Lack of reciprocity in access to the Chinese market and the absence of a level playing field for EU investors in China have posed major challenges for EU-China investment relations in recent years, with the negotiation of a comprehensive agreement on investment (CAI) being considered by the EU a key instrument to remedy this state of play. The CAI negotiations are aimed at establishing a uniform legal framework for EU-China investment ties by replacing the 25 outdated bilateral investment treaties (BITs) China and EU Member States concluded prior to the entry into force of the Lisbon Treaty in 2009 when the EU gained competence for most investment issues. The CAI is intended to go far beyond traditional investment protection to also cover market access, investment-related sustainable development, and level playing field issues, such as transparency of subsidies, and rules on state-owned enterprises (SOEs) and forced technology transfer. Although leaders at the 2019 EU-China Summit jointly committed to concluding the CAI talks in 2020, lack of engagement at the highest political level on the Chinese side has raised doubts as to whether a breakthrough can be reached in time, with China more focused on navigating the uncertainties of its relations with the United States from January 2021. Considering that not even the short-term commitments on the trade and investment agenda from 2018 have been met, that the context of US-China great power competition looms large and that the EU has adopted more assertive language in its recently issued EU-China strategic outlook, it remains to be seen whether meaningful outcomes will be reached at this year's summit.

The escalating trade conflict between the United States and other countries and regions, such as China and the European Union, coupled with a capricious outcome of the recent summit of the world’s seven most industrialised economies (G7) have raised a question mark over the US’s continued commitment to the stability of the post-Cold War, rules-based international economic and political order. The row, which is already affecting stock and bond markets, started when US President Donald Trump imposed tariffs on steel and aluminium imports this year, under his ‘America First’ policy. Now that China and the EU have applied retaliatory tariffs, President Trump threatens to erect more trade barriers, for example against EU-made cars. This note offers links to a series of recent commentaries and reports from major international think tanks and research institutes on the trade conflict, the outcome of the G7 meeting and the future of the international economic order. India has the world's third-largest armed forces in terms of personnel numbers. However, although India was also the seventh-biggest spender on military equipment in 2014, the country has a problem of deficiency in equipment. India's defence procurement is still dominated by imports, as the domestic industry is handicapped by inefficiency. New Delhi is thus the world's largest importer of military equipment. Attempts in the past to reform the national security system have also failed.

Although EU Regulation 428/2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items system is in line with the main export control regimes and is seen as a model for others to follow, there are a number of ways in which the regulation could be enhanced and refined. Part One outlines the current state of play, purpose and implementation of the current regulation. In Part Two, against the backdrop of the European Commission's reform proposal, the effectiveness of the EU's dual-use export controls regime is explored further with regard to its potential contribution to international, national and human security, as well as their impact on EU economic and trade interests. The study concludes that the system’s effectiveness could be improved in a number of ways, but that this requires an effort to mobilise political will at different levels and across different institutions within the EU and its Member States, and to enhance human resources, cooperation and capacity-building. The European Parliament should also give consideration on a regular basis to issues relating to the scope and implementation of the regulation, in order to ensure that the objectives continue to be achieved.

Ten years after Beijing’s accession to the World Trade Organisation (WTO), this raises a number of crucial issues about EU companies market access capacities and, in the long run, the attractiveness of a Chinese market that is perceived as both strategic and difficult to penetrate. This study provides an independent and concise overview of the major risks and opportunities in EU-China trade and investment relations. It draws upon a number of economic and legal assessments largely related to China’s WTO commitments and its performance in implementation.
