia papierosów – nie palę i jestem zwolennikiem edukacji, która trafi do ludzi i przekona ich do niepalenia papierosów. Ale nie wprowadzajmy takich ograniczeń, które spowodują poważne problemy gospodarcze w pewnych krajach i jednych preferują i wspierają, a innym rzucają kłody pod nogi.

  Mairead McGuinness (PPE). - Mr President, I come from Ireland and we have this week, under the direction of our Health Minister, James Riley, decided that Ireland will be tobacco-free by 2025. It is a very ambitious target, so I want in particular to compliment the President-in-Office for a very passionate speech about the fact that cigarettes kill: there is no way round this statement of fact.

So if this Directive under the direction of our rapporteur helps to stop young children like mine from smoking, let us give it every bit of support and let us discuss some of the details as the rapporteur has.

However, on e-cigarettes, I think this is a very contentious issue. I am always touched or surprised or puzzled when on the Ryanair flight e-cigarettes are ‘encouraged’, let us say. I did not know that Michael O’Leary had a clinic to help people stop smoking on all his flights. If that is the case, I compliment him. I rather suspect that this is another product to keep people smoking, perhaps stop ....

  Phil Prendergast (S&D). - Mr President, over the last decade since the introduction of the Tobacco Products Directive we have had attempts at a reduction in the numbers of smokers, but there is a much higher rate of tobacco use among our youth. Like my colleague Mairead McGuinness, I would like to see a very big reduction. I think the legislative review is an essential instrument to keep improving public health in the face of a scourge. We do want to see three quarters of cigarette packs covered with health warnings and a ban on flavourings and an end to the attractive slim cigarette formats.

Whilst plain packaging and point-of-sale display bans failed to secure a majority in the Committee on the Environment, Public Health and Food Safety, nothing in this legislation prevents EU Member States from taking these and further measures. I hope many will be following the good example set by Ireland on this front.

  Struan Stevenson (ECR). - Mr President, I have no doubt at all that electronic cigarettes could set millions of non-smokers on the path to nicotine addiction, and should therefore be regulated as medicinal products. It is clear that less than a decade since their first appearance they have already become a multibillion dollar industry, with the major tobacco giants snapping up the key e-cigarette companies and with glamorous movie stars appearing in advertisements, former Playboy models now advertising cigarettes, and huge full-page advertisements.

This is why Norway and Brazil have banned e-cigarettes altogether. This is why we should be clear that these e-cigarettes are not a pathway to giving up smoking. They are a gateway to taking up smoking.

  Sergio Paolo Francesco Silvestris (PPE). - Signor Presidente, onorevoli colleghi, signor Commissario, Lei ha detto 700.000 morti in Europa per fumo, quanti per carne rossa che è cancerogena? Per grassi animali, che provocano colesterolo? Per dolci, che inducono diabete? Per alcool, per droga? Signor Commissario, quando una direttiva antidroga?

Dopo questa direttiva, se sarà approvata, signor Commissario, ad Amsterdam si potrà andare nei coffee shop a comprare cannabis per farsi una canna e i ragazzi di 18 anni potranno farsi legalmente, ad Amsterdam, una canna, un torcione, ma non una sigaretta al mentolo! Se questa le sembra una cosa che ha una sua logica, signor Commissario, io sono curioso di capire quale sia!

Se non sa dove si vende la cannabis, lo chieda ai tanti assistenti dei deputati di sinistra che vogliono questa direttiva, che da Bruxelles partono ogni fine settimana per recarsi in pellegrinaggio ad Amsterdam. E poi, tutti questi divieti, queste limitazioni anche, signor Commissario, per proteggere l'embrione dal fumo – perché le donne incinte non debbono fumare – allora noi siamo…

  Zigmantas Balčytis (S&D). - Esu vienas iš tų, kuris 20 metų rūkė ir dabar 19 metų nerūko, tai turiu teisę pasakyti, kad rūkymas kas dieną, po truputį, bet labai kenkia sveikatai. Prieš keletą metų mano valstybėje buvo labai didelės diskusijos dėl draudimo rūkyti viešose vietose, tarp jų – kavinėse ir restoranuose. Šiandien, po keleto metų, labiausiai džiaugiasi ne tik tie, kurie nerūko, bet ypač tie, kurie rūko, nes per vakarėlius, ypač jaunimas, surūko žymiai mažiau cigarečių.

Todėl ši direktyva (aš nesileisiu į diskusijas ir į detales) yra subalansuotas sprendimas tarp gamintojų (nes iš tikrųjų daug žmonų dirba šiame sektoriuje) ir sveikatos problematikos. Jeigu mums sveikata yra pirmoje vietoje, tai aš manau, kad ši direktyva turi būti priimta. Sveikinu Lietuvą, sveikinu ...

  María Auxiliadora Correa Zamora (PPE). - Señor Presidente, sin duda todos los que estamos aquí esta mañana compartimos el objetivo de esta Directiva, que es evitar que nuestros jóvenes se inicien en el consumo del tabaco.

En su afán por conseguir este objetivo, el texto que se nos presenta, por parte de la Comisión Europea, ignora por completo el gravísimo impacto socioeconómico que estas medidas tendrían en términos de destrucción de empleo y menoscabo de la riqueza de las regiones afectadas. Regiones como, por ejemplo, Extremadura, en España, en la que al menos el 25 % de su producción final agraria depende del cultivo del tabaco.

La Comisión nos presentó un texto desequilibrado y carente de base científica. Estos objetivos no se van a conseguir con un exceso de regulación, sino mediante campañas de prevención y educación dirigidas a nuestros jóvenes. Así, al menos, lo han entendido las cinco comisiones parlamentarias competentes en sus respectivas opiniones, aunque la Comisión ENVI de este Parlamento ha hecho oídos sordos a dichas opiniones.

De cara al voto de esta mañana, me gustaría…

  Mojca Kleva Kekuš (S&D). - Po dvanajstih letih uporabe obstoječe tobačne direktive je kajenje še vedno eden izmed glavnih vzrokov prezgodnje smrti v EU in zahteva letno več kot 700.000 življenj, kar smo slišali v današnji razpravi že večkrat.

Ker pa je največ novih kadilcev med najstniki, zlasti med puncami, se je zanje tobačna industrija posebej potrudila s posebej atraktivnim pakiranjem. Okusi mentola, čokolade, vanilije in sadja so prvi način, da se sploh mladi seznanijo s kajenjem in postanejo kasneje tudi odvisni.

Z novo direktivo bomo povečali zdravstvena opozorila na škatlicah, regulirali sestavo, obliko in velikost cigaret, omejila se bo propaganda tobačne industrije, ki skuša med mladimi dobiti nove odvisnike.

Elektronske cigarete morajo biti kvalitetne in zdravju neškodljive, zato podpiram strožji postopek avtorizacije tega farmacevtskega proizvoda.

Ker svoj mandat jemljem resno in ker zagovarjam javno zdravje, predvsem zdravje najmlajših, bom odgovorno ravnala in bom tudi podprla spremembo tobačne direktive.

  Tonio Borg, Member of the Commission. − Mr President, this has indeed been an interesting and, I may add, colourful debate, because of the plethora of arguments which have been put forward, mostly in favour of health, but others in favour of saving jobs. The argument that jobs will be lost has been a recurrent argument put forward by those who oppose the Directive.

So the question is whether we protect jobs or lives. Of course, if we had to make just that choice – to choose between jobs or lives – I think it is obvious that we would choose lives. After all, the right to life is number one in all the charters of fundamental human rights. But I believe that it is possible to protect both lives and jobs. As Mrs Willmott said, if we succeed in our aims in controlling tobacco, lives will be saved, but jobs will also be saved, because the economic funds which will be released by less expenditure on health care and more savings made by those who quit smoking will be invested in the economy, thus also generating jobs.

Let us be very careful about the argument relating to jobs. If we start with the argument that by reducing the number of smokers there will automatically be a loss of jobs, that is an argument which can be used not only against this Directive, but against any measure of tobacco control. So let us withdraw our education campaigns to prevent consumption, otherwise the number of smokers will decrease and a number of jobs will be lost. Or let us abandon our fiscal measures, because by making tobacco products more expensive, fewer people will smoke and there will be a loss of jobs. So let us be very careful about the argument concerning jobs.

Another argument is that state revenue will be lost. Now I am surprised at this argument, because on 21 June the governments, in some display of masochism, decided to approve this Directive. Here in Parliament, we hear this argument about protecting state revenue. Well, the governments felt that the loss of fiscal revenue which they are now suffering, because of what they spend on curing and treating smoking-related diseases, far exceeds the revenue which the state gets from tobacco consumption.

Then there was the nano-state argument, taken to its extreme by Mr van der Stoep, who suggested that we regulate Bible reading, but not smoking. Of course my advice to him is to read the Bible and not smoke at the same time. If we put forward this nano-state argument in relation to health matters, then we should abolish all the regulations imposing on us the obligation to wear seat belts when driving or for motorcyclists to wear crash helmets because, after all, they have a right to die in traffic accidents if they want to. Of course, these regulations are in place first of all because of health – because deaths arising from traffic accidents create emotional disturbance and emotional distress – and also because, after all, it is the state which foots the bill each time there is an accident and we have to treat the injuries which are suffered.

Mr Krahmer then asked me what scientific evidence I had that, with larger health warnings, there would be a reduction in the number of smokers. What scientific evidence is there to prove that with a ban on flavours there would be reduction in smoking? There are scientific studies, which have been commissioned by us, that large pictorial health warnings on the front and back of packs are effective deterrents and that in countries which have introduced such measures, such in Canada or Brazil – and these are two countries the size of continents – there has been, simultaneously with the introduction of these measures, a fall on the graph.

Now of course Mr Krahmer can say that this is just a coincidence and that it just happens that in two different countries – Brazil and Canada – when they introduced these measures there was a gradual decrease in smoking. But I do not believe in that number of coincidences and I think there is perfect evidence that this Directive will be effective. It will be effective because the opposition to it by the tobacco industry has been strong. This is because it is effective. Had it not been effective – if it is approved – then why has there been all this opposition to this Directive? The opposition to this Directive is based on the fact that, if we approve this EU law, in practice, when it comes into force, it will bring about a reduction in tobacco consumption.

I would like to conclude by referring to the legal basis, which was raised by Mr Lehne of the Committee on Legal Affairs. The current directive, the one we have already, which introduces certain restrictions and regulates the internal market tobacco products, is based on Article 114, which is the legal basis for the internal market, and it harmonises the presentation of tobacco products.

This directive, the one we have already, has already been unsuccessfully challenged before the European Court of Justice. The European Court of Justice said yes, the current directive, the one we have already, is in line with Article 114 of the Treaty. As Mr Liese said, Article 114 states that the Commission, in its proposals concerning health and safety, will take as a basis a high level of protection. So this is the article on which this directive which we are proposing, which is building on the current directive, is based.

Then there was the usual argument of ‘Why don’t you prohibit smoking altogether?’ As someone said, probably if smoking had been introduced today, we would have prohibited it altogether. But I find this argument strange, because it sometimes comes from the same people who deem it controversial to have the health warning on the upper part of the cigarette packet, instead of the lower part. Of course they want it on the lower part because when you put it on display it will not be seen. If this is controversial, can you imagine if we had to prohibit sweets, if we had to prohibit smoking, if we had to prohibit red meat?

Politics is the art of the possible, of course. What we are doing is introducing a measure which will reduce the number of smokers, which will save lives. And let us not be flippant about this. This is something serious, of course, along with other measures. I am not saying that only the Tobacco Directive will help in the reduction of the number of smokers, but it will certainly be a tool in our hands to reach our aim. I hope that Parliament will help the Commission and Council to reach it as well.

  Vytenis Povilas Andriukaitis, President-in-Office of the Council. − Mr President, I should like to thank Members for an interesting and well-argued debate and for the excellent report by Linda McAvan.

Of course I fully agree with what Commissioner Borg said. We are eagerly awaiting your vote later today. However, listening to the position expressed, I am hopeful that this Parliament’s position and the Council’s approach in general will be relatively close, particularly on the main points. This gives us encouragement that we can reach an agreement relatively quickly.

As I said before, the Council is ready to start negotiations with the European Parliament as soon as possible. There will certainly be some points where we have a different perspective, but overall we share the same objective: the protection of the health of European Union citizens, especially young people and their access to correct information about the consequences of smoking.

I will do my utmost to ensure that we reach our shared goal of a text which can enter into force as soon as possible. This is an important piece in a vital strategy to tackle the significant health problems caused by smoking. It will serve the common interest of society, with higher standards of health and well-being. In so doing, it will bring substantial economic benefit. All of this is in our collective interest. I, personally, believe in a Europe free of smoking and I thank you very much for this interesting debate.

  Linda McAvan, rapporteur Mr President, I would like to thank the President-in-Office for his support this morning and throughout the last few months. I do hope we will start good negotiations and have a quick resolution. I also wish to thank Commissioner Borg for his very frank debate here this morning and for putting the legislation on the table and enabling us to – hopefully – complete it before the end of this parliamentary term. And I would like to thank all colleagues who have shown their support this morning from across the House. That shows this is a balanced proposal. I hear people saying it is not flexible, but we took on board many comments from many people, so the outcome can be supported across Parliament.

I want to say an extra special ‘thank you’ to the shadow rapporteurs, some of whom are not here now, but who really have worked very hard, and to their staff and the staff of the groups. Particular mention should be made of Kiri Hanks, my researcher who has worked extremely hard, and Emilia Romano from the secretariat of the Committee on the Environment, Public Health and Food Safety and Ulrike Schoner from the Socialist Group. People often forget how many hours go into preparing a voting list, and all the staff and all colleagues have worked very hard.

Finally, we have heard many figures this morning and many different points have been made, but Europe is not ahead on tobacco policy. We are lagging behind the United States. We are lagging behind many Latin American countries. This morning it is time to play catch-up. In my country, 570 children start smoking every day. Mr Krahmer asked: ‘Where is the evidence about warnings?’ I have sent him some. He has disappeared now but I hope he has read it in the past hour.

There is lots of evidence. The independent evidence from doctors is very strong, while the rest comes from the tobacco industry. Please believe doctors – people who have public health at heart. The Commissioner said, and other colleagues have said: ‘Let us choose life this morning’. Let us put the interests of citizens and future generations of citizens first.

Estamos perante uma legislação da maior importância no controlo essencial do tabagismo e na melhoria da saúde pública de milhões de europeus afetados pela doença e das largas centenas de milhar que morrem prematuramente todos os anos em resultado do consumo do tabaco. Reduzir o consumo do tabaco sobretudo nos jovens é um imperativo que nenhum responsável pode deixar de prosseguir e onde nenhum interesse maior pode ser evocado para se lhe sobrepor. Basta referir que 13 milhões de pessoas sofrem de problemas de saúde e 700 mil morrem todos os anos devido ao consumo de tabaco e que até aos 18 anos 70% dos nossos jovens se iniciam no seu consumo e até aos 25 anos 94% o fazem.

É por isso que saudamos esta diretiva em todos os pontos que genuinamente defendem a saúde. Todavia, há aspetos não ligados à saúde em que a proposta de diretiva foi longe demais. Quero, por isso, agradecer ao S&D ter aberto uma exceção apresentando unicamente a plenário a minha proposta de alteração para salvaguardar a não discriminação do tabaco açoriano, injusta e injustificada, por nada ter a ver com razões de saúde. Peço, por isso, a todo o Parlamento o apoio para a reparação desta injustiça.

  Erik Bánki (PPE), írásban. – Tisztelt Elnök Úr! Mindenekelőtt hadd hívjam fel a figyelmet a magyar kormány azon erőfeszítéseire, amelyeket az utóbbi három évben tett a dohányzás visszaszorítása érdekében, különös tekintettel a fiatalkorúak védelmére. A számtalan intézkedésből csak néhányat említve érdemes kiemelni a nemdohányzók védelméről szóló törvényt, illetve a dohánytermékek értékesítésének korlátozását, melynek értelmében Magyarországon cigarettát már csak az erre kijelölt értékesítő helyeken, ún. trafikokban lehet vásárolni. A kormány tevékenységének kiemelkedő elismerése az Egészségügyi Világszervezet díja, melyet a Orbán Viktor miniszterelnök úr a dohányzás visszaszorításáért vívott sikeres harcáért kapott. Mindezek fényében örömmel tölt el, hogy az Európai Bizottság egy olyan irányelv-tervezetet nyújtott be, amely az emberek érdekeit – különösen a fiatalkorúak egészégének védelmét – az ipar érdekeinek védelme fölé helyezi.

Hadd jegyezzem meg, hogy Janez Potocnik, környezetvédelemért felelős biztos ezzel szemben semmit sem tett a verespataki cianidos bányaberuházás megakadályozása és a cianidos bányászati tevékenység uniós betiltása érdekében, ahol az emberi élet és környezeti értékekkel kapcsolatos kockázatok mit sem számítottak, és az ipari érdekek oltárán feláldozta őket!

  Sergio Berlato (PPE), per iscritto. – Lo scorso dicembre la Commissione europea ha presentato una proposta di revisione della Direttiva europea sui Prodotti del Tabacco. Tra le misure previste dalla proposta della Commissione, si prevede la riduzione sia della differenziazione tra prodotti-confezionamenti sia dello spazio riservato ai marchi. A mio avviso, cio' rappresenterebbe una violazione dei diritti di proprietà intellettuale delle imprese produttrici e, inoltre, porterebbe all’eliminazione dal mercato legale di intere categorie di prodotti incoraggiando i consumatori ad orientarsi sui prodotti provenienti dal commercio illecito. Inoltre, desidero portare all'attenzione della Commissione europea un dato economico di importanza non trascurabile: la filiera italiana del tabacco impiega direttamente circa 200mila addetti a cui vanno sommati i dipendenti dell’indotto. L'applicazione della proposta di revisione della direttiva in oggetto, cosi' come concepita, comporterebbe consistenti perdite economiche e occupazionali per la filiera italiana di questo settore che, in un momento storico come quello attuale di persistente crisi economica, sarebbe auspicabile fossero scongiurate. Come sottolineato nei numerosi emendamenti che ho presentato in Commissione ENVI negli scorsi mesi, ribadisco in questa sede come, al fine di salvaguardare la sopravvivenza del settore del tabacco come comparto vitale per l'economia, sia fondamentale una revisione dei divieti relativi all’utilizzo di ingredienti nella manifattura di sigarette.

  Преслав Борисов (PPE), в писмена форма Г-жо Председател, колеги, защитата на общественото здраве е несъмнено най-важната цел на предложената директива. Трябва обаче да се запитаме дали мерките, заложени в нея, са пропорционални.

Забраната на определен вид тютюневи изделия като слимс и ментол няма да доведе до желания резултат, а до точно обратното. Потребителите ще продължават да ги търсят, но този път ще си ги набавят чрез пазара на черно, където ще са изправени пред фалшифицирани и още по-вредни продукти.

Ограничението за тютюнопушенето на обществени места е достатъчна мярка и тя вече показа своя положителен резултат. Надявам се в България тя да продължи да действа. Подкрепям напълно намаляването на атрактивността на опаковките на цигари, но не и прекомерното регламентиране, което би нарушило други права, заложени в европейското законодателство като например правата на марките. Според мен, комбинирани предупреждения от 65% са напълно достатъчни, за да информират потребителите за опасността от тютюнопушенето и ние трябва да търсим по-балансиран подход.

Предложената директива би имала и доста отрицателно влияние върху цялата индустрия, и най-вече върху малките и средните предприятия, предизвиквайки загуба на работни места, особено във време, в което всички полагаме огромни усилия да се справим с безработицата. Моментът за такива радикални промени не е сега.

  John Bufton (EFD), in writing. My party has made it very clear from the outset that we oppose all aspects of this Directive. No-one can dispute that smoking is a major health issue that affects the whole of Europe. Indeed we have all seen the statistics – that over 700 000 people a year in Europe die of smoking. However shocking this figure is, though, it is ultimately these people’s right to smoke – and the EU certainly does not have the right to try and stop them. Ironically, the measures outlined in the Directive are flawed on so many levels that they are unlikely to stop people smoking anyway. Banning smalls packs will simply make people buy more cigarettes. Banning menthol and other flavoured cigarettes will simply increase the cigarette black market. Demanding that large health warnings be put on cigarette packs will make counterfeiting easier, fuelling the black market yet further. Once again, the EU has failed to see the wood for the trees here and, as a result, this Directive is not only misinformed and unfounded but entirely unfit for purpose.

  Nessa Childers (NI), in writing. – We need to enforce, regulate and legislate for tobacco activities and products. Research shows that tobacco places a heavy burden on governments and society as a whole. Costs include indirect costs related to workday losses due to morbidity and direct costs associated with inpatient and outpatient care. Non-smokers also pay for the costs of smoking, primarily in the form of higher health insurances and medical costs related to second-hand smoke, leading to higher taxes and higher prices for healthcare products and services. The new Directive will be good for people’s health and will especially act to discourage young people from getting hooked on tobacco products. One in every five young boys and girls between the ages of 13 and 15 in Europe are smokers. This is an absolutely shocking ticking time bomb for our public health systems. We have a chance to protect our children from the harms of tobacco and assist those who smoke to stop. For those reasons, I support and applaud the rapporteurʼs work.

  Lidia Joanna Geringer de Oedenberg (S&D), na piśmie. Popieram ogólne założenia dyrektywy zmierzające do ograniczenia palenia, a w szczególności do prewencji inicjacji tytoniowej wśród młodych ludzi oraz do uświadamiania obywateli w zakresie negatywnych skutków palenia. Jestem jednak przeciwna niektórym przepisom projektu, które stwarzają problemy natury prawnej. Wątpliwości nasuwa podstawa prawna wybrana przez Komisję tj. art. 114(1) TFUE, który ma za zadanie dostosowywać wymogi służące lepszemu funkcjonowaniu jednolitego rynku. Cel Komisji – ochrona zdrowia – leży w zakresie kompetencji państw członkowskich na mocy art. 168 ust. 5 TFUE, jednoznacznie wykluczającego jakąkolwiek harmonizację środków, „których celem jest bezpośrednia ochrona zdrowia publicznego w odniesieniu do wyrobów tytoniowych”.

Ponadto zakaz sprzedaży papierosów typu „slim” lub „mentol” oraz wyłączenie z zakresu obostrzeń wyrobów takich jak cygara na podstawie nieudowodnionych naukowo twierdzeń, iż jedne są bardziej atrakcyjne dla młodych niż drugie, nie ma nic wspólnego z ulepszeniem funkcjonowania jednolitego rynku. Co więcej – może prowadzić do dyskryminacji pewnych przedsiębiorców i faworyzowania innych, co zakłóci konkurencję na rynku unijnym. Standaryzacja opakowań nasuwa kolejne wątpliwości co do poszanowania praw zapisanych w Karcie praw podstawowych. Dodatkowo narzucenie „ujednoliconych opakowań” może naruszać prawa własności intelektualnej, a w szczególności znaki towarowe wyraźnie objęte prawem własności z art. 17 Karty oraz art. 20 porozumienia TRIPs. Kontrowersje wzbudzają również liczne akty delegowane zaproponowane przez Komisję, które zgodnie z art. 290 TFUE powinny dotyczyć wyłącznie pobocznych elementów legislacji. W projekcie stosowane są jednak do spraw dużej wagi, co daje Komisji de facto prawo nawet do ustalenia maksymalnej ilości nikotyny w papierosach do 0%, co może spowodować całkowity zakaz obrotu tymi towarami i przenieść papierosy na „czarny rynek”, co jedynie zwiększy, a nie rozwiąże problem.

  Eduard-Raul Hellvig (ALDE), în scris. – O politică ambițioasă de promovare a sănătății presupune și o reglementare inteligentă a produselor din tutun. Din acest motiv, salut propunerea Comisiei care conține numeroase elemente care vor scădea atractivitatea produselor din tutun în special în rândul tinerilor. Consider, totuși, că trebuie păstrat un grad de proporționalitate, în sensul că nu putem merge prea departe cu interdicțiile. Cât timp comercializarea țigărilor rămâne legală, trebuie să recunoaștem că există o industrie pe care nu o putem împiedica să-și desfășoare activitatea. De aceea, îmi manifest simpatia față de introducerea avertismentelor de sănătate pe suprafața a 75 sau 65% din suprafața pachetului, însă nu cred că introducerea ambalajelor standard este oportună.

Aș dori să fac o observație și în ce privește țigările electronice. Este de notorietate că acestea sunt mai puțin nocive decât țigările obișnuite și că pot ajuta fumătorii să se lase de fumat. Totuși, nefiind produse total inofensive, este ilogic să le calificăm drept medicamente. Acest lucru ar însemna un acces mai redus al fumătorilor la un produs mai puțin nociv decât țigările, la care accesul este unul larg. Cred că este mai echilibrat ca acestea să fie considerate produse derivate din tutun și să poarte avertismentele de sănătate adecvate.

  Jarosław Kalinowski (PPE), na piśmie. – Głównym założeniem tzw. dyrektywy tytoniowej jest ograniczenie liczby osób palących w UE. Jak wynika z badań przeprowadzonych przez Komisję Europejską, młodzi Europejczycy sięgają głównie po papierosy smakowe oraz typu slim, dlatego też zaproponowano wycofanie tych produktów ze sprzedaży. Decyzja ta niesie jednak ze sobą bardzo poważne skutki dla przemysłu tytoniowego, który w wielu państwach członkowskich ma ogromne znaczenie dla gospodarki. Oczywiście dbając o zdrowie obywateli, a zwłaszcza ludzi młodych, powinniśmy ograniczać dostęp do wyrobów tytoniowych osobom niepełnoletnim, wspierać działania edukacyjne i informacyjne uświadamiające obywateli o skutkach palenia, a także wymagać od producentów przekazywania na opakowaniach rzetelnych informacji o szkodliwości ich wyrobów. Jednakże wprowadzenie tak restrykcyjnych zapisów będzie miało fatalne skutki dla sektora rolnego, przemysłu oraz handlu. Ucierpią zarówno plantatorzy tytoniu, producenci, jak i sprzedawcy, a zatrudnienie straci ogromna liczba osób.

Ponadto, jeśli ograniczymy produkcję papierosów w UE, z całą pewnością wzrośnie ona w krajach sąsiadujących, tj. w Rosji i na Białorusi, a to z kolei spowoduje wzrost nielegalnego handlu, szczególnie na wschodniej granicy Unii. Dlatego też opowiadam się za odrzuceniem tak rygorystycznych propozycji. Jeśli chcemy ograniczyć handel wyrobami tytoniowymi w UE, musimy zrobić to stopniowo, z okresami przejściowymi i rekompensatą dla producentów, bez negatywnych konsekwencji dla sektora rolnego, przemysłu i handlu.

  Sandra Kalniete (PPE), rakstiski. Uzskatu, ka šodien pieņemtie ierobežojumi ir tikai nepilnīgs solis, kas sperts pareizajā virzienā. Smēķēšanas dēļ katru gadu Eiropas Savienībā priekšlaicīgi mirst ap 700 tūkstošiem cilvēku. Statistika liecina, ka vairāk nekā 10 miljoni cilvēku dalībvalstīs sirgst ar dažādām smēķēšanas izraisītām slimībām. Šie skaitļi ir šokējoši, un tieši tādēļ es atbalstīju Eiropas Komisijas priekšlikumu grozīt Tabakas produktu direktīvu. Šodien balsojumā es atbalstīju tos Vides komitejas kolēģu sagatavotos grozījumus, kuri paredz stingri ierobežot smēķēšanas izplatību, aizliegt mentola un citas aromatizētās cigaretes un pēc iespējas lielāku cigarešu paciņas daļu noklāt ar informatīviem ziņojumiem par smēķēšanas izraisītajām slimībām. Es neloloju ilūzijas, ka šie stingrākie noteikumi samazinās esošo smēķētāju skaitu Eiropā, bet tāds arī nav to mērķis. Tie ir vērsti uz preventīviem pasākumiem, kas mazina smēķēšanas pievilcīgumu un attur jauniešus no agras smēķēšanas. Statistika liecina, ka 70 % smēķētāju sāk smēķēt vēl nesasnieguši 18 gadu vecumu. Tieši tādēļ tas ir sabiedrības pienākums informēt pusaudžus un bērnus par ļaunumu, ko veselībai nodara smēķēšana. Tiem, kas aizbildinās ar tabakas rūpniecības ekonomisko nozīmi un apdraudētajām darba vietām, aicinu uzdot sev jautājumu: „Vai vēlaties, lai jūsu bērns sāk smēķēt?” Esmu pārliecināta, ka neviens cilvēks to nevēlas.

  Vladimír Maňka (S&D), písomne. Fajčenie je v EÚ jednou z najväčších príčin smrti. Zabije ročne 700 tisíc ľudí! Až 70 % fajčiarov začne fajčiť vo veku menej ako 18 rokov.

Sem preto musia smerovať naše opatrenia – ako odradiť mladých ľudí od fajčenia: na cigaretových krabičkách použiť drsnejšie výstrahy a zakázať balenia a arómy, ktoré sú príťažlivé pre mladých ľudí.

Na druhej strane musíme dbať, aby naše opatrenia viedli účinný boj proti falšovaniu a pašovaniu cigariet. Aj z tohto dôvodu nemôžem podporiť extrémny návrh veľkosti zdravotných varovaní. Ministri zdravotníctva krajín EÚ sa zhodli, že zdravotné varovania majú pokrývať 65 % plochy krabičky. Podľa informácií z ministerstva financií z mojej krajiny by akákoľvek veľkosť nad 65 % technicky znemožnila umiestniť na krabičky kontrolnú známku. Tým by sa stratil účinný nástroj proti falšovaniu a pašovaniu.

  Alajos Mészáros (PPE), písomne. – Naša diskusia by nemala byt o tom, či je fajčenie škodlivé alebo nie. Vieme, že konzumácia tabakových výrobkov škodí zdraviu, a členské štáty sa majú usilovať o zníženie spotreby týchto produktov. Pri tom všetkom, niektoré ustanovenia návrhu Komisie vyvolávajú vážne pochybnosti, pokiaľ ide o ich súlad so základnými právami, napríklad s vlastníckym právom, právom na informácie a so slobodou podnikania. Mali by sme zabezpečiť udržateľný a spravodlivý európsky priestor na pôsobenie našich firiem. Návrh zavádza nadmernú reguláciu v oblasti výroby a obchodovania s tabakovými výrobkami, na úkor vnútorného európskeho trhu. Zvýšenie rozsahu zdravotných varovaní na baleniach tabakových výrobkoch môže byt kontraproduktívne. Táto kontraproduktívnosť nových opatrení sa môže ukázať aj vo zvýšení podielu nelegálneho obchodu. Negatívny vplyv môže mať smernica na ekonomickú situáciu malých a stredných podnikov. Ďalej sa musí pripomenúť, že kvôli väčšiemu trhu falšovaných tabakových výrobkov unikne členským štátom dôležitý príspevok do štátneho rozpočtu. Musíme chrániť záujmy spotrebiteľa, či ide o fajčiarov alebo nefajčiarov. Spotrebiteľ má právo na úplnú informáciu o zdroji výrobku, a práve preto som za rozmer zdravotného varovania do 50 %. Našou povinnosťou však nie je iba chrániť spotrebiteľov, ale aj výrobcov, ktorí majú právo na transparentné označenie ich chránených obchodných značiek.

  Wojciech Michał Olejniczak (S&D), na piśmie. W projekcie nowej dyrektywy tytoniowej Komisja Europejska próbuje narzucić jeden model działania wszystkim państwom członkowskim. Kierując się celem ograniczenia palenia w Europie o znikome 2%, Komisja sięga po środki, których skuteczność nie jest wcale potwierdzona, za to przewidywane efekty uboczne w postaci spadku zatrudnienia czy wzrostu przemytu i przestępczości zorganizowanej są znaczące. Polska jest jednym z największych europejskich producentów surowca tytoniowego i wyrobów tytoniowych. Papierosy mentolowe i typu „slim” cieszą się w Polsce zauważalnie większą popularnością niż w innych państwach członkowskich. Jest to wyraz europejskiej różnorodności: tak jak w Szwecji zażywa się snusu, w Finlandii sięga po cukierki przypominające fajki, a w Portugalii po tradycyjne krótkie papierosy, tak w Polsce pali się „mentole” i „slimy”.

Sprzeciwiam się także regulowaniu e-papierosów jako produktów medycznych. E-papierosy powinny być zawsze badane pod względem jakości, ale potraktowanie ich jak leków z pewnością podwyższy ich cenę i uderzy w ich wytwórców – głównie małe i średnie przedsiębiorstwa. Nie ulega wątpliwości, że wszystkie produkty tytoniowe są szkodliwe i mogą prowadzić do chorób i śmierci. Dlatego jestem gorącym zwolennikiem informowania Europejczyków o szkodliwości palenia, a w szczególności popieram stosowną ochronę ludzi młodych. Taka regulacja nie może jednak prowadzić do dyskryminacji rolnictwa, przemysłu i lokalnej przedsiębiorczości w jednym państwie.

  Владимир Уручев (PPE), в писмена форма. Г-н Председател, колеги, една от декларираните цели на Директивата за тютюневите изделия е да предпази младите хора от посягането към цигарите. Вярвам, че по-силно въздействащите предупреждения върху кутиите на цигарите и премахването на някои „овкусители“ могат да изиграят позитивна роля, затова подкрепям увеличаването на размерите на тези предупреждения и ограничаването на овкусителите в цигарите. Но не виждам как се отрежда „въздържаща“ роля и на уеднаквяването на кутиите, на обезличаването на марката. Опасявам се, че това ще доведе до употреба на по-евтин и некачествен тютюн с по-големи вреди за здравето. Затова не подкрепям такива мерки, които по-скоро могат да имат негативен ефект.

Не подкрепям и тезата, че слим цигарите могат да бъдат класифицирани като притегателно тютюнево изделие и заради това да бъдат забранени. Премахването им би насочило пушачите на такива цигари към обикновени цигари, но не би ги отказало от пушенето. Всеки от нас изпитва вътрешно противоречие по отношение на електронните цигари, когато се касае за по-строга медицинска регулация към тях, а значи и по-голяма безопасност или да останат на пазара като никотинов продукт. Имайки предвид обаче факта, че електронните цигари са по безопасни за здравето от обикновените цигари, защитавам оставането им на пазара на еднаква основа с останалите цигари.

While the TPD addresses many important facets of public health I fear that it also infringes on the rights of our citizens while preventing them and their Member States from determining what tobacco products can and can’t be sold. I am concerned that historically traditional products that are used in certain Member States are in danger. In saying that, I want to emphasise that I support the pursuit of protecting the youth of this Union; however, adults should retain their right to purchase products that have long been part of their culture. Also, certain bans, such as those outlined in this directive, have the effect of imposing on our internal market, and subsequently impede our ability to not only improve the economies of certain Member States but also reduce our ability to control and/or regulate the sale of tobacco products on the black market, which are, without a doubt, going to drastically increase given the restrictions put forth by the TPD.
