  Raül Romeva i Rueda, author. − Mr President, it is not an easy topic to discuss because the People’s Republic of China performs more than 10 000 organ transplants a year and Chinese organ transplantation centres advertise that matching organs can be found within two to four weeks and yet, as of May 2013, it did not have an organised or effective public system of organ donation or distribution.

China has a very low rate of voluntary organ donation, due to traditional beliefs, and the country implemented regulations in 1984 that permitted the harvesting of organs from executed prisoners. Some sources, such as Mr Huang Jiefu, Director of the China Donation Committee and former Vice-Minister of Health has even said that around 90% of the organs for transplant extracted from deceased donors stemmed from executed prisoners in China and that, by mid-2014, all hospitals licensed for organ transplantation will be required to stop using the organs of executed prisoners and will use only those voluntarily donated and allocated through a national system.

We have to express our deep concern regarding persistent and credible reports of systematic, state-sanctioned organ harvesting from non-consenting prisoners of conscience in the Republic of China, including from large number of Falun Gong petitioners, imprisoned for their beliefs, and members of other religious and ethnic minority groups. The Chinese authorities should respond thoroughly to the request of the UN Special Rapporteur on Torture and the Special Rapporteur on Religious Freedom, who ask the Beijing government to explain where the extra organs come from following the increase in organ transplants, and allow them to conduct an investigation into organ transplantation practices in China. We also call for the immediate phasing-out of the harvesting of organs from executed prisoners.

  Nirj Deva (ECR), blue-card question. – Mr President, I am puzzled by this motion for a resolution. I would like to ask the mover of the motion, my honourable friend, to explain why we are discussing this. The Chinese Government has admitted that they were harvesting organs from prisoners of conscience, and they have committed themselves to ceasing this practice by 2014 and stopping it altogether by 2015. They are making transitional arrangements to move to a different system. Why are we debating this now as a matter of urgency? What is the point of it?

What we are asking is precisely for the Chinese authorities to demonstrate that they are going to respond positively to these requests. There are still many doubts as to how this will proceed, and that is what we need to demonstrate now. That is why we are asking. If by mid-2014 we are not in a position to defend what has been done, obviously we will have to respond in a much tougher manner.

  Tunne Kelam, author. − Mr President, each year it is estimated that thousands of human organ transplants are carried out in China and it is estimated too that more than 90% of organs are taken from executed prisoners. Most of them are affiliated to Falun Gong’s spiritual practice, hundreds of thousands of whose practitioners have been arrested and executed in China over the past 14 years. Also numerous Tibetans and Uighurs are among the victims.

A huge shady and immoral business of organ selling to foreigners has developed in China and involves a number of non-Chinese doctors. We asked the Chinese authorities to put a stop to it immediately, and we also asked EU Member States not only to raise the organ harvesting issue with the Chinese Government but to also condemn publicly the corrupt and immoral organ transportation business which is conducted at the expense of the lives of thousands of prisoners of conscience. Finally, most importantly, all prisoners of conscience in China should be released immediately.

  Marie-Christine Vergiat, auteure. − Monsieur le Président, une fois de plus, nous allons parler de la Chine et des violations des droits de l'homme qui y ont cours.

Il est des pays sur lesquels la vigilance de ce Parlement est extrême. 300.000 nouveaux patients sont inscrits chaque année sur la liste d'attente des greffes d'organes dans cet immense pays qu'est la Chine. 10 000 greffes d'organes Seulement ont lieu chaque année, essentiellement pour des raisons religieuses, comme l'a expliqué mon collègue Romeva. Mais 65 à 90 %, selon les sources, le seraient grâce à des prélèvements sur le corps des prisonniers exécutés. C'est une horreur que nous condamnons, comme nous condamnons la peine de mort dans ce pays comme ailleurs.

Les autorités chinoises ont annoncé leur intention d'éliminer progressivement ces pratiques, et ce au plus tard d'ici 2015, dont acte. Venant d'autres États, on aurait vu cela comme un signe de bonne volonté, et cela aurait justifié bien des atermoiements. Pour s'en convaincre, il suffit de regarder la résolution Sri Lanka. Mais c'est en Chine. Je prendrai juste le pari que, les accords économiques se multipliant, la vigilance de certains va se faire plus parcimonieuse.

  Kristiina Ojuland, author. − Mr President, voluntary and informed consent of the donor is the basis for ethical organ donation, not only according to World Health Organization rules, but also according to the principles of perhaps all existing collective systems of values. Sufficient proof exists that organ harvesting does take place in China, especially from Falun Gong prisoners of conscience.

It is the European Parliament’s obligation to condemn decisively the actions of the Chinese Government in this appalling issue that strikes at the heart of human dignity and the fundamental right to life. The practice must be ended immediately, and the least the EU can do to stop it is to condemn publicly organ transplantation abuses in China and to inform those European citizens who travel to China for organ transplants that the organ source for their operation might be an executed prisoner.

  Charles Tannock, author. − Mr President, for over a decade now China has been accused of operating a heinous state-sponsored programme of non-consenting organ harvesting, particularly against executed Falun Gong detainees of conscience.

Whilst these are extremely serious accusations, it is important to recognise that no definitive evidence has yet been presented to support these outrageous claims. Nevertheless, such a severe potential human rights violation clearly warrants attention, and it is right for the EU to urge the Chinese authorities to fully investigate and to come clean if it is proven.

The EU has no such powers. The ECR is therefore calling on China to increase the accountability and transparency of its rather murky organ transplant system, as well as wanting to see measures taken that would see those responsible, if proven, for any such criminal abuses, prosecuted and punished.

I welcome today’s debate on the subject for highlighting the issue and I hope that the government in China will be prompted to investigate. I hope, too, that it has raised awareness of the desperate plight of the Falun Gong, a group which faces deplorable discrimination within China.

I believe that a former health minister in China is on the record as saying that there is evidence. If that evidence is then substantiated, would you be able to raise this with the British Prime Minister, who recently visited China, and maybe put this on the agenda in future?

  Charles Tannock (ECR), blue-card answer. – I picked my words very carefully. For something definitive, I would need to see it. I do not know about the case you raise. I have certainly heard allegations over the ten or more years I have been in this Parliament, but I have never seen sworn statements or affadavits by Chinese about this issue.

It is a question of disentangling. We know that organ harvesting is taking place from executed prisoners. The serious issue is whether people who are innocent are being executed deliberately to organ harvest. I am not absolutely sure about that. We know that it is going on but are Falun Gong practitioners or Uighurs or other people being selected, imprisoned and killed just for their organs? That is why I think proof is still lacking.

  Monica Luisa Macovei, on behalf of the PPE Group. – Mr President, in China the removal of organs from donors without prior and free consent is happening today in front of our eyes. Chinese doctors have testified in this Parliament and before the US Congress that they have harvested organs from live people. International reports show that, of 100 000 organ transplants in China in the last 10 years, more than half have come from Falun Gong. Since 1999 the Chinese Government party has sent hundreds of thousands of practitioners to their death. The government launched a nationwide persecution to eradicate the traditional and peaceful spiritual practice of Falun Gong. This follows the principles of truth, compassion and tolerance.

In China, organ harvesting has become basically a booming business. For kidney and liver transplants, the waiting time in Europe is several years. In China it is one to four weeks. This shows that China has a huge bank of living people from whom organs can be removed at any time. We must save innocent people from being killed in China at any time for their organs. The EU must impose sanctions on …

  Véronique De Keyser, au nom du groupe S&D. – Monsieur le Président, le prélèvement d'organes suscite toujours rumeurs, fantasmes mais évoque peut-être aussi une épouvantable réalité. Il nous appartient, et c'est notre responsabilité en tant que députés, de faire prudemment la part entre rumeurs et réalité.

Le commerce des organes est, aujourd'hui, un des moins réglementés au monde. La demande est croissante et dépasse de très loin l'offre, d'où des zones grises, sans réglementation, où toutes les pratiques sont possibles sans être illégales et, d'autre part, des pratiques criminelles existent aussi, associant trafic d'êtres humains, adoption, rapt, etc.

Dans certains pays, il est courant de vendre des organes et de les prélever sur des êtres vivants pour des raisons religieuses, par exemple, parce qu'on ne peut pas les prélever sur les morts. C'est le cas en Inde où des pauvres vendent des cornées, des reins, etc. Mais on trouve aussi de telles pratiques en Amérique latine. Parfois, il est licite, comme en Autriche ou en Belgique, de prélever des organes sur des morts, quel que soit le décès, sans demander l'avis de qui que ce soit.

Quatre pays d'Afrique seulement ont une législation sur le prélèvement d'organes et deux seulement en Asie, le Sri Lanka et l'Indonésie. La Chine n'en fait pas partie et est donc dans une zone grise.

Pour notre groupe, nous avons deux certitudes. La première, c'est que la Chine utilise en grande partie, pour son besoin d'organes, des prisonniers politiques ayant été exécutés. Mais je suis comme M. Tannock, nous sommes incapables de dire si leur exécution est liée à un besoin d'organes ou s'ils ont été exécutés, et nous sommes contre la peine de mort.

Nous ne trouvons aucun élément démontrant une persécution particulière de Falun Gong, comme l'atteste le rapport circonstancié de la Chambre des représentants de la Nouvelle-Zélande, qui a largement enquêté sur cette question et que je tiens à votre disposition.

C'est pourquoi, en notre âme et conscience, notre groupe a décidé de s'abstenir sur cette résolution. Nous n'avons pas signé la résolution mais nous sommes prêts à travailler, avec le Conseil de l'Europe d'ailleurs, sur cette question, qui est une question extrêmement sensible et extrêmement épineuse. Cependant, mais il faut le faire, non pas en urgence, mais en notre conscience de parlementaires.

  Hannu Takkula, ALDE-ryhmän puolesta. – Arvoisa puhemies, elinten poistot Kiinassa ovat hyvin järkyttävä asia. Voi sanoa näin, että me tiedämme, että Kiinassa ei ole ihmisoikeuksia ja ihmisen elämän, ihmisen ruumiin kunnioittaminen on hyvin heikkoa. Sen vuoksi sieltä on tullut viestejä, että tämäntyyppistä luvatonta elinten poistoa olisi harjoitettu ja harjoitettaisiin. Niin teloitetut vangit kuin myös Falun Gong -liikkeen seuraajat ovat olleet tällä listalla. Jo nämä väitteet ja se, että Kiina ei avoimesti näistä asioista ole puhunut eikä raportoinut, ovat vakavia ja meidän Euroopan unionina on toimittava sen puolesta, että kaikenlaisiin ihmisoikeuksien loukkaamisiin ja polkemisiin ja tämäntyyppisiin laittomiin elinsiirtoihin puututaan ja ne pyritään estämään.

  Jaroslav Paška, za skupinu EFD Oficiálne priznanie riaditeľa čínskeho výboru pre darcovstvo orgánov na madridskej konferencii, že viac ako 90 % transplantovaných orgánov pochádza od popravených väzňov, nepriamo potvrdilo, že väzni svedomia sa v tejto krajine stali nedobrovoľne obeťami obchodovania s ľudskými orgánmi.

Títo ľudia sú zabíjaní len kvôli získaniu orgánov vhodných na transplantácie pre klientov prichádzajúcich do Číny a do ich nemocníc z celého sveta. Oznámenie čínskej administratívy, že s takouto praxou do roku 2015 postupne skončí, je cynickým priznaním neuveriteľne krutého zaobchádzania s niektorými skupinami obyvateľstva tejto krajiny.

Priznám sa, že je pre mňa nepochopiteľné, že národ s takou bohatou kultúrou a civilizáciou vôbec začal s takýmto dekadentným prístupom k ľudskému organizmu. Som presvedčený o tom, že ak sa vrcholní predstavitelia tejto krajiny zamyslia nad etickým aspektom tohto konania, okamžite pochopia, že s tým musia prestať.

Vous déclarez: "Ils sont exécutés en fonction de la demande d'organes". Pouvez-vous me dire, et je serais ravie de le savoir, pour l'information de notre groupe, d'où vous avez tiré cette évidence, de source fiable en tout cas?

  Franz Obermayr (NI). - Herr Präsident! Die Organbeschaffungspolitik von China ist menschenverachtend und an Grausamkeit kaum zu überbieten.

NGOs werfen China vor, für den Markt wertvolle Organe von zum Tode Verurteilten zu entnehmen, auch gegen den Willen der Betroffen. Schätzungsweise werden ca. 3 000 Personen pro Jahr in China zum Tode verurteilt. Laut ehemaligen chinesischen Transplantationsärzten werden die Organe auch lebenden Menschen entnommen, damit diese solange wie möglich durchblutet werden. Genauere Details möchte ich Ihnen jetzt ersparen.

Dramatisch stellt sich für mich auch der Fall der Falun-Gong-Glaubensgemeinschaft dar, deren Anhänger gezielt verfolgt und verurteilt werden; somit werden sie als Organspender wider Willen dem Markt zur Verfügung gestellt.

Diese Organentnahmen sind schockierend und widersprichen jeglicher Vorstellung von menschlicher Würde. China hat somit sofort diese verabscheuungswürde Vorgehensweise zu unterlassen, und die Ankündigung, man werde diese Organbeschaffung ohnedies in drei bis fünf Jahren einstellen, ist für mich nichts mehr als eine Absichtserklärung und somit völlig unbefriedigend.

Es ist gut, dass Sie heute das Thema behandeln, ja leider nur behandeln, denn bei einem großen Handelspartner wie China verzichtet die EU gerne auf konsequentes Handeln. Da hoffe ich dann doch, dass es dieses Mal eine Ausnahme gibt und die Union auch dementsprechend konsequent gegen die große Wirtschaftsmacht China vorgeht.

  Marie-Christine Vergiat (GUE/NGL), question "carton bleu". – Si vous le permettez, je voudrais vous poser une question. Vous nous dites qu'il y a tout un marché d'organes qui se développe en Chine. J'ai beaucoup travaillé pour essayer de m'appuyer sur des sources fiables. Nous sommes tous d'accord pour dire qu'il y 10 000 prélèvements d'organes et, tous les ans, il y a 300 000 demandeurs supplémentaires en Chine. Donc, je me demande où vous voyez qu'il y a un marché. Il est vrai qu'il existe un problème en Chine en matière de prélèvements d'organes. Il faut que la Chine possède une législation qui soit conforme au droit international, mais il n'est pas utile de dire tout et n'importe quoi en la matière. Sur quoi appuyez-vous votre argumentation?

  Franz Obermayr (NI), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. – Danke für die Frage, allerdings konnte ich keine wirkliche Frage entnehmen.

Es war ein Ko-Referat von Ihnen, in dem Sie mich ja bestätigen. Und wenn Sie die Frage stellen, ob es einen Markt gibt: Ja, natürlich, offensichtlich erfolgt nicht alles gratis und natürlich gibt es eine Nachfrage, es gibt viele kranke Menschen, und ich nehme an, das wird dort nicht alles ehrenamtlich und gratis passieren. Somit werden natürlich diese Organe dementsprechend auf einem sogenannten Markt auch gehandelt und weitergegeben. Damit ist es klar beantwortet.

  Sari Essayah (PPE). - Arvoisa puhemies, täällä ovat muutamat kollegat, De Keyser ja Vergiat, kyselleet, että mistä lähteistä nämä tiedot tulevat. Pyytäisin, että voisitte tutustua Kanadan Aasian ja Tyynenmeren alueesta vastaavan entisen ulkoministerin David Kilgourin ja ihmisoikeusjuristi David Matasin jo vuonna 2007 tekemään tutkimukseen, joka on hyvin kattava selvitys Kiinan elinryöstöistä, jotka liittyvät erityisesti Falun Gongin seuraajiin. Samoin Minnesotan yliopiston tutkija Kirk Allison on tehnyt vuonna 2006 tutkimuksen. Myös parlamentin varapuhemies Edward MacMillan-Scott on käynyt Kiinassa ja tehnyt selvityksen asiasta eli kyllä tästä löytyy riippumattomia todisteita.

Toiminnassa on nimittäin kyse järjestäytyneestä ja suunnitellusta tavasta, jolla elimiä poistetaan paitsi teloitetuilta vangeilta niin myös yhtä lailla eläviltä mielipidevangeilta vastoin heidän tahtoaan. Nämä vangit saattavat elinsiirtojen tuloksena menehtyä operaatioihin tai komplikaatioihin. Siksi on tärkeää, että tässä päätöslauselmassa vedotaan paitsi tämän toiminnan lopettamisen puolesta myös sen puolesta, että Kiinan tulee vapauttaa nämä mielipidevangit.

  Marc Tarabella (S&D), Question "carton bleu". – Chers collègues, je prolonge ici le propos de ma collègue Véronique de Keyser et une partie du propos de notre collègue Tannock. La semaine dernière, devant le Parlement européen, pendant trois jours, les adeptes de la secte Falun Gong ont distribué des disques, des CD, des documents.

Que le Sri Lanka soit traité en urgence, c'est normal, que la Centrafrique soit traitée en urgence, c'est normal, et il pourrait y en avoir beaucoup d'autres. Mais qui dicte les urgences dans ce Parlement? Est-ce que c'est la présence de lobbyistes d'une secte devant le Parlement la semaine passée ou bien des faits qui sont étayés? Alors qu'ici aucune des organisations défendant les droits humains que nous consultons habituellement ou qui nous consultent...

Erityisen tärkeä minun mielestäni on kattava, vuodelta 2007 oleva David Kilgourin ja David Matasin tekemä riippumaton tutkimus. Mainitsin myös Minnesotan yliopiston Kirk Allisonin ja parlamentin varapuhemiehen MacMillan-Scottin tutkimukset tästä aiheesta. Pyydän, että tutustutte näihin.

  Eija-Riitta Korhola (PPE). - Arvoisa puhemies, kollega Essayah puhuu asiaa, olisin itsekin viitannut tähän Kilgourin tutkimukseen. Tunnen Kilgourin henkilökohtaisesti ja olen tutustunut aineistoon.

Muutama vuosi sitten Kiina vihdoin myönsi käyttävänsä teloitettujen vankien sisäelimiä luovutustarkoitukseen. Vaikka luovutuksiin lain mukaan tarvitaan vangin lupa, useat ihmisoikeusjärjestöt ovat huolissaan siitä, ettei tätä käytännössä kysytä. Kiinassa teloitetaan tuhansia vankeja vuosittain, ja on arvioitu, että 63 prosenttia luovutetuista sisäelimistä tulee heiltä.

On syytä kiinnittää myös huomiota Falun Gong -harjoittajien kaltoinkohteluun. Kiina on pyrkinyt jo vuodesta 1999 hävittämään kyseisen hengellisen liikkeen. Useiden lähteiden mukaan mielipiteidensä vuoksi pakkotyöleireille lähetetyille Falun Gong -vangeille tehdään vangittaessa kalliita, yksityiskohtaisia terveystarkastuksia, sillä myös heidän sisäelimiään ryöstetään ja luovutetaan eteenpäin. EU:n on aika julkisesti tuomita törkeä epäeettinen käytös teloitusvankien osalta ja peräänkuuluttaa laajempaa tutkimusta aiheesta.

  Véronique De Keyser (S&D), question "carton bleu". – Madame Korhola, puisque vous avez cité les sources, avez-vous eu l'occasion de lire l'avis de novembre 2013, qui est très récent, de la Chambre des représentants de Nouvelle-Zélande, qui dit, à propos de Falun Gong, qu'il n'y a aucune preuve indépendante d'un prélèvement d'organes, qu'ils ont été voir auprès des sources étrangères, auprès du département des Nations unies, auprès des ONG, auprès du rapporteur spécial des Nations unies sur la torture – et tout ceci est cité – et qu'ils ne trouvent aucune preuve indépendante de ce prélèvement d'organes chez Falun Gong? C'est tout de même sérieux, non?

  Seán Kelly (PPE). - Mr President, there is obviously a certain amount of confusion here today because, as Mr Tannock pointed out, definitive evidence may not be available but anecdotal evidence would certainly suggest that something is amiss. For that reason, it is only right that we should discuss it to bring any malpractice to an end as soon as possible. There are 10 000 organ transplants per year and 165 organ transplant centres that say that they can get matching organs within two to four weeks, whereas in the rest of the world it takes years.

So I think that it is only right that we should be concerned, especially as there is no organised or effective public organ donation system in China. Given the fact that members or representatives of Falun Gong were here in the early morning giving out leaflets etc., I think it is only right that we should at least consider what they have to say and ask the Chinese to try to bring clarity to this situation once and for all.

  Crescenzio Rivellini (PPE). - Signor Presidente, onorevoli colleghi, ciò che si afferma in questa risoluzione è contro ogni diritto e l'Europa che basa la propria Costituzione su valori fondanti come la difesa dei diritti umani non può rimanere insensibile a queste notizie.

Chiedo pertanto che ci sia un approfondimento a seguito di questa risoluzione, che accerti la gravità e la veridicità di quanto sopra, anche perché tutte le precedenti risoluzioni e azioni non hanno avuto nessun tipo di risultato pratico e dobbiamo evitare di discutere una risoluzione che non avrà alcun riscontro.

Inoltre, spero che la Repubblica popolare cinesi tramuti in realtà le affermazioni del direttore del comitato donazioni organi in Cina che ha dichiarato che si autorizzeranno negli ospedali per i trapianti di organi solo quelli donati volontariamente. Concludo, chiedendo che sia introdotto in Cina il sistema informatizzato di assegnazione di organi Cotrs per un maggiore controllo.

  Laima Liucija Andrikienė (PPE). - Mr President, systematic and state-sanctioned organ harvesting from prisoners of conscience in China, including from Falun Gong practitioners – according to the information I have received – in prison for their religious beliefs, is absolutely unacceptable and should be ended immediately. Voluntary and informed consent is a precondition for ethical organ donation and this is not the case in China as far as I know, and my knowledge is based on the information I have.

It is a shame that the great country China, which, a month ago, was elected to serve on the United Nations Human Rights Council for a period of three years, is on the list of countries with a lamentable human rights record.

Finally, all prisoners of conscience in China, including Falun Gong practitioners, should be released immediately.

  Marc Tarabella (S&D). - Monsieur le Président, dans le prolongement du discours que j'ai tenu tout à l'heure, je voudrais ajouter que la Chine aurait bien des occasions de venir à l'ordre du jour des urgences. Ne nous méprenons pas sur ce que j'ai dit précédemment.

Cela étant, chaque fois que les droits humains sont évoqués pour certains pays, c'est pour des faits objectifs – aujourd'hui, pour la Centrafrique, le Sri Lanka –, qui sont étayés par des crimes, mais aussi étayés par des organisations internationales dont c'est le travail de détecter les endroits où il y a des problèmes de droits humains, que ce soit Human Rights Watch, la Fédération internationale des droits humains, mais aussi Amnesty International et bien d'autres.

Nous cautionnons, par le fait de tenir un débat, ce genre de rapports qui sont étayés ici – je le répète et je le regrette – par la présence de ce que j'appelle une secte – Falun Gong. Leur présence devant le Parlement, pendant trois jours, la semaine passée, en distribuant des tracts, suffit à déterminer une urgence, alors que, comme l'a dit Véronique De Keyser, un rapport notamment de l'Assemblée de Nouvelle-Zélande, entre autres, n'étaie pas les faits, ne les accrédite pas nécessairement. Donc, je me permets de douter de la raison pour laquelle cette urgence est venue aujourd'hui dans ce débat.

  Michael Gahler (PPE). - Herr Präsident! Irgendwie scheint mir diese Debatte hier etwas zu entgleisen. Also ich frage mich wirklich: Sind denn nicht die Opfer normalerweise die besten Zeugen für das, was ihnen zugestoßen ist? Oder welchen Grund sollten denn Menschen haben, hier etwas Falsches zu behaupten, wenn es nicht ihnen oder ihren Familienangehörigen tatsächlich zugestoßen ist? Das ist mir schon ein starkes Rätsel. Das erinnert mich fast an die Zeiten, als die Opfer von Stalins oder Hitlers Konzentrationslagern nachweisen mussten, dass es wirklich so schrecklich war. Das kann doch nicht Sinn der Sache sein, nur weil eine Diktatur sich diese Intransparenz leisten kann, dann das, was uns die Opfer erzählen, in Zweifel zu ziehen. Ich weiß es ja auch nicht, ich war auch nicht dabei.

Meine Schlussfolgerung daraus ist, dass wir fordern müssen, dass hier Transparenz einkehrt, dass wir – die internationale Gemeinschaft – Zugang zu den Krankenhäusern, zu den Gefängnissen, zu den Straflagern bekommen, wo das angeblich stattfindet. Und das sollte im Rahmen der Vereinten Nationen durch die Sonderbeauftragten geschehen, die für Folter und unmenschliche Behandlung zuständig sind. Das ist aus meiner Sicht die Lösung.

  Dacian Cioloş, membre de la Commission. − Monsieur le Président, Mesdames et Messieurs, permettez-moi d'intervenir sur ce sujet au nom de la haute représentante et vice-présidente de la Commission, Cathy Ashton.

Le Service européen pour l'action extérieure et la Commission européenne reçoivent un courrier abondant et de nombreuses questions parlementaires sur la pratique du prélèvement d'organes sur des prisonniers chinois, le trafic d'organes et le tourisme médical. Une pétition internationale, qui circule actuellement – avec un million et demi de signatures – demande aux Nations unies de faire pression sur le gouvernement chinois pour mettre fin à ces pratiques et pour qu'il arrête les persécutions des membres du Falun Gong.

Toutes nos préoccupations dans le domaine des droits de l'homme sont régulièrement soulevées avec les autorités chinoises dans le cadre des dialogues réguliers UE-Chine sur les droits de l'homme.

L'Union européenne a soulevé ces préoccupations à l'égard de la peine de mort en Chine et a notamment demandé aux autorités chinoises une plus grande transparence, tant pour ce qui concerne les exécutions que pour les statistiques en matière de prélèvement d'organes. L'existence de ce phénomène est difficile à évaluer et à combattre en l'absence de données fiables.

L'Union européenne a également transmis ses regrets qu'un règlement chinois sur les transplantations d'organes, qui est entré en vigueur en 2006, ne contienne aucune disposition requérant l'accord écrit du donneur.

Lors du récent sommet Union européenne-Chine, qui s'est tenu à Pékin le 29 novembre, l'Union européenne a également salué la décision d'abolir le système de rééducation par le travail, à l'occasion de la dernière réunion plénière du comité central du parti communiste chinois.

En ce qui concerne le problème du trafic d'organes au sein de l'Union européenne, la directive 2010/53 fournit un cadre général pour le don d'organes et la directive 2011/36 prévoit des sanctions pénales pour la traite d'êtres humains à des fins de trafic d'organes. En outre, le plan d'action sur les organes devrait également permettre de lutter contre ce type de trafic.

Un rapport de la Commission européenne au Parlement sur la mise en œuvre de la directive 2010/53 est prévu pour 2014, ainsi qu'une évaluation à mi-parcours du plan d'action, qui est en cours.

  Tadeusz Zwiefka (PPE), na piśmie. – W 1984 roku reżim chiński przyjął prawo legalizujące pobieranie narządów od straconych więźniów. Jednak zarówno samo prawo jak i praktyka wydają się być dalekie od spełniania wymogów Światowej Organizacji Zdrowia. Brakuje przede wszystkim przejrzystości procesu opierającego się na niejasnych i trudnych do skontrolowania regułach. Karygodne są również praktyki władz chińskich polegające na zabijaniu więźniów religijnych i politycznych w celu sprzedaży narządów do przeszczepu. To postępowanie zbiega się również z obserwowaną od wielu lat w Chinach brutalną kampanią prześladowań osób praktykujących Falun Gong, którym wiara nie zezwala na transplantację organów. Także od nich pobierane są narządy, co łamie nie tylko międzynarodowe normy prawne, ale także religijne i etyczne.

Nieustannie będę podkreślał, że na Parlamencie Europejskim spoczywa obowiązek reagowania w sytuacjach naruszania podstawowych wartości i praw człowieka. Zwracam przy tym uwagę, że deklaracja stopniowego wycofywania się władz Chin z powyższej praktyki od 2015 r. jest niewystarczająca. Z tego względu popieram dzisiejszą rezolucję i wzywam rząd chiński do natychmiastowego zaprzestania pobierania organów od więźniów niewyrażających na to zgody. Jednocześnie uważam, że niezbędna jest penalizacja osób odpowiedzialnych za stosowanie tych karygodnych praktyk. Mam także nadzieję, że naszą rezolucją zwrócimy uwagę właściwych organizacji międzynarodowych na tę kwestię, wymuszając tym samym stosowną reakcję wobec chińskich instytucji.
