WRITTEN QUESTION by Simon Busuttil (PPE‑DE) to the Commission

Subject: EC law on fixed-term contracts in Malta: excluded categories of workers
 Answer(s)

Further to its supplementary answer to my parliamentary Question E‑2624/06, the Maltese authorities issued a legal notice, earlier this year, in order to bring Maltese law on fixed-term contracts in line with the requirements of the relevant EU directive.

However, this legal notice excludes certain categories of workers from the benefits of the law, notably from the right to have their fixed-term contract converted into an indefinite-term contract after a lapse of four years.

Can the Commission state whether these exclusions are compatible with EC law?
