MOTION FOR A RESOLUTION

European parliament resolution on the human rights situation in Tibet

The European parliament,

–  having regard to its earlier resolutions on Tibet and the human rights situation in China, and its resolutions on human rights in the world,

–  having regard to its resolution of 19 December 2002def_1_1 on the cases of Tenzin Delek Rinpoche and Lobsang Dhondup,

–  having regard to its resolution of 18 November 2004 on the on Tibet and the case of Tenzin Delek Rinpoche,

-  having regard to Rule 115(5) of its Rules of Procedure,

A.  whereas on 2 December 2002 the Kardze Intermediate People's Court in the Kardze Tibetan Autonomous Prefecture of Sichuan Province sentenced Tenzin Delek Rinpoche, an influential and respected Buddhist lama, to death with a 2-year suspension,

B.  whereas both Tenzin Delek and Lobsang Dhondup were charged with “causing explosions and bombings” but their guilt has never been proven,

C.  whereas the period of suspension of Tenzin Delek Rinpoche's execution will expire on 23 January 2005,

1.  Calls once more on the Government of the People’s Republic of China to stop the continued violation of human rights against the Tibetan people and other minorities and to ensure that the international standards of human rights and humanitarian law, as well as religious rights, are respected by the Government of the People’s Republic of China;

2.  Renews its request to the Government of the People’s Republic of China to suspend immediately he death sentence handed down to Tenzin Delek and to release him immediately from prison;

3.  Urges the Council not to abolish the arms sales embargo against the People’s Republic of China until such time as all human rights are respected;

4.  Calls on the Government of the People’s Republic of China to actively engage in dialogue with the representatives of the Dalai Lama in order to seek a democratic and mutually acceptable solution to the issue of Tibet;

5.  Instructs its President to forward this resolution to the Council, the Commission, the UN Secretary-General, the Government of the People’s Republic of China, the Governor of Sichuan Province and the Chief Prosecutor of the Sichuan Provincal People's Procuratorate.
