The European Ombudsman's activities in 2019

At the first plenary session of March 2021, the European Parliament is set to discuss and adopt a resolution on the European Ombudsman's activities in the year 2019, based on the Ombudsman's annual report presented on 4 May 2020. The report covers the final year of Emily O'Reilly's first mandate as Ombudsman before her re election for a second term in late December 2019.

Implementation of the Employment Equality Directive in light of the UN CRPD

3 December marks the International Day of Persons with Disabilities. EPRS has prepared a study on the implementation of the Employment Equality Directive in light of the UN CRPD, in support of the ongoing EMPL implementation report. The study places a particular focus on reasonable accommodation, positive action, sanctions and equality bodies, and also to employment-related data regarding persons with disabilities.

Employment and disability in the European Union

Approximately one in six people in the European Union (EU) aged 15 and over lives with some kind of disability. Even if there has been an overall improvement in the employment situation of persons with disabilities in the EU (given the increase in employment rates), they still remain among the most disadvantaged groups as regards employment. This phenomenon considerably affects the EU's social integration ability and economic growth. Alongside and in support of Member States' policies, the EU has introduced a series of legal provisions, initiatives, actions and strategies to improve the employment situation of disabled people. In 2010, the EU signed the UN Convention on the Rights of Persons with Disabilities (CRPD), which is a legally binding international treaty. According to the CRPD, the right to work and employment is a fundamental right (Article 27). The main instrument supporting the CRPD's implementation in the EU is the European disability strategy 2010-2020. Its overall aim is to empower people with disabilities so that they can enjoy their full rights, participate in society and have equal access to employment as others. Since 2017, the European Pillar of Social Rights has provided further impetus to the active social inclusion of people with disabilities. In relation to the European disability strategy 2010-2020, the European Pillar of Social Rights and the European Semester (established in 2010 as an annual cycle for economic, social and fiscal policy coordination), the EU supports a number of initiatives designed to assist disabled people as regards employment. These include: non-discrimination, workplace adaptations, public employment services, accessibility, financial incentives and EU funding. Since the early 1980s, the European Parliament has given priority to combating all forms of discrimination against disabled people, in particular, as regards employment. Academics and stakeholders share the view that tackling any kind of discrimination against, and fostering the active inclusion of, people with disabilities in the labour market are equally important for the EU's economy and society.

Access to cultural life for people with disabilities

Despite the additional barriers they face, artists with disabilities make a creative contribution to cultural life. People with disabilities should also have equal access to works of art and be able to enjoy cultural life on a par with all citizens. People with disabilities should also have equal access to works of art and be able to enjoy cultural life on a par with all citizens. The United Nations (UN) Convention on the Rights of People with Disabilities entered into force in 2011. It enshrined, among other rights, the right of people with disabilities to access cultural venues such as theatres, cinemas and museums, and to enjoy cultural materials, books, films and music in an accessible format. It also highlighted the right of people with disabilities to participate in cultural life as both amateur and professional artists. The European Union, party to the Convention, is committed to working on legislation, and implementing and promoting programmes and actions in favour of these rights. The EU disability strategy is a step in this direction. It also covers the cultural rights of 80 million people with disabilities in the EU. According to a public consultation on disability issues carried out in accordance with the recommendations of experts from the Member States working on access to culture, such access is an important area that the EU should address. Various EU funds contribute financially to research and innovation, cultural and infrastructure projects, and programmes promoting the right to cultural life of people with disabilities within this framework. In October 2018, the EU also ratified the Marrakesh Treaty, administered by the World Intellectual Property Organization, to facilitate access to published works for people who are blind, visually impaired, or otherwise print disabled. The EU effectively became a party to the treaty as of 1 January 2019, committing to set mandatory limitations and exceptions for the benefit of the blind, visually impaired, and otherwise print disabled. The European Parliament and its Disability Intergroup, established in 1980, promote the rights, including the cultural rights, of people with disabilities.

The situation of indigenous children with disabilities

Indigenous children with disabilities (ICwD) have received little attention in academic research and development policies. However, they face discrimination at many levels, based on ethnicity, age, ability and gender and this often leads to serious human rights violations. The lack of data, both on the prevalence of disabilities among indigenous children and young people and on specific violations of their human rights, is a serious constraint to any policy intended to respect, protect and promote their human rights. This study seeks to identify these gaps, point to certain patterns and recommend ways of improving data collection and the situation of ICwD in future.

Implementation of the European disability strategy

Almost one in six people in the EU aged 15 and over live with some kind of disability. As the population ages, this number is expected to rise significantly. In February 2017, the European Commission published a progress report on the implementation of the European disability strategy 2010-2020. The Protection Role of the Committee on Petitions in the Context of the Implementation of the UN Convention on the Rights of Persons with Disabilities

This briefing note provides an update on developments in the implementation of the UNCRPD in the EU since the study "The Protection Role of the Committee on Petitions in the Context of the Implementation of the UN Convention on the Rights of Persons with Disabilities", requested by PETI in 2015 and updated in 2016. It reviews the recommendations of that study and identifies the key challenges regarding the European Parliament’s responsibilities in relation to the UN CRPD and other EU institutions. There have been developments in legislation, increased visibility for disability issues in the open methods of co-ordination, and progress on disability data and indicators for rights monitoring. However, some long-standing blockages remain and few of the PETI study recommendations have been actioned.

In addition, the study analyses whether and how the EU legislative and national policy frameworks address the multiple discrimination faced by women with disabilities. This combines a gender mainstreaming approach, such as the internalisation of a gender perspective in all disability policies and legislation, with specific measures targeted to women with disabilities. The study also includes clear indications on implementation and monitoring mechanisms. The analysis is based on available European comparative data and in-depth analysis of seven European Member States.

The European Disability Strategy 2010-2020 (EDS) constitutes a comprehensive multiannual framework for implementing the United Nations Convention on the Rights of Persons with Disabilities (CRPD) at EU level. The EDS and CRPD are thus closely intertwined. Whilst many stakeholders had called for a revision of the EDS, the recent European Commission progress report suggests instead to maintain the Strategy's objectives for the remaining period. However, given that the current Strategy ends in 2020, preparation of the future disability framework will need to start before much longer. This briefing, prepared by the Ex-Post Evaluation Unit of the European Parliamentary Research Service (EPRS), aims to outline the scope and objectives of the EDS and to analyse its implementation. It has been drafted in support of the implementation report on the EDS, which is currently being drawn up by the Committee on Employment and Social Affairs (EMPL) in close consultation with disability organisations, in response to the Commission’s progress report.
