  Juan Fernando López Aguilar, Autor. − Señora Presidenta, todos estamos de acuerdo en que el crimen transfronterizo está en aumento en la Unión Europea. El informe final de la Comisión CRIM así lo pone de manifiesto y lo mismo hace el último ejercicio de evaluación del SOCTA (Serious and Organised Crime Threat Assessment), llevado a cabo por Europol, al apuntar que toda una nueva estirpe de delitos operan en red o a través de networks capaces de actuar internacionalmente en varios países, con socios múltiples y en áreas muy distintas a la vez. Esto supone no solamente una transgresión muy fácil de las antiguas fronteras nacionales, sino el hecho de que el crimen ya no puede ser asociado tampoco a regiones específicas ni a un concreto centro de gravedad.

Resulta muy importante por eso, en la Unión Europea, que estas redes criminales sean atacadas de forma conjunta, con un uso eficiente de todos los mecanismos transfronterizos disponibles para intercambiar información y coordinar actividades operativas. De modo que nos encontramos ante un desafío mayúsculo para el conjunto de la Unión Europea y el debate de hoy debería intentar aportar algo acerca de cómo podemos estructurar y organizarnos mejor para intercambiar información en materia de aplicación de las leyes de la Unión, de manera que los criminales puedan ser detenidos lo más rápidamente posible y garantizar, al mismo tiempo, los derechos fundamentales de los ciudadanos.

Hay ya una panoplia, un abanico de herramientas para reunir, procesar y comparar información entre las autoridades de la Unión Europea en el cumplimiento de la Ley europea, tanto a nivel judicial como policial, pero estas herramientas no fueron diseñadas desde un principio, sino que están desarrollándose paulatinamente y, en algunos casos, se producen solapamientos de instrumentos, se produce también un uso ineficiente y, a veces, incluso poco transparente.

Por eso, el Parlamento Europeo es consciente de la necesidad de establecer un marco coherente y consolidado en el que todos esos instrumentos sean evaluados de manera conjunta y elaboremos un mapa de situación de la legislación comunitaria y de los Estados miembros en este campo, incluyendo los acuerdos internacionales que regulan el intercambio de datos y una evaluación independiente para incrementar nuestra eficiencia contra el crimen.

En este análisis, la Comisión debe proponer una visión de futuro que se traduzca en un debate sobre cómo optimizar los esfuerzos para compartir información contra el crimen dentro de la Unión, asegurando que exista, al mismo tiempo, respeto por la privacidad y por la protección de los datos. Estamos hablando, en definitiva, de los principios de necesidad, proporcionalidad, transparencia, rendición de cuentas a la hora de cruzar los datos disponibles.

Y este es el punto en el que, en esa caja de herramientas se suscita una reflexión en torno a la llamada Decisión Prüm, que fue adoptada en el año 2008. Porque, desde 2005, siete Estados miembros, bajo el paraguas de la Comisión Prüm, habían incorporado al Derecho europeo una posibilidad sujeta a condiciones de rastreo y comparación automática de datos personales relativos a las bases de datos de ADN, huellas dactilares y también matriculación de vehículos.

Prüm ha probado ser una herramienta efectiva, una herramienta útil para la actividad policial transfronteriza en investigaciones penales. Pero lo que queremos hacer es un llamamiento a «lisbonizar» Prüm, un llamamiento para que tengamos en cuenta que la Decisión Prüm fue adoptada, en su momento, en el marco del tercer pilar —cooperación intergubernamental— y de manera completamente ajena a las capacidades de control democrático que, en el nivel europeo, expresan las mayores competencias de este Parlamento después de la entrada en vigor del Tratado de Lisboa.

Por eso, creo que la pregunta es sobre la disposición de la Comisión a impulsar la «lisbonización» de la Decisión Prüm, de acuerdo, me parece, a lo que sería una interpretación coherente del Protocolo 36 del Tratado de Lisboa, y me gustaría escuchar de la Comisión Europea un compromiso en esa dirección.

  Cecilia Malmström, Member of the Commission. − Madam President, I would like to thank the Committee on Civil Liberties, Justice and Home Affairs and its chair for raising this question.

Information exchange is a very important instrument for law enforcement cooperation in the European Union, so we are very happy to see a debate revolving around this important topic.

We welcome the changes made by the Lisbon Treaty, notably the greatly-enhanced role of the European Parliament, which enhances the democratic scrutiny and accountability of EU activities in areas which were previously largely intergovernmental.

As regards the Prüm Decision, the Commission decided not to consider further changes to the legal basis before full implementation has taken place. Otherwise we would have even slower implementation, which would delay the whole process. We are pushing for very swift implementation by Member States in a legally-stable environment. This was adopted under the former third pillar, so the Commission does not have the usual rules for monitoring national implementation in a transitional period. But from December 2014, the Commission will be able, if needed, to use infringement proceedings.

In the communication from the Commission on the European Information Exchange Model, we concluded that no new EU-level law enforcement information exchange instruments are needed at this stage. The existing EU instruments could – and should – be much better applied in a more consistent way. We have presented a number of specific recommendations, for instance agreeing on a common, standard communication channel – preferably Europol – establishing integrated units as single points of contact to facilitate a consistent approach to cross-border data sharing, and stepping up EU training to exchange tools, in line with the Law Enforcement Training Scheme.

We also need to ensure high standards of data security and data protection, and we need to have meaningful statistics. The debate on how best to improve the effectiveness of the existing instruments, channels and tools for law enforcement information exchange has been under way for a while. It was inspired by the preparation and publication of our communication.

We very much welcome the fact that this debate is now going on at a political level, in the Council and at the European Parliament. We have discussed this in the Council of Ministers on several occasions and pushed Member States to move on with their implementation.

Finally, on data protection, you are of course aware that the proposed directive on data protection in the field of law enforcement includes a commitment from the Commission to review existing legal instruments in this field, involving processing of personal data within three years of the directive entering into force. That is where we are at the moment. We are of course looking forward to your proposals.

  Agustín Díaz de Mera García Consuegra, en nombre del Grupo PPE. – Señora Presidenta, oportuna pregunta oral que acojo, desde luego, muy favorablemente. La complejidad de la lucha contra la delincuencia transfronteriza debe hacernos intensificar la cooperación policial y judicial en materia penal.

Fue, como se sabe, en el año 2005 cuando se firmó el Tratado de Prüm, entre tan solo siete Estados, y fue adoptado en 2008. Su éxito hizo que nuevos Estados miembros quisieran adherirse al mismo hasta convertirlo en una herramienta propiamente comunitaria.

Sin embargo, tal y como han demostrado las diferentes revisiones realizadas por la Comisión, la asistencia de múltiples agencias europeas con mayores o menores competencias en materia judicial y policial, la firma de convenios internacionales bilaterales y multilaterales de los propios Estados miembros, así como los diferentes sistemas de intercambio de información (el SIS, el SIS II, el SIRENE, el SIENA, entre otros) han creado un entramado normativo que no siempre facilita la necesaria cooperación a nivel comunitario.

Dicho esto, no obstante, comparto las conclusiones emitidas por la Comisión en su Comunicación del 7 de diciembre, ya que creo que no hay necesidad de crear ni nuevas bases de datos ni nuevos instrumentos de intercambio de información, sino que los ya existentes pueden y deben aplicarse de manera más coherente.

Es necesario que esa normativa se adapte al Tratado de Lisboa dotándola de mayores salvaguardias y sometiendo sus iniciativas al escrutinio democrático en el Parlamento. Lisboa debe sustituir una decisión del tercer pilar, y todo ello sin olvidar los principios sustantivos del original Tratado de Prüm.

¡Qué curioso para el anterior debate! Salvaguardar los derechos fundamentales de las personas, en particular su derecho a la intimidad y a la protección de los datos personales, o lo referente a la necesidad, es decir: las restricciones del derecho a la intimidad solo pueden justificarse si son lícitas, persiguen una finalidad legítima o son necesarias en una sociedad democrática. Esto también es Prüm.

  Josef Weidenholzer, im Namen der S&D-Fraktion. – Frau Präsidentin! Ich schließe mich in der Einschätzung des Prümer Vertrags meinem Kollegen Díaz de Mera an: Er ist ein wichtiges sinnvolles Instrument im Kampf gegen grenzüberschreitende Kriminalität, und die Zusammenarbeit der Polizei und Justizbehörden über die Grenzen hinweg ist ein wichtiges Erfolgskriterium. Wesentlich dabei ist aber auch, dass Bürgerrechte eingehalten und Daten, die im Rahmen der Vereinbarung übertragen werden, geschützt sind.

Im Prümer Vertrag gibt es leider, was den Datenschutz betrifft, erhebliche Schwächen. So existiert keine klare Definition des Begriffs „personenbezogene Daten“ usw. Das hat das Europäische Parlament übrigens schon in seiner 2008 angenommenen Stellungnahme gefordert. Sogar die bereits im Steinzeitalter, 1981, beschlossene Datenschutzkonvention des Europarats über den Schutz bei der automatischen Verarbeitung personenbezogener Daten sieht eine Verpflichtung zur innerstaatlichen Gewährleistung subjektiver Rechte auf Geheimhaltung, Löschung, Richtigstellung und Auskunft sowie die Überwachung des Datenaustauschs durch eine unabhängige Kontrollstelle vor.

Mit einem Legislativvorschlag haben wir die Möglichkeit, Nachbesserungen auf das Niveau der Entschließung des Europäischen Parlaments, der Europaratsverordnung und des sich aktuell im Beschlussfassungsprozess befindenden Datenschutzpakets zu erreichen. Ich wünsche mir, dass die Innenminister mit demselben Elan ans Werk gehen, den sie damals an den Tag gelegt haben, als es darum ging, den Prümer Vertrag noch vor dem Inkrafttreten des Vertrags von Lissabon zu unterzeichnen. Seit diesem Zeitpunkt sind nämlich, wie wir wissen, wir als Parlament Mitgesetzgeber in Fragen der inneren Sicherheit!

  Olle Schmidt, för ALDE-gruppen. – Fru talman! Gott att se dig här, fru kommissionär, hemkommen från denna förfärande tragedi.

Europas 3 600 kriminella ligor utgör ett hot mot vår säkerhet och vår frihet. De geografiska landsgränserna är ju inget hinder numera. EU:s medborgare vet detta. Vid en rankning av avgörande frågor kom ekonomin och jobben först, men sedan kom faktiskt den gränsöverskridande brottsligheten.

I utskottet för frågor om organiserad brottslighet har vi tagit fram en rad konkreta förslag för att öka samarbetet mellan EU:s länder. En gemensam definition av organiserad brottslighet är ju ett första viktigt steg. Vi vet att handeln med droger, människor, vapen och förfalskade varor inbringar hundratals miljoner euro varje år. Vi vet att det leder till mänskliga tragedier av oanade mått.

I dessa tider av ekonomisk kris behöver vi mer än någonsin se till att dessa enorma summor kommer tillbaka till den lagliga ekonomin.

I Stockholmsprogrammet erkändes behovet av enhetliga verktyg för insamling, bearbetning och utbyte av information. Detta är ju grunden för ett effektivt samarbete i ett gränslöst Europa. Jag kan se i min egen hemstad, där vi har haft svåra problem, att just utbyte över gränserna har givit resultat.

Med tanke på detta är det svårt att förstå att flera medlemsländer är så motvilliga till att inse att det krävs ett utökat samarbete och informationsutbyte. De enda som vinner på detta och medlemsländernas tvekan är ju skurkarna, de kriminella. Jag tror mig ana att problemet att gå snabbare fram inte ligger hos kommissionen.

Jag vill se ett starkare europeiskt rättssystem, ett bättre rustat Europol med tydligare mandat och en europeisk åklagarmyndighet. EU är ju lösningen på våra problem, men då måste EU:s länder lita på varandra och arbeta tillsammans för att stoppa skurkarna.

Proportionalitet, integritet och datakänslighet – men inte naivitet!

  Jan Philipp Albrecht, on behalf of the Verts/ALE Group. – Madam President, it is really important that we have better cooperation for police and justice in Europe. We need this but – as I have said and as my group has said for years now – we need common standards in order to have better cooperation. We need common standards with regard to data protection, procedural rights, the principle of the rule of law, and basic principles laid down in our constitutions. It is not sufficient just to say that there should be mutual recognition of common standards in Europe. That is not sufficient.

We need to work on common standards so that we can better facilitate the work of police and justice authorities. We also need to concentrate on those things which facilitate police and justice cooperation on the ground, not by spending vast amounts of money on mass surveillance systems which, in my view, have not proved to be very efficient in lowering crime rates, but by investing in things like the Joint Investigation Teams of Europol and the real cooperation of police and justice authorities at a local level.

That would be the right way to proceed, but that is not the policy which is currently being followed by the Member States in the Council, nor, I have to say, by you as Commissioner. I hope this will be improved and that we will go in the right direction.

  Monica Luisa Macovei (PPE). - Pentru ca autorităţile naţionale să coopereze pentru combaterea criminalităţii transfrontaliere este nevoie, în primul rând, de armonizarea canalelor de informare dintre statele membre şi, desigur - sunt de acord cu colegul meu -, de standarde comune în statele membre. Ca raportor al Regulamentului Eurodac, ştiu cum funcţionează instrumentele pentru schimbul de informaţii dintre statele membre.

Baza de date Eurodac - este vorba de amprente - permite accesul la informaţie al autorităţilor naţionale pentru prevenirea unor infracţiuni foarte grave şi a terorismului, pentru identificarea autorilor, martorilor sau victimelor. Investigatorii pot verifica dacă reţele de crimă organizată sau mişcări teroriste încearcă să-şi introducă membrii pe teritoriul Uniunii Europene sub identităţi false, pentru a le permite şederea legală pe teritoriul Uniunii şi, eventual, comiterea de infracţiuni grave.

De aceea, susţin că accesul la aceste date este foarte util în lupta împotriva crimei transfrontaliere. Dar statele membre nu pot să aibă acces la baza de date Eurodac dacă nu caută mai întâi informaţiile într-o altă bază de date, respectiv Prüm, care acum funcţionează numai în 11 state membre, ceea ce reduce accesul la informaţiile din cele două sisteme, Eurodac şi Prüm. Statele membre care nu au implementat încă decizia Prüm trebuie să o facă cât mai repede şi să pună în practică astfel cerinţele Comisiei Europene pentru a putea folosi informaţiile care sunt esenţiale în lupta împotriva criminalităţii transfrontaliere.

  Wim van de Camp (PPE). - Als er één sector is in Europa die het belang van de open grenzen en het vrije verkeer van personen goed begrijpt, is het wel de georganiseerde misdaad in ons werelddeel. Als je kijkt wat er op dit moment in Europa gebeurt, en zeker ook in mijn land Nederland met die open grenzen, dan mag je zelfs wel zeggen dat wij op een aantal punten heel naïef zijn. De invloed van de georganiseerde misdaad in Europa is helaas erg groot. We hebben pas nog in Nederland een zware maffiajongen gearresteerd, die al jaren in een flatje woonde in Nieuwegein. Dankzij die gegevensuitwisseling is die uiteindelijk gearresteerd.

Ik ben het zeer met mijn collega Aguilar eens dat het verdrag van Prüm en de gegevensuitwisseling in verband daarmee van zeer groot belang zijn voor de criminaliteitbestrijding.

Maar de vraag aan de commissaris is toch wel: 'Waarom duurt die implementatie toch zo lang? Verschillende collega's zeggen dat, dat er nu nog maar elf landen zijn die het verdrag hebben geïmplementeerd. Wanneer volgt de rest? Ik kom daar zo meteen nog even op terug.

Ik ben het ook eens met Aguilar dat de democratische controle op deze criminaliteitbestrijding versterkt moet worden. Ik begrijp nu van de commissaris dat zij zegt: 'Dat doe ik pas als iedereen het geïmplementeerd heeft.' De vraag is dan wel: Wanneer is dat? En kunnen we daarop wachten?

  Marco Scurria (PPE). - Signor Presidente, onorevoli colleghi, molti dei problemi che abbiamo come Unione è la non conformità di applicazione delle leggi, questo comporta un vero e proprio vulnus democratico e un inadeguato controllo a livello di Unione europea.

Occorre quindi una mappatura delle legislazioni nazionali e degli accordi internazionali che disciplinano lo scambio transfrontaliero di informazioni. Occorre anche che la Commissione automatizzi le procedure, per applicare gli strumenti esistenti, per arrivare a valutare la creazione di un formato universale per lo scambio di informazioni. Ma tutto questo va anche aggiunto a una serie di iniziative di addestramento delle forze di polizia per rafforzare lo scambio di informazioni e di cooperazione.

Infine, la decisione di Prüm: è uno strumento divenuto ordinario nelle indagini di polizia e nella loro cooperazione, adesso c'è bisogno di una sua reale attuazione negli Stati membri e dobbiamo fare in fretta. Insomma, ancora una volta, c'è necessità di una maggiore integrazione della nostra Unione per dare delle risposte migliori alle nostre società.

  Petru Constantin Luhan (PPE). - Vorbim foarte mult de protecţia datelor, vorbim foarte mult de transparenţă, vorbim foarte mult de dorinţa de a pune la dispoziţia cetăţenilor cât mai multe informaţii pentru a avea succes în orice direcţie vorbim.

Vorbim de liberă circulaţie, însă nu reuşim să dezvoltăm standarde comune, nu reuşim să corelăm instituţiile deja existente, şi vă spun că de curând am avut onoarea să găzduiesc în Parlamentul European aşa-numitul eveniment EUhackathon, unde experţi din 17 state UE şi non-UE au analizat pe fond transparenţa datelor puse la dispoziţie în spectrul online versus securitatea cetăţenilor. Vă spun că, în anumite cazuri, situaţia încă este catastrofală în interiorul Uniunii Europene, ca să nu mai vorbim de relaţia dintre Uniunea Europeană şi alte state.

De aceea, cred că Comisia Europeană trebuie să coreleze mai bine sistemele europene existente, fie că vorbim de Schengen, fie că vorbim de SIS II, fie că vorbim de Eurodac şi aşa mai departe - Europol, Eurojustice - şi, în al doilea rând, trebuie să punem la dispoziţie programe concrete pentru implementarea acestora.

  Bogusław Liberadzki (S&D). - Jestem zdania, że bardzo dobrze dzieje się, że o to pytamy, że o tym rozmawiamy. Dlaczego? Jedną z zasadniczych spraw jest pokazanie, że stanowione prawo i dostępne reguły są egzekwowane. Świadomość nieuchronności kary, świadomość tego, że każde transgraniczne wykroczenie może zostać zidentyfikowane, ma kluczowe znaczenie dla postaw obywateli. W związku z tym wszelkiego rodzaju instrumenty: prawne, informacyjne, techniczne, dotyczące wyposażenia, służb czy wymiany informacji, które mogą służyć w dochodzeniu, mają zasadnicze znaczenie. Chciałbym to Komisji i Pani Komisarz gorąco rekomendować, bo w ten sposób czynimy naszą Wspólnotę lepszą i możemy zyskać szacunek u obywateli.

  Cecilia Malmström, Member of the Commission. − Madam President, I would like to thank the Members of Parliament who have raised this issue. I absolutely agree that organised crime is a truly cross-border challenge and that the only way to combat this is by closer cooperation by our law enforcement agencies, and organised crime is of course a key issue here. That is why it is sad that we do not make use of the instruments that we have at our disposal. I do not think that it is of any use right now to come up with new ideas for information-sharing, but we should use the ones that we have. Only half the Member States have actually implemented the Prüm Decision, and that is why it makes no sense to change the legal base.

Why is there this delay? We have tried to identify this. For some, it is a clearly practical issue. They do not know how to do it, which is why we are financing courses and training to help those Member States. We are also putting together different Member States so that they can coach each other and share experiences. This seems to be the main reason for the delay: they do not really know how, and it has not been high on their list of priorities either, but we are pushing and, as I said in my introduction, in many meetings of the JHA Council we have asked the Member States to do much more.

When will this be finalised? I am sorry, I cannot tell you. In a year it will be fully ‘lisbonised’, so then we can go for infringements, but I hope that by then, most of the Member States will actually have done this.

I fully agree with you, as well, that we need to have common standards and to look at this data protection. As soon as we see implementation moving further ahead, we will start looking at this as well. We will need to reflect on the best approach for further development in this field, and this is possibly something that could be done in a post-Stockholm context. I am looking forward to discussions with the Committee on Civil Liberties, Justice and Home Affairs and others on this.

  Kinga Göncz (S&D), írásban. A határon átnyúló bűnözés elleni harc legfőbb eszköze az információcsere a tagállami rendőrségek között. A 2008-as prümi határozat ezt tűzi célul - a kidolgozása azonban még akkor történt, amikor erről kizárólag a tagállamok dönthettek. A határozatnak azóta is hiányzik a demokratikus kontrollja. A parlament annak ellenére nem kapta meg a Lisszaboni Szerződésben meghatározott hatáskörét, hogy már csak egy év van hátra a végrehajtásra. Én is szeretném sürgetni a Bizottságot, hogy a javaslatát mihamarabb tegye le az asztalra, hogy a jelenlegi Parlament, mint társ jogalkotó, elláthassa a feladatát. A parlament sürgetően vár egy másik javaslatot is a Bizottságtól, mégpedig az Európai Rendőrakadémia, a CEPOL jövőjének a rendezéséről.

Kiemelkedően fontosnak tartjuk a rendfenntartó erők magas színvonalú képzését a jövőben is, enélkül ugyanis nincs jó színvonalú jogalkalmazás. Ahogy erről többször volt szó, a parlament Állampolgári Bizottsága fontosnak tartja az intézmény függetlenségét, nem támogatja az összevonását az Europollal. Így gondolkodik a Tanács is. A bizottsági összevonási javaslatot gyakorlatilag elutasítottuk. Emiatt kérem a biztos asszonyt, hogy ne várjon tovább, és kérje fel a szolgálatokat egy olyan javaslat kidolgozására, amely a függetlenség megtartása mellett biztosítja a CEPOL számára a jövőre esedékes költözéshez szükséges költségkeretet.
