(Non-)replacement of Commissioners elected to EP

03-07-2019

Having been elected to the European Parliament, two current members of the College of Commissioners have resigned as Commissioners in order to take up their seats. As a general rule, a vacancy caused in this way needs to be filled by a new Commissioner of the same nationality – unless the Council unanimously decides otherwise. On 16 June 2019, given the short duration of the remainder of the current Commission’s mandate, the Commission President, Jean-Claude Juncker, proposed not to replace the departing ...

The added value of the European Citizens' Initiative (ECI), and its revision

13-04-2018

The European Citizens' Initiative (ECI) is aimed at bringing the EU closer to its citizens, by enabling them to invite the European Commission to make a proposal for a legal act. Introduced by the Treaty of Lisbon, the ECI should provide every citizen with the right to participate in the democratic life of the Union. However, the ECI in practice has had various procedural hurdles, preventing the fulfilment of the regulation's objectives. The ECI is thus not fulfilling its potential with regard to ...

Introduced by the Treaty of Lisbon, the ECI should provide every citizen with the right to participate in the democratic life of the Union. However, the ECI in practice has had various procedural hurdles, preventing the fulfilment of the regulation's objectives. The ECI is thus not fulfilling its potential with regard to bringing the EU closer to its citizens. Against this background, the present study outlines the weaknesses in the existing ECI procedure. Moreover, it assesses, with a view to their added value, the main reform proposals that have been put forward to improve the ECI's functioning.

European Citizens' Initiative (ECI)

The European Citizens' Initiative (ECI), introduced in 2009 with the Lisbon Treaty, is a key element of participatory democracy, allowing citizens to play an active role in the EU's democratic life, through addressing a request to the European Commission to make a proposal for a legal act. The procedure and conditions for ECIs are governed by Regulation (EU) No 211/2011, in force since April 2012. The procedure and conditions for ECIs are governed by Regulation (EU) No 211/2011, in force since April 2012. In September 2017, the European Commission presented a proposal for its amendment, picking up on a number of suggestions for improvement. This is a further update of an 'at a glance' note published in July 2017: PE 608.644. For more detailed information on the proposed amendment of the ECI Regulation, please see EPRS' 'EU Legislation in progress' briefing, Revising the European Citizens' initiative, PE 614.627.

Az Európai Parlament: választási eljárások

01-10-2017

Az Európai Parlament választási eljárásait egyrészt a valamennyi tagállamra érvényes közös szabályokat meghatározó európai jogszabályok, másrészt államonként változó külön nemzeti rendelkezések szabályozzák.

This handbook provides the Committee on Legal Affairs with a practical tool aimed at simplifying its tasks when verifying the credentials of the newly elected Members of the European Parliament, when ruling on the validity of their mandate or when considering requests for the waiver or defence of parliamentary immunity. The handbook is intended for internal use only and does not purport to be an exhaustive study on the incompatibilities and immunity of the Members. The first part of the handbook briefly recalls the legal framework governing the verification of the credentials and the immunity of Members of the European Parliament. A detailed analysis of the legislative and procedural rules on the mandate of Members is available in the following studies published by the Policy Department: "Election and mandate of MEPs" and "Parliamentary immunity in the European Parliament". The second part of the handbook is composed of national reports summarising for each Member State the relevant national provisions on parliamentary immunity and on those national offices which are incompatible with the office of a Member of the European Parliament, according to Article 7(1) and (2) of the Act concerning the election of the Members of the European Parliament by direct universal suffrage. Each national report is therefore divided into two chapters. The first chapter sets out the legal provisions on the composition of national governments and parliaments, the denomination of their respective members and the date of the beginning of their term of office. The second chapter provides an overview of national rules on parliamentary immunity and identifies the national authorities which are competent to request the waiver of Members' immunity. Lastly, two annexes reproduce the lists of national authorities entitled to notify the names of newly elected Members to the European Parliament and those competent to request the waiver of a Member's immunity. Both lists have been drawn up by
