The future partnership between the European Union and the United Kingdom: Negotiating a framework for relations after Brexit

Following the European Council's additional guidelines of March 2018, the European Union (EU) and the United Kingdom (UK) have started discussions on their future relationship after Brexit. The aim is to agree on a political framework for their future partnership by autumn 2018, to be adopted alongside the withdrawal agreement. Conclusion of a treaty or treaties establishing future EU-UK relations will only take place after the UK leaves the Union and becomes a third country. Both parties have expressed the desire to remain in a close partnership, which would cover several areas including trade and economic matters, internal security, foreign and security policy, and cooperation on defence. This study looks at the respective aims for, and principles underpinning, the negotiations, as expressed publicly to date by each party, and analyses some of the legal constraints and existing practices or precedents shaping EU cooperation with third-country partners. This allows assessment of the possibilities and limits of any future EU-UK partnership, in light of the stated objectives and 'red lines' officially announced, leading to the conclusion that, notwithstanding several common aims, significant divergences still persist with respect to the means of achieving the stated objectives.

This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the LIBE Committee, provides expertise on the legal, institutional and technical implications of the UK’s future relationship with the EU after Brexit in the areas of police cooperation and judicial cooperation in criminal matters (Chapters 4 and 5 of Title V TFEU).

This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the LIBE Committee, provides expertise on the legal, institutional and technical implications of the UK’s future relationship with the EU after Brexit in the areas of police cooperation and judicial cooperation in criminal matters (Chapters 4 and 5 of Title V TFEU).

The Commission proposal aims to improve the sharing financial information among national law enforcement authorities and financial intelligence units to prevent and fight crime and terrorism. The impact assessment accompanying the proposal examined comprehensively the problems encountered by law enforcement authorities and financial intelligence units, and made a real attempt to analyse the impacts of the proposed measures. A more thorough analysis of the safeguards on fundamental rights would have been useful. The Commission admits that the calculations of costs and benefits were limited due to a lack of data. Finally, the overall preferred option remains unclear.

Framework for future EU-UK relations

The European Parliament will hold a debate and vote a resolution setting out its proposals on the future relationship with the United Kingdom after Brexit, during its March plenary session. It thus aims to feed into the guidelines the European Council is expected to adopt on 22 March, on opening exploratory discussions with the UK on the framework of the future EU-UK relationship.

This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the LIBE Committee, provides an overview of current approaches to countering terrorist narratives. The first and second sections outline the different responses developed at the global and European Union levels. The third section presents an analysis of four different approaches to responding to terrorist narratives: disruption of propaganda distribution, redirect method, campaign and message design, and government communications and synchronisation of message and action. The final section offers a number of policy recommendations, highlighting five interrelated ‘lines of effort’ essential to maximising the efficiency and effectiveness of counter-terrorism and countering violent extremism strategic communication.

The strategy for Countering Violent Extremism launched by the Obama administration in 2011 signalled a turn away from a counterterrorism policy dominated by law enforcement and intelligence towards a comprehensive strategy based on engagement with broader policy communities. Countering extremism in Arab countries

Terrorist attacks in Sousse, Tunis, Beirut and the Sinai clearly show that hardly any country in the Arab world is immune to the threat posed by jihadi terrorism. Despite their different political agendas, countries in the region have been taking unprecedented steps to identify local factors in radicalisation and recruitment to violent extremism, and to prevent and counter these processes.

As sport has grown increasingly popular worldwide, it has become a greater target for individuals and groups of people wishing to take advantage of its lucrative aspects. As sport has grown increasingly popular worldwide, it has become a greater target for individuals and groups of people wishing to take advantage of its lucrative aspects. A conservative Interpol estimate for the period 1 June 2012 to 31 May 2013 indicates that match-fixing – i.e. the manipulation of results of sporting contests, or elements within a game – has been reported in over 70 countries across six continents, for football alone. Globalisation has further aggravated the phenomenon, with transnational criminal organisations taking advantage of changes in regulations, and flaws in legal and judicial systems. Various sports have been affected by match-fixing, even though most cases occur in cricket, football, and tennis. Contests are not always rigged by individual players or referees; some cases involve coaches, club managers, and more unexpectedly, maintenance staff. Match-fixing is often linked to gambling, with criminal networks exploiting unregulated gambling markets, notably in Asia. In the EU, the Framework Decisions on combatting corruption and the fight against organised crime underpin the operational work carried out by Europol and Eurojust. However, their provisions are still insufficiently well enacted by EU countries. The impact of international legal instruments, such as the United Nations and Council of Europe conventions, is also limited, since their provisions are not mandatory. In this context, the International Olympic Committee, due to its political, social and sporting authority, appears as a key factor in the continuing fight against manipulation in sport.
