Svoboda pohybu a pobytu osob na území EU je základním aspektem občanství Unie, které bylo zavedeno Maastrichtskou smlouvou v roce 1992. Po postupném odstranění vnitřních hranic podle Schengenské dohody následovalo přijetí směrnice 2004/38/ES o právu občanů EU a jejich rodinných příslušníků svobodně se pohybovat a pobývat na území EU.
